Abstract

Abstrak Penelitian ini merupakan hasil dari rekonstruksi yang dibuat berdasarkan kajian dan analisis mengenai tindakan yang diambil oleh Jan Willem Janssens sebagai gubernur jenderal dan panglima tertinggi pasukan Belanda-Prancis di Jawa pada periode Mei-September 1811. Periode ini merupakan masa ketika Jawa berada di bawah ancaman serangan Inggris. Persoalan dari tulisan ini adalah apa yang mendasari pemilihan Janssens oleh Napoleon sebagai panglima dan apa tindakannya menghadapi situasi Jawa yang kritis secara strategis militer. Focus dari penelitian ini adalah sosok Janssens dalam lingkungannya di kalangan para petinggi Prancis atau Belanda, dan sikapnya dalam menghadapi Inggris. Oleh karenanya metodologi yang digunakan dalam kajian ini adalah strukturasi dengan tujuan untuk mengungkapkan proses agency yang dilakukan oleh agent dalam lingkup perubahan structural yang dihadapinya. Sebagai kesimpulan dari penelitian ini, berdasarkan analisis yang menggunakan teori Anthony Giddens, bisa diketahui bahwa pilihan atas Janssens oleh Napoleon untuk mempertahankan Jawa lebih didasarkan pada aspek loyalitas daripada kualitas pribadinya, sementara bagi Janssens sendiri penunjukkan ini merupakan suatu penghormatan besar yang dirasakannya dari seorang tokoh terkenal di Eropa masa itu. Dengan demikian factor psikis sangat memegang peranan dalam proses perubahan penting dalam bidang strategis militer dan politik di Hindia Timur pada awal abad XIX. Abstract

This article aims to provide a brief overview regarding the existence of Confucianism as a religion in the Dutch East Indies and its relationship with the colonial ruling regime during the last four decades of Dutch rule. With the overview, it is hoped that the type of colonial policy that was made towards the Chinese ethnic belief could be understood, whether in social or political aspects and also its relevance to world developments that took place at the time. To realise this goal, the method used in this paper is the historical research method which consists of four stages: data search (heuristic), source criticism, interpretation, and reconstruction as a form of final academic presentation. With this method, it is hoped that a short paper can be presented that is arranged in a reconstructive manner and is able to provide answers to research problems. As a final conclusion, this paper reveals that in principle, colonial political interests cannot be separated from the existence of religion in her colony, including Confucianism. Especially the international aspect that began to colour the existence of this religion in the Dutch East Indies colony became the main motivation for the colonial government to determine their policies. In this case, the dualistic nature of Dutch colonial policy can be recognised.

Abstract

This article aims to elucidate the existence of two distinct forms of land property rights within the colonial civil law system in Indonesia. By doing so, it seeks to identify the historical origins of issues encountered in contemporary civil law cases. These issues, which are deeply rooted in colonial legal practices, can be better understood by tracing the development of two parallel regimes of property rights: Western civil property rights and indigenous property rights. To examine the origins of these problems, this study employs the historical method, which consists of four stages, namely heuristics, source criticism, interpretation, and historical reconstruction. The sources used are primarily historical documents, with particular emphasis on their authenticity and reliability. The findings indicate that the colonial civil law system was characterized by a dualism of land property rights, each governed by distinct limitations and regulatory frameworks. This dualism emerged as a result of ambiguities and inconsistencies in colonial policies concerning indigenous land ownership.
