Abstract

Pemutusan hubungan kerja sering kali terjadi di dunia usaha, akan tetapi masih banyak hak-hak dari pekerja yang belum di penuhi haknya oleh pihak pengusaha. Maka permasalahan yang muncul adalah apakah gugatan yang melampaui jangka waktu dapat diterima dan bagaimanakah eksekusinya. Untuk menjawab permasalahan tersebut maka dilakukan penelitian secara yuridis normatif terhadap Putusan nomor: 241/Pdt.Sus-PHI/2018/PN.JKT.PST Pengolahan data dilakukan secara kualitatif, sedangkan pengambilan kesimpulan dilakukan dengan menggunakan logika deduktif. Berdasarkan analisis terhadap Putusan nomor: 241/Pdt.SusPHI/2018/PN.JKT.PST maka diketahui bahwa 1) Gugatan yang dapat diterima adalah gugatan PHK yang tidak termasuk dalam pasal 160 ayat 3 dan 162 Undang-undang no 13 tahun 2003 tentang Ketenagakerjaan 2) Eksekusi wajib dilaksanakan sesuai yang tertuang dengan amar putusan dilakukan oleh para pihak yang berselisih melalui persidangan dan yang putusannya sudah berkekuatan hukum tetap

Abstract

Undang-Undang Nomor 2 Tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial mengatur mengenai penyelesaian sengketa di dalam hubungan kerja antara pekerja dengan pengusaha, baik sengketa yang berupa perselisihan hak, perselisihan kepentingan, perselisihan pemutusan hubungan kerja, maupun perselisihan antar serikat pekerja di dalam satu perusahaan. Di dalam penyelesaian perselisihan hubungan industrial tersebut dibentuk Pengadilan Hubungan Industrial yang pada akhirnya akan memeriksa dan memutus sengketa perselisihan hubungan industrial tersebut, dan berdasarkan putusan tersebut akan dilaksanakan eksekusi atas putusan yang dijatuhkan. Yang menjadi permasalahan ialah bagaimana pelaksanaan eksekusi dalam Pengadilan Hubungan Industrial atas putusan yang telah mempunyai kekuatan hukum dan bagaimana perlunya didirikan lembaga sita eksekusi tersendiri diatur dalam Undang-undang tentang Penyelesaian Perselisihan Hubungan Industrial.Berdasarkan Pasal 57 Undang-Undang Nomor 2 Tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial yang berbunyi bahwa hukum acara yang berlaku pada Pengadilan Hubungan Industrial adalah hukum acara perdata yang berlaku pada pengadilan pada lingkungan peradilan umum, kecuali diatur secara khusus dalam undang-undang ini. Artinya seluruh proses hukum beracara pada penyelesaian perselisihan hubungan industrial menggunakan proses beracara hukum acara perdata, termasuk aturan perihal pelaksanaan eksekusi Kata Kunci: Manusia, Perbedaan Pendapat dan Perselisihan, Serikat Pekerja, Ketenagakerjaan

Abstract

Pegawai pemerintah selain Pegawai Negeri Sipil (PNS) sebelum adanya UU ASN atau Pegawai honorer bekerjaberdasarkan perjanjian kerja dengan kepala instansi Pemerintah terkait yang menandatangani perjanjian kerjanya.Berbeda dengan pegawai honorer, PPPK tidak serta merta dapat diangkat menjadi Pegawai Negeri Sipil dantidak semua pekerjaan dapat diberlakukan bagi PPPK. Hal tersebut akan menimbulkan permasalahan tersendiriuntuk PPPK berkaitan dengan status, kedudukan dan hubungan hukum pekerja serta bagaimana berakhirnyahubungan hukum tersebut termasuk tunduk kepada aturan hukum yang mana dalam mengatur mengenai PPPK.Yang menjadi pokok permasalahan dalam penelitian ini adalah bagaimana status, kedudukan serta hubunganhukum yang diatur bagi PPPK berdasarkan Peraturan Perundang-undangan di Indonesia dan bagaimanapenyelesaian berakhirnya hubungan hukum antara Pegawai Pemerintah dengan Perjanjian Kerja berdasarkanPeraturan Perundang-undangan di Indonesia. Penelitian ini menggunakan metode penelitian normatif denganmenggunakan data sekunder berupa bahan-bahan hukum, baik bahan hukum primer, maupun bahan hukumsekunder. Hasil penelitian ini adalah di Indonesia terjadi ambivalensi maupun ambiguitas berdasarkan UUASN dengan Undang- UU Naker mengenai keberdaan PPPK antara lain waktu perjanjian kerja, hak upah yangtidak ada standar minimun. Untuk penyelesaian perselisihan pemutusan hubungan kerja juga belum secarategas dijelaskan bagaimana cara penyelesaiannya dan bagaimana kompensasi atau akibat hukum bagi parapihak, khususnya PPPK. Oleh karenanya peneliti memberikan rekomendasi dalam draft RPP Manajemen PPPKtersebut antara lain adanya pengaturan mengenai hubungan kerja baik dari awal hubungan perjanjian kerjahingga pemutusan hubungan perjanjian kerja. selain itu perlu ada kejelasan mengenai bagaimana penyelesaianhubungan hukum berupa ganti kerugian yang harus dipenuhi oleh pihak yang ingkar janji dalam Perjanjian KerjaPPPK sesuai batas waktu yang diperjanjikan dan besaran nilai upah/gaji perbulan yang dilanggar tidak dipenuhipara pihak, maupun oleh karena akibat lain yang dilanggar terhadap isi Perjanjian Kerja PPPKKata kunci: pegawai honorer, pegawai Pemerintah dengan perjanjian kerja, aparatur sipil negara, perjanjiankerja, hubungan kerja

