Abstract

Adoption in Balinese customary law, known as "Nyentanang/Meras Pianak/Meras Sentana," serves to continue the family lineage, especially in the patrilineal family system. Adoption in Balinese society has certain principles that prioritize family relationships and the continuity of customary descent. This study aims to analyze the application of Balinese customary law in the adoption process through a study of Decision Number 214/PDT.P/2024/PN. The main focus of the study is to assess the application of Balinese customary law in court decision-making, examining the conformity between Balinese customary law norms and Indonesian laws and regulations regarding adoption. This study uses a normative legal method with a statutory, case, and conceptual approach. The results of the study show that although Indonesian positive law regulates adoption through government regulations and laws, the application of Balinese customary law in adoption provides flexibility in accordance with local cultural values, which prioritize the continuity of descendants and responsibility in the family. However, there is tension between the unwritten Balinese customary law and the written national law, especially regarding the age of the adopted child, which in Decision Number 214/PDT.P/2024/PN involved a 29-year-old child, contrary to the provisions of national law that regulate the adoption of children under the age of 18. The results of this study emphasize the importance of a balance between the application of Balinese customary law and compliance with positive law in maintaining justice and children's rights, so as to create balanced legal certainty in the adoption process.

Abstract

This study aims to examine the tradition of determining the auspicious day before a marriage contract using titen science from the perspective of ‘urf in Andongsari Village, Ambulu Sub-district, Jember Regency. Ilmu titen, as part of Javanese customs, is a method based on custom and observation of past events (niteni), which is used to determine the right time for important events such as marriage. This research uses empirical legal method with legal sociology approach and conceptual approach. Data were obtained through interview, observation, and documentation techniques, with primary and secondary sources. The results show that although this tradition is highly upheld by the local community, the practice of determining a good day does not contradict the provisions of Islamic law. The pillars and conditions of marriage are still fulfilled, so this tradition can be seen as part of an effort to preserve Javanese cultural customs that are harmonious with Islamic teachings. The implications of this research show that the implementation of titen science not only helps maintain local wisdom, but also strengthens social and cultural harmony in the Andongsari Village community, which is predominantly Muslim.

Abstract

Tradisi Rokat merupakan prosesi pembersihan diri atau ruwatan yang wajib dijalani oleh anak yang masuk dalam kategori Pandhaba sebelum akad nikah. Tradisi ini sering dianggap membutuhkan biaya yang besar dan dikaitkan dengan mitos-mitos yang mengarah pada kemusyrikan. Penelitian ini bertujuan untuk memahami praktik pelaksanaan tradisi Rokat Pandhaba penganten di Desa Dawuhan Mangli serta menganalisis konstruksi masyarakat terhadap tradisi tersebut. Data diperoleh melalui studi lapangan (field research) menggunakan pendekatan hukum empiris. Teknik pengumpulan data meliputi wawancara dengan tokoh masyarakat, observasi langsung saat ritual berlangsung, serta dokumentasi berupa foto dan rekaman terkait tradisi ini. Analisis data dilakukan menggunakan model Miles dan Huberman, yaitu reduksi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa Rokat Pandhaba wajib dijalankan bagi anak kategori Pandhaba melalui rangkaian ritual yang dipimpin oleh Kiai Rokat (Imam Rokat) pada malam hari, diawali dengan pembacaan Al-Qur’an 30 juz. Setelah itu, dilakukan ritual mandi dengan perlengkapan yang ditentukan oleh Kiai Rokat, dilanjutkan oleh sanak keluarga, dan diakhiri dengan doa serta pembagian sesajen. Tradisi Rokat Pandhaba penganten dikonstruksikan oleh masyarakat sebagai sarana penyucian jasmani dan rohani serta penolak bala, seperti kesialan dan ketidakdamaian dalam lingkungan keluarga, yang merepresentasikan eksternalisasi nilai tradisi leluhur

Abstract

This study aims to analyze the integration of customary criminal law into the national legal system based on the principles of justice and the values of Pancasila. The research adopts a normative legal method by analyzing statutory regulations, legal concepts, and relevant cases. It also explores the philosophical foundations and the ratio legis of recognizing customary criminal law within the context of legal modernization, as reflected in the new Criminal Code under Law Number 1 of 2023. The findings indicate that customary criminal law holds a significant position as a reflection of social justice in local communities. However, its integration into the national legal system faces challenges, particularly in harmonizing customary law principles with modern legal norms. This study concludes that the principles of justice enshrined in Pancasila can serve as an ethical framework to align customary criminal law with national law, fostering an inclusive and culturally responsive legal system in Indonesia.

Abstract

Kajian dalam artikel ini menganalisis dan membandingkan hak kebebasan berpendapat di Indonesia dan Malaysia dari perspektif hak asasi manusia (HAM), dengan mempertimbangkan perbedaan sistem hukum dan pemerintahan di kedua negara. Di Indonesia, yang menganut sistem hukum civil law dan pemerintahan presidensial demokratis, kebebasan berpendapat diatur oleh UU No. 9 Tahun 1998, UU No. 39 Tahun 1999, UU No. 19 Tahun 2016, dan Pasal 28E Ayat 3 UUD 1945. Sementara itu, Malaysia yang menggunakan sistem hukum common law dan pemerintahan monarki parlementer, mengatur kebebasan berpendapat melalui Pasal 10 Konstitusi Malaysia dan peraturan tambahan seperti Sedition Act 1948, Communications and Multimedia Act 1998, dan Printing Presses and Publications Act 1984. Penelitian ini mengevaluasi efektivitas implementasi undang-undang tersebut, termasuk tantangan seperti kriminal sasi, sensor, dan pelanggaran HAM. Selain itu, pengaruh latar belakang sosial-politik terhadap pelaksanaan kebebasan berpendapat juga dianalisis. Dengan pendekatan komparatif, perundang-undangan, dan historis melalui penelitian sebelumnya, penelitian ini bertujuan untuk mengidentifikasi persamaan dan perbedaan dalam perlindungan HAM di kedua negara. Hasilnya diharapkan dapat memberikan rekomendasi untuk memperkuat kerangka hukum dan praktik perlindungan HAM di Indonesia dan Malaysia. Metode penelitian ini menggunakan metode normatif dengan tiga pendekatan (komparatif, perundangan, dan historis) menggunakan bahan hukum berupa dokumen-dokumen otoritatif dengan teknik pengumpulan bahan hukum melalui studi pustaka dan analisis hukum. Hasil kajian ini menegaskan bahwa kebebasan berpendapat adalah hak asasi yang diakui internasional dan dijamin oleh hukum Indonesia dan Malaysia, meskipun dengan aturan berbeda sesuai konstitusi masing-masing negara.

