Abstract

This article examines globalization, between opportunities and threats for Indonesia's multicultural society. Globalization has brought changes in the social, political, economic, and cultural life of the people, especially for multicultural Indonesians. The swift flow of globalization that continues to move through various lines of life of people and reduce the borders of nations. Globalization will bring two consequences at the same time for the Indonesian cultural community, namely how the opportunities and threats of globalization to Indonesia's multicultural society. This study uses a literature study approach, where data and information relevant to the topic or problem are subject to study and compiled from various scientific sources and other sources. The theoritical framework used in this study is the theory of cultural homogenization. The results of this literature study indicate that the current of globalization will pose a threat as well as an opportunity for Indonesia's multicultural society. An opportunity that can be exploited is the emergence of a collective awareness about living together in differences that are co-existent. Meanwhile, the threat that needs to be watched out for is the strengthening of cultural homogenization that can erode and uproot the roots of local culture. Therefore, Indonesian multicultural society is not only required to think and act more critically and intelligently in dealing with the various subversive and destructive effects of globalization, but more than that it is able to build diversity immunity

Abstract

Kebijakan otonomi daerah sebagai wujud reformasi telah berjalan satu dekde. Namun kebijakan ini belum mampu memberikan kontribusi positif terhadap peningkatan kesejahteraan masyarakat. Rendahnya kesejahteraan masyarakat tak lepas dari kinerja keuangan pemerintahan daerah. Karena itu, Pemerintahan Propinsi dan Kabupaten/Kota perlu memperbaiki dan menata kembali manajemen pemerintahan dan pengelolaan keuangannya. Yakni dengan komitman dan konsisten pada prinsip-prinsip tata kelola pemerintahan yang baik (goog governance) guna meningktkan keejahteraan masyarakat yang lebih baik.

Abstract

This article aims to examine the critical theory of the Fraknfurt school, especially those related to its history, concepts, assumptions, and contributions. Historically-geneologically, critical theory was born from the womb of Marxist theory. Although born from the womb of Marxist theory, critical theory is not too satisfied with the analysis of the Marxians who are considered too mechanistic economic determinism in seeing the social reality of Western capitalist society. According to critical theory, the Marxian analysis in viewing and analyzing the inequality of the reality of capitalist society in Europe is too reductionist, that is, it is the economic factor (structure) that determines socio-economic inequality or class conflict in a capitalist society. The critical theory developed by the people who call themselves Neo-Maxians, exists to further develop the classical Marxian analysis, which rests not only on economic factors, but also on other socio-economic factors. The Frankfurt school of critical social theory thought services pioneered by Horkheimer, however, has provided a relatively new (though not very new) theoretical perspective in seeing, understanding and analyzing social reality. This critical social theory perspective has contributed significantly to the development of social theory. One of them is that critical theory has contributed to the development of critical and emancipatory awareness of human practice in seeing social realities that are full of inequality and injustice.Keyword : Critical Theory, Frankfurt School, History, Development of Social Theory

Abstract

Praktik penegakan hukum yang terjadi di tengah masyarakat, khususnya yang menimpa masyarakat miskin kerapkali melahirkan ketidakadilan. Masyarakat miskin adalah kelompok sosial paling rentan terhadap perlakuan hukum yang tidak adil. Ketidakdilan hukum ini bersumber dari bekerjanya hukum dalam sebuah sistemnya. Ketika hukum dilepaskan dari konteks sosialnya, maka hukum akan jauh dari rasa keadilan masyarakat. Aparat penegak hukum melihat dan memahami kasus hukum masyarakat miskin hanya pada teks-teks “kaku” yang ada dalam aturan perundang-undangan semata, legalistic-positivistik, tanpa berusaha memahami kasus hukum tersebut dalam konteks sosiologisnya. Keberpihakan hukum pada masyarakat miskin adalah sebuah kenicayaan. Penegakan hukum yang affirmative dan berpihak, tidak cukup dibangun dengan paradigma dan cara berhukum legalistic-positivistic, tapi juga perlu dibangun dengan paradigm kritis-progresif. Para pengadil tidak hanya dituntut untuk memiliki kecakapan dan pengetahuan hukum yang cukup, tapi juga dituntut untuk memiliki skiil, kreativitas dan terobosan hukum yang positif yang berdampak pada keadilan dan kemanfaatan hukum bagi masyarakat yang lebih luas. Kata Kunci : Keadilan Hukum, Masyarakat Miskin

