Abstract

Keterlibatan masyarakat dalam pengelolaan wilayah pesisir merupakan suatu keniscayaan untuk mewujudkan pengelolaan wilayah pesisir yang berkelanjutan dan menyejahterakan. Konsekuensinya, keserasian antar kebijakan pengelolaan wilayah pesisir terkait keterlibatan masyarakat menjadi penting, guna mewujudkan kepastian hukum bagi masyarakat untuk berperan aktif dalam pengelolaan wilayah pesisir. Oleh karena itu, artikel ini akan menganalisis keserasian antara kebijakan pengelolaan wilayah pesisir Lampung dengan peraturan perundang-undangan yang lebih tinggi maupun yang setara, khususnya ketentuan mengenai pelibatan masyarakat dalam pengelolaan wilayah pesisir. Kajian ini berkesimpulan bahwa kebijakan pemerintah Provinsi Lampung terkait keterlibatan masyarakat dalam pengelolaan wilayah pesisir masih disharmoni dengan peraturan perundang-undangan yang lebih tinggi maupun yang setara. Disharmoni ini menimbulkan ketidakpastian hukum, kesenjangan dalam peruntukan dan pemanfaatan sumber daya pesisir, dan keterbatasan akses masyarakat untuk berpartisipasi dalam pengelolaan wilayah Pesisir Lampung. Sehingga kebijakan pengelolaan wilayah pesisir Provinsi Lampung perlu direvisi melalui harmonisasi secara vertikal maupun horizontal, guna mewujudkan pengelolaan wilayah pesisir berbasis masyarakat.Kata kunci: Lampung, Harmonisasi Kebijakan, Pengelolaan Pesisir

Abstract

This research is describing about the use of deixis on the teachers’ speech in learning of the State Elementary School 16 Banda Aceh. Specifically, the problems of this research are (1) how does the use of person deixis on the teachers’ speech in learning, (2) how does the use of spatial deixis on the teachers’ speech in learning, and (3) how does the use of temporal deixis on the teachers’ speech in learning. The data of the research was the teachers’ speech containing the deixis, such as a person deixis, a spatial deixis, and a temporal deixis during the learning process at the class. The data collection was carried out by using an observation technique. Data analysis was conducted by identifying data, classfying data, analyzing data, and taking decision. The research results was classified into three groups: the use of person deixis, the use of spatial deixis, and the use of temporal deixis. Firstly, person deixis found on the teachers’ speech consist of the first singular person, the first plural person, the second singular person, the second plural person, and the third singular person. The first singular person, includes the form of greetings Ibu, Ibu Ani, and Bu Ani, the first plural person is kita. Besides, kita was also used to refer to the second singular and plural person. The second singular person, includes the form of kamu and greeting Nak. Apart from using as the second singular person, kamu and greeting Nak was also used to refer to the second plural person. The second plural person was in the form of kalian. The third singular person, includes dia, attachment form -nya, and the greeting forms Ibu itu and Bu Cut. Form -nya, was not only used as the second plural person, but also as the second singular and plural person. Secondly, the spatial deixis found on the teachers’ speech, includes ini, sini, di sini, itu, di situ, ke situ, di sana, ke sana, kemari, and ke belakang. Third, temporal deixis found on the teachers’ speech, includes nanti, sebentar, sebentar lagi, sekarang, besok, besok-besok, dari tadi, tadi, hari ini, kemarin, lusa, tahun yang kemarin, kemarinnya dulu, and kemarin dulu. Kata kunci: deiksis, tuturan guru, dan pembelajaran

Abstract

Kegiatan ini bertujuan memperkenalkan dan mengedukasi masyarakat Kabupaten Lampung Selatan mengenai Tindak Pidana Korupsi dan Pembuatan Hospital By Laws, Adapun target khusus kegiatan ini yakni mewujudkan Dinas Kesehatan Kabupaten Lampung Selatan yang mampu melakukan pengawasan dan pencegahan Tindak Pidana Korupsi, serta dapat menyusun dan melaksanakan Peraturan Internal Rumah Sakit (Hospital by Laws). Metode yang dipakai dalam pencapaian tujuan tersebut yakni penyampaian materi melalui ceramah, diskusi terarah dan tanya jawab, serta pelayanan klinis. Kegiatan ini berlokasi di Dinas Kesehatan Kabupaten Lampung Selatan. Hasil yang diharapkan pasca kegiatan yaitu terbentuknya karakter dinas kesehatan Kabupaten Lampung Selatan yang mampu melakukan pencegahan tindak pidana korupsi, serta terbentuknya Peraturan Internal RumahSakit (Hospital Laws).

