Abstract

Special autonomy needs to be examined further on the constitution in terms of providing loopholes or justifying the implementation of special autonomy, so that harmonization and synchronization of statutory regulations can be realized. The purpose of this study is to analyze the formation of the Law on Aceh Government in accordance with the mandate of the constitution and to determine the juridical consequences of the enactment of the Law on Governing Aceh. The results showed that the Special Autonomy of Aceh Province is a mandate of the constitution as viewed from the historical approach to the constitution regarding regional governance. The juridical consequence in terms of Indonesian constitutionality is that Aceh as a regional government has broad authority in the administration of autonomy with the broadest possible principle of special autonomy. Keywords: legal policy, special autonomy, government, Aceh

Abstract

Perimbangan Dana Otonomi Khusus Aceh antara Provinsi dan kabupaten/kota dalam rangka mempercepat pembangunan di Aceh dalam berbagai sektor akan terwujud apabila pengelolaannya sesuai dengan prinsip kesejahteraan rakyat serta mekanisme pengawasan yang sesuai dengan asas kemanfaatan. Penelitian ini bertujuan untuk mengetahui dan menjelaskan kesesuaian peraturan perimbangan Dana Otonomi Khusus Aceh dengan prinsip kesejahteraan rakyat serta kemanfaatan mekanisme pengawasan pengalokasian Dana Otonomi Khusus Aceh yang dilakukan Pemerintahan Aceh. Penelitian ini merupakan penelitian yuridis normatif yang ingin mengidentifikasi dari aspek hukumnya. Data yang digunakan terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Hasil peneltian menunjukkan bahwa pengelolaan Dana Otonomi Khusus Aceh belum memenuhi prinsip Negara kesejahteraan, karna pembagiannya lebih besar untuk Provinsi daripada Kabupaten/Kota. Mekanisme pengawasan terhadap pemanfaatan Dana Otonomi Khusus belum menjamin pemenuhan asas kemanfaatan. Belum adanya Peraturan Gubernur Aceh tentang Satuan Kerja Khusus dan tentang kriteria seleksi program serta kurangnya peran pengawasan dari lembaga khusus Aceh sebagai bentuk pengawasan eksternal. The balance of Aceh Special Autonomy Fund between provinces and districts/cities in order to accelerate development in Aceh in various sectors will be achieved if the management is in accordance with the principle of people's welfare and the supervisory of its mechanism is in line with the principle of expediency. This study aims to identify and explain the appropriateness of the regulation on the balance of the Special Autonomy Fund of Aceh with the principle of people's welfare. In addition to that, this study also wants to assess the usefulness of monitoring mechanism for the allocation of the Special Autonomy Fund of Aceh that is conducted by the Government of Aceh. This research is a normative juridical research that wants to identify from its legal aspect. This research uses three kinds of data: they are primary legal materials, secondary legal materials, and tertiary legal materials. The results of the study indicate that the management of the Aceh Special Autonomy Fund has not yet fulfilled the basic objectives of the welfare state, because the distribution is greater for the province than the districts/cities. The mechanism of supervision over the utilization of the Special Autonomy Fund has not been in accordance with the principle of expediency. The absence of Aceh Governor Regulation on Unit Special Working and selection criteria program and then lack of Role of Supervision from Aceh special Autonomy institutions as a form external controls.

Abstract

This study focuses on sexual crimes in the form of obscene acts against children. According to R. Soesilo, obscene acts are all acts that violate decency or decency, or can also constitute a heinous act that is included in the environment of sexual lust. The problem lies in the criminal sanctions regulated between the two regulations. Criminal sanctions regulated in the PA Law and the PKS Law have differences in terms of the length of the sentence, the amount of the fine, and others. Then there will also be a test of the PA Law and the TPKS Law against the theory of the purpose of punishment. The research method used is a normative research method, namely research conducted with reference to the principles, legal concepts, legal norms contained in the legislation. The results of this research are that in terms of the comparison of the length of imprisonment or the number of fines, the PA Law is more effective than the TPKS Law. There are also articles regulated in the PA Law that are not regulated in the TPKS Law, such as Articles 76D and 76E. In the article, it is more specific how to commit obscene acts, namely by means of "threats of violence and violence." Both the PA Law and the TPKS Law adhere to a combined theory. In the PA Law and the TPKS Law, the main punishments regulated are imprisonment, fines and payment of restitution to victims. If it is related to the combined theory, then the PA Law and the TPKS Law have fulfilled the purpose of the combined theory. However, in the TPKS Law, in addition to stipulating the main punishment, it also regulates additional crimes, namely revocation of child custody or revocation of guardianship, announcement of the identity of the perpetrator and/or confiscation of profits and/or assets obtained from criminal acts of sexual violence. With the provision of additional penalties in the TPKS Law, it can be seen that the types of criminal sanctions in the TPKS Law provide more complete understanding of the combined theory. So that it can be concluded that the TPKS Law in terms of types of criminal sanctions is more comprehensive in its arrangement.

