Abstract

Pemberlakuan Pembatasan Kegiatan Masyarakat (PPKM) telah diberlakukan sejak 3 juli 2021 dan terus diperpanjang hingga sekarang, PPKM memang dapat menurunkan jumlah terinfeksi covid-19 tetapi malah memperparah di sektor lainnya. Artikel ini bertujuan untuk mengetahui bagaimana kondisi masyarakat pasca diterbitkannya peraturan PPKM dan urgensi partisipasi masyarakat dalam proses pembentukan perturan PPKM dengan metode Yuridis normatif dan pendekatan Statue Approach dan Literature Review. PPKM yang terus menerus diperpanjang dan ternyata semakin terasanya efek negative dari kebijakan tersebut banyak masyarakat mulai melakukan tindakan-tindakan yang menyuarakan protesnya dengan berbagai bentuk. Maka dari itu sangat dibutuhkan peranan masyarakat dalam tahapan-tahapan pembuatan peraturan. Menurut teori Walfare State atau bisa disebut dengan “Negara Sejahtera” bila melibatkan partisipasi masyarakat yang akan merasakan dampak langsung dari aturan terebut. Oleh karena itu pemerintah diharuskan untuk menggunakan pendekatan secara Bottom-Up, yang berarti membentuk peraturan berdasarkan masukan dari rakyat yang akan disusun dan direalisasikan oleh pemerintah. Partisipasi masyarakat akan memberikan landasan yang lebih baik dan memberikan solusi disertai implementasi yang lebih efektif atas segala permasalahan khususnya pada golongan menengah kebawah.

Abstract

Abstrak: Disahkannya Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja (UU Cipta Kerja) diharapkan dapat mendukung dan membantu dalam pertumbuhan ekonomi pada masa pandemi Covid-19 maupun pasca endemi Covid-19. Secara umum semua sektor Usaha Mikro dan Kecil (UMK) memiliki permasalahan legalitas dan lemahnya strategi berbisnis serta minimnya informasi atas kemudahan dari Perusahaan Perseorangan khususnya dimasa pasca endemic Covid-19. Tujuan dari pengabdian melibatkan Perangkat Desa sebagai perpanjangan pengabdi untuk dapat tepat pada sasarannya yaitu UMKM yang membutuhkan, agar dapat ditindak lanjuti pada proses pendampingan secara real time. Berdasarkan hasil survey kepada perangkat Desa Mangunjaya, menghasilkan bahwa masyarakat Desa Mangunjaya membutuhkan peningkatan strategi pemasaran dan kesadaran hukum dagang untuk meningkatkan pendapat para pelaku UMKM di wilayah Desa Mangunjaya . Kegiatan pengabdian ini disusun menggunakan metode Plan - Do - Check - Action disertai pelaksanaan dialog dan praktik lapangan untuk menghasilkan bukti yang nyata kepada masyarakat Desa Mangunjaya. Penggunaan metode Plan - Do - Check - Action menjadi solusi praktis untuk pelaksanaan proses kegiatan. Pendampingan peningkatan kesadaran hukum yang dilaksanakan tim pengabdi menghasilkan 4 buah sertifikat Nomor Induk Berusaha. Sosialisasi peningkatan strategi bisnis menghasilkan peningkatan pengetahuan ilmu ekonomi kepada 85% peserta yang mengikuti kegiatan.Abstract: The enactment of Law Number 11 of 2020 concerning Job Creation (Job Creation Law) is expected to support and assist in economic growth during the Covid-19 pandemic and post-endemic Covid-19. In general, all Micro and Small Enterprises (MSE) sectors have problems with the nature and weak business strategy and lack of information on the convenience of Individual Companies, especially in the post-endemic period of Covid-19. Thepurpose of service involves the Village Apparatus as an extension of service to be able to be right on its target, namely MSMEs in need, so that it can be followed up on the mentoring process in real time. Based on the results of a survey of the Mangunjaya Village apparatus, it was found that the people of Mangunjaya Village need to improve marketing strategies and awareness of trade laws to increase the opinions of MSME actors in the Mangunjaya Village area. This service activity was prepared using the Plan - Do - Check - Action method accompanied by the implementation of dialogue and field practices to produce concrete evidence to the people of Mangunjaya Village. The use of the Plan - Do - Check - Action method is a practical solution for the implementation of the activity process. Assistance in increasing legal awareness carried out by the service team produced 4 Certificates of Business Identification Numbers. Socialization of improving business strategies resulted in an increase in knowledge of economics to 85% of participants who participated in the activity.

