Abstract

The enactment of Law Number 11 of 2006 concerning the Government of Aceh has provided a legal basis for Aceh Province to revitalize traditional life in Aceh Province. As an inseparable part of the Aceh Province, Gampong Lamie, Darul Makmur District, Nagan Raya Regency is certainly part of the legal area of the Aceh Qanun No. 9/2008. The implementation of community service activities is carried out by the method of delivering materials directly by displaying materials in the form of Aceh Qanun No. 9 of 2008. Customs settlement of cases in Aceh is recognized by several regional regulations and policies. Article 13 paragraphs (2) and (3) of Aceh Qanun Number 9 of 2008 state that the settlement of 18 types of disputes/disputes between customs and traditions as referred to above is resolved in stages and law enforcement officers provide an opportunity for disputes/disputes to be resolved first. traditionally in the gampong (village) or other names. Abstract

Suspension of detention is regulated in Article 31 of Law no. 8 of 1981 concerningCriminal Procedure Law, which states that at the request of a suspect or defendant,an investigator or public prosecutor or judge, in accordance with their respectiveauthority, can hold a suspension of detention with or without a guarantee of moneyor a guarantee of person, based on the conditions. which is determined. Theserequirements are regulated in Article 21 paragraph (1) of the Criminal ProcedureCode or referred to as subjective requirements and Article 21 paragraph (4) KUHAPor so-called objective requirements. The subjective view carried out by the PoldaMetro Jaya investigators in suspending detention of a case (GA) is not in accordanceor continuous with Article 21 paragraph (1) of the Criminal Procedure Codeaccording to the author's subjective view. Abstract

An act against the material law in criminal law is that a person commits an act against the law living in society (unwritten law). So if a person's actions are not against an unwritten law, then he cannot be punished. The author wants to investigate whether the theft of loose palm oil in Lamie Village is an act against the law or not. The author's initial hypothesis is that in several plantations in Lamie Village, after harvest workers have finished harvesting palm oil where they work, there is a habit of harvesting workers choosing loose palm kernels that have fallen to the ground and then sold. The research method in this writing is through an empirical juridical approach. This research was conducted by enforcing or applying normative law into legal relationships in society. The results of the study said that all garden owners in Lamie Village with a land area of 3 ha and above allowed harvesters to take loose palm oil. So the harvester's actions are not against the unwritten law. Then, some garden owners whose land area is 3 ha and below must have prior permission from the garden owner. If the permit is given then it does not violate the unwritten law, but on the contrary if the permission is not given then the perpetrator may be subject to Article 362 of the Criminal Code concerning theft.

Abstract

This study focuses on sexual crimes in the form of obscene acts against children. According to R. Soesilo, obscene acts are all acts that violate decency or decency, or can also constitute a heinous act that is included in the environment of sexual lust. The problem lies in the criminal sanctions regulated between the two regulations. Criminal sanctions regulated in the PA Law and the PKS Law have differences in terms of the length of the sentence, the amount of the fine, and others. Then there will also be a test of the PA Law and the TPKS Law against the theory of the purpose of punishment. The research method used is a normative research method, namely research conducted with reference to the principles, legal concepts, legal norms contained in the legislation. The results of this research are that in terms of the comparison of the length of imprisonment or the number of fines, the PA Law is more effective than the TPKS Law. There are also articles regulated in the PA Law that are not regulated in the TPKS Law, such as Articles 76D and 76E. In the article, it is more specific how to commit obscene acts, namely by means of "threats of violence and violence." Both the PA Law and the TPKS Law adhere to a combined theory. In the PA Law and the TPKS Law, the main punishments regulated are imprisonment, fines and payment of restitution to victims. If it is related to the combined theory, then the PA Law and the TPKS Law have fulfilled the purpose of the combined theory. However, in the TPKS Law, in addition to stipulating the main punishment, it also regulates additional crimes, namely revocation of child custody or revocation of guardianship, announcement of the identity of the perpetrator and/or confiscation of profits and/or assets obtained from criminal acts of sexual violence. With the provision of additional penalties in the TPKS Law, it can be seen that the types of criminal sanctions in the TPKS Law provide more complete understanding of the combined theory. So that it can be concluded that the TPKS Law in terms of types of criminal sanctions is more comprehensive in its arrangement.

