Abstract

The job reassignment (mutasi) of Civil Servants (ASN), particularly in cases involving demotion, is one of the key instruments in personnel management, as regulated under the National Civil Service Agency Regulation Number 5 of 2019 and other relevant laws and regulations. The research problem focuses on the implementation of ASN job reassignments involving demotionspecifically whether such reassignments are based on the principle of justice as mandated by Indonesia’s positive law, and aims to identify the obstacles encountered in its execution. This study employs a normative legal method with statutory and case approaches, using secondary data as the primary source, which is analyzed qualitatively and concluded deductively. The findings indicate that ASN job reassignments, particularly those involving demotion, often fail to comply with existing regulations both in terms of employee welfare and adherence to administrative procedures. The main challenges identified include a lack of transparency in the process, disharmony between institutional policies, and decisions that are misaligned with the employees’ professional needs. To ensure a fair implementation of job reassignment, it is necessary to strengthen oversight mechanisms, clarify procedures, and provide legal protection for civil servants adversely affected by such decisions.

Abstract

The process of resolving industrial relations disputes in Indonesia can basically be carried out through bipartite followed by mediation or conciliation or arbitration and carried out with industrial relations courts. This normative settlement providesaway out with an orderly state. Industrial relations can arise due to several related matters such as: employment agreements, positive laws and differences in interests. The focus of the problem is whether the definition of the concept of industrial relations conflict has been clearly defined? Has the resolution of industrial relations conflicts been achieved? Is the purpose of closing the company achieved according to its legal objectives? Is the closure of the company to resolve industrial relations conflicts achieved? What limitations are there in court decisions in examining and resolving industrial relations disputes before or after the closure of a company? This study uses the systematic study method of verdict. The results showed that the closure of the company was not effective in resolving industrial relations conflicts

Abstract

The publication of Minister of Manpower Regulation Number 2 of 2022 was rejected by the public. Responding to this, on March 16 2022, the Minister of Manpower, Ida Fauziyah, explained that the rules for disbursement of Old Age Security (JHT) were in the process of being revised, so that disbursement (JHT) currently refers to Minister of Manpower Regulation Number 19 of 2015 (previous regulation). Permenaker 19/2015 after Permenaker 2/2022 was promulgated, the status is no longer valid and has been revoked with a new regulation (Permenaker 2/2022), so what is the legal status of Minister of Manpower Regulation Number 19 of 2015 if it refers to the regulatory foundations and guidelines in accordance with the Hierarchy Legislative Regulations, Are they in accordance with the Republic of Indonesia Government Regulation Number 12 of 2011 concerning the Formation of Legislative Regulations. The research method used is descriptive normative research based on primary and secondary data, which is analyzed qualitatively by drawing conclusions deductively.

Abstract

The Law Number 2 of 2004 concerning Settlement of Industrial Relations Disputes regulates the settlement of disputes in the employment relationship between workers and employers, including disputes over rights, interests, termination of employment, and disputes between trade unions within one company. The Industrial Relations Court is formed to examine and decide on the industrial relations dispute, and the execution of the decision handed down will be carried out. However, the problem is how to carry out the execution in the Industrial Relations Court for decisions that have legal force, and whether it is necessary to establish a separate execution confiscation institution is regulated in the Law on the Settlement of Industrial Relations Disputes. Article 57 of the law states that the procedural law applicable to the Industrial Relations Court is the civil procedural law that applies to courts within the general court environment, unless specifically regulated in this law. The entire legal process for the settlement of industrial relations disputes uses the civil procedural legal process, including the rules regarding the execution. Several studies have highlighted the need for a separate execution confiscation institution to improve the effectiveness of the settlement of industrial relations disputes.