Abstract

AbstractThis articleaims is to analyzed the case of agrarian land conflict Bongkoran Land in Wongsorejo Banyuwangi regency in the perspective of sociology of law. Agrarian conflict is a structural phenomenon that one of them stems from the conflict of law, namely between state law and community law. On behalf of development and state law, the government takes over unilaterally lands that have been controlled by local communities. At the same time, the community feels that they have the right to control their land acquired hundreds of years from generation to generation with the social legitimacy of the community or local customary law. This agrarian conflict, is not sufficiently approached and explained by using positive legal approach of the state that characteristic legalistic-positive. The issue of agrarian conflict needs to be approached with a legal sociology approach. The approach of legal sociology is permitted to read and understand the issue of agaric conflict more fully and hence can be found a more social justice solution for society.AbstrakArtikel ini bertujuan untuk menganalisiskasus konflik agraria tanah Bongkoran di Wongsorejo Kabupaten Banyuwangi dalam perspektif sosiologi hukum.Konflik agraria merupakan suatu gejala struktural yang salah satunya berpangkal pada konflik hukum, yakni antara hukum negara dan hukum masyarakat. Atas nama pembangunan dan hukum negara, pemerintah mengambil alih secara sepihak tanah-tanah yang telah dikuasai masyarakat lokal. Pada saat yang sama, masyarakat merasa dirinya memiliki hak atas penguasaan tanahnya yang diperoleh ratusan tahun secara turun-temurun dengan legitimasi sosial masyarakat atau hukum Adat setempat. Konflik agraria ini, tidak cukup didekati dan dijelaskan dengan menggunakan pendekatan hukum positif negara yang berkarakter legalistik-positifistik. Persoalan konflik agraria perlu didekati dengan pendekatan sosiologi hukum. Pendekatan sosiologi hukum diyakani dapat membaca dan memahami persoalan konflik agaria lebih utuh dan karenanya dapat dicarikan jalan penyelesaian yang lebih berkeadilan sosial bagi masyarakat

Abstract

The query #megawati was posted by the proprietor of Twitter. The quotes are the reactions offered by netizens to these posts in their comments. The general public, or netizens, give their remarks, which might be seen as popular opinion against Megawati. Public opinion can take the form of information that is given, passion that is donated in the form of knowledge, or feelings that are felt in order to support the citizen community's behavior. The purpose of this study is to analyze #megawati data from Twitter in order to describe the image of women in politics. This study employs a netnographic approach, retrieving #megawati data from Twitter and analyzing the qualitative data with Atlas.ti version 9 software. The findings of this study will be presented in the form of a flowchart, which is a visualization of qualitative data from 100 tweets. Furthermore, data analysis of existing references about the opportunities for women to rule. This study is unique and intriguing because it has never been done before. It delves into the most recent incident, in which Megawati's speech was widely circulated, causing social media to erupt with various quotations, statuses, mentions, and hashtags. According to the findings of this study, there are more quotes that lead to positive opinions than those that are neutral or contain negative opinions. More research on women and politics should be conducted in the future using other social media platforms such as Facebook, Instagram, and Tiktok. In order to provide a more diverse comparison of Indonesia's political situation for women.Keywords: twitter, netnography, #megawati.

Abstract

Anti-corruption village is a program that aims to create a village that is free from corruption. Community service was carried out in Senduro Lumajang Village, East Java Province. Senduro Village is a village with unique culture and traditions, such as Javanese customs and the unique customs of the Tengger Tribe. Senduro Village has attractive tourism potential, such as Tancak Waterfall, Banyu Anjlok Waterfall, and Coban Rondo Senduro Waterfall. The potential of the village provides a lot of income for Senduro village so the management of natural resource products must be monitored so that their utilization is for the welfare of the people and not for corruption. Therefore this community service aims to prevent acts of corruption within the Senduro village government and promote transparency, accountability, community participation, and integrity in financial management and public services. The results of this activity have an impact on increasing knowledge of corruption actions to become an anti-corruption village. In the future, it is suggested that more routine related pieces of training be carried out in maintaining an anti-corruption village because these activities have a significant impact on building an independent and integrated village.