Abstract

A child in conflict with the law, who is then sentenced and placed in the Special Child Development Institution (LPKA), has the right to receive supervision, assistance, training, guidance and the right to education in accordance with the mandate and provisions of the relevant law. This research discusses the application of Guaranteed Educational Rights for Correctional Students (Andikpas) in Class II LPKA Bandar Lampung with the legal issue behind this research is that there are several LPKAs in Indonesia that have not paid attention to the right to education for Andikpas. Based on these legal issues, the problem in this research is related to the application of education rights guarantees in the sentencing of Andikpas at LPKA Class II Bandar Lampung and what are the inhibiting factors for implementing education rights guarantees in the sentencing of Andikpas in LPKA Class II Bandar Lampung. This research uses normative legal research methods which are supported by empirical research. Sources of primary data collection were carried out through field studies by conducting interviews with LPKA structural officials, LPKA employees, Andikpas representatives, and lecturers in the Criminal Law section of the Faculty of Law, University of Lampung. Secondary data collection is done by literature study. The data that has been obtained by the author is then analyzed qualitatively. The results of the research carried out show that the implementation of the Education Rights Guarantee at LPKA Class II Bandar Lampung for Andikpas has been implemented, but not yet fully implemented properly. The forms of education available include formal and non-formal education. For formal education, there are Package A (SD), SMP, and SMA equivalency education programs that work independently with the Dwi Mulya Foundation. Non-formal education can be said to be a skills and training activity in which Andikpas are fostered and trained in their skills through various activities prepared by LPKA on a regular basis. In carrying out the implementation of education, of course, they are faced with various kinds of obstacles, including legal factors, namely there are no specific technicalities in legislation that show how to apply education to Andikpas. Law Enforcement Factors, namely there are still deficiencies in quality and quantity in coaching officers. Factors of Facilities and Infrastructure, which are still classified as limited and not sufficient enough. Community factors, regarding the negative stigma against Andikpas who have returned to social life. And Cultural Factors, cultivate laziness from within Andikpas in carrying out educational obligations. In this way, LPKA strives fully, whatever becomes an obstacle in implementing the implementation of education and the Head of LPKA Class II Bandar Lampung hopes that the education and coaching that has been held can develop the potential of children so that when they return to social life they are still educated and can play an active and responsible role.

Abstract

Binary options are increasingly familiar to the public with online promotions on various social media by Indra Kenz. The link between binary options affiliation and money laundering crimes is that the money generated from promoting binary options is illegal because regulations stipulate that binary options are illegal investments. The research aims to identify predicate crimes related to binary options affiliates in action money laundering crimes. The research is normative juridical with a statute approach. The data used were primary, tertiary secondary. At the same time, data processing was obtained through data selection, classification, and systematization. The data processed was analyzed qualitatively, and conclusions were drawn using inductive methods. Based on the research and discussion results, binary options affiliation could be charged with the predicate crime of fraud as stipulated in Article 378 of the Criminal Code and Article 45A Paragraph (1) Juncto. Article 28 Paragraph (1) Law Number 19 of 2016 concerning ITE. Likewise, with gambling Article 303 Paragraph (1) of the Criminal Code. The results of playing binary options include criminal acts of money laundering due to gambling and fraud, so the origin of money or assets must be hidden first to look legal. The authors suggest that more detailed arrangements are needed to ensnare binary options affiliates. The arrangements can be learned from the modus operandi and approaches regarding affiliates and binary options.

