Abstract

Tindak kekerasan dalam masyarakat sebenarnya bukan suatu hal yang baru. Berbagai pendapat, persepsi dan definisi mengenai kekerasan dalam rumah tangga berkembang dalam masyarakat, kekerasan dalam rumah tangga biasanya menimpa istri atau anak, sebab wanita dianggap sebagai kaum yang lemah, Upaya normatif dari negara untuk mencegah terjadinya kekerasan terhadap perempuan, dilanjutkan dengan dikeluarkannya Undang Undang No. 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga, yang secara tegas dan luas merumuskan kekerasan dalam rumah tangga sebagai suatu tindak pidana. Mengingat banyaknya kasus yang terjadi terhadap kekerasan dalam rumah tangga pada saat ini dan juga kejamnya tindakan yang dilakukan terhadap korban maka, kepentingan korban sangat perlu diperhatikan. Perlindungan hukum terhadap korban kekerasan dalam rumah tangga khususnya istri maupun anak, diperlukan juga suatu pemulihan korban, yang mengalami suatu penderitaan baik itu secara kekerasan fisik, psikis, seksual, maupun penelantaran rumah tangga. Maka disusunlah PP No.4 Tahun 2006 tentang Penyelenggaraan Dan Kerjasama Pemulihan Korban Kekerasan Dalam Rumah Tangga

Abstract

Permasalahan lingkungan telah menjadi salah satu isu penting dalam dunia, dimana suatu permasalahan lingkungan yang terjadi di suatu negara telah menjadi tanggungjawab dunia internasional. Permasalahan lingkungan yang terjadi meliputi pencemaran lingkungan, degradasi sumber daya dan pemanasan global. Pencemaran lingkungan adalah salah satu bentuk kerusakan lingkungan yang terjadi akibat kegiatan atau aktivitas manusia ataupun secara alami, selain pencemaran tanah dan udara, pencemarn air laut juga menjadi salah satu masalah yang banyak di hadapi oleh beberapa negara di dunia. Pencemaran laut dapat didefinisikan sebagai peristiwa masuknya partikel kimia, limbah industri, pertanian dan perumahan, kebisingan atau penyebaran organisme invasive (asing) ke dalam laut, yang berpotensi memberi efek berbahaya. Dalam sebuah kasus pencemaran, banyak bahan kimia yang berbahaya berbentuk partikel kecil yang kemudian diambil oleh plankton dan binatang dasar yang sebagian besar adalah pengurai ataupun filter feeder (menyaring air). Sebagai negara kepulauan dengan luas wilayah perairan yang sangat luas, Indonesia hanya memiliki undang-undang yang mengatur tentang kelautan yakni Undang-Undang Nomor 32 tahun 2014. Di dalam undang-undang tersebut digunakan untuk mengontrol dan mengawasi semua jenis kegiatan di perairan Indonesia. Dalam ketentuan umum Undang-Undang Kelautan disebutkan bahwa laut adalah ruang perairan di muka bumi yang menghubungkan daratan dengan daratan dan bentuk-bentuk ilmiah lainnya, yang merupakan kesatuan geografis dan ekologis beserta segenap unsur terkait dan yang batas dan sistemnya ditentukan oleh peraturan perundang-undangan dan hukum internasional.. Undang-undang Kelautan juga menjelaskan mengenai perlindungan lingkungan laut adalah upaya sistematis dan terpadu yang dilakukan untuk melestarikan sumber daya kelautan dan mencegah terjadinya pencemaran dan/atau kerusakan lingkungan di laut yang meliputi konservasi laut, pengendalian pencemaran laut, penanggulangan bencana kelautan, pencegahan dan penanggulangan pencemaran, serta kerusakan dan bencana. Pengelolaan dan perlindungan lingkungan hidup khususnya di bidang kelautan sangat dibutuhkan dan memang harus diterapkan segala peraturan yang tertuang di dalam peraturan perundang-undangan yang berkaitan dengan hal tersebut. Dikarenakan agar terjaganya kestabilan perekonomian khususnya yang berkediaman di pesisir laut dan tentu akan terjaganya ekosistem kelautan.

