Abstract

The enactment of Law No. 1 of 2023 on the Indonesian Criminal Code (KUHP Baru) marks a fundamental shift in the regulation of concurrence of criminal offenses (concursus), replacing the mixed cumulative-absorption system inherited from the colonial Wetboek van Strafrecht. This study examines the transformation of sentence cumulation in concursus and evaluates the extent to which the new regime re-actualizes proportionality and individualization in sentencing. Employing a normative juridical method with statutory, conceptual, and comparative approaches, the research analyses Articles 123–128 of the new KUHP alongside doctrinal developments and hypothetical case simulations. The findings reveal that the new KUHP explicitly abandons the pure cumulative stelsel in favor of an aggravated absorption system (stelsel absorpsi yang dipertajam), whereby the maximum penalty for multiple acts is set at the most severe principal threat plus one-third, and judicial discretion is bounded by overarching sentencing objectives that mandate proportionality and individual culpability. The discussion demonstrates that this structural change harmonizes Indonesian concursus law with modern sentencing theories, particularly limiting retributive excess and enabling individualized sanctions. However, residual ambiguity in the definition of “multiple acts” and the absence of operational guidelines for aggravation pose risks of disparity. The article concludes that the new KUHP constitutes a significant normative advancement toward proportionality and individualization, but its practical realization demands coherent implementing instruments and intensive judicial training

Abstract

Praktik rentenir masih menjadi persoalan yang banyak dialami kelompok rentan akibat rendahnya literasi hukum. Kondisi ini menyebabkan masyarakat belum memahami hak dan perlindungan hukum terhadap praktik pinjaman yang merugikan. Kegiatan pengabdian kepada masyarakat ini bertujuan meningkatkan literasi hukum melalui sosialisasi Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana (KUHP Baru). Kegiatan dilaksanakan di Desa Sitalasari, Kabupaten Simalungun, menggunakan metode penyuluhan hukum partisipatif melalui ceramah, diskusi, studi kasus, dan evaluasi pre-test serta post-test. Hasil kegiatan menunjukkan peningkatan pemahaman peserta mengenai praktik rentenir, ketentuan KUHP Baru, serta upaya perlindungan hukum bagi korban. Selain itu, masyarakat menjadi lebih sadar untuk memilih sumber pembiayaan yang legal dan menghindari pinjaman berbunga tinggi. Kegiatan ini menunjukkan bahwa sosialisasi KUHP Baru merupakan strategi yang efektif dalam memperkuat literasi dan kesadaran hukum masyarakat untuk mencegah praktik rentenir.

Abstract

The development of information and communication technology has led to the emergence of various forms of cybercrime, one of which is revenge porn, namely the distribution of intimate content without the victim's consent with the intention of humiliating, threatening, or seeking revenge. This offense causes serious psychological, social, and economic impacts and constitutes a violation of the right to privacy and human dignity. This study aims to analyze criminal law policies regarding revenge porn in Indonesia and evaluate the effectiveness of existing legal regulations in protecting victims. This research employs a normative legal research method using statutory and conceptual approaches. Data were collected through library research consisting of primary, secondary, and tertiary legal materials and analyzed qualitatively using a descriptive-analytical method. The results indicate that the handling of revenge porn initially relied on the provisions of the Indonesian Criminal Code and the Electronic Information and Transactions Law, which have not provided optimal legal protection for victims. The enactment of Law Number 12 of 2022 concerning Sexual Violence Crimes represents a progressive step, as it provides a clearer legal basis for addressing electronic-based sexual violence. Nevertheless, its implementation still faces challenges, including limitations in digital evidence, insufficient understanding among law enforcement officers, and victims' reluctance to report incidents due to social stigma. Therefore, strengthening criminal law policies through repressive, preventive, and rehabilitative measures is necessary to improve victim protection and enhance the effectiveness of combating revenge porn in Indonesia.
