Abstract

This paper is part of non-doctrinal legal research using socio-legal research approach. The role of intermediary traders in the fishing business is very important. One side as an intermediary and on the other hand provides capital to fishermen and / or fish processors. The relationship creates an imbalance seen from the perspective of contract law because the position of intermediary traders as the owner of capital is stronger, so the balance principle among the parties can not met. In practice from the perspective of local law it is not an imbalance because the contribution of intermediary traders is not only in business relations but also in social relationships. Nevertheless, to develop the principle of legal balance in an effort to improve the welfare of fishery business actors, intervention to regulate is needed

Abstract

Radicalism poses a serious threat to state integrity and democracy. In Indonesia, it has increasingly affected the younger generation, including students. A human rights approach is crucial in fostering public understanding of tolerance and Pancasila as the foundation of state ideology. To counter radicalization effectively, collaboration between the government, educational institutions, and society is essential. One key institution in this effort is the Ministry of Human Rights, which plays a role in promoting legal awareness and human rights education. This study aims to examine its role in countering radicalism among students. Using a normative legal research method through literature and legal document analysis, this study explores how government policies address radicalization in educational environments. Findings indicate that preventing violence, intolerance, and terrorism requires a comprehensive strategy that integrates legal, educational, and social approaches. While a human rights perspective is vital, it must be supported by concrete actions, including legal education programs, student engagement initiatives, and policy reforms. The government must ensure that human rights protection is not merely conceptual but has real impacts on students and society. The Ministry of Human Rights can strengthen its role by developing collaborative programs with universities and civil society, integrating human rights education into curricula, and ensuring policies that safeguard students from radical influences. Through these efforts, radicalism can be countered effectively while upholding democratic values and national unity. Keywords: Basic; Rights; Radicalism; Students.

Abstract

Pengembangan pariwisata di Desa Tapak Gedung menjadi desa wisata merupakan upaya meningkatkan perekonomian dan kesejahteraan Masyarakat tetapi juga menimbulkan masalah sampah baik dari warga desa maupun pengunjung kawasan wisata. Permasalahannya di Desa Tapak Gedung belum ada Bank Sampah, karena BUMDes belum memiliki unit pengelola sampah. Hal tersebut dikarenakan pengelola BUMDes dan perangkat desa lainnya belum memiliki pengetahuan, kesadaran tentang Bank Sampah dan keterampilan mengelola Bank Sampah serta mengolah sampah. Tujuan kegiatan Pengabdian Kepada Masyarakat ini untuk meningkatkan pengetahuan dan kesadaran masyarakat mengenai pariwisata berkelanjutan dan meningkatkan keterampilan mengelola dan mengolah sampah melalui Bank Sampah sebagai upaya pencegahan pencemaran lingkungan. Kegiatan pengabdian kepada masyarakat dengan metode ceramah, diskusi, dan pelatihan ini berupaya untuk memberikan motivasi dan kesadaran dan meningkatkan pengetahuan dan keterampilan pentingnya mengelola dan mengolah sampah. Pelaksanaan pengabdian kepada masyarakat (PkM) ini telah memberikan pengetahuan melalui materi pariwisata berkelanjutan, sampah organik dan anorganik, pilah dan olah sampah serta kelembagaan Bank Sampah. Pelatihan pilah dan olah sampah organik menjadi eco-enzyme dan sampah anorganik menjadi eco-brick. Menyampaikan draft AD/ART dan struktur organisasi Bank Sampah. Setelah kegiatan PkM ini diharapkan di Desa Tapak Gedung melalui musyawarah desa dapat membentuk Bank Sampah Desa.

