Abstract

Abstract: One of mawâniʿ al-qishâsh is that victims are part of the perpetrators. That is, parents who kill their children can not be sanctioned qishâsh. This is based on the hadith of the Prophet which states that, "lâ yuqâd al-wâlid bi waladihî" and "anta wa mâluk li abîka". This opinion is held by Abû Hanîfah, al-Syâfiʿî, and Ahmad ibn Hanbal. This study aims to determine the validity of the first hadith which is used as a basis so that it can be a guideline whether the hadith is acceptable or not. The method used is the takhrîj method. The results showed that the hadith had a variety of matan who were narrated by at least seven mudawwin. This shows that the hadith is narrated in meaning rather than lafaz. There are at least eleven lanes of the shilshilah sanad found, but none of them have the quality of shahîh because there are weaknesses in each of the lane of the sanad. Therefore, if seen from the validity requirements of the hadith, the value of the hadith is weak.Abstrak: Salah satu penghalang sanksi kisas adalah korban merupakan bagian dari pelaku, maksudnya, orang tua yang membunuh anaknya tidak dapat dikenai sanksi kisas. Hal ini didasarkan atas hadis dari Nabi saw yang menyatakan bahwa, “lâ yuqâd al-wâlid bi waladihî” dan “anta wa mâluk li abîka”. Pendapat ini dipegang oleh Abû Hanîfah, al-Syâfiʿî, dan Ahmad ibn Hanbal. Penelitian ini bertujuan untuk mengetahui validitas hadis pertama yang dijadikan landasan sehingga dapat menjadi pegangan apakah hadis tersebut dapat diterima atau tidak. Metode yang digunakan adalah metode takhrîj. Hasil penelitian menunjukkan bahwa hadis tersebut memilik redaksi yang beragam yang diriwayatkan setidaknya oleh tujuh mudawwin. Ini menunjukkan bahwa hadis tersebut diriwayatkan secara makna bukan lafaz. Setidaknya ada sebelas jalur silsilah sanad yang ditemukan, namun semuanya tidak ada yang memiliki kualitas shahîh karena pada setiap jalur silsilah sanadnya ada kelemahan. Oleh karena itu, jika dilihat dari persyaratan kesahihan hadis, maka hadis tersebut nilainya lemah.

Abstract

The enactment of the Job Creation Law in approval of Government Regulation in Lieu of Law No. 2 of 2022, which became Law No. 6 of 2023 on Job Creation, has resulted in significant changes in halal certification in Indonesia, which is the main focus of this research. This study aims to discuss halal certification in Indonesia following the implementation of the omnibus law on job creation. The author adopts a standardized legal approach and a descriptive-analytical approach through literature research. The research findings indicate that comprehensive legislation is expected to streamline the halal certification process in Indonesia. There are important changes regarding halal certification in Law No. 6 of 2023 compared to Law No. 11 of 2020 on Job Creation. This regulation aims to accelerate and enhance efficiency in halal certification, ensuring legal certainty and fostering trust among Muslim consumers in halal products. The growth of micro-enterprises in terms of expediting halal certification shows positive trends. The research contributes new perspectives and original findings that positively impact problem-solving or theory development in the advancement of halal certification in Indonesia.Lahirnya UU Cipta Kerja sebagai pengesahan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 menjadi Undang-Undang Nomor 6 Tahun 2023 tentang Cipta Kerja telah menghasilkan perubahan signifikan dalam sertifikasi halal di Indonesia. Tujuan dari penelitian ini adalah untuk membahas sertifikasi halal di Indonesia pasca penerapan omnibus law penciptaan lapangan kerja. Penulis mengadopsi pendekatan hukum standar dan pendekatan deskriptif-analitik melalui penelitian literatur. Temuan penelitian menunjukkan bahwa peraturan yang komprehensif diharapkan dapat merampingkan proses sertifikasi halal di Indonesia. Ada perubahan penting terkait sertifikasi halal pada UU No 6 Tahun 2023 dibandingkan dengan UU No 11 Tahun 2020 tentang Cipta Kerja. Regulasi ini bertujuan untuk mempercepat dan meningkatkan efisiensi dalam sertifikasi halal, menjamin kepastian hukum dan menumbuhkan kepercayaan konsumen muslim terhadap produk halal. Pertumbuhan usaha mikro dalam hal percepatan sertifikasi halal menunjukkan tren yang positif. Penelitian ini menyumbangkan perspektif baru dan temuan orisinal yang berdampak positif terhadap pemecahan masalah atau pengembangan teori dalam kemajuan sertifikasi halal di Indonesia.

Abstract

Increasingly advanced technology does not always have a positive impact, sometimes it has a negative impact. This is like a widespread case because of the development of the Shopee marketplace which provides Cash On Delivery services) which, instead of benefiting the seller, is detrimental. This loss is not the responsibility of Shopee, but the seller itself. However, there is relevance to positive laws and regulations in Indonesia that can resolve this case. This study's goal is to determine the type of legal protection available to seller viewed from the Consumer Protection Act, the ITE Law, and the Civil Code and to find out Shopee's responsibility in protecting sellers who lose money because of the COD service. A technique to study called normative juridical is applied. The approach used is the legal approach. The data collection technique used is literature study. The data and data sources used come from secondary data, namely research journals, laws, and electronic sources that can be accounted for. The results and analysis of this study are that the regulations contain Law no. 8 of 1999 concerning Consumer Protection Articles 5, 6, 7, 34 and 45; Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions Article 45A; and the Civil Code Articles 1513, 1514, 1517, 1243, and 1267. Then, efforts to resolve this case can be done either through or outside the court and the seller activates the shipping insurance provided by Shopee.
