Abstract

There are inconsistencies between the regulation of alcoholic beverages in Presidential Regulation No. 73/2013 on the Control and Supervision of Alcoholic Beverages and Pekalongan City Regional Regulation No. 13/2000 on the Supervision and Prohibition of Alcoholic Beverages. This article discusses the dialectics of Islamic law and positive law in regulating alcoholic beverages in Pekalongan as a city of santri and its legal consequences. This article is a doctrinal research using statutory, conceptual, and historical approaches. The analysis of legal material is prescriptive to offer arguments to answer problem issues, while the inference technique uses deductive thinking logic. Based on the analysis of Hans Kalsen's norm theory and the principles of legal norm formation, the research shows that the dialectic of Islamic and positive legal norms that produce local regulations on the prohibition of alcoholic beverages in the city of santri is a consequence of the autonomy authority of local governments in making local regulations in order to carry out assistance tasks. Consequently, the local regulation on the prohibition of alcoholic beverages has no binding force because the basic rules of its formation have been declared contrary to law by the Supreme Court, and the content material is contrary to Presidential Regulation No. 74 of 2013. It does not comply with the principles of the formation of local regulations. The legal consequences are uncertainty, regional regulations not following national legal policy, and the potential to cause discrimination. This article presents an understanding of the dialectic of Islamic law on the one hand and positive law on the other regarding regulating the circulation of alcoholic beverages. Terdapat inkonsistensi pada regulasi minuman beralkohol dalam Peraturan Presiden Nomor 73 Tahun 2013 Tentang Pengendalian dan Pengawasan Minuman Beralkohol dengan Peraturan Daerah Kota Pekalongan Nomor 13 Tahun 2000 Tentang Pengawasan dan Pelarangan Minuman Beralkohol. Artikel ini membahas dialektika hukum islam dan hukum positif dalam pengaturan minuman beralkohol di kota Pekalongan sebagai kota santri serta akibat hukumnya. Artikel ini merupakan penelitian doktrinal menggunakan pendekatan undang-undang, konseptual dan historis. Analisis materi hukum bersifat preskriptif dengan maksud untuk menawarkan argumen untuk menjawab masalah masalah, sedangkan teknik inferensi menggunakan logika berpikir deduktif. Berdasarkan analisis teori norma Hans Kalsen dan asas-asas pembentukan norma hukum, penelitian menunjukkan bahwa dialektika norma hukum Islam dan positif yang menghasilkan peraturan daerah tentang larangan minuman beralkohol di kota santri merupakan konsekuensi dari kewenangan otonomi pemerintah daerah dalam membuat peraturan daerah dalam rangka melaksanakan tugas pendampingan. Akibatnya, keberadaan peraturan daerah tentang larangan minuman beralkohol a quo sebenarnya tidak memiliki kekuatan yang mengikat karena aturan dasar pembentukannya telah dinyatakan bertentangan dengan hukum oleh Mahkamah Agung dan materi isinya bertentangan dengan Peraturan Presiden No. 74 Tahun 2013 dan tidak sesuai dengan prinsip-prinsip pembentukan peraturan daerah. Konsekuensi hukumnya adalah ketidakpastian hukum, keberadaan peraturan daerah tidak sesuai dengan kebijakan hukum nasional dan berpotensi menimbulkan diskriminasi. Artikel ini menyajikan pemahaman mengenai dialektika hukum islam di satu sisi, dan hukum positif di sisi lain mengenai bagaimana praktik pengaturan peredaran minuman beralkohol.