Abstract

This research seeks to explore the divine values in the development of legal science through the lens of the philosophy of science. In the context of humans as social beings created by the Almighty God, law functions as a normative guide to achieve justice and regulate social interactions. This research focuses on two main issues: the influence of divine values on the formation and development of legal science, and the integration of these values to create a balance between legal certainty, utility, and justice. This study employs a qualitative approach using historical and analytical methods. The type of research is a literature study. This research utilizes primary legal materials such as books, scholarly articles, previous academic studies, and other documents discussing divine values, the philosophy of science, and their relationship with legal principles such as justice, utility, and legal certainty. Subsequently, all obtained data is analyzed through qualitative analysis. The findings indicate that divine values play a crucial role in shaping a divinely-oriented legal paradigm that not only prioritises the formal aspects of law but also the moral and spiritual values derived from religious teachings. From this perspective, law is understood as a manifestation of universal divine values, with Pancasila serving as the epistemological framework that ensures the integration of moral principles within Indonesian law. Furthermore, divine values can create harmony between legal certainty, utility, and justice, where the concept of justice is emphasised to be not merely formal but also substantive, reflecting social justice and human dignity as creations of God. This research underscores the importance of divine values as a foundation in the development of legal science that is adaptive to the social dynamics of society.

Abstract

Monitoring and assessment of water quality in subwatershed areas are essential to support sustainable watershed management, pollution control, and protection the aquatic ecosystems. This study aimed to assess the water quality status of the Tiku Subwatershed using the Pollution Index (PI) approach based on 12 key physicochemical parameters. Water samples were collected from three monitoring stations representing upstream, midstream, and downstream segments in September 2024. The analyzed parameters included dissolved oxygen (DO), biochemical oxygen demand (BOD), chemical oxygen demand (COD), pH, and heavy metals. Laboratory analyses were carried out following standard procedures, and the PI was calculated according to the Decree of the Indonesian Minister of Environment No. 115 of 2003. The results showed that PI values ranged from 1.15 to 3.90, indicating that all sampling locations were classified as lightly polluted. These findings highlight the need for targeted pollution control measures, particularly in upstream and midstream areas, to maintain water quality and support the sustainable functioning of aquatic ecosystems in the Tiku Subwatershed.

Abstract

Freedom of religion or belief (FoRB) is one of the human rights stated in the 1945 Constitution. Article 29 paragraphs (1) and (2) of the 1945 Constitution. The recognition of religion guarantees the independence of each of its inhabitants to embrace their respective religions and to worship according to their religion or beliefs. The state guarantee on FoRB consists of assurance for the internal and external forums. Freedom to embrace religion or belief is an internal forum for everyone, an absolute right as regulated in ICCPR that Indonesia has also ratified. In fact, this provision is also regulated in Article 28 I paragraph (1) of the 1945 Constitution. The fulfillment of the right to FoRB is frequently discriminated against in Indonesia. The  issue of forcing to wear school uniforms with hijab for non-Muslim female students is still common in many public schools in Indonesia. The State has issued a joint decree (SKB) of 3 ministers to normalize the discriminatory status quo. However, the attempt to return it to its normal position was thwarted by the LKMM, which carried out the SKB test. Unfortunately, the Supreme Court (SC) canceled the SKB because schools have the right to carry out religious education and instilled values. The judges ratio decidendi made by the SC Justices were very dry from the perspective of freedom of religion or belief in canceling the 3 Ministerial Decrees. The judge saw the issue of forcing to wear hijab on non-Muslim students from the perspective of the majority religious thought without noticing that Indonesian society is very diverse. Therefore, the protection of the right to FoRB should also safeguard the religious minorities rights. This paper will examine decision made by judiciary power in term protecting the FoRB right. This verdict will be reviewing toward to justice consideration (ratio decedendi) and legal archicteture in filling the norm FoRB. Moreover, it will also appraise to judicial behavior based on breakfasting theory.

Abstract

This study examines the relationship between customary law communities and the ideology of Pancasila within Indonesia’s legal philosophy. Article 18B Paragraph (2) of the 1945 Constitution affirms state recognition of customary law communities and their long-standing social, legal, and cultural systems. However, challenges persist in integrating customary law into the national legal framework, including normative disparities and conflicts of interest. Using a normative juridical method with philosophical, statutory, and case approaches, and drawing on secondary data through literature review, this research finds that the intersection between legal philosophy and Pancasila reflects the value of social justice. Pancasila provides a philosophical and constitutional foundation for recognising and protecting customary law communities while promoting national unity and sustainable development, thereby affirming its role in upholding diversity, justice, and humanity.