Abstract

Settlement of disputes between residents in Aceh Tamiang Regency was organized by the Setikar Village Council (MDSK) as a village deliberation body, which was later better known by the community through mediation through village traditional apparatus. This study aims to find out and explain how the procedures for resolving disputes between communities by MDSK, and analyze the legal certainty of dispute resolution between communities by MDSK in the Indonesian Judicial system. The research method of this study is normative juridical research by examining aspects of legal certainty in dispute resolution by the Aceh Tamiang District MDSK in the Indonesian justice system. The legal materials used consist of primary, secondary and tertiary legal materials. The approach taken in this research is the approach to legislation and the approach to the principle of legal certainty. The research data will be analyzed qualitatively in accordance with the legislation and conformity with the principle of legal certainty. The results of the study indicate that out-of-court dispute resolution in Aceh Tamiang District is organized by MDSK. The dispute resolution process is carried out by examining initial data related to the subject of the dispute, examining documentary evidence and adjusting it in the field, then making decisions by deliberation and consensus. Dispute resolution by MDSK has not met the principle of legal certainty. Because, MDSK does not have legality as a mediation forum and is not recognized as a mediator as regulated in Supreme Court Regulation Number 1 of 2016 concerning Mediation Procedures in Court. Then, there are no implementing regulations in the form of guidelines for dispute resolution through MDSK, standard rules for implementation procedures and dispute resolution procedures.

Abstract

Arrangements for Foreign Workers are regulated in Law Number 13 of 2003 concerning Manpower which is basically intended for certain jobs or positions that cannot be occupied by local workers and to accelerate the human development index (HDI) needed to support and improve field competence for local Indonesian workers through Knowledge Transfer and Technology or which is often referred to as the transfer of knowledge and technology by means of transferring skills from foreign workers to local workers through their field education and training, in terms of accepting foreign workers in Indonesia, this cannot be separated from the General Agreement on Trade in Services (GATS)/ WTO as the rules of the WTO game that wants policies without discrimination in all aspects. This study uses the juridical-normative legal research method. As for the Juridical-Normative approach, it uses all the methods and techniques that are often used in legal research studies, namely through a statutory approach (statute approach, case approach) to see cases of the entry of Foreign Workers in Indonesian, a comparative approach to compare regulations between one country and another and the last approach, namely, a conceptual approach in the form of views that can be elaborated in solving the issues faced by foreign workers at this time. However, Indonesia must also be careful in observing WTO rules by looking at the GAST/WTO Provisions concerning the natural movement of persons. It also needs to be adopted in the policy of placing foreign workers by taking into account experience and its application in other countries in the interest of protecting Indonesian workers and not using services. foreign workers who do not have good work skills.

Abstract

Indonesian GIs is still little than of their leading commodities that have the potential to receive legal protection as GIs. One of them is South Aceh's nutmeg as leading commodities. The research question revolves around the concept of social ownership within the legal protection framework of South Aceh Nutmeg's geographical indication and how its legal protection operates. This study aims to elucidate the concept of social ownership concerning the legal protection potential of South Aceh Nutmeg's geographical indication. This research employs a normative juridical method using legislative analysis and a conceptual approach. The registration of geographical indications is vital for securing legal protection concerning social ownership rights and the product's regional origin. Geographical indications serve as instruments to protect products possessing unique geographical characteristics, acting as a claim to social ownership for the communities producing these goods. There are four fundamental principles in developing the concept of social ownership: active participation, sustainable management, responsibility in preservation, and equitable benefit-sharing. The development of social ownership concepts is anticipated to resolve issues related to the deserving and fair legal protection of the South Aceh Nutmeg Geographical Indication. Abstract

The existence of local political party wing organisations in Aceh has not yet received legal legitimacy. This creates legal uncertainty and injustice for local political parties in balancing national political parties so that special rules regarding local political party wing organisations must receive attention from the government. Further review through normative juridical studies by analysing aspects of legal certainty of the rights of local political parties in Aceh in the formation of party wing organisations and their driving factors. The formation of local political party wing organisations in Aceh in terms of statutory rules there is a legal vacuum, namely a situation where there are things that have not been regulated by law. This is in accordance with the adage het recht hink achter de feiten aan, i.e. the law always lags behind reality. Of course, this results in the absence of legal certainty for local political parties regarding the right to establish local political party wing organisations. The driving factor in the formation of local political party wing organisations in Aceh is the urgent need for local political parties to balance national political parties in facing unequal or unbalanced conditions in terms of external support in the form of political machines outside the party.

