Abstract

Conventionally speaking, the current Muslim law of inheritance is habitually considered as a sufficient and final form of legal formula that reflects the true spirit of Islamic Law ordained by God. The majority of Muslims currently are of belief that the ulama of the first generation have passed down to us the most complete and sophisticated set of law based on their acute interpretation of the Qur’an and the Sunnah. This belief however has now been subjected to a severe criticism by the contemporary critiques especially from the like of David S. Powers. His Studies in Qur’an and Hadith: The Formulation of the Islamic Law of Inheritance that employs the historical and literary criticism approach discovered that there are other sides of Muslim inheritance law. This work challenges the established belief among the traditional Muslims and offers a new legal paradigm whereby a legal ruling must bee seen as reflecting a social and historical dimension. This paper in every respect is a critical review of Powers’ book.

Abstract

The status of the Qur'an as the verbatim words of God has become undisputed belief among Muslims. However, beyond the agreement on this fundamental doctrine, they differed from interpreting the nature of "the Qur’an" whether it is eternal and co-existent with God or created by God like other beings in this world? Throughout Islamic history, there are at least two major trends in interpreting the nature of the Qur’an as God words, i.e. scholars who believe in the eternity of the Qur’an and those who believe in the createdness of the Qur’an. A number of Muslim thinkers since three decades ago have adopted the concept of the createdness of the Qur’an to support their methodological principles developed in interpreting the Qur’an. This paper will explore further the origin of the doctrine of eternity and the createdness of the Qur’an, the debate on this issue in classical and contemporary Islamic thoughts and its methodological implications on the interpretation of the Holy Scripture. Abstract

Ali Abdul Raziq rejected a logical axiom that building khilafah is a requirement for getting religious and common goods. For him, it is not merely khilafah, but every social system in the certain community needs a common good. Every country, whatever religion they mostly embraced, needs a certain system of organizing the common goods. The system could be based on every ideological underpinning, including khilafah. Furthermore, a claim that khilafah is the only religious system is unacceptable. Ali Abdul Raziq argues that religion has nothing to do with this system. There is no Islamic law which ruled khilafah, neither rejected it. All types of constitution and the ways they kept maintaining them are based on logical capability and living experience.

Abstract

The purpose of this article is to reveal the Javanese translation of the word Anâ Allâh in QS. Taha/20: 9-15. To discuss the issue the author uses a critical content analysis and comparative analysis approach. The findings in this qualitative research are: first, the translators agreed to use Ingsun to translate Anâ Allâh. Second, they use Ingsun for Anâ Allâh because they want to dwell and honor Allah above everything, the Almighty. It is related to their understanding, awareness, and implementation of Javanese culture, unggah-ungguh (honorific speech). Third, they chose Ingsun to translate Anâ Allâh: philosophically, Ingsun is the Essence and Existence of God. Culturally ethically, Ingsun is only used by high-class people. An ordinary man who pronouns Ingsun for himself, shows that he is involved in conflict or doesn’t understand unggah-ungguh. Sufistically, Ingsun is a perfect word that represents a person's spiritual experience of uniting with his God. This research significantly contributes to the body of knowledge on ethical linguistics in religious texts, especially from a Javanese perspective which is relatively understudied by scholars of Islamic studies.

Abstract

ABSTRACT Studies on nature and the environment from a religious perspective, especially interpretation studies, are important to be carried out to answer questions and see the extent of the role and solutions offered by religion in environmental preservation. Therefore, this research will reveal two main things: Yusuf Qardawi's interpretation of the verses prohibiting harming the environment and their implications for the future of nature conservation. This study used the interpretation approach of ma'na cum maghza. The research method used was qualitative library research, with analytical descriptive as the type of research. This study succeeded in revealing that: first, Yusuf Qardawi interpreted the verses prohibiting harming the environment (ifsad) by specifying the generality of the meaning of the word ifsad and its derivatives as maghza al-mutaharrik al-mu'ashir from these verses; thus, what is meant by ifsad includes damage to nature that is visible or invisible to the senses (ifsad al-ma'nawi and ifsad al-madi). Second, in the actualization of the maghza verses of ifsad, the implications of Yusuf Qardawi's ecological interpretation appear, namely in the form of a solution to the stages of nature conservation as follows: prevention stage, repair stage and maintenance stage.

Abstract

The increasing trend of hijra in Indonesia since the last decade has had an impact on workers in the Islamic banking sector. Even though these workers are already working in Islamic financial institutions, not a few of them have resigned because they want to leave usury. This study aims to explore the views of members of the XBank community regarding Shariah non-compliance practices at Shariah banks, the causal factors, and their implications for these financial institutions. This study was conducted on former Islamic bank employees who resigned due to religious reasons and joined the Xbank community. Data was obtained through observation, in-depth interviews, and documentation. The findings of this study indicate that the resignation of workers in the Islamic banking sector is influenced by the many practices that violate sharia principles in the process of executing Islamic bank products. This sharia non-compliance was triggered by the low commitment of Islamic bank human resources to sharia principles and pressure from management to pursue bank profit targets. This sharia non-compliance has the potential to cause a decline in Muslim confidence in this Islamic financial institution.

Abstract

The presentation of the story of Queen Bilqis in the Qur’an has sparked debate among Muslim scholars regarding women's public leadership. The majority of classical and modern scholars argue that the positive portrayal of Bilqis in the Qur’an cannot be used as evidence of women’s suitability for leadership roles, as this tradition is associated with non-believers. Only a few scholars use the positive image of Bilqis as an argument for women’s leadership capabilities, asserting that it is inconceivable for the Qur’an to depict something forbidden in a positive light. This study aims to reveal the Qur’anic ideology on women’s leadership, the pro and con responses of scholars to this ideology, and the factors that have led to the dominance of interpretations that prohibit women’s leadership. This research is a literature review with a feminist approach. Data were collected through bibliographic searches of Qur’anic exegesis from the classical to the modern era. The study shows that the Qur’an fully and unconditionally recognizes women’s public leadership. However, this gender-egalitarian Qur’anic ideology has not developed from the classical to the modern era due to power-knowledge relations that regulate, limit, and control the discourse surrounding women’s agency in the Islamic public sphere. The study recommends providing equal access to women in public leadership spaces