Abstract

Abstrak: Desa Babakankaret merupakan salah satu desa di Kabupaten Cianjur yang memiliki potensi sumber daya alam yang cukup besar. Permasalahan yang dialami mitra adalah minimnya modal warga tidak produktif untuk dapat mengelola lingkungan desa yang memiliki sumber daya alam,Tujuan penyelenggaraan pengabdian kepada Masyarakat ini agar dapat meningkatkan pemahaman legalitas dalam berkontrak bagi kelompok tani dan pemberdayaan lingkungan di Desa Babakankaret.. Metode pelaksanaan pengabdian kepada masyarakat menggunakan Community Based Participatory Research (CBPR) yaitu metode yang mengutamakan partisipasi masyarakat dalam setiap tahap penelitian dan pengabdian, lalu diturunkan dalam tiga tahapan yaitu tahap survey, tahap pelaksanaan penanaman bibit dan diakhiri dengan tahapan sosialisasi perjanjian bagi hasil. Hasil dari pelaksanaan pengabdian kepada masyarakat adalah pemberdayaan lingkungan pada Desa Babakankaret dengan ditanamnya 3000 bibit hibah dari Kementerian Lingkungan Hidup dan Kehutanan (KLHK) pada 5 lokasi Desa. Pemberdayaan hukum yang terlaksana adalah 90% dari 40 warga Desa Babakankaret dari beberapa elemen masyarakat telah memahami pentingnya hukum dan tersosialisasinya perjanjian bagi hasil yang akan digunakan warga desa apabila akan melakukan perjanjian dengan pemilik tanah yang ingin dikelola oleh kelompok tani yang ada di Desa Babakankaret.Abstract: Babakankaret Village is one of the villages in Cianjur Regency which has quite large natural resource potential. The problem experienced by partners is the lack of capital for unproductive residents to be able to manage the village environment which has natural resources, this is also reinforced by the low knowledge of legal partners to enter into production sharing agreements with landowners so they can manage productively. The method of implementing community service uses Community Based Participatory Research (CBPR), which is a method that prioritizes community participation in each stage of research and community service, then is passed down in three stages, namely the survey stage, the seed liberation stage and ends with the agreement socialization stage for results for the population village. The result of the implementation of community service is environmental empowerment in Babakankaret Village by planting 3,000 grant seeds from the Ministry of Environment and Forestry (KLHK) in 5 village locations. The legal empowerment that was carried out was that 90% of the 40 residents of Babakankaret Village from several elements of society had understood the importance of law and the socialization of Income share agreements that would be used by villagers when they were to have relations with landowners who wanted to be managed by farmer groups in Babakankaret Village.

Abstract

Penelitian ini bertujuan untuk menganalisis peran Pemerintah Daerah Kota Depok terkait perlindungan konsumen atas keterangan tidak halal pada produk pangan yang diperdagangkan di Kota Depok. Penelitian ini dilakukan dengan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa konsumen muslim dapat tidak terlindungi ketika membeli produk pangan dikarenakan tidak adanya regulasi dalam hal ini Peraturan Daerah di Kota Depok mengenai produk makanan halal serta kemungkinan terdapat produsen yang melakukan penipuan dalam hal penggunaan bahan pangan tidak halal namun tidak mencantumkan informasi halal atau tidaknya produk yang dijual meskipun dalam Pasal 26 ayat (2) Undang-Undang Jaminan Produk Halal menyatakan bahwa produsen wajib memberikan keterangan tidak halal apabila bahan yang digunakan merupakan bahan yang diharamkan, sehingga pemerintah Kota Depok perlu segera membuat Peraturan Daerah yang mengatur produk makanan halal agar konsumen muslim dapat terlindungi. ABSTRACT This study aims to analyze the role of the Depok City Regional Government regarding consumer protection for non-halal information on food products traded in Depok City. This research was conducted using normative legal research method with statutory approach and conceptual approach. The results showed that Muslim consumers may not be protected when buying food products due to the absence of regulations in this case the Regional Regulation in Depok City regarding halal food products and the possibility that there are producers who commit fraud in terms of using non-halal food ingredients but do not include halal information or not the products sold even though Article 26 paragraph (2) of the Halal Product Guarantee Act has stated that producers are required to provide non-halal information if the ingredients used are prohibited ingredients, so the Depok City government needs to immediately make Regional Regulations governing halal food products so that Muslim consumers can be protected.

