Abstract

Protection of the marine environment within the framework of international law is actually an accumulation of The Principle of National Sovereignity and The Freedom of High Sea. The International Maritime Organization (IMO) states that "a right on the part of an astat threatened with the environmental injury from sources beyond its territorial jurisdiction, at least where those sources are located on the high seas, to take reasonable action to prevent or abate that injury ". The general principle of good neighbor liness can be found in international customary law as well as in Article 74 of the UN Charter. This principle is reflected in several international treaties and is supported by the country's main practices in dangerous and emergency activities. Cooperation is contained in the 24th Principle of the Stockholm Declaration and the 27th Principle of the Rio Declaration which states that countries must cooperate in the principles of good faith and the spirit of partnership as efforts to protect the environment. Keywords: protection of the marine environment, principles of good faith, International Maritime Organization (IMO)

Abstract

The research results showed that dumping is stillunderstood pluralistically in Indonesian Legal System through someexisting laws, such as Law No. 17 of 1985 on the Ratification ofUNCLOS, Law No. 32 of 2009 on Environmental Protection andManagement, the Government Regulation No. 29 of 2014 on thePrevention of Environmental Pollution, the Regulation of the Minister ofMaritime Number 136 of 2015 on the Second Amendment to theMinisterial Regulation No. 52 of 2011 on Dredging and Reclamation,and the Ministerial Decree No. 4 of 2005 on the Prevention of Pollutionfrom Ships. Dumping Countermeasures in general is still understood asan act of dredging and reclamation as the cause of the silting ofshipping channels. Indonesia has not ratified the London DumpingConvention. The list of wastes that need special arrangements and isabsolutely not disposed in the territory of the coastal states has notbeen set. Therefore, compensation has not been the priority of theprotection to the marine environment by the state. The responsibility ofthe state through the State Attorney requires procedural formalities inthe form of a special power of attorney. Hence, a cooperation withrelevant institutions, in this case the Ministry of Environment andForestry, is necessary. Currently in Indonesia, there are too manyoverlapping authorities among the agencies that resulted in opposinginterest in interpreting the issues of civil lawsuit for environmentaldamages. The model that we offerred is on putting environmentalpriorities in one ministry, which is the Ministry of Environment andForestry, through the State Attorney.

Abstract

Kebijakan sistem ekonomi politik ini jika tidak berhati hati dalam penerapannya (anthroposentrisme) dapat bertentangan dengan konsep ekologi sosial yang tengah berkembang di Indonesia melalui konsep ekonomi hijau dan ekonomi biru. Konsep yang dianut dalam sistem ekonomi politik terkait dengan keadilan lingkungan pasca amandemen UUD 45 mulai bergeser dalam era globalisasisehingga mulai merespon modernisasi ekologi. Hal ini tentu saja diharapkan akan berpengaruh pada keadilan ganti kerugian pencemaran minyak oleh kecelakaan kapal tanker di Indonesia. Kebijakan sistem ekonomi politik ini jika tidak berhati hati dalam penerapannya (masih berciri anthroposentrisme) dapat bertentangan dengan konsep ekologi sosial yang tengah berkembang di Indonesia melalui konsep ekonomi hijau dan ekonomi biru. Ciri sistem sosialisme dalam sistem ekonomi politik terkait dengan keadilan lingkungan pasca amandemen UUD 45 mulai bergeser dalam era globalisasisehingga mulai merespon modernisasi ekologi. Namun karena terbentur konsep sosialisme yang bersentral pada peran dan dominasi negara, maka sistem keadilan ekologi dalam konteks sistem hukum Indonesia bernuansa Keadilan ekologi sosial. Hal ini tentu saja akan sangat berpengaruh pada keadilan ganti kerugian pencemaran minyak oleh kecelakaan kapal tanker di Indonesia.

