Abstract

Settlement of disputes between residents in Aceh Tamiang Regency was organized by the Setikar Village Council (MDSK) as a village deliberation body, which was later better known by the community through mediation through village traditional apparatus. This study aims to find out and explain how the procedures for resolving disputes between communities by MDSK, and analyze the legal certainty of dispute resolution between communities by MDSK in the Indonesian Judicial system. The research method of this study is normative juridical research by examining aspects of legal certainty in dispute resolution by the Aceh Tamiang District MDSK in the Indonesian justice system. The legal materials used consist of primary, secondary and tertiary legal materials. The approach taken in this research is the approach to legislation and the approach to the principle of legal certainty. The research data will be analyzed qualitatively in accordance with the legislation and conformity with the principle of legal certainty. The results of the study indicate that out-of-court dispute resolution in Aceh Tamiang District is organized by MDSK. The dispute resolution process is carried out by examining initial data related to the subject of the dispute, examining documentary evidence and adjusting it in the field, then making decisions by deliberation and consensus. Dispute resolution by MDSK has not met the principle of legal certainty. Because, MDSK does not have legality as a mediation forum and is not recognized as a mediator as regulated in Supreme Court Regulation Number 1 of 2016 concerning Mediation Procedures in Court. Then, there are no implementing regulations in the form of guidelines for dispute resolution through MDSK, standard rules for implementation procedures and dispute resolution procedures.

Abstract

Arrangements for Foreign Workers are regulated in Law Number 13 of 2003 concerning Manpower which is basically intended for certain jobs or positions that cannot be occupied by local workers and to accelerate the human development index (HDI) needed to support and improve field competence for local Indonesian workers through Knowledge Transfer and Technology or which is often referred to as the transfer of knowledge and technology by means of transferring skills from foreign workers to local workers through their field education and training, in terms of accepting foreign workers in Indonesia, this cannot be separated from the General Agreement on Trade in Services (GATS)/ WTO as the rules of the WTO game that wants policies without discrimination in all aspects. This study uses the juridical-normative legal research method. As for the Juridical-Normative approach, it uses all the methods and techniques that are often used in legal research studies, namely through a statutory approach (statute approach, case approach) to see cases of the entry of Foreign Workers in Indonesian, a comparative approach to compare regulations between one country and another and the last approach, namely, a conceptual approach in the form of views that can be elaborated in solving the issues faced by foreign workers at this time. However, Indonesia must also be careful in observing WTO rules by looking at the GAST/WTO Provisions concerning the natural movement of persons. It also needs to be adopted in the policy of placing foreign workers by taking into account experience and its application in other countries in the interest of protecting Indonesian workers and not using services. foreign workers who do not have good work skills.

Abstract

The issuance of Supreme Court Circular Letter (SEMA) Number 2 of 2023 concerning Instructions for Judges in Adjudicating Cases on Applications for Registration of Marriages Between People of Different Religions and Beliefs has caused pros and cons reactions in society, in essence in this SEMA applications for registration of marriages between different religions cannot be granted by the Court, this is of course contrary to Supreme Court Decision Number 1400 K/Pdt/1986 which states that differences in the religion of prospective husband and wife are not prohibited in marriage, and also contradicts the content in the Elucidation of Article 35 letter a of Law Number 23, 2006 concerning Population Administration, where it is explained that the Court can determine marriages between people of different religions. This research aims to determine the position and legal strength of SEMA in the hierarchical system of statutory regulations. This research method uses normative juridical with a statutory approach. The research results show that the position of SEMA Number 2 of 2023 is under the law and its legal force cannot erase or revoke articles in the Population Administration law, even though SEMA Number 2 of 2023 contains the same material as Article 2 paragraph (1 ) and Article 8 letter f of Law Number 1 of 1974 concerning Marriage, but can only revoke legal products issued by the Supreme Court, so with the issuance of SEMA this automatically revokes Supreme Court Decision Number 1400 K/Pdt/1986. The binding legal power of SEMA is not directly legally binding, but contains legal relevance aimed at the Judicial body under the Supreme Court, thus closing the door for the Court to grant Applications for Registration of Interfaith marriage.

Abstract

The spread of hoax information in Indonesia has recently increased, causing concern, especially with the ease of accessing information through various media, with social media being the primary platform for its dissemination. The active users of social media are mostly teenagers, particularly students, who are accustomed to commenting, sharing, and providing critiques on these platforms. Often, the information shared is not verified for its source, and as long as it goes viral, it is quickly spread to others. This habit can lead to the spread of unverified hoaxes, which can have negative impacts such as psychological attacks, bullying, and legal consequences for hoax spreaders under the ITE Law. Based on this issue, we conducted a community service activity using socialization and discussions about the dangers of hoax dissemination and how to anticipate them among students. The event held at SMA 2 Meulaboh went well and solemnly. The results of this activity showed that many students are still unaware of the dangers of spreading hoax information. Therefore, this initiative provided a deeper understanding, with the hope that students will become more cautious and able to filter the information circulating, especially from unknown sources.