Abstract

Law Number 23 of 2002 concerning Child Protection emphasizes that in the event of separation due to divorce and other situations without eliminating the child's relationship with his parents, the child still has the right to meet and have permanent personal contact with both parents. However, the situation that occurs in society and the existence of a legal vacuum shows that often children cannot meet their parents who have been appointed as custodians because the divorce case decision has not yet become legally binding. This normative juridical research uses statutory approach and the conceptual approach. The concept of child protection regulated in the Child Protection Act and other laws and regulations also includes the protection of children in situations of parental household conflict and protection in situations where the legal process against parental household conflicts is still ongoing and has no permanent legal force. The researcher recommends a change to the Law on Religious Courts. In this case, it is necessary to add legal norms that stipulate those children must be handed over to parents who are holders of custody since the court decision is pronounced, or the issuance of a Supreme Court Rule as the legal basis for implementing execution.

Abstract

Dalam menegakkan hukum Hakim wajib mempertimbangkan segala keputusannya demi terwujudnya nilai dari suatu putusan hakim yang mengandung keadilan dan kepastian hukum, dan juga mengandung manfaat bagi para pihak yang bersangkutan sehingga pertimbangan hakim ini harus disikapi dengan teliti, baik, dan cermat. Putusan merupakan mahkota hakim. Mahkota hakim harus terhindar dari kecacatan atau kekeliruan. Putusan hakim yang cacat atau keliru akan mengakibatkan tidak sempurnanya suatu putusan. Jenis penelitian ini adalah penelitian hukum normatif karena penelitian ini meneliti putusan pengadilan Negeri Jakarta Utara pada Perkara Nomor 1246/Pid.Sus/2020/PN Jkt.Utr didukung penelitian kepustakaan dari literatur- literatur yang berkaitan dengan pembahasan penelitian ini. Permasalahan dalam penelitian ini yaitu hakim dalam mengadili putusan keliru dan tidak sesuai dengan dakwaan Penuntut Umum. Hasil pembahasan yaitu sesuai Pasal 182 Ayat 4 UU Nomor 8 Tahun 1981 tentang Hukum Acara Pidana (KUHAP), menyatakan bahwa musyawarah terakhir hakim untuk mengambil keputusan harus didasarkan atas surat dakwaan dan segala sesuatu yang terbukti dalam pemeriksaan di sidang. Berdasarkan aturan ini, pada prinsipnya, hakim tidak dapat menjatuhkan hukuman kepada terdakwa jika perbuatan tersebut tidak didakwakan oleh penuntut umum dalam surat dakwaan. Penuntut Umum mendakwakan Pasal 62 ayat (1) Undang-Undang No. 8 tahun 1999 tentang Perlindungan Konsumen, Namun dalam bagian mengadili hakim memutuskan terdakwa bersalah melakukan perbuatan “pencurian dengan pemberatan”. Jika dilihat peristiwa pidananya terdakwa membeli Handphone HDC yang tidak bersertifikat sesuai ketentuan Peraturan Menteri Kominfo No. 16 Tahun 2018, kemudian dijual kembali secara online melalui beberapa market place. Maka dapat dikatakan bahwa terdakwa bukan melakukan “pencurian dengan pemberatan” tetapi melakukan perdagangan. Maka dapat disimpulkan bahwa hakim pada Putusan Nomor: 1246/Pid.Sus/2020/PN Jkt.Utr, keliru dalam mengadili dan memutus perkara. Kata Kunci: Putusan Hakim, Penerapan Hukum, Perdagangan

Abstract

Preparatory criminal acts are actions committed by a person or group of people to plan or prepare a certain criminal act. Even though the actual criminal act has not been committed, these preparatory actions can also be considered a criminal act if they involve elements regulated in criminal law. The problem in this research is what is the difference between preparatory action, trial and initial action of execution as well as analyzing criminal acts of preparatory action in the new Criminal Code. The type of research used is normative legal research, namely legal research carried out by reviewing library materials or secondary data. The results of the research can be concluded that the difference between initial implementation actions and preparatory actions is that preparatory actions are carried out before the start of implementation to prepare the action and not violate the law. Meanwhile, the start of implementation was carried out after preparatory measures and was contrary to the law. So after the enactment of the latest Criminal Code, preparatory acts are no longer seen as acts that are not against the law. Preparatory acts in the latest Criminal Code are considered a separate criminal act. Meanwhile, the urgency of implementing preparations in the latest Criminal Code is the prevention of criminal acts, community protection, prevention, justice, investigation and disclosure.

Abstract

The spread of hoax information in Indonesia has recently increased, causing concern, especially with the ease of accessing information through various media, with social media being the primary platform for its dissemination. The active users of social media are mostly teenagers, particularly students, who are accustomed to commenting, sharing, and providing critiques on these platforms. Often, the information shared is not verified for its source, and as long as it goes viral, it is quickly spread to others. This habit can lead to the spread of unverified hoaxes, which can have negative impacts such as psychological attacks, bullying, and legal consequences for hoax spreaders under the ITE Law. Based on this issue, we conducted a community service activity using socialization and discussions about the dangers of hoax dissemination and how to anticipate them among students. The event held at SMA 2 Meulaboh went well and solemnly. The results of this activity showed that many students are still unaware of the dangers of spreading hoax information. Therefore, this initiative provided a deeper understanding, with the hope that students will become more cautious and able to filter the information circulating, especially from unknown sources.