Abstract

With the enactment of the ASEAN Single Market in 2015 opened opportunities for Indonesian MSMEs to market their products and compete with foreign products. UMKM which is the driving force of the national economy must be able to take this golden opportunity for Indonesia's national interests and not on the contrary we are the market for other member countries. Of course this becomes a challenge for national MSMEs to face the ASEAN Single Market next year, MSMEs must maintain and enhance competitiveness as a creative and innovative industry. In addition, MSMEs must also improve product standards, design and quality to comply with ASEAN regulations by looking at the ISO 26000 requirements for Green Products. The Indonesian government must work hard to help MSMEs who experience obstacles such as facilitating the provision of credit access at banks, providing entrepreneurial training, increasing access to finance for MSMEs, facilitating financing for beginner entrepreneurs. Expanding access to finance and reducing KUR interest costs, Food and Energy security loans, and mapping the potential export of MSME products to ASEAN and other countries and facilitating promotion of MSME products at home and abroad.

Abstract

Untuk mengetahui ketentuan dan akibat hukum Penggunaan Dana Desa di Luar Prioritas Dana Desa (Pembangunan Balai Desa di Desa Adipasir Kecamatan Rakit Kabupaten Banjarnegara). Untuk mencapai tujuan tersebut peneliti menggunakan metode pendekatan Yuridis Normatif, Spesifikasi Penelitan adalah penerapan hukum in abstractodalam perkara in concreto (Clinical Legal Research). Metode penyajian data disajikan dalam bentuk uraian yang disusun secara sistematis, logis, dan rasional. Kesimpulan: - Secara regulatif Penggunaan Dana Desa di Luar Prioritas untuk Pembangunan Balai Desa Adipasir Kecamatan Rakit Kabupaten Banjarnegara telah sesuai dengan ketentuan di dalam Surat Bupati Banjarnegara Nomor :142.41/148/Setda/2016-R Tanggal 25 April 2016 perihal Rekomendasi Penggunaan Dana Desa Di Luar Prioritas Penggunaan Dana Desa Tahun Anggaran 2016. - Akibat hukum dari Penggunaan Dana Desa di Luar Prioritas Dana Desa untuk Pembangunan Balai Desa Adipasir Kecamatan Rakit Kabupaten Banjarnegara, yaitu tidak terdapat akibat hukum, karena mendapat persetujuan Bupati Banjarnegara sesuai dengan Pasal 27 Ayat (1) Peraturan Menteri Keuangan Nomor : 247/PMK.07/2015 tentang Tata Cara Pengalokasian, Penyaluran, Penggunaan, Pemantauan dan Evaluasi Dana Desa.

Abstract

The Covid-19 pandemic has led to shifts and changes in consumer purchasing patterns. Usually, even though there are online sales, many consumers still buy products directly to shops or shopping centers. But now, because there are restrictions and government regulations not to leave the house, consumers automatically do not allow it to stay outside the house for long. MSME players must also adjust and condition the sales of their products and services. It is necessary to improve product quality and service adjustments to attract consumers. The Covid-19 pandemic that occurred in Indonesia had an impact on economic instability, especially on MSMEs. These UMKM players feel a direct impact in the form of a decrease in sales turnover. For this, MSMEs players must have a strategy to survive in the midst of this pandemic and are required to be able to adapt to the conditions that occur

Abstract

Peran korporasi saat ini mendominasi kehidupan sehari-hari, terlebih dengan meningkatnya kebutuhan masyarakat. Bukan lagi negara yang menyediakan kebutuhan, tetapi korporasi. Korporasi dapat meningkatkan kekayaan negara dan tenaga kerja, namun revolusi struktur ekonomi dan politik telah menyebabkan kekuatan korporasi yang besar, sehingga negara dapat dipengaruhi sesuai dengan kepentingannya. Berdasarkan latar belakang tersebut, muncul permasalahan yaitu bagaimana kebijakan formulasi penegakan hukum pidana selama ini terhadap korporasi yang melakukan tindak pidana serta bagaimana kebijakan formulasi hukum pidana dalam menghadapi tindak pidana korporasi di masa yang akan datang. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normatif dengan menggunakan data sekunder. Pengumpulan data dilakukan dengan mengumpulkan dan menganalisis bahan-bahan kepustakaan yang berkaitan. Selanjutnya, data dianalisis secara normatif kualitatif dengan menafsirkan dan mengkonstruksi pernyataan yang terdapat dalam dokumen dan perundang-undangan. Simpulan dari penelitian ini adalah pengaturan sanksi mengenai tindak pidana korporasi yang tidak konsisten. Ketidak konsistennya dalam hal penetapan atau penjatuhan maksimum denda yang dikenakan terhadap korporasi, tidak adanya keseragaman dalam menentukan kapan suatu korporasi dapat dikatakan melakukan tindak pidana, mengenai siapa yang dapat dipertanggungjawabkan atau dituntut dan dijatuhi pidana, serta formulasi jenis pidana yang dapat sikenakan kepada korporasi yang melakukan tindak pidana.

