Abstract

This study discusses about itsbat talak (legal recognition of divorce) pronounced by husbands out of court in the perspective of Marriage Law in Indonesia. There are three issues answered in this study. First, how is the legal problem of out-of-court divorce in the perspective of Marriage Law in Indonesia and Fiqh? Second, what is the urgency of itsbat talak in the view of fiqh and Marriage Law in Indonesia? Third, what is the review of the Marriage Law in Indonesia on the itsbat talak out-of-court? To answer this problem, a library study was conducted. The data was collected through searching of the research results, books, fiqh books, laws or regulations and electronic as well as digital data through websites. The study found that there are some legal problems of itsbat talak for out-of-court divorce such as its legality, the probability of talak for twice, no legal protection, the couple blocked from other marriage, and the lost of post-marriage rights. Itsbat talak for out of court divorce can be recognized in the Marriage Law in Indonesia. Studi ini mengkaji tentang itsbat (pengakuan hukum) talak yang telah dijatuhkan suami di luar pengadilan dalam perspektif hukum perkawinan di Indonesia. Ada tiga persoalan yang akan dijawab dalam studi ini. Pertama, bagaimana problematika hukum talak di luar pengadilan dalam perspektif Hukum Perkawinan di Indonesia dan Fikih ? Kedua, bagaimana urgensi itsbat talak dalam pandangan Fikih maupun Hukum Perkawinan di Indonesia ? Ketiga, bagaimana tinjauan Hukum Perkawinan di Indonesia terhadap itsbat talak  perceraian di luar pengadilan ? Untuk menjawab permasalahan ini dilakukan studi kepustakaan. Data tentang talak di luar pengadilan atau itsbat nikah dikumpul melalui penelusuran hasil-hasil penelitian, buku-buku atau kitab fikih, undang-undang atau peraturan dan data elektronik melalui website. Data ini diolah, dianalisis dan dijadikan bahan untuk mengkaji itsbat talak dengan menggunakan metode kajian hukum normatif. Hasil penelitian menemukan jawaban, pertama; ada lima problem hukum talak di luar pengadilan, seperti keabsahannya, kemungkinan terjadi talak dua kali, tidak adanya perlindungan hukum, pasangan talak di luar pengadilan tidak dapat melakukan penikahan resmi dengan yang lain, tidak bisa mendapatkan  hak-hak setelah talak. Itsbat talak dapat diakui dalam hukum perkawinan di Indonesia.

Abstract

Studi ini mengkaji tentang aturan wajib vaksinasi Covid-19 dalam rangka penaggulangan pandemi Covid-19 dalam Peraturan Presiden Nomor 14 Tahun 2021 yang mewajibkan masyarakat yang menjadi sasaran penerima vaksinasi untuk melakukan vaksinasi Covid-19 bagi masyarakat yang menolak vaksinasi akan dikenakan sanksi berupa saksi administrative dan sanksi denda. Permasalahannya adalah terdapat pasal-pasal dalam hukum positif yang bertentangan dengan aturan wajib vaksinasi tersebut dan menurut kreteria pembentukan perundang-undangan dalam siyasah suariyah aturan wajib vaksinasi Covid-19 belum memenuhi kriteri-kriteria tersebut. Penelitian ini menggunakan penelitian kepustakaan (library research). Data dan bahan diperoleh melalui membaca, mengutip buku, meneliti, menganalisis dokumen, berita di internet dan undang-undang terkait pembahasan. Setelah data/bahan terkumpul diolah dengan cara kualitatif deskriptif dan dianalisis dengan cara deduktif.

Abstract

This thesis examines the supervision carried out by the Election Supervisory Agency (Bawaslu) over digital campaign activities on social media during the 2024 Regional Head Election (Pilkada) in Tanah Datar. The study focuses on three main issues: the forms and characteristics of digital campaigns that emerged on social media platforms, the supervisory mechanisms employed by Bawaslu in responding to these dynamics, and the challenges faced by Bawaslu in exercising its oversight function amid the rapid development and openness of digital information. This research adopts a qualitative field research approach. Data were collected through in-depth interviews with relevant stakeholders, documentation analysis, and observation of local social media accounts that were active during the campaign period. The collected data were analyzed descriptively and qualitatively using several analytical frameworks, including surveillance theory, campaign theory, institutional theory of Bawaslu, and the perspective of fiqh siyasah tanfidziah. The findings indicate that digital campaigns in the 2024 Tanah Datar Pilkada were not limited to informational, persuasive, and mobilizational content, but also evolved into spaces of political criticism, satire, humor, and complex public interaction. This development confirms that social media has become a strategic arena for shaping public opinion, while simultaneously presenting significant challenges for electoral supervision. Bawaslu’s supervisory efforts—implemented through direct, indirect, and preventive mechanisms—reflect an institutional attempt to adapt to digital realities. However, their effectiveness remains constrained by technical limitations, the absence of detailed regulatory frameworks governing digital campaigns, and relatively low levels of public participation. This condition illustrates a gap between positive legal norms governing elections and the actual practices of digital campaigning in the field. From the perspective of fiqh siyasah tanfidziah, electoral supervision constitutes a mandate that must be carried out fairly and oriented toward the public interest (maslahah). Accordingly, this study emphasizes the importance of strengthening digital campaign regulations, enhancing supervisory technological capacity, and encouraging broader public involvement to ensure that digital campaign oversight is more effective, just, and aligned with both legal principles and sharia values.
