Abstract

Looking at the current phenomenon, buying and selling using the marketplace is becoming increasingly popular, this is motivated by the ongoing corona virus pandemic, so many people choose to buy and sell using the online system. Shopee is one of the marketplaces that competes in the world of online buying and selling, by offering attractive programs, such as flash sale promos, free shopee shipping, and there is also 10,000 shopee packages. The aim of this research is to describe whether buying and selling practices on nmtstore.id on the Shopee application are in accordance with Islamic law and Islamic business ethics. The method used in this research is a qualitative method with data collection techniques through interviews, sources and literature studies used to strengthen the analysis. The results of this research explain that there is a discrepancy or the terms and conditions of sale and purchase have not been fulfilled, namely in the terms and conditions of the person entering into the contract, because the buyer and seller are the same person, in this case the contract is damaged because it does not fulfill the terms of sale and purchase and the terms of sale and purchase. carrying out the contract is a different person. Meanwhile, in the view of Islamic business ethics, purchasing one's own goods at Shopee does not violate the rules or violate the provisions of Islamic business ethics.

Abstract

This Study or discussion to talk about the history of the birth of Hijri Calendar (al-al-Hijri calendar) among Muslims. On the 1st of Muharram, Muslems commemorating their New Year Hijri or Islamic New Year. Researching history dating Arabs of pre-Islamic period up to the reign of Umar bin Khattab with the birth of Hijri Calendar. When the Prophet was alive, Muslims can ask all religious matters to him, but at the time he passed away, the friends or ulama trying to interpret Islamic religious teachings. Historically, pre-Islamic Arabs used Qamariyah-Syamsiyah calendar system (luni-solar). This calendar system requires intercalation or adding one month to adjust Qamariyah with Syamsiyah. However, no agreement in the placement of the years that had made their break with tradition intercalation Abraham, respecting and forbidden to do battle in the months noble (al-asyhur al-Hurum), namely Qa`dah, Dzu al-Hijjah, Muharram and Rajab. They were still fighting in the month of Muharram, for example, because it as month 13 (intercalation). This lasted until the Prophet Hijrah to Medina. The fall of al-Tawbah/9: 36-37 Syamsiyah-stop calendar system and replace it with Qamariyah Qamariyah pure (lunar). Until the Prophet's death (11 H/634 AD), the Arabs use Qamariyah calendar system, without the year. They only know the name of the day, month and date. In the reign of Umar bin Khattab (13-23 H/634-644 M), exactly 17 years H/637 M, he defined as the Hijri Calendar Islamic government official calendar. The proposal submitted by the beginning of the calendar creation of Abu Musa al-Ash'ari (governor of Kufa). The Prophet's hijrah year chosen as the first year as the proposal of Ali ibn Abi Talib, while selected as the first month Muharram is proposed Uthman bin al-Affan. In the determination to Hijri Calendar, choice of Muharram as the first month of the year motivated by political considerations.

Abstract

The use of new transactions in Islamic finance has faced criticism, particularly regarding the implementing of ḥȋlah (legal stratagem) which is seen as adopting conventional financial instruments that go against religious morals. This research examines the application of ḥȋlah in the Indonesian Ulama Council's (DSN-MUI) fatwa, or religious ruling, on funds that are not considered to be halal (funds that cannot be recognized as income). A way to divide up accounts and direct non-halal money toward social causes is offered by the DSN-MUI. Using a normative-philosophical perspective, this study reveals how ḥċlah is applied in the fatwa. The results show indications of the application of ḥȋlah, as seen from: (1) the recognition of non-halal funds, (2) the obligation to have a special account to separate halal and non-halal funds, and (3) the distribution of non-halal funds for socio-religious activities as an effort to avoid the stagnation of wealth. Overall, this fatwa tends to use ḥȋlah by referring to the practice of the Prophet Muhammad in handling assets with unclear legal status.

Abstract

This research looks at the application of Islamic business ethics principles in the DSN-MUI fatwa related to gifts in the fundraising activities of Islamic financial institutions, aiming to maintain integrity and compliance with Sharia law. Using a qualitative method with literature review and descriptive-analytic approach, this research analyzes how the principles of Unity (Tawhid), Equilibrium (Balance), Free Will, and Responsibility are applied in the fatwa. The findings reveal that the DSN-MUI fatwa integrates the values of justice, transparency, and social responsibility in the regulation of gift-giving, ensuring practices that comply with Sharia while supporting the stability and sustainability of Islamic financial institutions. This study offers insightful information for the creation of ethical policies in Islamic finance and serves as a reference for academics and practitioners in addressing moral challenges in business.

