Abstract

Cases involving people with disabilities who become victims of sexual violence continue to increase from year to year and often do not receive adequate attention, both from a legal and social perspective. In fact, this group needs stronger legal protection because the limitations they have often become obstacles in fighting for justice. The police have a crucial role in providing legal protection based on an inclusive approach for children with disabilities who are victims of sexual violence. This study aims to ensure that the legal protection provided by the Police can be just and equal. The method used is normative legal research with a legislative and conceptual approach, as well as qualitative analysis of primary and secondary legal materials. The results of the study show that the inclusive approach carried out by the Police is interpreted as a method of service and handling that guarantees equality without discriminating between conditions, as well as fulfilling the special needs of children with disabilities without physical, communication, or attitude barriers. The inclusive approach is carried out through the provision of professional assistance, the use of easily understood language or sign language, and the creation of a safe and child-friendly environment

Abstract

The imposition of community service as a conditional punishment for children in conflict with the law is a form of restorative justice aimed at rehabilitation rather than retribution. This study focuses on judicial considerations in sentencing community service for child offenders, specifically in District Court Decision No. 59/Pid.Sus-Anak/2024/PN.Tjk, and whether such punishment aligns with the objectives of criminal sentencing. This research adopts a normative and empirical juridical approach, using legal literature and field interviews with judges, prosecutors, and community counselors as primary sources. Data were analyzed qualitatively. The findings reveal that the judge's decision to impose community service is legally grounded in Article 71(1)(c) of the Juvenile Criminal Justice System Law (UU SPPA), which permits alternative sanctions for child offenders. Philosophically, the sentence aims to reform and educate the child, while sociologically, the court considers both mitigating and aggravating factors, such as the child’s background, remorse, and potential for rehabilitation. The type of service assigned, such as assisting with administrative tasks at a local government office, reflects efforts to promote social responsibility. Furthermore, the imposed punishment fulfills the objectives outlined in Article 51 of the Indonesian Criminal Code, including deterrence, reintegration, conflict resolution, and community peace. Overall, the use of community service supports a more humanistic, child-centered approach to juvenile justice in Indonesia.

Abstract

Children are increasingly involved in narcotics crimes, not just as users but as intermediaries in drug transactions. This study examines the judicial reasoning behind the imposition of imprisonment and work training on a child offender in Decision No. 55/Pid.Sus-Anak/2024/PN.Tjk, and assesses whether such punishment aligns with the goals of juvenile sentencing. This normative legal research uses a statute and conceptual approach, supported by secondary data obtained from legal literature, which are analyzed qualitatively. The findings indicate that the court sentenced the child to two years of imprisonment at LPKA and two months of work training at LPKS. The decision was grounded on juridical considerations (violation of Article 114(1) of the Narcotics Law), philosophical justification (punishment as rehabilitation), and sociological factors (social impact and offender’s background). The punishment imposed reflects the purpose of juvenile justice, which prioritizes the child's reformation and reintegration rather than mere retribution. The ruling emphasizes the educational and preventive aspects of punishment, aiming to guide the child toward becoming a productive member of society.

Abstract

Child exploitation through forced begging in Bandar Lampung City constitutes a severe violation of fundamental rights, substantially undermining both physical and psychological development. Criminal networks systematically manipulate vulnerable minors for economic gain, representing a grave breach of child labor protection statutes. This research examines law enforcement mechanisms targeting exploitation perpetrators, identifies systemic barriers, and proposes enhanced legal protection frameworks. The investigation employs a sociological-juridical methodology, utilizing documentary analysis, ethnographic observations, and structured interviews with law enforcement personnel, social service practitioners, and child advocacy specialists. Analysis draws upon child protection theory and progressive jurisprudence principles. Findings reveal enforcement mechanisms remain fragmented, reactive, and institutionally unsupported. Primary impediments encompass inter-agency coordination deficits, inadequate street children documentation, and insufficient rehabilitation funding. The research advocates for policy restructuring and systematic strengthening of child protection mechanisms through interdisciplinary collaboration. The study's significance lies in advancing more integrated and effective legal safeguards for exploited children across municipal and national jurisdictions.