Abstract

Penelitian ini mengkaji tentang Kewenangan Pemerintah Dalam Pembubaran Organisasi Kemasyarakatan. Fokus penelitian ini adalah pada pasal-pasal yang terdapat dalam Undang-Undang nomor 17 tahun 2013 tentang Organisasi Kemasyarakatan dan pada Undang-Undang nomor 16 tahun 2017 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang nomor 2 tahun 2017 tentang Organisasi Kemasyarakatan.Terdapat perbedaan aturan tentang pembubaran organisasi kemasyarakatan antara Undang-Undang lama dan Undang-Undang terbaru Organisasi Kemasyarakatan dimana perbedaan tersebut mengenai pembubaran ormas oleh pengadilan dan pembubaran ormas langsung tanpa melalui proses pengadilan. Permasalahan yang timbul tersebut perlu dikaji ratio legisnya dan apakah pembubaran tersebut sudah sesuai dengan konsep negara hukum dan demokrasi.Tujuan penelitian ini adalah untuk mengetahui ratio legis pemerintah membubarkan organisasi kemasyarakatan tanpa proses peradilan. Penelitian ini termasuk jenis penelitian yuridis normatif dengan menggunakan teknik analisis preskriptif. Hasil penelitian ini menunjukkan bahwa ratio legis pemerintah membubarkan organisasi kemasyarakatan adalah perlunya asas contrarius actus atau asas hukum administrasi negara yang mana tidak terdapat dalam Undang-Undang terdahulu tentang ormas, sehingga Undang-Undang tersebut diperbarui menjadikan pemerintah dalam hal ini kemenkumham dapat membubarkan ormas tanpa proses peradilan, dan mekanisme tersebut tentu tidak sesuai dengan konsep negara hukum dan demokrasi. Abstract

The time limit in the judicial review of legislative process was first made in Constitutional Court Decision Number 27/PUU-VII/2009, in legal considerations the judge made a new law (judge making of law) by limiting the filing of formal test applications 45 today the law was published in the state gazette. This was done for the sake of legal certainty and the impact of the formal test application submitted past the 45-day deadline would be rejected by the Constitutional Court. This research uses a normative or doctrinal juridical type that focuses on library research. The purpose of this research is to find out the legal reasoning of the Constitutional Court judges in limiting the filing of formal tests and analyzing these restrictions from the aspect of justice. This research is a doctrinal research using statutory, conceptual and case approaches. The results of the study show that restrictions on the filing of formal tests are imposed in order to achieve legal certainty, so that the law requested for a formal test is more quickly known whether its status has been made legally or not, because formal testing will cause the law to be canceled from the start. Time restrictions in the Constitutional Court are not entirely contrary to the principle of justice, because in practice the Constitutional Court still provides space of justice for applicants to submit formal tests.

Abstract

This study aims to describe the (existing) appointment of acting regional heads to fill vacant permanent regional head positions and to propose the ideal appointment of acting regional heads based on democratic principles as stipulated in Law No. 10/2016 on Regional Elections. This study is a normative legal study using a legal and conceptual approach. The data obtained are analyzed and interpreted using relevant legal interpretation methods, and deductive conclusions are drawn. The results of this study indicate that the acting governor who will fill the vacant position will be directly appointed by the President based on the submission of names from the Ministry of Home Affairs (Kemendagri). As for Acting Regents and Mayors, they are directly selected by the Ministry of Home Affairs. A more democratic appointment design is proposed by implementing a merit-based system in recruitment and broader participation from various political parties, including the Regional People's Representative Council (DPRD). This more democratic design aims to ensure the appointment process is more transparent, accountable, and aligned with democratic principles and regional aspirations.

Abstract

The public service sector is a reflection of the governance of a government. Poor public service delivery will certainly disrupt the stability of government administration because it will affect the level of public trust in the government. The Pekalongan Regency Government created an e-government-based public complaint service system called the Regent's Report, as an effort to improve public services. This study aims to evaluate the implementation of the Regent's Report complaint system in Pekalongan Regency and to find out the factors that influence the implementation of the Regent's Report complaint system in Pekalongan Regency. This research is a qualitative descriptive study. The results of this study indicate that the Evaluation of the Regent's Report complaint system was carried out by reviewing William Dunn's evaluation theory, among others; effectiveness, efficiency, adequacy, alignment, responsiveness, and accuracy. The Pekalongan Regency Government should increase the leveling and responsiveness points because it was found that the majority of the people did not know about the Regent's Report complaint system. The factors that influence the implementation of the district head's report complaint system consist of supporting factors, namely e-government-based systems and adequate infrastructure, and inhibiting factors, namely budget, human resources and implementation standard guidelines.