Abstract

Establishment of the National Agency for the Placement and Protection of Indonesian Workers (BNP2TKI) To optimize the protection of migrant workers abroad which is more integrated, the government forms a national body whose duty is to protect Indonesian migrant workers abroad. A Non- Departmental government agency that is responsible to the President who is domiciled in the national capital, namely the National Agency for Placement and Protection of Indonesian Workers (BNP2TKI), whose functions are coordinating and integrated placement and protection of migrant workers abroad, with several tasks as follows: 1. Placing on the basis of a written agreement between the government and the government of the country that uses TKI or legal entity users in the destination country; 2. Providing services, coordinating, and supervising: documents, final departure briefing (PAP), problem solving, sources of funding, departure until repatriation, improvement of the quality of prospective migrant workers, information, quality of implementing TKI placement, and improving TKI welfare and his family. In accordance with the principle of international law, legal protection for citizens ceases when the citizens of that country cross the borders of the state jurisdiction. Protection of Indonesian workers abroad or in recipient countries is carried out in accordance with international law and applicable laws in the country.

Abstract

To find out the legal provisions and consequences of the use of Village Funds Outside the Priority of Village Funds (Development of Village Halls in Adipasir Village, Rakit District, Banjarnegara Regency). To achieve this goal the researcher uses the Normative Juridical Approach method, Research Specification is the application of law in abstracto in cases in concreto (Clinical Legal Research). The method of presenting data is presented in the form of a description arranged systematically, logically, and rationally. Conclusions: - Regulatively the Use of Village Funds Outside Priority for the Development of Adipasir Village Hall, Rakit District, Banjarnegara Regency is in accordance with the provisions in the Banjarnegara Regent's Letter Number: 142.41/148/Setda/2016-R dated April 25, 2016 concerning Recommendations on the Use of Village Funds in Outside the Priority of the Use of Village Funds for Fiscal Year 2016. - The legal consequences of the use of Village Funds outside the Priority of Village Funds for the Development of the Adipasir Village Hall, Rakit District, Banjarnegara Regency, namely there are no legal consequences, due to the approval of the Banjarnegara Regent in accordance with Article 27 Paragraph (1) Regulation of the Minister of Finance Number : 247/PMK.07/2015 concerning Procedures for the Allocation, Distribution, Use, Monitoring and Evaluation of Village Funds.

Abstract

Public roadside parking has become main requirement and the demand grows quite rapidly in common activity. For the time being, the procedures for parking management and withdrawal of parking payments accompanied by “Ticket” have been regulated by Regional Government. The purpose of the study of study is to explore and provide information on related subjects regarding the procedures for parking payment withdrawals accompanied by “Ticket” in accordance with applicable regulations, namely Regent Regulation Number 88 of 2017 concerning Guidelines for Managing Parking Levies Management in Banjarnegara Regency, which are expected can be useful applied in parking procedures in Banjarnegara. Generally, the study is using the Normative Juridical method and descriptive analytical research specifications while the method or presenting data will be presented in the form of a breakdown based on qualifications then arranged systematically. In Conclusion: It can be concluded thah the Procedure for Parking Management and Withdrawal of Parking Payments Accompanied by the “Ticket” on the Side of Public Road is closely related to the Regional Government which is obliged to carry out guidance and supervision of Regents Regulations in the form of Public Roadside Parking. Furthermore, parking and ticket procedures related to parking taxes and parking levies on the side of public roads so that they are in accordance with Regent Regulation Number 88 of 2017.
