Abstract

Perkembangan hukum pidana di Indonesia mengalami transformasi dengan pengakuan korporasi sebagai subjek hukum pidana. Paradigma baru diperlukan karena tindak pidana korporasi tidak selalu bersifat personal melainkan hasil kebijakan atau praktik sistemik. Konsep vicarious liability menjadi fondasi, meski masih banyak perdebatan konseptual dan praktis. Penelitian ini menggunakan pendekatan yuridis normatif, menggunakan bahan hukum primer dan sekunder, dengan analisis kualitatif deskriptif dan interpretatif, serta validasi melalui studi kasus putusan pengadilan terkait sanksi pidana korporasi kasus suap. Analisis menunjukkan pentingnya harmonisasi prinsip vicarious liability dengan asas geen straf zonder schuld dan pengakuan kesalahan kolektif. Model compliance defense menjadi instrumen penting untuk menunjukkan itikad baik korporasi dalam pencegahan tindak pidana, mendukung pemisahan tanggung jawab antara korporasi dan individu. Standardisasi pembuktian dibutuhkan untuk menjamin keadilan dan transparansi proses hukum. Peran Mahkamah Agung krusial dalam menyusun pedoman teknis pembuktian compliance dan hubungan kausal, guna menciptakan kepastian hukum dan efektivitas penegakan. Pengembangan sanksi restoratif dan compliance model dapat mendorong reformasi tata kelola dan pencegahan korupsi. Diperlukan harmonisasi prinsip, diferensiasi pengaturan untuk korporasi dan UMKM, serta penguatan budaya antikorupsi melalui compliance program. Integrasi sanksi restoratif dan model compliance diharapkan meningkatkan efektivitas penegakan hukum sekaligus menjunjung keadilan substantif, dengan dukungan regulasi dan pedoman implementasi yang jelas dari Mahkamah Agung.

Abstract

Kepastian hukum akad pembiayaan murabahah dan pelunasan utang sebelum jatuh tempo di PT Bank Perekonomian Rakyat Syariah HIK Insan Cita dengan tujuan untuk menganalisis aspek-aspek hukum serta implementasinya dalam praktik perbankan syariah. Menggunakan metode yuridis normatif dengan pendekatan kualitatif, penelitian menganalisis data berdasarkan teori kepastian hukum Gustav Radbruch dan teori maqasid al-syariah melalui wawancara dengan pihak bank serta studi dokumentasi. Hasil penelitian menunjukkan bahwa BPRS HIK Insan Cita telah menjalankan akad pembiayaan murabahah sesuai dengan ketentuan Fatwa DSN-MUI dan peraturan perundang-undangan yang berlaku, namun belum sepenuhnya mengimplementasikan Fatwa DSN-MUI terbaru No. 153/DSN-MUI/VI/2022 mengenai pelunasan utang pembiayaan murabahah sebelum jatuh tempo, serta belum adanya opini tertulis dari Dewan Pengawas Syariah mengenai praktik tersebut menyebabkan potensi ketidakpastian hukum, sehingga diperlukan penyesuaian kebijakan untuk memastikan kesesuaian dengan prinsip syariah dan memberikan kepastian hukum bagi seluruh pihak.

Abstract

The annulment of Grant Deeds due to unlawful acts by the Grantee within the context of an inheritance dispute raises complex legal issues concerning the conflict between the formality of deeds and the protection of free will. This research aims to analyze the basis of the Panel of Judges’ reasoning in finding unlawful acts by the child (Grantee) and annulling the Grant Deeds, as well as to analyze the forms of legal protection afforded to the Grantor in Decision Number 85/Pdt.G/2021/PN Bdg. The research method employed is normative legal research utilizing case study, statute, and conceptual approaches, with a qualitative descriptive-analytical analysis of the aforementioned decision. The analysis results indicate that the Panel of Judges annulled the Grant Deeds based on the non-fulfillment of the subjective requirement for a valid agreement according to Article 1320 of the Civil Code, namely the absence of free consent resulting from defects of consent (duress and abuse of circumstances) caused by the proven unlawful acts of the Defendant. The conflict between the grant mechanism and the principles of joint marital property according to Law Number 1 of 1974 and the rules of inheritance law further reinforced the basis for annulment. The manifestation of legal protection for the Plaintiff was effectively realized through the annulment of the deeds, which restored the autonomy of will, the order for restitution for the recovery of material losses, the affirmation of correct inheritance rights providing legal certainty, and the judicial declaration of unlawful act as a form of juridical recognition of the violation of the rights. This decision underscores the court’s priority on substantive justice and the protection of aggrieved parties in family grant disputes tainted by unlawful acts.

