Abstract

Peningkatan angka perceraian di Indonesia, beberapa tahun terakhir mengalami peningkatan. Berbagai Upaya yang telah dilakukan oleh pemerintah seperti, kursus calon pengantin yang dilakukan oleh KUA, undang-undang pencegahan perkawinan anak, memasifkan mediasi yang ada di pengadilan agama. Namun angka perceraian masih tinggi. Banyak faktor yang menyebabkan terjadinya perceraian yang ditangani di pengadilan agama, di antaranya, pertengkaran yang terus menerus, kekerasan dalam rumah tangga, meninggalkan salah satu pihak, masalah ekonomi, dan penyebab lainnya. Tulisan ini fokus ke faktor ekonomi merupakan salah satu penyebab utama dalam peningkatan perceraian di Kota Makassar. Kajian yuridis menunjukkan bahwa meskipun hukum memberikan mekanisme untuk mengajukan perceraian, penyelesaian melalui pengadilan sering kali diwarnai oleh masalah-masalah sosial yang lebih kompleks, terutama yang berkaitan dengan kesejahteraan ekonomi pasangan. Penanganan masalah ini membutuhkan sinergi antara kebijakan hukum, peningkatan kesejahteraan, dan intervensi sosial.

Abstract

The use of lafadz with absolute and or limited capacity (muqayyad) is one of the beauties of Arabic rhetoric. And in that indisputable Book, he was acquainted with the absoluteness of the Quran wa muqayyaduh or the absoluteness of the Qur’an and its limitations. In this article will discuss the meaning of absolute and muqayyad, examples of absolute and muqayyad lafadz, the law of absolute and muqayyad lafadz, and the division of absolute and muqayyad lafadz. The purpose of this discussion is for the reader to understand the concepts of absolute and muqayyad more deeply. By understanding the meaning of a particular verse, a believer will more easily obtain a legal ruling. Law has been established , then it will be easier for anyone to apply it. Absolute and muqayyad are fundamental concepts in jurisprudence that serve as guidelines in understanding and extracting law from the nash-nash of Shariah. Absolute is a pronoun that expresses a general meaning without any particular restriction, whereas a muqayyad is a pronoun that is limited by a specific attribute, condition, or condition. Both play an important role in a careful and responsible legal istinbath process.

Abstract

This study highlights the spiritual transformation experienced by the Tabbaqé community, located in Benteng Tellue Village, Amali District, Bone Regency, known as the "Texas Village." This study aims to understand the transformation that occurs in the community's daily behavior that is influenced by the religious dimension. The type of research used is field research using historical, phenomenological, and ethnographic approaches. This study reveals the background of the formation of negative stigma against the Tabbae community and their self- and collective identity. This study also highlights how the spirituality of the Tabbaqé community both in the past and in the present and the important role of religious leaders in transforming religious life patterns. This study shows that religious literacy plays a significant role in changing the negative stigma attached to the Tabbaqé community using stigma theory. It was found that changes in the community's social identity occurred through a process of negotiation of meaning between individuals and external groups. The previously entrenched stigma began to erode with increased understanding of religion and better spiritual practices. Meanwhile, from the perspective of tazkiyah an-nafs, the spiritual transformation that occurs helps people purify their souls to build collective awareness in living a life that is more based on religious values.

Abstract

Ada dua jenis kepimpinan, yaitu bersifat negarawan dan kepimpinan politik semata-mata. Negarawan memikirkan nasib generasi akan datang, sementara pemimpin politik semata-mata memikirkan kemenangan pilihan rakyat akan datang. Kepimpinan politik seperti ini sangat bahaya bukan saja kepada rakyat, tetapi juga kepada negara. Justeru dia akan berbuat apa saja untuk memenangkan pilihan rakyat dan mengekalkan kekuasaan.

Abstract

This study is motivated by the limited research on the effectiveness of sharia economic law and positive law in responding to the rapid pace of digital transformation, particularly in providing legal protection and certainty for digital entrepreneurs in Indonesia. The aim of this research is to examine the extent to which these two legal systems are capable of effectively and sustainably regulating and responding to technological developments. The study employs a qualitative approach using socio-juridical and historical-normative designs. Data were collected through literature review of formal regulations, sharia fatwas, and expert interviews. The findings reveal that sharia economic law demonstrates a high degree of flexibility through approaches such as ijtihād, maṣlaḥah, and contemporary fatwas, including DSN-MUI Fatwa No. 117/2018 on information technology-based financing services. However, these fatwas do not yet carry binding legal force within the national legal system. Conversely, positive law offers stronger legal certainty through formal regulations such as the Electronic Information and Transactions Law (ITE Law), Financial Services Authority Regulation (POJK) No. 77/2016 on IT-Based Lending Services, and the Personal Data Protection Law (UU PDP), although it often lags in addressing emerging technologies such as blockchain and smart contracts. The study concludes that sharia economic law excels in ethical values and social benefit orientation, while positive law is stronger in terms of legal structure and formal sanctions. The implications of these findings highlight the importance of integrating both legal systems into a hybrid legal framework that ensures justice, legal certainty, and public benefit in supporting an inclusive and sustainable digital economic ecosystem in Indonesia.

Abstract

Sharia Fintech represents a digital financial innovation that integrates technology with Islamic principles such as the prohibition of riba (usury), gharar (uncertainty), and maysir (gambling). This study analyzes the legal framework and Sharia compliance of fintech in Indonesia through a juridical-normative approach to OJK (Financial Services Authority) regulations and DSN-MUI (National Sharia Council–Indonesian Ulema Council) fatwas. The findings indicate that the application of Maqashid al-Shariah, particularly Hifz al-Mal (protection of wealth) and Hifz al-Din (protection of religion), serves as a crucial foundation for the development of fair and sustainable Sharia fintech. Although regulations such as OJK Regulations No. 3 and No. 26 of 2024, along with DSN-MUI Fatwa No. 117, have provided essential guidelines, there remains a gap between the ideality of fatwas and digital practices—especially in the implementation of the Murabahah contract. Therefore, institutional synergy and the strengthening of technology-based Sharia compliance governance are required to ensure a balance between innovation and Islamic principles.