Abstract

Salah satu pelanggaran yang berpotensi terjadi dalam tahapan pemilu di berbagai daerah adalah pelanggaran terhadap peraturan perundang-undangan lain yang bukan pelanggaran pemilu, bukan sengketa proses dan bukan tindak pidana pemilu. Pada pelaksanaan pemilu 2024, terdapat dugaan pelanggaran pemilu yang diduga dilakukan oleh oknum kepala desa di Kabupaten Aceh Barat. Berdasarkan hasil pemeriksaan yang dilakukan, Panwaslih Kabupaten Aceh Barat menyatakan terdapat dugaan pelanggaran peraturan perundang-undangan lainnya yaitu pelanggaran terhadap ketentuan Pasal 29 huruf e jo. Pasal 30 ayat (1) Undang-Undang Nomor 6 Tahun 2014 tentang Desa. Dengan demikian, Panwaslih Kabupaten Aceh Barat meneruskan dugaan pelanggaran peraturan perundang-undangan lainnya kepada pemerintah daerah Kabupaten Aceh Barat. Rekomendasi Panwaslih Kabupaten Aceh Barat memiliki kekuatan mengikat apabila diteruskan kepada penyelenggara pemilu lainnya seperti KIP Kabupaten. Namun sebaliknya, apakah suatu rekomendasi dari Panwaslih Kabupaten Aceh Barat kepada pemerintah daerah setempat juga memiliki kekuatan mengikat. Penelitian ini bertujuan untuk mengetahui bagaimana kekuatan hukum rekomendasi Panwaslih Kabupaten Aceh Barat kepada pemerintah daerah dan untuk mengetahui apakah suatu rekomendasi dari Panwaslih Kabupaten Aceh Barat wajib ditindaklanjuti oleh pemerintah daerah. Penelitian ini merupakan penelitian yuridis normatif, yaitu dengan cara melakukan penelitian kepustakaan sebagai bahan hukumnya. Pendekatan dari penelitian ini adalah pendekatan peraturan perundang-undangan. Hasil penelitian menunjukkan bahwa kekuatan mengikat atau kewajiban pemerintah daerah untuk menindaklanjuti rekomendasi tersebut memiliki batasan-batasan tertentu. Suatu rekomendasi tidak bersifat mengikat secara hukum namun rekomendasi tersebut menjadi penting untuk ditindaklanjuti oleh pemerintah daerah sebagai upaya menjaga pelaksanaan demokrasi agar berjalan sesuai dengan asas-asas pemilihan umum. Meskipun pemerintah daerah berkewajiban menindaklanjuti rekomendasi tersebut, namun tidak ada sanksi langsung jika rekomendasi tersebut tidak dijalankan. Rekomendasi Panwaslih kepada Pemerintah Kabupaten Aceh Barat bersifat administratif dan bukan suatu bentuk keputusan yang mengikat secara langsung sehingga kewajiban pemerintah pemerintah daerah untuk menindaklanjuti bergantung kepada regulasi yang ada

Abstract

The efficiency with which Government Regulation Number 24 of 2018 is being implemented in the area of electronically integrated business licensing. The study's goals are as follows: (1).Explain how Government Regulation Number 24 of 2018 in Electronically Integrated Business Licensing (2) is applied and analyze it. The aim of this study is to examine and elucidate the challenges encountered during the execution of Government Regulation Number 24 of 2018 concerning Electronically Integrated Business Licensing. Normative research is the analytical technique employed, which entails gathering data via a review of the literature. The study's findings indicate that the electronic one-stop integrated service policy has not been fully implemented effectively. This is because of a number of factors, the first of which is the occurrence of network disruptions during system operation. These disruptions can make it more difficult for the integrated licensing service information system to perform its functions, including data collection, printing, and monitoring. Thus, network interruption is a critical component in the deployment of an integrated licensing service information system, according to experts. The second issue is a lack of management training, which can lead to a lack of understanding among staff members and impede work processes. Third, there are still people who visit the office to take care of permits because there is a deficiency of socialization in the neighborhood.It is anticipated that the government's electronic one-stop integrated service program will be further enhanced in order to ensure smooth operation free from any roadblocks that could impede the system's implementation.
