Abstract

Modern retail is a business channel selling consumer goods directly and indirectly with the fastest growth for consumer goods companies in Indonesia. With the rapid growth of the modern retail business in the Sidoarjo area, it is enough to cover the existence of traditional retail in the vicinity. After the enactment of the Sidoarjo Regency Regulation Number 10 of 2019 concerning Supermarket Arrangement in Sidoarjo Regency, can the regulation provide protection and maintain the consistency of the existence of traditional retail amidst the proliferation of modern retail. The research uses normative research based on the legal approach. With the changes in the Regional Regulation of Sidoarjo Regency Number 10 of 2019 concerning Arrangement of Supermarkets in Sidoarjo Regency from the previous regulation, Regent's Regulation Number 36 of 2016 concerning Arrangement of existing Minimarkets and the changes made.

Abstract

The Industrial Land Use Agreement between PT SIER and the Tenants has been going on since the 1980s. According to PP No. 40 of 1996, the tenants have a Building Use Right over the Management Right for 30 years and can be extended for another 20 years. This study aims to determine whether the agreement is in accordance with the legal terms of the agreement because there are new provisions to extend its rights. This type of research is normative, the object of which lies in the principles applied in the contract and theoretical aspects of land law as well as normative studies related to the use of land on management rights. The results of the research from this agreement when viewed from Article 1320 of the Civil Code have actually been legally fulfilled as long as there is no element of coercion from the Tenant who pays the income. Abstract

Pengembangan BUMDesa merupakan salah satu cara yang digunakan pemerintah untuk mengembangkan dan meningkatkan perekonomian masyarakat desa serta meningkatan perolehan Pendapatan Asli Desa termasuk juga bagi desa lemujut. Desa lemujut mempunyai BUMDesa yang sudah beroperasi dengan beberapa unit usaha yang ada diantaranya Unit usaha sewa menyewa kios, PAMSIMAS, Bank desa dan Pengelolaan TPS, dimana kendala yang dihadapi adalah  adanya belum adanya legalitas hukum dari BUMDesa lemujut. Tujuan dari pengabdian ini adalah untuk membantu legalitas BUMDesa Lemujut. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan (statute approach) dan metode empiris dengan pendekatan wawancara. Adapun hasil penelitian ini adalah adanya penataan dan penyesuaian AD/ART, Perdes tentang BUMDesa dan tata lembaga BUMDesa sesuai dengan ketentuan peraturan perundang-undangan. Setelah dilakukannya penataan dan penyesuaian AD/ART, Perdes sesuai ketentuan hukum, selanjutnya dilakukan pendaftaran legalitas BUMDesa melalui system informasi desa kementerian desa dan terakhir adalah terbitnya legalitas badan hukum BUMDesa Lemujut yang dikeluarkan oleh kementerian Hukum dan HAM. Abstract Legal status of BUMDesa: Assisting BUMDesa Lemujud in Fulfilling Good Corporate Governance The development of the Village-Owned Enterprises (BUMDesa) is one of the government's strategies to enhance and boost the rural community's economy, including in Lemujut village. Lemujut village has an operational BUMDesa comprising various business units such as rental kiosks, PAMSIMAS, a village bank, and waste management. However, a significant challenge faced is the lack of legal status for the BUMDesa in Lemujut. The objective of this service is to assist in obtaining legal recognition for BUMDesa Lemujut. This research employs a juridical-normative method using a statutory approach and an empirical method involving interviews. The research findings involve the restructuring and adaptation of the Articles of Association and Village Regulations concerning BUMDesa, aligning them with legal provisions. Once the restructuring and alignment of regulations comply with legal requirements, the next steps involve registering the BUMDesa's legality through the Ministry of Village's information system. Finally, the issuance of legal recognition as a corporate entity for BUMDesa Lemujut is expected from the Ministry of Law and Human Rights.

Abstract

Abstract: Digital technology enhances communication and transactions, but unauthorized document modifications necessitate secure electronic signatures due to the risk of unauthorized modifications. This research aims to identify electronic signatures compliant with the ITE Law in Indonesia to ensure their legal validity and enforceability. By utilizing a normative research method with a statute approach, this study examines primary sources, including Law No. 11 of 2008 on Electronic Information and Transactions, Ministerial Regulation No. 11 of 2008 on Electronic Certification, and Law No. 71 of 2019 on Electronic Systems and Transactions. The results indicate that electronic signatures must fulfill specific criteria outlined in Article 11 of the ITE Law to be considered legally binding. These criteria require that the data used for the electronic signature is solely associated with the signer and under their control at all times, along with mechanisms to track modifications and identify signers' approval. The novelty of this research lies in its comparative analysis of certified versus non-certified electronic signatures, contributing to a deeper understanding of their legal implications. The implications of this study highlight the necessity for enhanced authentication measures to safeguard the integrity of electronic transactions, ultimately promoting confidence in digital communications and transactions in Indonesia. Abstract

Background: Economic growth drives an increasing demand for credit, with land as the most strategic collateral due to its stable value and legal clarity. Specific Background: The split of mortgaged land (splitzing) raises legal concerns regarding the creditor’s rights and the continuation of mortgage obligations. Gap: Limited discussion exists on how mortgage splitting affects creditors’ protection under Indonesian mortgage law. Aim: This study analyzes the implementation of creditor protection in land mortgage splitting based on Law No. 4 of 1996 on Mortgage Rights. Results: The study finds that mortgage splitting must be explicitly agreed upon in the Deed of Mortgage Granting (APHT) and approved in writing by the creditor. Roya (deletion) of mortgage registration occurs only after full repayment. Novelty: This paper highlights the creditor’s legal certainty amidst property division practices. Implications: The findings contribute to strengthening legal frameworks ensuring creditor protection in Indonesia’s mortgage system. Abstract