Abstract

Laju perkembangan zaman, membawa dampak perkembangan cara dan jenis kegiatan jual beli di tengah-tengah masyarakat. Salah satunya, transaksi jual beli yang dipraktekkan oleh Kafe Ujung Senja Batang, yang menggunakan system voucer sebagai media tukar dalam transaksi jual beli makanan dan minuman. Metode ini tidak lazim digunakan oleh masyarakat setempat, untuk itu diperlukan kajian untuk meninjau keabsahan akad pada jual beli yang dilakukan dengan system tukar voucer. Penelitian ini bertujuan untuk mengetahui bagaimana pelaksanaan praktik jual beli dengan system tukar voucer di Kafe Ujung Senja Batang dan untuk mengetahui keabsahan akad yang digunakan dalam praktik jual beli dengan system tukar voucer. Metode penelitian ini adalah deduktif analitis, dengan jenis penelitian normatif empiris. Hasil penelitian bahwa praktik jual beli yang dilakukan di Kafe Ujung Senja Batang adalah dengan mewajibkan pengunjung untuk menukarkan uang rupiahnya dengan voucer bernominal sama, yaitu senilai Rp. 30.000, Rp 50.000, dan Rp 100.000, sebagai alat tukar dalam transaksi jual beli makanan dan minuman di dalam area Kafe. Praktek ini adalah sah dan dibolehkan karena terdapat sebagian pengunjung yang meridhoi terhadap ketentuan transaksi yang dilakukan. Namun, ada pula transaksi yang hukumnya fasid atau rusak dikarenakan tidak memenuhi salah satu syarat dalam jual beli yaitu syarat nilai tukar pengganti barang yang menyebabkan adanya keterpaksaan dan kerugian pada sebagaian lain pengunjung.Kata Kunci: Jual Beli, Sistem Tukar Voucer, Hukum Islam

Abstract

Penelitian ini bertujuan untuk menganalisis bai’ al-wafa dan klausul buyback emas dalam budaya transaksi masyarakat Muslim di Kadipaten, Pekalongan. Metode yang digunakan dalam penelitian ini adalah penelitian hukum empiris-sosiologis, dengan menggunakan pendekatan konseptual dan pendekatan perundang-undangan. Sumber data dalam penelitian ini adalah data empiris dari hasil wawancara dengan masyarakat adat, dan data sekunder yang didapatkan dari dokumen terkait dengan penelitian. Data tersebut dianalisis dengan metode analisis deskriptif kualitatif. Hasil penelitian menunjukkan bahwa transaksi jual beli emas yang melibatkan klausul buy back dalam budaya transaksi masyarakat adat, sering kali tidak disepakati secara rinci mengenai harga dan waktu pembelian kembali, sehingga menimbulkan ketidakjelasan (gharar). Perjanjian buy back sering dilakukan tanpa mencantumkan batas waktu, sehingga belum sepenuhnya sesuai dengan Pasal 1519 dan 1532 KUHPerdata, yang mengatur pengembalian harga dan penggantian biaya. Perjanjian lisan jual beli emas dengan klausul buy back sah menurut hukum, namun lemah dalam pembuktian dan kepastian hukum. Ketidakjelasan mekanisme buy back dapat merugikan salah satu pihak. Kontribusi penelitian ini terletak pada penguatan teori kepastian hukum, dengan menunjukkan bahwa ketidakjelasan dalam perjanjian lisan—khususnya dalam klausul buy back—berimplikasi terhadap lemahnya jaminan kepastian hukum dan perlindungan hak para pihak, baik dalam perspektif hukum positif maupun hukum Islam. Kontribusi penelitian ini terletak pada penguatan teori kepastian hukum dan memberikan landasan evaluatif bagi penyelarasan praktik lokal dengan prinsip-prinsip hukum positif dan hukum Islam.

Abstract

This research examines the discretionary authority of Acting Regional Heads in implementing employee transfers regulated by the Ministry of Home Affairs Circular Letter No. 821/5492/SJ. The study focuses on the normative conflict between the Circular Letter and Government Regulation No. 49 of 2008, as well as its legal implications for governance. The research employs a normative juridical method with statutory and conceptual approaches. The findings indicate that the Circular Letter is inconsistent with the principle of legality and general principles of good governance, creating a potential for abuse of authority. The implications include disruption of good governance principles and an increased risk of bureaucratic politicization during transitional periods of regional leadership. This study highlights the need for regulatory harmonization and clear limits on discretionary powers of acting officials to ensure legal certainty and maintain the neutrality of civil servants.
