Abstract

This study discusses foreign investment disputes involving Indonesia in international arbitration forums, particularly under the jurisdiction of ICSID (International Centre for Settlement of Investment Disputes). The main focus of this study is on the interpretation of the provisions of Article 2 paragraph (1) in the Indonesia-UK Bilateral Investment Treaty (BIT), which regulates the conditions for the entry of foreign investment in Indonesia. In the Rafat Ali Rizvi case, the arbitration panel decided that the process of entering investment that does not comply with the provisions of the Foreign Investment Law (UU PMA) cannot be included in the scope of the BIT. This study provides important recommendations for Indonesia in re-evaluating the provisions in each BIT involving Indonesia, as well as conducting further studies on ICSID arbitration decisions to understand the interpretation of BIT articles related to jurisdiction and the subject matter. Thus, this study aims to strengthen Indonesia's position in facing investment disputes at the international level

Abstract

Ruang adalah ruang imajiner yang diciptakan oleh ilmu pengetahuan. Dengan demikian, ruang angkasa menjadi objek penelitian dari ilmu pengetahuan itu sendiri. Yang dimaksud dengan ilmu di sini adalah berbagai disiplin ilmu. Dengan kata lain, ruang menjadi bagian objek kajian berbagai disiplin ilmu dengan tujuan berbeda-beda. Secara umum ruang diposisikan sebagai ruangan tanpa tuntutan yurisdiksi di dalamnya. Bahkan dalam UUD 1945 juga tidak ada klaim terhadap ruang. Faktanya, posisi klaim yurisdiksi di antariksa telah memberikan ruang bagi klaim ilmu pengetahuan dan teknologi tinggi untuk menguasai ruang angkasa. Klaim antariksa tidak hanya melibatkan antar negara di dunia namun melibatkan korporasi besar (khususnya di bidang teknologi) yang ada di dunia. Berbagai kepentingan di bidang antariksa berpotensi menimbulkan konflik internasional. Untuk mencegah potensi konflik, diperlukan pengaturan ruang melalui konsep hukum ruang angkasa yang dapat diterima oleh berbagai pihak yang berkepentingan. Berdasarkan hal tersebut maka penelitian ini layak untuk dilakukan.

Abstract

Fan fiction is amateur writing that imaginatively recreates a work in pop culture while maintaining identifiable aspects of the pre-existing work. The phenomenon and popularity of fan fiction today has led to the emergence of issues related to the legality of such works in the context of Copyright Law. Is fan fiction recognized and legitimate under copyright law? Do the creators of fan fiction works have copyrights and get the same rights to obtain economic benefits from the works they create? This research uses a qualitative normative juridical research approach. The normative juridical research approach in legal research is an approach that focuses on analyzing the applicable legal regulations. Support for the existence of fan fiction is based on the existence of the fair use doctrine in the United States Copyright Law. In the context of Indonesian law, these works of fan fiction fall into the category of adapted works in accordance with Law Number 28 of 2014 concerning Copyright. Fan fiction works that are widely circulated on the internet have no commercial opportunities because they are freely accessible and have no opportunity for profit. Fan fiction authors often include a 'disclaimer' at the top of their work to say that they receive no monetary profit or benefit from its production. One suggested solution is to use an alternative license agreement. In this case, the current doctrine of fair use may not be sufficient to cover the beneficial and non-commercial use in the form of fan fiction. Therefore, the expansion of fair use to cover such uses may be proposed as a possible solution.

Abstract

ABSTRAK Transformasi ruang siber sebagai ruang sosial dan hukum baru telah meningkatkan ketergantungan masyarakat terhadap teknologi digital sekaligus memperluas risiko kejahatan siber yang menempatkan individu pada posisi rentan. Cybercrime berkembang sebagai fenomena struktural yang diproduksi oleh karakter ruang siber yang terbuka, lintas batas, dan asimetris. Penelitian ini mengkaji bagaimana cybercrime dalam struktur ruang siber meningkatkan kerentanan individu, bagaimana orientasi pengaturan cyber law Indonesia dalam memberikan perlindungan, serta faktor-faktor yang menyebabkan ketidakefektifan perlindungan tersebut. Penelitian ini bertujuan menganalisis kerentanan individu sebagai konsekuensi struktural ruang siber dan mengevaluasi orientasi normatif cyber law dalam sistem hukum Indonesia. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan konseptual, menggunakan bahan hukum primer, sekunder, dan tersier, serta dianalisis secara deskriptif-analitis. Hasil penelitian menunjukkan bahwa cyber law Indonesia masih didominasi pendekatan kriminalisasi dan keamanan negara (state-centric), sehingga perlindungan individu dan pemulihan korban belum menjadi pusat pengaturan. Penelitian ini merekomendasikan reorientasi cyber law menuju pendekatan perlindungan subjek hukum yang lebih protektif, adaptif, dan responsif terhadap dinamika ruang siber.

Abstract

Digital transformation has increased the use of personal data as a strategic asset in various sectors, but it has also given rise to the risk of data leaks that cause material and immaterial losses to society. This study aims to analyse cyber legal liability for personal data leaks in Indonesia using a substantive justice perspective. The method used is descriptive qualitative through a literature study of regulations, legal doctrines, and data protection practices to obtain a comprehensive understanding of legal responsibility in the digital ecosystem. The results of the study show that cyber legal responsibility still faces challenges of cross-border jurisdiction, weak implementation of the responsibility of digital corporations as legal subjects, and suboptimal restoration of victims' rights. A damage-based jurisdiction approach is needed to reach global digital actors, while strengthening corporate accountability is key to preventing avoidance of responsibility. From a substantive justice perspective, the legal system needs to be oriented towards the effective restoration of victims' rights through compensation, ongoing protection, and system improvements. This study emphasises that strengthening an adaptive, accountable, and victim-oriented cyber legal framework is an important prerequisite for realising fair personal data protection and increasing public trust.

Abstract

The rapid development of information technology has led to various innovations in the digital financial sector, one of which is crowdfunding. In principle, crowdfunding is a legitimate fundraising mechanism that provides social and economic benefits. However, in practice, crowdfunding is often misused as a means to commit cybercrime. Such misuse includes fictitious fundraising, misleading information, and the misappropriation of funds collected from the public. This study aims to analyze crowdfunding as a form of cybercrime from the perspective of Indonesian criminal law. The research employs a normative legal method using statutory and conceptual approaches. The findings indicate that unlawful crowdfunding practices may fulfill the elements of criminal offenses, both as conventional fraud and as electronic-based crimes, thereby giving rise to criminal liability for perpetrators, including corporate entities. Therefore, stronger supervision, effective law enforcement, and enhanced digital legal literacy are essential to ensure legal protection for the public.