Abstract

Penelitian ini menggarisbawahi peran penting bank sebagai perantara dalam mendukung perekonomian nasional melalui pemberian kredit untuk kepentingan bisnis. Meskipun UU Perbankan 1998 tidak menyebutkan secara spesifik mengenai korupsi, namun terdapat keterkaitan yang jelas, terutama dalam pemberian kredit. Penelitian yuridis normatif ini menyoroti bagaimana tindak pidana korupsi, akibat hukum dan pencegahan tindak pidana korupsi pada sektor perbankan terkait dengan kasus Putusan Nomor: 09/PID/TPK/2013/PT.DKI dengan menggunakan pendekatan perundang- undangan dan pendekatan analisis. Dengan menggunakan pendekatan perundang-undangan dan analitis, studi ini mengkaji keterkaitan antara tindak pidana korupsi, konsekuensi hukum, dan pencegahannya di sektor perbankan, dengan fokus pada Putusan Nomor: 09/PID/TPK/2013/PT.DKI. Kasus ini mengungkapkan transformasi penyimpangan kredit menjadi tindak pidana korupsi, yang menjerat individu seperti Athouf Ibnu Tama. Dalam kasus-kasus perbankan dan korupsi yang terjadi secara bersamaan, pelanggaran SOP dan kerugian keuangan merupakan perbuatan melawan hukum secara formal. Untuk mencegah korupsi, memperkuat kontrol internal, mematuhi standar, dan perilaku etis sangat penting, namun konflik dengan Undang-Undang Perbankan dapat muncul, terutama mengenai kewenangan penyidik pasca pemberian kredit dan potensi dampak terhadap kerahasiaan nasabah.

Abstract

Fintech berupa pinjaman online memudahkan peminjaman dana dengan waktu yang singkat, namun sering memicu masalah kredit macet yang memerlukan penyelesaian melalui kerjasama dengan para debt collector terhadap debitur yang sulit ditagih dengan dinyatakan melakukan wanprestasi. Penelitian ini adalah penelitian yuridis normatif. Adapun sumber data yang digunakan adalah bahan hukum yakni Putusan No. 592/PDT.G/2019/PN. JKT UTR serta Aturan Perundang-Undangan yang berhubungan pada putusan itu ialah UU No. 4 Tahun 2023 terkait Pengembangan dan Penguatan Sektor Keuangan, Pasal 1 angka 6 Peraturan OjK No. 77/POJK. 01/2016, terkait pelayanan Pinjam Meminjam Uang Berbasis Teknologi Informasi serta Kitab UU Hukum Perdata, serta KUHAP, buku, jurnal, artikel dan bahan hukum lain yang berkaitan. Data yang terkumpul diuraikan melalui kalimat yang efektif, teratur dan logis, sehingga menjawab tiap rumusan masalah. Hasil penelitian ini menemukan bahwa, Negara memberikan perlindungan hukum melalui prosedur penyelesaian sengketa yang mana Junfeng Sheng (debt collector) digugat di pengadilan perdata berdasarkan Putusan 592/PDT.G. / 2019/PN. JKT UTR dan membayar ganti rugi kepada Junfeng Sheng sebesar Rp. 1.046.926.809,12. Kedua, negara memberikan kepastian terhadap aturan dan sanksi yang ditentukan di peraturan perundang-undangan terhadap perkara putusan No. 592/PDT.G/2019/PN. JKT UTR memutuskan PT Baraccuda Fintech Indonesia memberikan kompensasi kerugian sesuai peraturan.

