Abstract

Bangsa Indonesia saat ini sedang menghadapi dua fenomena dalam pergerakan global, pertama adanya bonus demografi di mana jumlah penduduk usia produktif termasuk anak-anak muda sangat besar, kedua masuk kedalam era revolusi industri di mana berbagai sektor kehidupan mengalami digitalisasi. Era ini dikenal dengan revolusi industri 4.0. Dalamm upaya kelangsungan kehidupan bermasyarakat, berbangsa dan bernegara maka kita harus menyiapkan generasi siap mengambil estafet kepemimpinan. Permasalahannya  bagaimanakah membentuk pemimpin muda berkarakter untuk membangun kehidupan masyarakat bahagia dan sejahtera. Tujuan penulisan makalah ini adalah untuk  menyiapkan pemimpin muda untuk tetap mempunyai kepribadian dan berkarakter Indonesia. Generasi muda yang berkarakter dan sudah selesai dengan dirinya sendiri maka akan mudah untuk di ajak membangun kehidupan yang lebih luas yaitu masyarakat bahagia dan sejahtera. Abstract

Hukum dagang di Indonesia diatur dalam kodifikasi hukum yaitu dalam KUH Dagang. KUH Dagang  sebagai peninggalan zaman Hindia Belanda sudah jauh tertinggal dan tidak dapat memenuhi kebutuhan hukum perdagangan saat ini baik dalam negeri maupun luar negeri. Selain itu beberapa pengaturan lain di luar KUH Dagang juga belum lengkap. Penulisan ini untuk mengkaji perlunya dilakukan pembaharuan Hukum Dagang Indonesia dan mencari model pembaharuan hukum dagang yang kita kehendaki supaya dapat memenuhi kebutuhan dan menunjang pembangunan nasional.Metode pendekatan yang dipergunakan dalam tulisan ini adalah yuridis normative dengan sumber data sekuder yang dikumpulkan dengan cara studi kepustakaan. Data yang terkumpul dianalisis secara kualitatif. Beberapa ketentuan KUHDagang sudah ketinggalan zaman, sedangkan bidang hukum yang bersangkutan sudah mengalami perkembangan yang pesat, sehingga tidak dapat memenuhi kebutuhan hukum perdagangan saat ini. Pembaharuan hukum dagang Indonesia perlu untuk segera dilakukan agar sesuai dengan perkembangan, kebutuhan masyarakat nasional maupun kebutuhan internasional. Ada berbagai alternaatif model pilihan dalam pembaharuan hukum dagang Indonesia, antara lain adalah model kodifikasi general hukum dagang Indonesia, model kodifikasi parsial, model kompilasi peraturan perundang-undangan, dan model kodifikasi terbuka dan pengaturan parsial.

Abstract

In the Indonesian constitutional system, the House of Representatives is given legislative, budgetary and supervisory functions. In carrying out its functions, the House of Representatives is given the right of interpellation, the right of inquiry and the right to express opinions as regulated in the law and other statutory regulations. Impeachment of the President or what is known as the removal of the President in the constitutional system is regulated in the 1945 Constitution of the Republic of Indonesia articles 7A and 7B. In article 7A it is stated that "the President and/or Vice President can be dismissed during their term of office by the People's Consultative Assembly at the suggestion of the House of Representatives, whether they are proven to have committed a violation of the law in the form of treason against the state, corruption, bribery, other serious criminal acts, or disgraceful acts. or if it is proven that he no longer meets the requirements as President and/or Vice President." The problem is that recently there has been a heated debate about the right to inquiry, the aim of which is to impeach the President for alleged violations in the 2024 general election. What is the legal regulation regarding the right to inquiry? Can the right of inquiry regarding the implementation of elections carried out by the KPU be assigned to the President? Can the right of inquiry be a basis for removing the President from office? This type of research is a normative legal research type. The approach used is the legislative and comparative legal approach (comparison approach), the legal philosophy approach (philosophical approach). The results of the research show that the right to inquiry is the right of the House of Representatives to conduct investigations into the implementation of a law and/or government policy relating to important, strategic matters and having a broad impact on the life of society, nation and state which is suspected to be in conflict with statutory regulations. -invitation. Based on the original intent of the right to inquiry norm in the comprehensive text of the amendments to the Constitution, the right to inquiry is only intended for state institutions in the executive family. The KPU as an independent institution as an election organizer can carry out a questionnaire, whereas the decision on the right to a questionnaire is a political decision, its recommendation cannot automatically impeach the President, to be able to impeach there is of course a follow-up process for allegations that the President has violated the laws and regulations as stipulated in article 7 A Constitution of the Republic of Indonesia of 1945.

