Abstract

M. Umer Chapra’s thought in economics is a blend of traditional sciences,theology and modern economics sciences. His thinking is dominated by macro economicsector because he was widely occupied in the world economy. His thinking are includingthe concept of falah, hayyahtayyibah and Muslims economic challenges, monetary policy,the Islamic financial institutions which is concerned to the central bank and its policies,and the concept of welfare states according to Islam. Like the other Muslim economists,Chapra hammered at moral as the way of reaching fair and healthy economy.The privilegedof M. Umer Chapra thought is the ability to mix and match between the Western economicconcepts with Islamic values. He was awarded as the ‘ success Islamic scholar ‘. While hisslight shortage is in the attitude of tolerance towards Western financial instruments. Thisattitude is the impact of his understanding of the world economy, that may not be erasedfrom these instruments except gradually and slowly. Although Chapra realizes that theIslamic economic system can deliver socio - economic justice to the world and become asolution for the failure of the capitalist and socialist economic systems.Key words: monetary policy, banking system, welfare state. Fokus utama makalah ini adalah membahas pemikiran M. Umer Chapra dalambidang ekonomi. Penulis menemukan pemikiran ekonomi Chapra merupakan perpaduanantara ilmu-ilmu tradisional, ilmu agama dan ilmu ekonomi modern. Pemikirannyadidominasi oleh bidang perekonomian makro karena ia banyak berkecimpung di duniaperekonomian negara. Diantara pemikirannya adalah mengenai konsep falah, hayyahthayyibah, dan tantangan ekonomi umat Islam, kebijakan moneter, lembaga keuangansyariah yang lebih ditekankan kepada bank sentral dan kebijakan-kebijakannya, serta konsepnegara sejahtera menurut Islam. Sebagaimana ekonom muslim lainnya, Chapramengedepankan pentinganya moral bagi jalannya perekonomian yang adil dan sehat.Keistimewaan pemikiran M. Umer Chapra adalah kemampuannya memadu-padankanantara konsep-konsep ekonomi Barat dengan nilai-nilai Islam. Sehingga ia mendapatkangelar sebagai ‘sarjana Islam yang sukses’. Sedangkan kekuranganannya terletak pada sikaptolerannya terhadap instrumen-instrumen keuangan Barat. Sikap tersebut merupakan imbasdari pemahamannya mengenai keadaan ekonomi dunia yang tidak mungkin dimurnikandari instrumen-instrumen tersebut kecuali secara bertahap dan perlahan. Meskipun Chapramenyadari bahwa sistem ekonomi Islam dapat mengantarkan kepada keadilan sosio-ekonomidunia dan menjadi solusi bagi kegagalan sistem ekonomi kapitalis dan sosialis.Kata kunci: kebijakan moneter, sistem perbankan, negara sejahtera

Abstract

Kuntowijoyo is one of the prominent Indonesian Muslim philosophers who discusses Islamic epistemology. However, unlike most philosophers who focus on the process of Islamization of knowledge, Kuntowijoyo actually formulated the concept of scientific which is an epistemological idea of integrating between Islam and the sciences. The idea of integrating science and religion needs to be re-echoed in the third decade of the 21st century, given that this long-term program has not produced much in the treasures of Islamic scholarship, especially in Indonesia.This study aims to review the idea of integrating science and religion in the work of Islam as Science compiled by Kuntowijoyo. The type of this research is library research with analytical descriptive method. The object of research is the book Islam as a science, by Kuntowijoyo. The results of this study, that Kuntowijoyo offers a process of integrating science and religion in a concept he named scientific Islam, where science is derived from the texts of the Qur'an and As-Sunnah into the context of scientific reality. Kuntowijoyo hopes that, with this idea of scientific Islam, the sciences that are built can stand on the basis of the integration of science and religion, without dominating one of them, so that it can be applied to all humans in general. included in the development of national law because the concept of scientific Islam which initiates the integration between science and religion is also in line with the concept of the formation of national law that integrates religion and the state.