Abstract

Tujuan dari penelitian ini ialah Untuk menganalisis pengaturan hukum tentang kerahasiaan data nasabah menurut peraturan perundang – undangan yang berlaku di Indonesia dan untuk menganalisis akibat hukum dan tanggung jawab bank terhadap nasabah atas terjadinya pelanggaran kerahasiaan bank yang disebabkan kelalaian oleh pegawai bank. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif yang dilakukan sebagai upaya untuk mendapatkan data yang diperlukan sehubungan dengan permasalahan. Data yang digunakan adalah data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Hasil penelitian menunjukkan bahwa Pengaturan hukum tentang kerahasiaan data nasabah menurut peraturan perundang-undangan yang berlaku di Indonesia telah memberikan kepastian hukum bagi nasabah. Dengan adanya pengaturan hukum ini, nasabah dapat merasa aman dalam memberikan data pribadinya kepada bank, serta yakin bahwa haknya akan dilindungi jika terjadi pelanggaran kerahasiaan data nasabah. Secara umum, pengaturan hukum tentang kerahasiaan data nasabah menurut peraturan perundang- undangan yang berlaku di Indonesia telah memberikan kepastian hukum bagi nasabah. Dengan adanya pengaturan hukum ini, nasabah dapat merasa aman dalam memberikan data pribadinya kepada bank, serta yakin bahwa haknya akan dilindungi jika terjadi pelanggaran kerahasiaan data nasabah. Tanggung jawab bank terhadap nasabah atas terjadinya pelanggaran kerahasiaan bank yang disebabkan kelalaian oleh pegawai bank didasarkan pada teori tanggung jawab pengganti atau vicarious liability. Menurut teori ini, seseorang yang bertanggung jawab atas perbuatan orang lain adalah orang yang memiliki hubungan hukum dengan orang tersebut, sehingga orang tersebut dapat dianggap sebagai wakil dari orang yang melakukan perbuatan tersebut.

The research method used in this paper is normative legal research, relying on secondary data from literature and legal sources. The collected data is analyzed qualitatively, and conclusions are drawn through deductive reasoning. The study provides insights into how current regulations impact employment, business operations, and consumer rights. This research adds value by providing a legal analysis that can inform policymakers, legal professionals, and businesses on how to navigate the complexities within Indonesia's legal system.

Abstract

ASEAN has created various instruments to protect migrant workers, such as the ASEAN Declaration on the Protection and Promotion of the Rights of Migrant Workers (2007) and the ASEAN Consensus on the Protection and Promotion of the Rights of Migrant Workers (2017). However, despite these regional commitments, Indonesian migrant workers (PMI) continue to face exploitation, discrimination, and inadequate legal protection. This study aims to evaluate the effectiveness of ASEAN instruments in protecting migrant workers by analyzing the gaps between regional policies, national regulations, and bilateral agreements. Using a qualitative approach with document analysis, this research examines ASEAN instruments, Indonesian regulations, and bilateral agreements to identify implementation challenges, problems, and possibilities. The results show that ASEAN's ineffectiveness stems from the inadequate binding force of the instruments, lack of enforcement mechanisms, weak coordination among member states, and minimal participation of migrant workers in the policy process. These findings demonstrate significant disparities between stated commitments and actual protection outcomes for Indonesian migrant workers. This research makes theoretical contributions by enriching the literature on regional governance and practical implications by offering policy recommendations to strengthen the protection of migrant workers in the ASEAN region.

Abstract

This study examines the role of the Governor of the Special Capital Region of Jakarta in determining the Provincial Minimum Wage (UMP) based on the Ministry of Manpower Regulation No. 16 of 2024. The background of this research is the wage policy dynamics in Jakarta, which often generate controversy, particularly the 2022 UMP determination by Governor Anies Baswedan, which caused tensions among the regional government, employers, and workers. The research problems focus on the UMP determination process by the governor and the governor’s role during the leadership periods of Joko Widodo, Basuki Tjahaja Purnama, and Anies Baswedan. The research method used is normative juridical, with a literature study approach on legislation and official documents, supported by interviews. The results show that the governor has a strategic authority in setting the UMP, integrating tripartite aspirations with local economic and social conditions. This process requires a balance between workers’ and employers’ interests, transparency, and compliance with national regulations. The study emphasizes the governor’s role as an accountable and fair decision-maker in setting the minimum wage and draws lessons from the 2022 case to strengthen governance mechanisms and UMP determination procedures in the future.