Abstract

The revitalization of Pancasila values has become an urgent necessity in strengthening the ethics of state institutions in Indonesia. In the current development of state governance practices, there appears to be a shift in institutional orientation that tends to be pragmatic and less grounded in constitutional moral values. Pancasila, as an ideology and the foundation of the state, is not only the source of the highest law but also a source of public ethics that guides the behavior of state institutions. This article analyzes how Pancasila values can be re-internalized into the ethics of state institutions through a normative legal approach, emphasizing the moral responsibility and integrity of state administrators. By examining legal doctrines, the constitution, and state governance practices, this study finds that strengthening institutional ethics must begin with the reconstruction of Pancasila values as a living and operational constitutional ethical foundation.

Abstract

This study aims to understand the role of the government in providing fair protection for child workers. This research is normative juridical legal research. The research specification is “descriptive analytical” because it will analyze the core issues being studied based on legislation. The results of the study indicate that protection for child workers has not been optimal due to weak law enforcement, limited labor supervision, minimal coordination between agencies, as well as strong structural factors such as poverty, culture, and low access to education. Using John Rawls' theory of justice, this study assesses that most policies have not fully met the difference principle, which is support for the least advantaged groups. This research discusses a framework for fair child labor protection that includes preventive, protective, and corrective justice as a new conceptual model. Abstract

In the Indonesian constitutional system, one of the manifestations of democracy and popular sovereignty is the freedom of opinion and expression guaranteed by the 1945 Constitution, freedom of opinion and expression is a human right (Article 28). This right is regulated by international law and national law. However, the fact is that the implementation of freedom of opinion and expression in social media causes a lot and does not pay attention to human rights and the legal interests of others. In this research, the research approach used is normative juridical using secender data as the main data (primary legal materials, secender legal materials, tertiary legal materials) supported by primary data (observations and interviews), the research data is analyzed descriptively qualitative. The results showed (1) Freedom of opinion and expression in social media in Indonesia in the form of digital platforms such as social media has many misunderstandings in its implementation (2) The implementation of freedom of opinion in social media in Indonesia must be limited by the responsibility to maintain ethics, not harm others, and conflict with applicable laws in Indonesia.

Abstract

Indonesia sebagai Negara yang berpenduduk muslim terbesar di dunia mempunyai problematika yang unik. Dalam kehidupan masyarakat ada sebagian orang yang menggunakan sistem kewarisan adat, hukum kewarisan barat dan ada pula yang menggunakan kewarisan Islam. Dalam pembentukan hukum waris nasional di Indonesia, kiranya kita tidak dapat memungkiri bahwa bangsa Indonesia adalah bangsa yang kaya akan adat istiadat yang sangat bermacam-macam dan dalam hukum adat itu telah mempunyai aturan atau ketentuan-ketentuan mengenai hukum kewarisan juga, sehingga perlu dalam pembaharuan hukum kewarisan nasional di Indonesia hendaknya tidak mengesampingkan aturan kewarisan adat. Hal ini dikarenakan masyarakat Indonesia masih sangat menjunjung tinggi adat istiadat mereka yang merupakan warisan dari para leluhur mereka.

Abstract

Implementing this Community Service Program strengthens the digitalization of tourism by accelerating the herbal medicine village tourism village based on the language variations of content creators.  Currently, not many tourists and enthusiasts come to buy herbal medicine at Kampung Jamu Wonolopo. Based on this description, the Community Service Team of the University of 17 Agustus 1945 Semarang assists Mitra Pokdarwis Manggar Selaras, which includes activities: Socialization and Program Coordination with Partners, Motivation and Strengthening HR Capacity, Training and Practice in Using Tools for Creating Digital Content, Workshop on Creating and Editing Video Content, Workshop on Using Various Languages for Content Creators, Handing Over Appropriate Technology Tools. As a result of this service, it is hoped that the residents of Jamu Wonolopo village will be able to improve the quality of human resources through digital skills to manage the development of the tourism potential of Jamu village by optimizing the preservation of nature and culture through interesting language variety content, to improve the quality of life for economic growth, job creation so that The results can improve community welfare.

Abstract

The era of digitalization has revolutionized the transportation sector, both air and land, by bringing operational service efficiency and transaction practicality for consumers. However, this massive digital transformation poses serious challenges regarding cybersecurity vulnerabilities and the protection of users' personal data privacy. This study aims to examine the legal protection of digital personal data of ride-hailing users in Indonesia and to analyze the responsibility of application provider companies for potential data protection failures. Through a normative legal approach, the study indicates that legal protection for consumers' digital privacy remains weak. This weakness is driven by specific regulatory gaps, the implementation of standard clauses that disadvantage consumers by shifting liability, and the storage of data outside Indonesia's legal jurisdiction which complicates oversight. Furthermore, companies often claim to be merely technology platform providers, effectively positioning themselves as having no direct responsibility for consumer losses, including the potential misuse of data by third parties such as driver-partners. In conclusion, specific regulations and comprehensive legal mechanisms are urgently needed to effectively ensure the protection of users' privacy rights in the digital era.