Abstract

The problem posed in this study is what are the factors causing the obstruction of the implementation of the PTUN decision? second, what is the solution to the obstruction of the implementation of the PTUN decision?  The purpose of the study is to determine the factors causing the obstruction of the implementation of the PTUN decision and the formulation of solutions for the obstruction of the implementation of the PTUN decision. This study uses doctrinal study methods.  emphasizes the use of secondary data from primary legal materials, especially on regulations related to material and formal aspects of State Administrative Justice, secondary legal materials in the form of reference books and research relevant to the theme of study. Especially for reference books and research will be expanded with historical and social themes to see the social factors that influence the formation of law. Third, tertiary law materials as data discovery tools. The results of this study found that obstacles to the implementation of PTUN decisions are procedural laws that have not been able to provide guarantees about the mechanism for implementing decisions and decisions that do not consider aspects of the state administrative law ecosystem and administrative political ecosystem. In the event that there is a request to issue a decision or take action or revise the decision by issuing a new decision, an ex nunc assessment and the implementing agency of the PTUN decision are required.

Abstract

Industrial relations conflicts are intricate issues that often arise in the lives of individuals, particularly for those in worker and employer roles. These conflicts can lead to employment termination or layoffs. Each country has its own methods for resolving labor disputes depending on the adopted legal system. Indonesia uses a Civil Law system, while Malaysia follows a Common Law system, resulting in different approaches to resolving these conflicts. This study aims to examine and describe the impact and resolution efforts related to labor disputes in both countries. The research methodology employed is normative legal research, with a descriptive analytical approach. Primary data, obtained from interviews, and secondary data, obtained from literature studies, were used for analysis. The study reveals notable disparities in labor dispute resolution between the two countries, particularly in the process and the role of judges during dispute resolution hearings.

Abstract

Every State Civil Apparatus (ASN) has an obligation to always be able to comply with all codes of ethics and regulations that govern, namely the Laws. The Disrespectful Dismissal Case committed by Daduk Agustyanta, Daduk Agustyanta's brother is a Civil Servant (PNS). The formulation of the problem in the case of Daduk Agustyanta's brother is whether the dismissal process does not respect the State Civil Apparatus based on decision Number 24/G/2021/PTUN.Sby in accordance with BKN Regulation Number 3 of 2020 concerning Technical Instructions for Dismissal of Civil Servants and what are the legal consequences for State Civil Apparatuses that are proven commit acts of corruption. Secondary and primary data are used as research supporting data, and normative law is used for descriptive research methods. using qualitative analysis and making conclusions with deductive logic. The results of the study showed that Daduk Agustyanta's brother had been dishonorably discharged based on Law Number 5 of 2014 concerning the State Civil Apparatus. Based on the discussion, the law has binding legal force because it is in accordance with the statutory hierarchy. In conclusion, the dismissal process handed down to brother Daduk Agustyanta was in accordance with the flow of dismissal stipulated in Law Number 5 of 2014 concerning State Civil Apparatuses and the legal consequences received by brother Daduk Agustyanta for committing a Corruption Crime, namely being dishonorably discharged and brother Daduk Agustyanta lost his employment rights and pension rights