Abstract

Based on humanitarian considerations and human rights enforcement, the Indonesian government through the Ministry of Law and Human Rights of the Republic of Indonesia has issued a policy to protect children in prisons during the Covid-19 pandemic. This policy is not far from the pros and cons of various circles. On the one hand, the policy is welcomed to reduce the spread of Covid-19, on the other hand, the policy is considered to disturb public security. Therefore, the policies of the Ministry of Law and Human Rights, especially those related to child protection during the Covid-19 pandemic, are important to be further reviewed in this article. This research is normative legal research / doctrinal research. The approach used in this research is the statutory approach (statute approach), analytical approach (analytical approach), conceptual approach (conceptual approach), and the case approach (case approach). The increasingly massive spread of Covid-19 poses its challenges in protecting children as a vulnerable group. Responding to this condition, the central government issued several policies to protect children during a pandemic. These policies include Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 10 of 2020 concerning Terms of Providing Assimilation and Integration Rights for Prisoners and Children in the Context of Preventing and Combating the Spread of Covid-19, as well as Decree of the Ministry of Law and Human Rights Number M.HH-19. .PK / 01.04.04 concerning the Release and Release of Prisoners and Children through Assimilation and Integration in the Context of Preventing and Combating the Spread of Covid-19. Abstract:The influence of Western values and ideology has infiltrated Indonesia's national legal instruments through deregulations which appear to always be in favor of the investor interest groups. This can of course be seen from the various laws made to protect the interests of capital owners, one of which is Law Number 11 of 2020 concerning Job Creation (Job Creation Law). Based on the reasons for considering it, the Job Creation Law was formed to realize the goal of forming the Indonesian state government and to create a prosperous, just, and prosperous society based on Pancasila and the 1945 Constitution. Abstract

Legal certainty in environmental protection is one of the issues of investing in Indonesia. After the issuance of the Job Creation Law, an existential question that emerged was how the investment regime of the Job Creation Law supports legal certainty for environmental protection. In this situation, there is a possibility of ignoring the legal certainty of environmental protection when making investments. However, legal certainty is highly expected by investors to ensure that investments made do not contradict environmental sustainability. Therefore, this research aims to analyze the role of investment in environmental protection, as well as analyze the legal certainty of environmental protection in the investment regime of the Job Creation Law. This research is normative or doctrinal research, where the object of research is legislation in the investment sector, supported by the results of a literature study. Apart from that, this research uses a qualitative analysis method by describing the data obtained based on the problem. The results of this research show that investment activities will always be in contact with environmental sustainability. However, the issuance of the Job Creation Law simplifies and facilitates investment activities but provides legal certainty in environmental protection

Abstract

Kegiatan pengabdian ini bertujuan untuk mendorong ketaatan masyarakat mitra terhadap protokol kesehatan penanggulangan Covid-19. Berdasarkan tujuan tersebut, target khusus kegiatan ini berupa terbentuknya satuan tugas masyarakat sadar hukum protokol kesehatan penanggulangan Covid-19 di Desa Seputih Raman Kabupaten Lampung Tengah. Guna mencapai tujuan tersebut kegiatan pengabdian ini menggunakan metode sosialisasi program, diskusi terarah dan tanya jawab, edukasi, dan pembentukan satuan tugas masyarakat sadar hukum protokol kesehatan yang dapat membantu dan mendukung setiap kebijakan pemerintah dalam penanggulangan Covid-19. Sasaran kegiatan ini yaitu masyarakat Desa Seputih Raman Kabupaten Lampung Tengah. Kegiatan ini dilaksanakan di Balai Desa Seputih Raman. Hasil kegiatan menunjukkan bahwa masyarakat mitra menyadari pentingnya mentaati regulasi pencegahan dan penanggulangan Covid-19, masyarakat mitra memahami protokol kesehatan penanggulangan Covid-19, dan terbentuknya satuan tugas masyarakat sadar hukum protokol kesehatan penanggulangan Covid-19, sehingga masyarakat mitra mampu berperan aktif dalam membantu pemerintah daerah melakukan penanggulangan Covid-19.

Abstract

Berdasarkan hasil penelitian sebelumnya, anak-anak yang dicabut kebebasannya lebih rentan terinfeksi COVID-19 karena keterbatasan kondisi tempat tinggal mereka. Perampasan kebebasan mempersulit penerapan isolasi diri atau pembatasan fisik, khususnya di fasilitas-fasilitas penahanan yang terlampau padat dan tidak bersih, di mana akses air, sanitasi, dan kebersihan dasar dibatasi karena alasan keamanan atau infrastruktur. Anak-anak yang dicabut kebebasannya memiliki karakteristik demografis yang serupa, dengan kondisi kesehatan yang lebih buruk dari penduduk lain pada umumnya, cenderung memiliki atau mengalami masalah-masalah psikososial, kesehatan fisik, dan mental yang diperparah fakta bahwa mereka ditempatkan dalam tahanan tanpa layanan kesehatan yang bermutu bahkan sebelum keadaan menjadi darurat. Berdasarkan hasil pelaksanaan kegiatan disimpulkan bahwa kegiatan ini benar-benar aktual dan menyentuh pada kebutuhan khalayak sasaran. Sehubungan dengan itu, diharapkan agar anak binaan LPKA Kelas II Bandar Lampung tidak tertular Covid-19. Lebih jauh lagi, kegiatan ini dimaksudkan agar anak binaan LPKA tidak menjadi residivis karena melanggar protokol kesehatan setelah kembali ke masyarakat.