Abstract

The performance of the Hajj pilgrimage is one of the pillars of Islam that must be fulfilled by Muslims who possess the ability (istita'ah). Due to the overwhelming number of applicants and the restrictions on the number of pilgrims allowed to depart each year imposed by the Saudi Arabian government, the Ministry of Religious Affairs of the Republic of Indonesia has limited the departure of prospective Hajj pilgrims through a quota system and the allocation of waiting numbers known as "nomor porsi" (quota numbers). This quota and waiting list system has resulted in a waiting period for prospective Hajj pilgrims in Indonesia reaching up to 46 (forty-six) years from the time of registration. One consequence of this situation is that some prospective Hajj pilgrims who have registered and received their quota numbers may pass away before their departure. To address this issue, the Director General of Hajj and Umrah Implementation has issued Decree Number 130 of 2020, which allows for the transfer of quota numbers to one of the heirs of a deceased prospective Hajj pilgrim who did not have the opportunity to perform the pilgrimage. The transfer of the Hajj quota to one of the heirs has sparked debate in society regarding its status: whether the quota is part of the inheritance that must be divided among the heirs or whether it is not considered part of the inheritance. The research method employed is normative juridical with a conceptual approach. The findings of the study indicate that the Hajj quota of a deceased prospective pilgrim is part of their rights that fall into the category of inheritance. When such a right falls into this category, it can become an inheritance that must be divided among heirs who meet the requirements.

Abstract

AbstractThe problematic legal arrangement of the tax court as stipulated in Article 5 paragraph (1) and paragraph (2) of Law number 14 Year 2002 on Tax Court, paragraph (1) "Technical judicial guidance for the Tax Court is carried out by the Supreme Court and paragraph (2) Organisational, administrative, and financial guidance for the Tax Court is carried out by the Ministry of Finance (now Ministry of Finance). This is certainly different from the independent judicial system or what is known as the "one roof system" in Law number 48 of 2009 concerning Judicial Power. This research uses a juridical-normative legal research method. The Juridical-Normative approach uses methods and techniques through a statute approach, case approach to examine the separation of powers and checks and balances of two power institutions, which attributively regulate the position of the Tax Court with the Tax Court Law and the Judicial Power Law and examine the Constitutional Court's decision relating to the discussion of the legal issues studied. The results of an in-depth study of the legal politics of the establishment of the Tax Court Law, should be directed at efforts to establish an independent judicial system "one roof system" and the Constitutional Court's decision to grant and declare Article 8 paragraph (2), Article 8 paragraph (3) and Article 13 paragraph (1) of the Tax Court Law does not have binding legal force, in maintaining the spirit of independent judicial power so that the court does not become an instrument of power (machtsapparaat), but becomes an instrument of law (rechtsapparaat), it is necessary to revise the Tax Court Law as part of improving the separation of powers and cheks and balances.Keywords: Legal Politics, Tax Court, Separation of Powers, checks and balances

Abstract

Artificial Intelligence has become a new aspect of social life in 2020, as the widespread use of technology has led to the development of devices with Artificial Intelligence as a key feature. Furthermore, Artificial Intelligence with more sophisticated features continues to develop and can be accessed by installing a dedicated program or through relevant websites. Cybercrimes are inherently diverse and not limited to online fraud. However, the growing phenomenon of online fraud stems from the close connection between perpetrators and victims, a strong relationship driven by numerous factors, such as urgency and high needs. This study aims to determine preventive measures for law enforcement against AI-based online fraud. The research method employed is a normative juridical approach with a conceptual approach. The findings demonstrate that preventive measures for law enforcement against Artificial Intelligence based online fraud can be implemented from three perspectives: from the perspective of the public as users, from the perspective of law enforcement as the spearhead of law enforcement, and from the perspective of the regulation itself as the legal umbrella.

Abstract

A situation involving Professional Assistance Personnel (TPP) running for legislative office has emerged in Langkat District. Two legislative candidates from the National Awakening Party (PKB) are also registered Village TPPs. Concurrently, Komnas HAM received a complaint alleging that the Ministry of Villages (MoV) terminated the employment of 1,040 TPPs because they became legislative candidates. However, the TPP employment contracts reportedly lack clauses prohibiting political candidacy, raising legal questions regarding the employment status of TPPs. This study aims to determine the regulations concerning the resignation requirements for TPPs seeking legislative office, in accordance with applicable legislation. Employing a socio-legal approach, the research finds that TPPs are eligible to run as legislative candidates provided they meet the necessary requirements. Nevertheless, TPPs must resign from their positions because funding for TPP roles originates from the state budget. TPPs are considered Ministry personnel, and those committing serious violations, such as serving in political party management, face sanctions including dismissal.