Abstract

This article examines the current construction of ad hoc judges within the Industrial Relations Court (PHI) and the resulting challenges impacting the settlement of industrial relations disputes. The primary objective of this analysis is to identify the legal problems associated with the present framework regulating ad hoc PHI judges and to propose solutions that mitigate these weaknesses. Utilizing a normative qualitative research methodology, this study relies on secondary data, employing both a statutory and conceptual approach to comprehension. Findings suggest that the existing construction of ad hoc PHI judges may compromise the objectivity of their decisions. This potential for bias can adversely affect fair conflict resolution, undermining trust in the judicial process. In light of these findings, the article advocates for a comprehensive reconstruction of the regulatory framework governing ad hoc judges. This would involve legislative reforms aimed at enhancing the performance and quality of PHI ad hoc judges. Such reforms could include stricter selection criteria, ongoing training programs, and mechanisms for accountability to ensure that these judges can make impartial and informed decisions. Ultimately, by addressing the identified legal shortcomings and implementing the proposed solutions, the integrity of the industrial relations dispute resolution process can be significantly improved. This approach not only aims to safeguard justice and fairness in industrial relations but also enhances the overall efficacy of the legal system in Indonesia. The insights underscore the urgent need for legislative action to foster a robust and unbiased framework for ad hoc PHI judges, ensuring equitable outcomes for all parties involved in industrial disputes.

Abstract

Bone Bolango Regency, as part of Indonesia's administrative entity, oversees a number of State Civil Apparatus (ASN) who perform vital functions in maintaining government stability and providing the best services to the public. However, in practice, there are cases showing dismissals of ASNs that do not align with the legal principles and ethical norms in force. The dismissal of State Civil Apparatus (ASN) without honor not only affects the individual concerned, but also reflects the quality of the public administration system in Bone Bolango Regency. The problem statement in this article is: How to reactivate ASNs dismissed without honor, and what are the legal consequences of the dismissal decision issued by the Regent of Bone Bolango? The research method used is normative juridical research. The result and the conclusion of this article is that reactivation is possible after the issuance of the decision letter by the Regent of Bone Bolango, on the grounds that it was made without referring to and considering the applicable laws. The legal consequence of the Dismissal Decision without honor for ASN in Bone Bolango Regency is that the individual concerned is not allowed to return to active civil servant status anywhere

Abstract

This research examines the legal issues between Hadi Yanto and PT Terang Jaya Lestari, specifically related to the error in persona exception in Case Decision Number 353/Pdt.Sus-PHI.G/2019/PN.JKT.PST. This dispute focuses on the validity of the party sued in the lawsuit filed by the plaintiff. The identification of the problem in this article; how the judge's consideration in resolving the case, and to explore the legal consequences arising from the decision of the judge's ruling and consideration. The research method uses normative juridical with analytical descriptive nature and is analyzed qualitatively. The research results and conclusions show that the lawsuit filed by the plaintiff is not in accordance with the applicable statutory provisions, especially related to errors in determining the party being sued, known as error in persona. In this case, the plaintiff made a mistake in suing an improper party, which resulted in the rejection of the lawsuit by the judge. The judge's consideration that the lawsuit cannot be accepted based on this party error shows the importance of clarity in the identification of parties in every lawsuit, especially in the context of resolving industrial relations disputes. This research is expected to contribute to the understanding of the application of legal principles in dispute resolution in the field of industrial relations.

Abstract

Illegal mining has become a complex phenomenon, involving low-income and poorly educated communities as mine workers. This practice poses high risks to workers, both in terms of occupational safety and environmental impact. The conducted study aims to examine the form of legal protection for workers in illegal soil excavation mining based on the applicable laws and regulations, particularly Law Number 13 of 2003 concerning Manpower. Additionally, the research problem in this case focuses on the protection of workers in illegal mining operations and the employer's responsibility in the event of work-related accidents, such as the case of a miner's death in Parung Panjang. The research employs a normative legal approach, supported by field studies to obtain empirical data. The findings and conclusions indicate that workers in illegal mining operations do not receive adequate protection. Cultural factors and the economic dependence of local communities exacerbate the situation, making it difficult to enforce legal regulations. The study recommends an active role of the government in supervising and regulating illegal mining operations, as well as the need for socialization on the importance of occupational safety and simplified licensing processes to provide better protection for workers.