Abstract

The Aceh Tengah Regency ecotourism development policy is based on the Qanun RIPPARDA since 2018-2025. On its way, the development of ecotourism over the past five years has not had a significant impact. The formulation of the problem in this study is how the implementation of the Aceh Tengah regency government policy in the development of ecotourism and what are the obstacles faced by the Aceh Tengah regency government in implementing the policy. The aim in this this research are to find out and explain the implementation of the policy of the Central Aceh district government in the development of ecotourism and provide an overview of the obstacles experienced by the Central Aceh district government in implementing policies on ecotourism development. This research is a qualitative research by applying descriptive analysis method and empirical juridical approach. The results showed that the ecotourism development policy in Central Aceh Regency has not been supported by separate implementing regulations such as regulations within the scope of tourism destinations, tourism industry, marketing and tourism institutions based on the provisions of tourism legislation. Constraints faced in policy implementation include, among others, a regulatory vacuum that has an impact on the emergence of illegal businesses, the non-absorption of local revenue in the field of tourism to the maximum, and the emergence of ecotourism businesses that do not rely on environmental protection, the high cost of licensing administration in the field of environmental impact control and the behaviour of people who are not friendly to tourists

Abstract

The issuance of Supreme Court Circular Letter (SEMA) Number 2 of 2023 concerning Instructions for Judges in Adjudicating Cases on Applications for Registration of Marriages Between People of Different Religions and Beliefs has caused pros and cons reactions in society, in essence in this SEMA applications for registration of marriages between different religions cannot be granted by the Court, this is of course contrary to Supreme Court Decision Number 1400 K/Pdt/1986 which states that differences in the religion of prospective husband and wife are not prohibited in marriage, and also contradicts the content in the Elucidation of Article 35 letter a of Law Number 23, 2006 concerning Population Administration, where it is explained that the Court can determine marriages between people of different religions. This research aims to determine the position and legal strength of SEMA in the hierarchical system of statutory regulations. This research method uses normative juridical with a statutory approach. The research results show that the position of SEMA Number 2 of 2023 is under the law and its legal force cannot erase or revoke articles in the Population Administration law, even though SEMA Number 2 of 2023 contains the same material as Article 2 paragraph (1 ) and Article 8 letter f of Law Number 1 of 1974 concerning Marriage, but can only revoke legal products issued by the Supreme Court, so with the issuance of SEMA this automatically revokes Supreme Court Decision Number 1400 K/Pdt/1986. The binding legal power of SEMA is not directly legally binding, but contains legal relevance aimed at the Judicial body under the Supreme Court, thus closing the door for the Court to grant Applications for Registration of Interfaith marriage.

Abstract

Pelaksanaan pemilihan umum (Pemilu) yang berkualitas dengan berasas langsung, umum, bebas, rahasia, jujur, dan adil menjadi kebutuhan dalam negara demokrasi seperti Indonesia. Pemilu yang berkualitas tidak terlepas dari sistem pengawasan untuk melakukan deteksi dini, pencegahan, dan penanganan sengketa yang mungkin muncul selama pelaksanaan pemilihan umum. Oleh karenanya kapasitas sumber daya manusia panitia pengawas pemilihan umum hingga level kecamatan menjadi salah satu aspek yang perlu ditingkatkan. Kegiatan pengabdian ini bertujuan untuk (1) memberikan transfer pengetahuan terkait pengawasan pemilihan umum kepada panitia pengawas di Kabupaten Aceh Barat dan (2) menyusun rencana tindak lanjut sebagai komitmen mendorong pemilihan umum yang berkualitas. Mitra dalam kegiatan ini adalah Panitia Pengawas Pemilihan (Panwaslih) Kabupaten Aceh Barat dengan kelompok sasaran 36 (tiga puluh enam) panitia pengawas di tingkat kecamatan. Hasil dari kegiatan ini menunjukkan perubahan positif peserta mengenai hierarki peraturan perundang-undangan dan jenis pelanggaran pemilu menjadi lebih baik. Selanjutnya dengan adanya kegiatan ini, kompetensi para peserta meningkat sehingga dalam pelaksanaan tugas dan fungsi dapat dijalankan secara optimal. Pemaparan dari narasumber diharapkan dapat menjadi informasi pendukung bagi peserta dalam mengawal pelaksanaan pemilu di Kabupaten Aceh Barat tahun 2024.
