Abstract

Mega proyek Centre Point of Indonesia (CPI) seluas 157 Ha yang berdiri di atas lahan Negara di kawasan pesisir Makassar dilakukan oleh Pemerintah Provinsi (Pemprov) Sulawesi Selatan bersama PT Yasmin Bumi Asri dan PT Ciputra Tbk sebagai investor. Izin reklamasi digugat oleh koalisi masyarakat sipil yang mengatasnamakan “Aliansi Selamatkan Pesisir (ASP) Makassar”. Koalisi ASP menggugat karena reklamasi dipandang menyalahi ketentuan dalam UU No. 32 Tahun 2009 tentang Lingkungan Hidup, PP No. 27 Tahun 2012 tentang Izin Lingkungan, Perpres No. 122 Tahun 2012 tentang Reklamasi di Wilayah pesisir dan Pulau-Pulau Kecil, serta Permen Kelautan dan Perikanan No 17 tahun 2013 tentang Pedoman Perizinan Reklamasi. Gugatan ini didukung hasil kajian ASP bahwa 60% terumbu karang di wilayah pesisir kota Makassar telah rusak. Alokasi ruang reklamasi yang nantinya akan dilaksanakan dalam sebuah proyek besar reklamasi akan menambah parah presentasi kerusakan terumbu karang. Selain itu, reklamasi juga semakin memperparah pencemaran air laut di sekitar pantai Losari, Makassar.

Abstract

This study aims to explain the legal effectiveness of BPIP's recommendations on statutory regulations that are contrary to Pancasila values and the main factors that are internal obstacles to BPIP institutions. This type of research uses normative-empirical research. This type of research uses secondary data (from the library) and is supported by primary data based on field research, such as observations, interviews and surveys. Using a normative/juridical approach and a philosophical/ideal values approach. The results of this study are that the implementation of the duties and functions of the BPIP in providing recommendations on regulations that conflict with Pancasila values or the institutionalization of Pancasila values in a product of current legislation is not fully effective due to various influencing factors, including the weak institutionalization of Pancasila values in political institutions. , economic, and socio-cultural, and lack of consistency in making Pancasila the source of all sources of state law in the formation of statutory regulations, BPIP with its duties and functions can provide recommendations on statutory regulations that are contrary to the values of Pancasila but need to be strengthened again the form of the recommendation so that it is final and binding, bearing in mind that the recommendation policy issued by BPIP is only in the form of written input on the contents of regulations or laws that are not in line with Pancasila values.

Abstract

This study aims to analyze the enforcement of sanctions against perpetrators of the destruction of tourist objects in Ke'te' Kesu' North Toraja. This research uses empirical legal research methods with a statutory approach. The results of this study indicate that the enforcement of sanctions against the perpetrators of the destruction of tourist objects in Ke'te' Kesu' North Toraja is still less effective and the case has not been followed up, despite having a Regional Regulation of North Toraja Regency Number 7 of 2016. There are several obstacles faced in the application of sanctions in law enforcement against perpetrators of destruction of tourist objects due to, among others: (1) the civil service police unit can’t apply criminal sanctions because it does not have an agreement from the Police, Prosecutor's Office, and the Court; (2) the budget is slow or even non-existent so that the civil service police unit can’t move in guarding every tourist who enters North Toraja, and (3) the lack of personnel of the civil service police unit, so that it does not reach every violation of the destruction of Ke'te Kesu' Toraja Utara tourist objects.

Abstract

Deforestation causes the availability of forest land for ecosystem and environmental, Forest management activities in Indonesia have been regulated in Law Number 41 of 1999 concerning. The Forestry Law states that all forests within the territory of the Republic of Indonesia, including the natural wealth in them, are controlled by the state for the greatest prosperity of the people. there is an environmental law enforcement agency appointed to supervise or take action against illegal loggers as well as a forest use licensing mechanism, however, the facts on the ground show that there are still many forestry activities that damage forest ecosystems and are even increasing. This research was conducted at the Kalaena Forest Management Unit (KPH) which carried out supervision in the Protected Forest Area area, This research is Empirical Research. The data used are primary, secondary and tertiary data. All data and materials obtained from the results of the research were compiled and analyzed qualitatively and presented descriptively.