Abstract

Dynastic politics is defined as leadership that only relies on the hands of groups that still have blood ties or kinship. In the Constitutional Court Decision Number 33/PUU-XIII/2015 concerning arrangements related to dynastic politics after a judicial review was carried out by parties who have legal standing and considered the law related to the prohibition of dynastic politics to be contrary to the 1945 Constitution. Because it was considered to formulate new norms and there was a violation of constitutional rights citizens to get equal opportunities in government. The interpretation of human rights following the issuance of the Constitutional Court decision No. 33/PUU-XIII/2015 concerning dynastic politics is that every citizen has the right to be elected and elected in regional head elections, so there is no longer any prohibition for incumbents to participate. in politics. Interpretation of Human Rights in the Constitutional Court Decision No. 33/PUU-XIII/2015 regarding dynastic politics if seen and understood more deeply from the point of view of fiqh principles based on the Constitutional Court's decision, regarding human rights, especially members of the incumbent' family to nominate regional heads, looking at so many data and surveys that show the negative impact of this dynastic politics, one of which often occurs is corruption, so based on fiqh principles it provides recognition that public interests must take precedence over special interests.

Abstract

Related to Omnibuslaw currently has been established to be part of the Law, but there are some issues that cause overlap and inconsistency with workers. As well as the existence of the work creation law gives more freedom to entrepreneurs than to workers or workers, one of them is like giving hours of work and giving wages that are only unilaterally discontinued without a joint agreement. This is the problem that is considered serious because so many workers complain about the problem. Therefore, with the existence of the application of omnibuslaw to the law of creation of work to correct the imbalance that has occurred to entrepreneurs and workers. As with the establishment of government regulations replacing the Law No. 2 of 2022 on job creation, these new regulations were enforced with the aim of further maximizing and improving the welfare of workers or entrepreneurs based on Pancasila. Even with the implementation of omnibuslaw to improve the existing employment system in Indonesia.

Abstract

Industrial relations disputes (PHI) are of great concern to the public. In principle, disputes can be resolved by the parties themselves or third parties. One of the industrial relations disputes is a strike. A Work Strike is a planned strike and industrial action carried out to stop or slow down work. This dispute will cause a decrease in company productivity, therefore it is necessary to resolve it so that company activities return to normal. Writing this paper uses the literature review method by browsing literature online consisting of theses, journals and books, relating to the resolution of industrial relations disputes. The result of this paper is that PHI is divided into two types, namely disputes of interest and disputes of rights. PHI resolution must be truly objective and fair. Settlement of PHI can be done in court or outside State court. Cassation is the cancellation of a lower court decision, a decision made on the basis of errors and omissions in the Supreme Court's decision. A work strike is an example of PHI. Striking workers must be warned, must not violate the law, and conditions must be met.

Abstract

The Implementation of Social Security has been regulated in Law Number 24 of 2011 concerning the Employment Social Security Organizing Agency. BPJS Employment is the institution responsible for administering worker social security programs in Indonesia. BPJS Employment aims to provide social protection to workers and their families and promote the welfare of workers in this country. Analysis of the implementation of worker social security at BPJS Employment in the context of Law no. 24 of 2011 involves research into the policies, procedures and mechanisms used by BPJS Employment to provide social security to workers. The purpose of this analysis is to evaluate the extent to which BPJS Employment has implemented the provisions contained in the Employment Law and to identify potential problems or challenges in its implementation. Analysis of the implementation of worker social security at BPJS Employment in the context of Law no. 24 of 2011 provides a deeper understanding of the effectiveness and challenges faced in the worker social security system in Indonesia. The research method used in this paper is normative legal research. With the help of social security, these workers can minimize the poverty of working class families who are experiencing an economic crisis, as well as termination of employment.

Abstract

Accreditation is a fundamental mechanism for evaluating the standard of higher education programs. The Constitutional Law Study Program within the Sharia Faculty at UIN Khas Jember has undertaken this process under the framework of BAN-PT, following the nine core criteria specified in BAN-PT Regulation No. 2 of 2019. This study investigates the challenges, hindrances, and potential solutions in implementing BAN-PT regulations to achieve superior accreditation status. Using an empirical legal research approach, the study collected data through interviews, direct observation, and document analysis. The accreditation process includes stages such as planning, submission, evaluation, and post-evaluation follow-up, involving various stakeholders lecturers, students, and administrative staff. Factors contributing to successful accreditation include qualified faculty, curriculum alignment, adequate infrastructure, and external partnerships. However, a significant challenge remains: limited international collaboration, which restricts access to research resources and funding. Achieving top-tier accreditation requires strategic planning, the formation of a competent accreditation drafting team, structured compliance with standards, and consistent application of the PPEPP quality cycle. Ultimately, excellent accreditation enhances institutional credibility and supports the advancement of legal education in Indonesia.