Abstract

Penelitian ini menganalisis transformasi kesadaran hukum masyarakat dan keberlanjutan dampak program penyuluhan hukum terpadu berbasis intervensi komunitas di Desa Pasir Angin. Melalui pendekatan mixed-method yang mengintegrasikan studi kasus partisipatif dan pengukuran kuantitatif pre-test serta post-test, penelitian ini mengeksplorasi perubahan paradigma masyarakat dari penyelesaian sengketa berbasis adat menuju mekanisme formal-legal, sekaligus menguji efektivitas program dalam empat dimensi isu hukum utama: pertanahan, perlindungan data pribadi dan fintech, narkotika, serta hukum keluarga dan waris. Hasil menunjukkan peningkatan signifikan rata-rata pemahaman hukum masyarakat dari 34 menjadi 78 poin, diiringi dengan pergeseran nilai normatif—seperti bergesernya preferensi masyarakat dari hukuman represif terhadap penyalahgunaan narkoba menuju pendekatan rehabilitatif. Program juga berhasil mendorong pembentukan spontan empat kelompok sadar hukum yang menunjukkan keberlanjutan internalisasi pengetahuan dan aksi kolektif, tanpa ketergantungan insentif eksternal. Penelitian ini juga mengidentifikasi adanya “knowledge-action gap” di mana peningkatan pengetahuan tidak otomatis berimplikasi pada perubahan perilaku konkret akibat hambatan struktural, stigma sosial, serta keterbatasan akses dan infrastruktur. Rekomendasi utama meliputi integrasi pembangunan legal capability dalam setiap penyuluhan, pendampingan berkelanjutan, penguatan kelompok sadar hukum, desentralisasi dan digitalisasi layanan, serta harmonisasi nilai hukum adat dengan mekanisme formal. Studi ini menegaskan bahwa transformasi paradigma hukum di tingkat desa menuntut intervensi partisipatif, berkelanjutan, dan sistemik yang memberdayakan komunitas menuju akses keadilan yang nyata.

Abstract

Background: Indonesia’s forest governance continues to face challenges such as overlapping land claims, agrarian conflicts, and institutional fragmentation. Presidential Regulation No. 5 of 2025 establishes a cross-sectoral Forest Area Order and Enforcement Task Force (PKH Task Force) to accelerate forest recovery and improve legal certainty. However, concerns remain regarding data reliability and social justice in its implementation. Objective: This study examines the implementation of forest area regulation under Presidential Regulation No. 5 of 2025, focusing on governance effectiveness, socio-ecological impacts, and the relationship between enforcement mechanisms and environmental justice. Methods: A qualitative socio-legal approach was employed, combining normative juridical analysis, focus group discussions, field observations, and comparative policy review. Data were analyzed using thematic content analysis and cross-case comparison. Results: Findings show that the PKH Task Force recovered approximately 3.3 million hectares of forest land by September 2025. Despite this achievement, structural issues persist, including inconsistent spatial data, overlapping customary land claims (17.6–24.4 million hectares), and unequal enforcement between large-scale actors and smallholders. Limited community participation has contributed to ongoing socio-ecological tensions. In contrast, participatory schemes such as PPTPKH/TORA (3.04 million hectares) and social forestry programs (4.1 million hectares involving over 800,000 households) indicate more inclusive governance outcomes. Conclusion: Forest governance reform demonstrates strong administrative performance but limited social legitimacy. Effective implementation requires integrating distributive, procedural, and restorative justice principles supported by participatory and integrated data governance systems. Limitations: The study is based on secondary data and selected qualitative cases, which may not fully represent regional variations in Indonesia

Abstract

The transfer of land rights through a grant instrument is absolutely limited to a maximum of one-third of the estate to protect the heirs’ legitime (legitieme portie). The violation of this material limitation strongly correlates with the negligence of Land Deed Officials and culminates in judicial disputes, as reflected in the jurisdictional anomaly between the Lumajang Religious Court Decision and the Surabaya High Religious Court Decision. This research aims to analyze the construction of the public official’s juridical liability and examine the degradation of the deed’s evidentiary value due to material defects. Through normative legal research employing case, statute, conceptual, and philosophical approaches, this study finds that the Land Deed Official’s failure to apply the prudential principle is qualified as negligence, implicating the emergence of administrative, civil, and ethical liability. Furthermore, exceeding the grant limit renders the legal act null and void, thereby degrading the deed’s evidentiary value to a private deed and nullifying its validity in state administrative affairs. However, the appellate court decision was rigidly bound by procedural formalism, refusing to adjudicate the case (déni de justice) on grounds of administrative jurisdiction. As a legal prescription, the religious court should annul the material act of the grant to revert the object into the undivided whole estate (boedel waris). This object’s status serves as a basis for requesting restoration to the original state (restitutio in integrum) at the Land Office. Supreme Court intervention through jurisprudence is required to align administrative certainty with the value of justice in wealth preservation (hifz al-mal).