Abstract

Untuk mendapatkan informasi tentang pelaksanaan UU No 6 tahun 2014 terhadap aparatur desa Desa sebagaimana yang termuat dalam Undang-Undang No. 6 Tahun 2014 tentang Desa merupakan kesatuan masyarakat hukum yang memiliki batas wilayah yang berwenang untuk mengatur dan mengurus urusan pemerintahan, kepentingan masyarakat setempat berdasarkan prakarsa masyarakat, hak asal usul, dan/atau hak tradisional yang diakui dan diormati dalam sistem pemerintahan Negara Kesatuan Republik Indonesia. Undang-Undang No 6 tahun 2014 ini memberikan wewenang yang cukup luas kepada desa dalam mengatur rumah tangga pemerintahan di desa, sebagaiman yang ditegaskan dalam pasal 18. Bagaimana desa menjalankan kewenangan dan otonominya untuk mewjudkan kesejahteraan masyarakatnya. Penelitian ini menggunakan pendekatan deskriptif-kualitatif yaitu menggambarkan dan menganalisis data yang diperoleh dari fakta dan data di lapangan. Pengumpulan data-data dilakukan melalui studi lapangan terhadap tata kelola pemerintahan desa di Desa Paciran Lamongan. Selain itu data pula dilakukan melalui wawancara mendalam yang dilakukan dan masyarakat desa. Adapun Hasil dari Penelitian ini adalah pengelolaan pemerintahan Desa Paciran Kabupaten Lamongan dalam rangka pengelolaan pemerintahan berbasis otonomi desa dapat berjalan relatif baik. Hhal ini ditunjukkan dengan kebijakan pengelolaan keuangan desa yang sudah lebih berfokus pada pembangunan desa yaitu pembangunan infrastruktur, pemberdayaan masyarakat dan pemerintahan. Selain itu pembangunan desa juga melibatkan peran serta masyarakat desa, sehingga pembangunan mulai perencanaan dan pelaksanaan, masyarakat memiliki peran aktif untuk mengawasi dan mengevaluasi pembangunan desa.