Abstract

This study explores the application of Maslahah Mursalah in the DSN-MUI fatwa concerning akad wasathah (intermediation) in business transactions. Maslahah Mursalah, as a principle in Islamic law, functions to regulate matters not explicitly covered by textual sources with the aim of achieving public benefit and preventing harm. This study's main emphasis is on the philosophical aspects of constructing the Maslahah Mursalah method in the DSN-MUI fatwa and its implications for business practices. The akad wasathah serves as an intermediary in business transactions, ensuring fair and beneficial agreements in accordance with Sharia principles. This study employs a descriptive qualitative approach to analyze the fatwa text and related literature, seeking to offer comprehensive insights about the application of Maslahah Mursalah within the framework of contemporary business law. The research findings are expected to offer significant contributions to the understanding of Sharia principles in business intermediation practices and provide recommendations for further development in fiqh muamalah.

Abstract

The purpose of this research is to determine the criteria that indicate that the Plaintiff's Shepora is a well-known mark that must be protected and how to prove if there has been a passing off of the Plaintiff's mark (Shepora) by Shepora Batik (defendant). This research is a study of documents related to the Passing off of the French Shepora Brand by Shepora Batik. The research results show that the two marks have similarities in essence, because the Defendant's mark also contains the words Sephora, which is the dominant element in the Plaintiff's mark and is also the Plaintiff's mark which has been registered in several countries in the world. The two brand writings are similar in terms of placement, writing method, and letter elements that make up the word Sephora itself, so they produce exactly the same sound when read. The Plaintiff's Sephora was registered in various countries long before the Defendant's brand was registered in Indonesia. If there are similarities in writing, speech and sound with the Plaintiff's brand, it can be ascertained that the Defendant's intentions are other than wanting to piggyback on and benefit from the popularity of the Sephora brand.

Abstract

The main focus of the research is the phenomenon of supernatural divorce, which is a legal remedy for the wife to end the marriage when her husband's whereabouts are unknown. The research uses a qualitative method with a phenomenological approach to explore the mechanism, causal factors, and impact of supernatural divorce. Primary data was collected through in-depth interviews with informants, while secondary data was obtained from related agency documents, books, and journals. The results of the study show that supernatural divorce lawsuits are regulated in Law Number 7 of 1989, the Compilation of Islamic Law, and other regulations. The court process includes summoning the defendant through the mass media and a verstek decision if the defendant is not present. In 2024, there will be 99 cases of supernatural divorce lawsuits at the Purworejo Religious Court, reflecting the high divorce rate. The analysis method includes data reduction, data presentation, and conclusion drawn. This research highlights the importance of legal protection for wives and the role of the court in ensuring justice for related parties.

Abstract

Di Dusun Beran Desa Bulus Kecamatan Gebang Kabupaten Purworejo sering terjadi fakta bahwa peminjam dalam memanfaatkan barang pinjamannya sering melebihi batas kewenangannya dan bahkan sering dalam pemanfatannya serasa menjadi miliknya sendiri, padahal itu tidak sama sekali, fakta perilaku para peminjam yaitu barang yang dipinjamnya tersebut sering dijadikan jaminan dalam transaksi yang lainnya seperti contoh hutang. Tujuan penelitian ini adalah untuk mengganaisis tentang barang pinjaman yang dijadikan jaminan hutang di Dusun Beran Desa Bulus Kecamatan Gebang Kabupaten Purworejo apa sesuai dengan hukum Islam. Penelitian ini termasuk jenis penelitian lapangan (field Reseach) yaitu suatu penelitian yang dilakukan di lingkungan masyarakat tertentu, baik di lembaga-lembaga organisasi masyarakat (social), maupun lembaga pemerintah. hasil penelitian menerangkan baahwa pelaksanaan akad rahn dengan barang pinjaman yang digunakan sebagai jaminannya pada Dusun Beran tidak semuanya dibenarkan jika dilihat menurut pandangan hukum Islam, karena banyak sekali mudharatnya, yang memungkinkan mereka seringkali tidak menunaikan kewajibannya. Pemanfaatan barang pinjaman yang tidak tepat mengakibatkan adanya pihak yang dirugikan dan itu tidak diperbolehkan dalam hukum Islam.

Abstract

The practice of buying and selling cabbage vegetables using the slash system has been carried out for generations by the Muslim community in Kalitengah Village, Garung District, Wonosobo Regency. This kind of buying and selling practice is carried out naturally and is not based on knowledge of religious teachings. Researchers are interested in uncovering this phenomenon using a fiqh analysis tool, namely the jizāf contract, because the majority of the Kalitengah village community is Muslim and they must know whether their muamalah activities are in accordance with the Islamic teachings they adhere to or not. This research reveals that the practice of buying and selling cabbage using the slash system carried out by the Muslim community in Kalitengah Village, Garung District, Wonosobo Regency tends to fulfill the jizāf buying and selling agreement. Namely buying and selling which is permitted in the plural by Islamic jurisprudence scholars for objects that cause mashaqqah (difficulty) and has become a necessity for the majority of society because of the ease of doing it.