General Background: Inheritance law in Indonesia reflects legal pluralism involving Islamic, Civil (BW), and customary systems.Specific Background: Ngadas Village, known for its strong customary traditions and mixed-religion population, applies local inheritance principles that differ from the Civil Code (BW).Knowledge Gap: Few studies have examined how these customary practices effectively prevent inheritance disputes.Aims: This research aims to analyze inheritance distribution in Ngadas Village through the perspective of customary and BW inheritance law.Results: The study found that inheritance distribution in Ngadas follows a bilateral kinship system, where assets are allocated equally during the testator’s lifetime to minimize disputes.Novelty: The integration of empirical and normative legal methods reveals the coexistence of traditional and state law principles.Implications: The findings emphasize the importance of community-based dispute resolution through consensus to maintain social harmony. Abstract

Background: Child labor in Indonesia remains a complex social issue, especially within Micro, Small, and Medium Enterprises (MSMEs), where informal employment often overlooks children’s rights. Specific Background: Many hawker children in Sidoarjo Regency work without contracts, fair wages, or safety standards, violating labor law provisions. Knowledge Gap: Previous studies have discussed child labor broadly but have not specifically examined the enforcement of hawker children’s rights within MSME contexts through a legal lens. Aim: This study aims to analyze the legal protection and enforcement of hawker children’s rights under Indonesian labor law. Results: Findings show that child workers in MSMEs experience excessive working hours, sub-minimum wages, and lack of contracts or occupational safety measures, primarily due to low legal awareness among MSME owners and weak supervision. Novelty: The study uses a conceptual and statutory approach by linking MSME regulations with labor law principles. Implications: The research suggests the need for inclusive labor policies, consistent law enforcement, legal education for entrepreneurs, and empowerment programs ensuring children’s rights to education and welfare. Abstract

Background: Open trip mountain services organized by communities are increasingly popular but prone to breaches of contract, causing losses to climbers. Specific Background: Cases such as forced descent at Pos 2 Sembalun Lawang, Gunung Rinjani, highlight the lack of clarity regarding compensation rights in community-managed trips. Knowledge Gap: Existing literature rarely addresses the intersection of civil law principles and economic transaction theories in regulating compensation for open trip services. Aim: This study analyzes legal obligations and compensation mechanisms for climbers affected by breaches of contract using civil law perspectives and supply-and-demand theory. Methods: Normative legal research with statutory and economic theory approaches, supplemented by secondary sources, analyzed descriptively. Results: Participants are entitled to compensation when services fail to meet agreed standards. Theories of offer, acceptance, and trust clarify when agreements are legally binding and how liability arises. Dispute resolution can occur through mediation, arbitration, or court litigation, with distinct procedural considerations. Novelty: Integrating legal theory with economic principles provides a clearer framework for determining compensation and managing expectations in open trip services. Implications: Understanding these frameworks enhances legal certainty and protects climbers’ rights in community-organized outdoor tourism. Abstract

Background: Divorce in Indonesia often leaves disputes over property division, particularly regarding the distinction between joint property and inherited or premarital assets. Specific Background: A recurring issue is whether personal assets renovated during marriage can be considered joint property, given unclear regulations and limited case law guidance. Knowledge Gap: Current laws, including Law No. 1 of 1974 and the Compilation of Islamic Law, do not explicitly address the status of renovated inherited property, leaving courts to rely on principles of contribution and fairness. Aim: This study examines how renovated personal assets are treated in divorce cases at the Sidoarjo Religious Court and provides recommendations for legal clarity. Method: Using a normative juridical approach with statutory and case study analysis, data was collected from legislation, court decisions, and legal literature. Results: Renovations to personal property can be classified as joint property if supported by significant financial or non-financial contributions from both spouses; otherwise, they remain personal property. Evidence and proof of contribution are critical in court decisions. Novelty & Implications: The study highlights the need for clearer regulations and public awareness to prevent disputes, ensure fair asset distribution, and protect the rights of both spouses and children in divorce proceedings. Highlights: Renovated inherited assets may become joint property with documented spousal contribution. Evidence of financial and non-financial contributions is crucial in court recognition. Abstract

Peningkatan jumlah kasus perceraian di Sidoarjo, baik di Pengadilan Agama maupun Pengadilan Negeri, menimbulkan keprihatinan tersendiri. Tidak kurang dari 4000 kasus yang muncul setiap tahun, khususnya di Pengadilan Agama Sidoajo. Jumlah ini memicu keingintahuan peneliti untuk melakukan penelitian, yang mengkaitkan sebaran jumlah kasus perceraian tersebut dengan konsep bekwaamheid (khususnya kedewasaan umur). Dimana dalam logika sederhana, semakin dewasa umur seseorang, semakin matang tingkat pengelolaan emosi, seharusnya tidak mudah menghancurkan perkawinannya sendiri. Apalagi dengan alasan selingkuh atau ekonomi. Dengan metode penelitian hukum sosiologis, ditemukan jawaban bahwa ternyata bekwaamheid dalam hal ini tidak banyak berpengaruh. Dari tahun ke tahun (2016-2019), jumlah kasus perceraian di Sidoarjo tidak mengalami penurunan.
