Abstract

Banking has a function as an intermediary institution, namely mobilizing funds from people who have excess funds and channeling them back to people in need in the form of financing facilities. Banking has a vital role in the economic sector, especially in regulating the circulation of money in society. The research method used is a qualitative research method with a literature approach. The results of the study state that the settlement of sharia banking disputes through non-litigation can be carried out through arbitration and alternative settlements, which consist of consultation, negotiation, mediation, conciliation, or expert judgment as regulated in Law Number 30 of 1999 concerning Arbitration and Alternative Disputes. In arbitration, customers and Islamic banks are given the right to choose the material law to be applied as stipulated in Article 56 paragraph (2) of Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution. Abstract

Abstract

The prosecution authority, as part of the state’s law enforcement system, plays a strategic role in ensuring legal certainty, justice, and public order while upholding moral values and human dignity. In this context, the application of restorative justice has emerged as an alternative approach to resolving criminal cases, including assault offenses. This study examines the implementation of termination of prosecution based on restorative justice in an assault case handled by the Palembang District Attorney’s Office. The research adopts a normative juridical method, focusing on statutory regulations and prosecutorial guidelines governing restorative justice. The findings indicate that the termination of prosecution was influenced by several key factors: the suspect committed the offense for the first time, the offense carried a maximum statutory penalty of no more than five years’ imprisonment, and the value of losses or evidence did not exceed IDR 2,500,000. Additionally, the case demonstrated successful reconciliation between the perpetrator and the victim, supported by community approval. The study concludes that the application of restorative justice in this case reflects prosecutorial discretion aimed at achieving substantive justice, social harmony, and efficiency in criminal law enforcement. Keywords: termination of prosecution; restorative justice; assault cases; prosecutorial discretion

Abstract

Housing sale and purchase disputes arising from property developers' tortious acts—specifically the systemic practice of double sales—pose severe threats to legal certainty and consumer protection in Indonesia. This research critically analyzes Palembang District Court Decision Number 225/Pdt.G/2024/PN Plg, moving beyond trivial element-matching under Article 1365 of the Indonesian Civil Code to examine deep legal dogmatics surrounding competing property rights, protection of good-faith purchasers, and the legal dichotomy between binding sale and purchase agreements (PPJB) and official land deeds (AJB). Employing a doctrinal legal research methodology with statute, case, and conceptual approaches, this study utilizes grammatical, systematic, and teleological interpretation tools to evaluate judicial reasoning. The findings reveal that the developer's act of selling a single townhouse unit to multiple buyers constitutes an unlawful act (onrechtmatige daad) that directly infringes upon the first buyer's subjective possessory rights, rather than a mere contractual default (wanprestasi). The court correctly applied the principle of protecting good-faith buyers (SEMA No. 1/2017) and the doctrine of nemo plus juris. However, judicial reasoning exhibits critical shortcomings in quantifying immaterial damages and defining evidentiary thresholds for systemic developer fraud. To address these systemic gaps, this paper proposes actionable legal reforms, including mandatory digital PPJB registration within the land registry system, statutory implementation of escrow account mechanisms under Law No. 1/2011, and Supreme Court guidelines for standardizing moral damage awards in property torts.

Abstract

Conventional institutional assessments frequently characterize penal security as 'effective' based on binary outcomes such as the absence of mass escapes or major riots. This article challenges this analytical assumption by investigating Class IIB Way Kanan Prison, a rural Indonesian penology facility housing 638 inmates within an authorized design capacity of 250 (a 255% overcapacity rate), monitored by a total staff of 65 and an active guard shift of only 8 to 9 officers (a 1:75 guard-to-inmate ratio). Addressing core analytical contradictions in prior literature, this study operationalizes security through empirical metrics: contraband confiscation logs (mobile phones, improvised weapons, illegal wiring), physical surveillance blind-spot mapping, and qualitative narratives from field officers and inmates. Grounding the analysis in five criminological and legal frameworks—Bentham's Panopticon failure, François Gény’s Ethical Free Law, Mochtar Kusumaatmadja’s Legal Development Theory, Crime Prevention Through Environmental Design (CPTED), and Rational Choice Theory—the findings demonstrate that facility stability is maintained not through absolute physical deterrence, but through a state of 'vulnerable operational resilience' reliant on informal administrative discretion, dynamic officer negotiation, and inmate self-governance. To bridge the gap between normative mandates under Law No. 22 of 2022 and penal reality, the paper advances actionable recommendations spanning legislative decriminalization of drug users, risk-indexed staffing models, and technological smart CPTED integration.