Abstract

The digitalization of trading is developing rapidly, but legal awareness has not been well developed. Although digital trading is fairly new in the world of economics in this country, it has been able to attract the attention of many people, especially business people, to become traders. Digital trading refers to trading activities using applications on smartphones or trading software commonly called trading robots. But unfortunately, the rise of digital trading activities is not accompanied by regulations that guarantee the safety of novice traders. Together with the inhabitants of Pekalongan's ignorance of the rules and laws pertaining to trading activities on the capital market. The purpose of this study is to examine the factors that prevent Pekalongan citizens from being aware of the legal implications of digital trading and know the implications of the lack of legal awareness of the people of Pekalongan regarding digital trading. This study employs both statutory and conceptual approaches and is grounded in empirical legal research. Techniques for descriptive qualitative data analysis. The population of Pekalongan served as the sample for this study, which used a random sampling technique. The findings of this study indicate that low literacy rates and a lack of interest in commodities trade are the main causes of the lack of legal awareness among Pekalongan residents (trading). The consequences of the people of Pekalongan's lack of legal awareness with regard to digital trading are: 1) They lack legal protection in transactions involving digital trading, and 2) They are vulnerable to fraud and losses in such transactions.

Abstract

Utang piutang adalah transaksi yang paling banyak terjadi di tengah masyarakat. Perbedaan penghasilan dan kebutuhan masing-masing individu masyarakat adalah salah satu factor utamanya terjadi transaksi utang piutang. Namun realita di masyarakat, pembayaran hutang seringkali terkendala dengan ketersediaan dana dari pihak yang berhutang sehingga akhirnya terjadilah praktek kilah utang piutang, salah satunya dengan barang rokok. Penelitian bertujuan untuk mengetahui praktik utang piutang dengan kilah barang rokok di Desa Kasepuhan Kecamatan Batang Kabupaten Batang dan untuk menganalisis pendapat ulama setempat terhadap praktik utang piutang kilah barang rokok. Penelitian ini merupakan penelitian kualitatif atau penelitian lapangan dengan mengumpulkan informasi secara langsung dari objek penelitian melalui wawancara dan dokumentasi. Sumber data dalam penelitian ini adalah koresponden dari desa Kasepuhan kecamatan Batang kabupaten Batang. Hasil penelitian ini menunjukkan bahwa praktik utang piutang dengan sistem ini sudah menjadi kebiasaan di masyarakat desa Kasepuhan, karena lebih mudah dalam kebutuhan mendesak. Namun sebenarnya sistem utang piutang ini merugikan pihak penghutang karena nilai rupiahnya menurun saat menjual rokok tersebut kepada toko klontong, dan meningkat jauh saat membelinya kembali ketika hendak membayar hutang. Menurut pendapat ulama bahwa sistem utang piutang dengan kilah barang rokok ini diperbolehkan dengan syarat akadnya benar dan tidak ada unsur kekecewaan antara dua belah pihak.

Abstract

The sale and purchase of jizaf on ready-to-plant rice seeds, is a buying and selling practice where farmers sell ready-to-plant rice seeds by hand and tie them together. In this sale and purchase there is no clarity in size, and the measurement is only based on the grip of the hand, whereas in essence the size of each person's palm is different, some are large, some are small. In addition, the strength of the grip affects the content of the rice seeds, so there is no uniformity in the quantity of the dose in this sale and purchase. This type of research is a field research with a qualitative approach. Sources of data in the form of primary data obtained by observation and interviews with sellers and buyers, and secondary data sources obtained by documentation techniques. The data were analyzed using interactive model qualitative data analysis techniques. The results of the study concluded, the sale and purchase of ready-to-plant rice seeds in Lebo Village was in accordance with the pillars and terms of buying and selling by means of jizaf. Another factor in the permissibility of this buying and selling is that there is a great benefit in it, the benefit in terms of doing muamalah to help each other. This buying and selling practice is a habit of the local community (urf), urf in this sale and purchase is a valid urf and does not conflict with Islamic teachings and can be used as a legal basis.

Abstract

Every human being cannot fulfill his needs without other people. So, Allah ordered His servants to fulfill the help. Human relations according to Islamic law are muamalah. In general, wages are the agreed total amount of replacement services determined by workers covering certain periods and conditions. This study aims to explain the practice of giving grave diggers wages in Yosorejo Village, Batang Regency in the 'Urf Perspective and to analyze the Conformity between the Ijarah Agreement and the Practice of Grave Digger Service Wages in Yosorejo Village, Batang Regency. This type of research is a socio legal research approach or empirical legal research and a conceptual approach. Primary data sources were obtained from observations and interviews by gravediggers and the community. Sources of secondary data obtained from research journals, previous research, and fiqh books related to research problems obtained by documentation techniques. Data analysis is carried out continuously. The results of this study indicate that the practice of providing wages for gravediggers in Yosorejo Village, it appears that the practice of wages is an inherent and long-standing tradition. Tradition in a society is a custom that is not easy to abolish or replace with new habits.