Abstract

Illegal levies are the designation of all forms of levies that are unofficial, which have no legal basis, so the act of levies is referred to as illegal levies. One of the criminal acts of corruption that occurs in people's lives is illegal fees. An example of a criminal case of illegal fees is the case in Decision Number: 46/Pid.Sus-TPK/2018/PN.Tjk in that case the defendant  was acquitted. Judging from the judge's decision that acquitted the defendant, the authors conducted research on the identification of illegal fees as a criminal act of corruption and what was the basis for the considerations of the Panel of Judges in passing an acquittal in cases of criminal acts of corruption based on Decision Number: 46/Pid.Sus-TPK/2018/ PN. Tjk. The problem with this research is the identification of extortion as a criminal act of corruption. and what are the basic considerations of the Panel of Judges in passing an acquittal in a corruption case based on Decision Number: 46/ Pid.Sus -TPK/2018/PN. Tjk The research method used is normative juridical research method, sources of primary and secondary legal materials. From this study it can be concluded that illegal fees can be categorized as a criminal act of corruption, this action is regulated in Article 12 letter e of Law Number 31 of 1999 which has been amended and added to Law Number 20 of 2001 concerning Eradication of Corruption Crimes. That the basis for the judge's considerations in deciding that the corruption case was free of Decision Number: 46/Pid.Sus-TPK/2018/PN.Tjk Defendant did not meet the elements of "benefiting oneself or others" and the element of "receiving gifts or promises" as charged in the Alternative indictment by the Public Prosecutor, so that the defendant is not legally and convincingly proven guilty of committing a criminal act of corruption.

Abstract

Infaq is an activity that is recommended for every Muslim. Giving Infaq can cause legal problems if the elements of the corruption crime are fulfilled. iAs happened in iCase Number i29/Pid.Sus-TPK/2022/PN iTjk. The Defendant was charged with article i5 paragraph I (1) of iLaw iNumber i20 of 2001 concerning the eradication of corruption, in conjunction with article i55(1) i1st iCriminal iCode, for giving in faq money amounting to IDR 250,000,000.00 to enroll his two nephews to the iFaculty iof iMedicine. iUniversity iof Lampung.An empirical juridical approach supports this research's informative juridical approach. The data are primary and secondary. Data collection is based on literature reviews and field studies. The data analysis method employed is qualitative analysis.

Abstract

The inclusion of a specific minimum crime in the Law on the Eradication of Criminal Acts of Corruption is intended to prevent a very striking disparity of sentencing, both for the same case in the context of deelneming, as well as for different cases but the types of offenses involved. the ratio decidendi of the judge's decision that imposes a criminal under a special minimum in corruption cases. Judges who impose criminal penalties under the special minimum criminal threat on decisions on corruption cases, the authors of the analysis assume that the degree of guilt of the accused is not directly proportional to its dangerous act and will be very disproportionate between the act and the punishment that will be given to the defendant of a criminal act of corruption, so that in the name of "Justice" the judge carries out contra legem or legal breakthroughs against the provisions of the special minimum criminal threat in the Law on the Eradication of Criminal Acts of Corruption. The independence of judges and the conviction of judges in imposing criminal penalties under a special minimum penalty in cases of criminal acts of corruption are reflected in legal reasoning in the judge's decision.

Abstract

Illegal, Unregulated, and Unreported (IUU) Fishing cases often occur in Indonesia. This is due to the lack of supervision by the Indonesian government towards foreign vessels conducting fishing activities in Indonesia’s territorial waters, and exclusive economic zone (EEZ).  IUU fishing has caused huge losses to the country. One of the perpetrators engaged in this illegal act was the Thai Silver Sea 2 ship. The ship entered Indonesian territorial waters specifically in Sabang waters, by flying the Indonesian flag to trick the Indonesian government patrolling around the area. However, gradually the Indonesian government became aware of the existence of foreign vessels which had been suspected by Indonesia for a long time because it often turned off VMS so that its existence could not be detected by the Indonesian government. This study delves deeper into whether the actions conducted by Silver Sea 2 Vessels violate Indonesian regulations and UNCLOS 1982. Additionally, it examines the compatibility of the Indonesian government’s legal enforcement of IUU Fishing with UNCLOS 1982. The results indicate that the actions of SS2 ships violated Indonesian legislation and UNCLOS 1982. Furthermore, the handling of this case by the Sabang District Court was deemed appropriate.

Abstract

The virtual universe always has its role in getting a massive response from society. This research elaborates on thepresence of the @/kampus.cantik account on Instagram media and its relation to self-concept and its construction insociety based on the theory of Symbolic Interaction according to Charles Horton Cooley's view. The research method inthis paper uses a qualitative approach with literature study methods referring to various related literature. This studyuses data collection techniques in the form of analyzing and collecting various literature review materials throughbooks, journals, articles, news websites and other credible sources. The results of the study show that there is relevancebetween Cooley's symbolic interaction theory regarding the Looking Glass Self and self-concept resulting from theappearance of the @/kampus.cantik account accompanied by the circulation of beauty standards created by societyand other external factors. In connection with this social construction, it sharpens beauty standards in society andnormalizes the objectification of women.