Abstract

Artikel ini akan mengulas tentang pelaksanaan Alokasi Dana Desa (ADD) dan dampaknya terhadap Kemandirian Sosial-Ekonomi Masyarakat Desa Senduro. Sejauh ini, penelitian tentang desa masih seputar soal kondisi desa dan masyarakat desa beserta problem-problemnya. Sementara yang berkaitan dengan pelaksanaan ADD dan dampaknya belum banyak mendapatkan perhatian. Padahal, kebijakan ADD diyakni dapat berkontribusi pada perbaikan dan peningkatan kemandirian desa, khususnya di bidang sosial-ekonomi masyarakat desa. Artikel ini adalah hasil penelitian dengan metode kualitatif dan pendekatan deskriptif. Hasil penelitiaan ini menunjukkan, bahwa pelaksanaan kebijakan ADD di Desa Senduro dijalankan sesuai kebutuhan masyarakat desa. Ada dua kebutuhan yang teridentivikasi, yakni pembentukan Senduro sebagai Desa Adat dan Pengembangan Desa Wisata. Pelaksanaan dua kebutuhan desa ini secara nyata memberikan dampak terhadap kemandirian sosial ekonomi desa. Program dan kegiatan dalam rangka pembentukan Desa Adat dan Pengembangan Desa Wisata dilakukan dengan semangat kebersamaan dan gotong royong. Ikatan sosial yang kuat diantara warga mampu membangun kemandirian ekonomi masyarakat. Pelaksanaan ADD secara gotong royong mampu membangun kemandirian sosial-ekonomi masyarakat Desa Senduro menjadi lebih produktif. Allocation of Village Funds and Socio-Economic Autonomy Of Village Communities: A Case in Senduro Village,Lumajang RegencyThis study aims to examine how the implementation of ADD and its impact on the Socio-Economic Independence of the Senduro Village Community, Senduro District, Lumajang Regency. This research is motivated by two important aspects that are currently happening and being experienced by the village. First, the condition of the village and village community, each of which struggles with socio-economic problems such as poverty, unemployment, and the village's economic level which is still weak and difficult to develop. Second, there is a very strategic and important opportunity for the improvement and improvement of the welfare of rural communities, namely through Law no. 6 of 2014 concerning Villages and Government Regulation No. 43 of 2014 concerning Implementing Regulations of Law Number 6 of 2014 concerning Villages. With the new legal basis, the village now has autonomy, both in governance and village financial management. The village fund allocation policy (ADD) is believed to be able to contribute to the improvement and improvement of village independence, especially in the socio-economic field of rural communities. This study uses a descriptive-qualitative approach. Descriptive research is research conducted with the main objective to describe the facts that occur objectively. This research is based more on collecting qualitative data in the form of informants' experiences which are presented in verbal form, especially those related to the implementation of ADD and its impact on the Socio-Economic Independence of the people of Senduro Village, Senduro District, Lumajang Regency. The research data obtained were analyzed using the theory of empowerment. The results of this study indicate that the implementation of ADD policies in Senduro Village is carried out according to the needs of the village community. There are two needs of villages that utilize ADD, namely the establishment of Senduro as a Traditional Village and Development of a Tourism Village. The implementation of these two village needs has a real impact on the socio-economic independence of the village. Community Programs and Activities of Senduro Village for the establishment of Senduro as a Traditional Village and Tourism Village Development is carried out in the spirit of togetherness and mutual cooperation. Strong social ties among citizens are able to build community economic independence. The implementation of ADD in mutual cooperation is able to build the socio-economic independence of the people of Senduro Village to be more productive.

Abstract

Hak Asasi Manusia merupakan hak dasar yang dimiliki setiap manusia sebagai ciptaan Tuhan Yang Maha Kuasa. Penegakan hukum merupakan suatu bentuk usaha mewujudkan atas ide-ide keadilan, kepastian hukum, dan kebermanfaatan sosial untuk menjadi kenyataan. Penegakan hukum pada dasarnya merupakan bentuk proses perwujudan ide-ide. Sedangkan penegakan hukum adalah proses dilakukannya upaya tegaknya atau berfungsinya atas norma-norma hukum yang ada secara nyata sebagai pedoman pelaku dalam kehidupan bermasyarakat dan bernegara. Hak Asasi Manusia selalu beriringan dengan permasalahan atas penegakan hukum yang terjadi, dimana ini menjadi satu hal krusial yang paling sering dikeluhkan oleh masyarakat, masyarakat akan terkesan apatis melihat penegakan hukum Hak Asasi Manusia. Masyarakat menyadari dimana hampir semua kasus yang berkaitan dengan hukum dalam skala besar, baik yang berhubungan dengan tindak kriminalitas, kejahatan akan ekonomi, apalagi pelanggaran terhadap Hak Asasi Manusia. Adapun upaya untuk yang dapat mencegah terjadinya pelanggaran Hak Asasi Manusia antara lain : Pertama, menanamkan bentuk kepribadian yang baik kepada anak, pendidikan kepribadian yang pertama dan utama sudah seharusnya didapatkan dari orang tua, karena orang tua berperan penting dalam membangun kepribadian anak. Kedua, kita melakukan penyuluhan kepada masyarakat mengenai esensi dari Hak Asasi Manusia sebenarnya dan mengedukasi mereka untuk mengetahui apa saja jenis-jenis maupun bentuk-bentuk pelanggaran Hak Asasi Manusia yang ada. Ketiga, Pemerintah mencegah kasus pelanggaran terhadap Hak Asasi Manusia dengan cara membuat Komisi Nasional Hak Asasi Manusia (Komnas HAM).
