Abstract

Compensation due to cancellation of sermons according to article 13 of the KHI (Islamic Jurisprudence) does not give impact in legal consequences. However, Islamic law has an opinion that allows for compensation due to the cancellation of the Khitbah (requests) in line with   the opinion of Dr. Muhammad Abu Zahrah. And the compensation is also for the benefit of people so that none of the parties feel wronged since of the suffering they feel as a result of the cancellation.

Abstract

The Marriage Dispensation is a way out for parties who wish to marry, but still below the age limit set by the Act. The limitations contained in Law No. 1 of 1974 jo. Law No. 16 of 2019, namely the age of 19 years for women and men. During the Covid-19 pandemic, there was an increase in applications for marriage dispensation at the Panyabungan Religious Court. The factors that cause it are due to personal desires, economic factors, parental factors and already pregnant without marriage.  Kata Kunci: Covid-19, Dispensasi Nikah, Peningkatan

Abstract

Siri marriage problems are increasingly rampant, one of which is in Muara Sipongi District. The existence of underage couples who are married in series for reasons of age does not reach the age limit for marriage according to the regulations of the Act. As for this research, it is included in empirical (field) research. The research informants are the parties to the marriage. It is known that in Islamic law siri marriage is legal, but in the law of the country it is invalid because of the necessity for marriages to be recorded (marriage registration). However, marriage should be avoided because it will complicate their domestic affairs in the future.

Abstract

Perceraian menurut ketentuan hukum nasional tidak dapat dilakukan di luar Pengadilan. Artinya bahwa perceraian dikatakan sah apabila diikrarkan di hadapan hakim Pengadilan (Pasal 39 ayat 1 UUP jo Pasal 65 UUPA jo. Pasal 115 KHI). Hal tersebut sesuai dengan prinsip dalam perundang-undangan No. 1 Tahun 1974 tentang perkawinan, yakni salah satu wujud prinsipnya adalah untuk mempersulit terjadinya perceraian. Adapun salah satu upaya untuk mewujudkan prinsip perkawinan adalah melalui Undang-Undang yang mengamanahkan kepada para hakim dalam setiap sidang perkara wajib terlebih dahulu untuk mendamaikan pasangan yang ingin bercerai. Terbukti bahwa setiap pasangan yang ingin bercerai akan melewati proses mediasi terlebih dahulu.

Abstract

Human trafficking is a transnational crime that is often committed across national borders. The victims also vary and it is not uncommon for children to be targeted as victims of this crime. The method in this research is normative research aimed at knowing the forms of legal rules, legal principles, and legal doctrines to answer the issues at hand to be imposed on the perpetrators of this human trafficking crime. And to find out also what kind of protection and assistance will be obtained by children who are victims of the crime of human trafficking in accordance with the laws and regulations in force in Indonesia.

Abstract

Epistemology, commonly understood as the theory of knowledge, occupies a central position in Islamic intellectual tradition, where human reason and sensory perception are acknowledged as legitimate means of acquiring knowledge, albeit within inherent limitations. This article aims to examine Islamic epistemology through an integrated ontological and axiological perspective, focusing on how sources of knowledge are conceptualized and function within Islamic philosophy. Employing a philosophical-analytical approach, the study explores the structural frameworks of Islamic epistemology—namely bayani, irfani, and burhani—and situates them within broader discussions of ontology and axiology. The findings demonstrate that Islamic epistemology does not treat revelation, reason, and empirical experience as competing sources, but as complementary foundations of knowledge. Ontologically, Islamic thought positions God as the ultimate source of value, while humans function as moral agents entrusted with stewardship grounded in the principle of tawhid. Axiologically, knowledge is viewed as inherently value-laden, serving ethical, spiritual, and civilizational purposes. This study argues that such an integrated epistemological framework enables Islamic thought to bridge moral values and modern scientific inquiry while contributing to the formation of a holistic conception of human knowledge.

Abstract

Divorce constitutes a legal event that carries significant juridical and social implications for family life. In Indonesia, the practice of divorce conducted outside the Religious Court is still found within society, particularly among Muslim communities, despite the normative provisions stipulated in Law Number 1 of 1974 on Marriage, which explicitly mandate that divorce may only be effected before a court of law. This study aims to analyze the legal and social consequences of divorces carried out outside the Religious Court within the framework of the national legal system. Employing a normative legal research method with statutory and conceptual approaches, this study is supported by an extensive review of legislation, court decisions, and doctrines of Islamic family law. The findings indicate that divorce for Muslim couples is legally valid only when it is pronounced through a decision of the Religious Court. Nevertheless, in social practice, divorces conducted outside the Religious Court—either unilaterally or through oral agreements between the parties—remain prevalent. Such practices generate complex implications. From a juridical perspective, divorces conducted outside the court lack legal force, resulting in the marriage status remaining administratively valid, which in turn complicates the fulfillment of civil rights, including the division of marital property, inheritance rights, and the issuance of divorce certificates. From a social perspective, this condition has the potential to give rise to stigma, discrimination, and socio-economic vulnerability, particularly for women and children. Furthermore, from the standpoint of state administration, out-of-court divorces create obstacles in civil registration processes and weaken legal protection mechanisms for children. This article underscores the urgency of law enforcement and the enhancement of public awareness regarding legally valid divorce procedures in accordance with Indonesian law in order to ensure legal certainty, the protection of women’s and children’s rights, and orderly state administration.

Abstract

Inequality in income distribution remains a structural problem in national economic development, including in mid-level urban areas such as Padangsidimpuan City. Islamic economics exists not only as a normative economic system but also as a practical approach that emphasizes distributive justice, social solidarity, and support for vulnerable groups. This study aims to analyze the contribution of Islamic economics in promoting equitable distribution of national income at the local level through a case study in Padangsidimpuan City. The research method used is descriptive qualitative, with data collection techniques through interviews, observations, and documentation studies of Islamic economic institutions such as BAZNAS, private zakat institutions, sharia cooperatives, and sharia-based micro, small, and medium enterprises (MSMEs). The results show that Islamic economic instruments, particularly zakat, infaq, sadaqah, and sharia financing, contribute significantly to increasing the income of the poor, expanding access to business capital, and reducing economic inequality. However, this contribution remains partial due to institutional limitations, low sharia economic literacy, and weak integration with regional development policies. This study recommends strengthening synergies between local governments and Islamic economic institutions as a sustainable strategy for income equality.