Abstract

Rentaru Kareshi is a term that refers to a "rental girlfriend" in Japan. This phenomenon has become a serious concern in recent years, due to its vulnerability to human trafficking, especially in cases of sexual exploitation. In addition, the buying and selling of rental services is carried out through intermediaries, namely platforms on social media that recruit these talents. This raises the question of whether this is a form of human trafficking. The aim of this research is to find out how the Ius Constitutum relates to the Rentaru Kareshi phenomenon in Indonesia and how law enforcement handles the occurrence of criminal acts in the Rentaru Kareshi Phenomenon. The method used is the Normative Juridical research method, with a problem approach, Legislative approach, Conceptual Approach, and comparative approach and the data collection technique used by the author is the literature study method. Even though the Ius Constitutum Indonesia has supported it, legal enforcement regarding this boyfriend rental service is still not visible because the phenomenon of boyfriend rental services can be said to be a new phenomenon causing a lack of understanding of law enforcement resulting in the absence of law enforcement actions.

Abstract

Legal politics plays a role in determining the direction of legal policy that must be taken by the government to achieve certain goals. Legal politics is a very important component, one of which is the implementation of existing laws in the country and every policy taken by the government reflects existing political dynamics and the interests of certain groups, thereby affecting the integrity and justice of the existing legal system. The purpose of writing this article is to research further on how the duties and objectives of legal politics are applied to the Indonesian legal system and whether the application of the nature of legal politics is appropriate to the Indonesian legal system. The method used is normative juridical with a statutory and conceptual approach. Legal politics in Indonesia is normative, dynamic, adaptive, pragmatic, progressive, and functions as a tool of social control. However, implementation is often hampered by political interests and lack of consistent implementation. Therefore, there is a need for regular regulatory evaluation, increased transparency of law enforcement, and public participation to create a more responsive and fair legal system.

Abstract

In the process of forming a law or legislation, the DPD does not have the power to decide or play a role in the decision-making process at all. Even though there are support requirements to become a member of the DPR. This means that the quality of the legitimacy of DPD members is not at all balanced by the quality of their authority as representatives of the regional people. The aim of this research is to analyze the function and authority of the Regional Representative Council in the Structural Institution of the Republic of Indonesia State Legislative Institution and how to optimize the function and legislative authority of the Regional Representative Council. The type of research we use is normative legal research, namely research carried out by examining the body of literature or secondary data. Strengthening the authority of the DPD by consistently incorporating the Constitutional Court's decisions into statutory regulations and other regulations under it. This is being done pending the issuance of the fifth amendment to the 1945 Constitution. The current revision of the MD3 Law has not yet adopted the authority of the DPD in accordance with the Constitutional Court's decision. The need for the fifth amendment is to reorganize the function of legislation firmly and clearly in the 1945 Constitution, because by reorganizing the function of legislation it will touch all institutions, including the DPR, DPD, President and other institutions.

Abstract

As countries located in the Asian region, Malaysia and Indonesia each have their own investment appeal. Over time, many investors have shown a stronger preference for investing in Malaysia rather than Indonesia. This phenomenon is influenced by various factors, making it a compelling subject of study. This research aims to examine the distinguishing factors in the investment appeal of Malaysia and Indonesia, particularly from the perspective of the positive legal systems in both countries. The objective of this study is to understand the legal regulations governing investment in Indonesia and Malaysia and to determine which regulatory framework is more attractive to investors. The research employs a normative juridical method using a comparative law approach. Data were collected from primary legal materials such as legislation and secondary sources such as books, journals, and previous studies through a literature review. The data were then analyzed descriptively and comparatively. The research findings indicate that Malaysia's investment regulatory framework is more attractive to investors compared to that of Indonesia. This is primarily due to the greater stability of Malaysia’s investment regulations and their relatively infrequent sudden changes. Furthermore, Malaysia’s legal system, which is based on common law, offers greater flexibility to foreign investors. The ease and stability of regulations in Malaysia make it a more preferred investment destination. These findings offer valuable input for the Indonesian government to improve its investment regulatory framework.