Abstract

Abuse of narcotics can result in a dependency syndrome if its use and distribution are not monitored. Narcotics abuse encourages illicit trafficking and causes an increase in abuse that is increasingly widespread and has an international dimension. Therefore, efforts to prevent and control narcotics abuse and efforts to eradicate illicit trafficking are needed. General Provisions in the explanation of Law Number 35 of 2009 concerning Narcotics, the definition of narcotics is a substance or medicine that is very useful and necessary for the treatment of certain diseases. However, if it is used not following treatment standards, it can have very detrimental consequences for individuals and society, especially the younger generation. Narcotics etymologically comes from the Greek Narkoum, which means to paralyze or make numb. Narcotics have properties and are useful for use in the medical field, useful for research, and pharmaceutical science. In this era of globalization, some crimes align children as perpetrators of criminal acts and in cases of abuse that are prohibited in criminal law, one of which is the crime of narcotics abuse. In this case, there is a lot of narcotics spread that has penetrated even remote levels of society, touching and highlighting children who still have a low level of thinking as the main targets or victims. Where, without us realizing it, the potential for children to be indirectly involved in the misuse of very dangerous items is due to factors involving adults. In this case, the main factor that triggers the child to face the law in a narcotics case comes from outside himself, including the very minimal attention of parents (family), and also accompanied by social environmental factors. These two factors simultaneously cause children to often fall into crimes which unknowingly lead the child to become involved in narcotics. Of course, this involvement often occurs when children do not yet have maturity in terms of thinking patterns, so there is a very high potential that a crime will occur. Apart from that, there is a culture of joining in and the participation of adults who try to persuade children to commit crimes that are very detrimental to their future

Abstract

Indonesia is a country where most of its territory consists of oceans with a population whose development continues to increase and can be expressed in meeting the needs of life, especially in coastal areas, such as fishermen who live in coastal areas generally using a source of life from the marine and fisheries sector. Indonesia as an archipelagic country surrounded by oceans has a strategic position and extraordinary potential with territorial waters, both archipelagic waters and inland waters. In addition, the Indonesian seas also include the sea waters of the Exclusive Economic Zone (EEZ). The economic loss caused by the practice of illegal fishing does not only result in loss of state revenues but also loss of opportunities for catching fish by Indonesian fishermen. If examined more deeply, it can be said that illegal fishing causes a lot of losses, not just counting how many fish have been stolen, but the impact is even wider, the financial burden is borne by the state, such as fuel subsidies (BBM) which are ultimately enjoyed by ships. -illegal vessels, reduced non-tax revenue (PNBP), reduced Indonesian fishermen's job opportunities, because illegal vessels are foreign ships that use their own crew (ABK), catches are generally brought directly abroad (country from ships), threats to the sustainability of fish resources because catches are not detected, both in type, size and quantity.

Abstract

The objective of this research is to improve students’ ability inappreciating poetry through inductive model. Method of researchthat is used is Research and Development which is modified. Dataanalysis technique that is used is descriptive analysis. The result ofresearch shows that learning through inductive model that concernthose eight instructional steps can improve students’ ability inappreciating poetry. The improvement can be seen numericallyfrom the average of evaluation result and observation in everytreatment. I n the fi rst i mplementati on, the average score ofevaluation result was 60.9, in the second implementation was 62.4and in the third implementation was 65.3, while the average score ofresult in the implementation I from ’less’ criteria gradually become’enough’ criteria, in the implementation II from ’enough’ criteriagradually become ’good’ criteria an in the implementation III from’good’ criteria gradually become ’very good’ criteria.

Abstract

Monitoring and securing forest areas are inherent components of forest resource protection and management, yet their implementation on the ground often fails to meet the expectations set by legal norms. This study aims to analyze the legal framework governing forest area monitoring and security systems in Indonesia, identify the factors that weaken such systems, and formulate ideal strengthening measures to improve the effectiveness of criminal law enforcement against forestry crimes and to prevent future ecological disasters, using the destruction of the mangrove ecosystem in Pasar Rawa Village, Langkat Regency, as a case study. This research employs normative and empirical juridical methods, through a literature study of statutory regulations combined with interviews and field observations at the Village Forest Management Institution (LPHD) of Pasar Rawa. The results show that legal provisions on forest protection, ranging from Law Number 41 of 1999 on Forestry, Law Number 18 of 2013 on the Prevention and Eradication of Forest Destruction, to Government Regulation Number 23 of 2021 on Forestry Administration, have positioned prevention as an inseparable part of forest protection. However, the operationalization of these norms on the ground has not been followed by a measurable and responsive monitoring mechanism, as reflected in the destruction of the mangrove ecosystem in Pasar Rawa Village. The weakness of the forest area monitoring and security system is caused by six main factors: regulations that remain general in nature, limited budget and facilities, weak human resource capacity, overlapping cross-sector authority, low community participation, and weak law enforcement that fails to produce a deterrent effect.
