Abstract

Penelitian ini bertujuan untuk mengetahui proses pembagian hak bersama berupa tanah warisan secara adatdi Surakarta, mengevaluasi pelaksanaan peran Pejabat Pembuat Akta Tanah dalam proses pembagian hakbersama berupa tanah warisan secara adat, dan mengungkapkan kendala yang dihadapi Pejabat Pembuat AktaTanah dalam proses pembagian hak bersama berupa tanah warisan secara adat di Surakarta. Metode yangdigunakan berupa penelitian hukum sosiologis empiris.Sumber data berupa data primer dan data sekunder.Teknik pengumpulan data berupa wawancara dan studi pustaka.Teknik analisa data dengan analisis kualitatif,logika berfikir secara induktif. Penelitian ini dapat disimpulkan (1)Proses pembagian hak bersama berupatanah warisan secara adat di Surakarta meliputi turun waris, pemecahan, dan pembagian hak bersama, (2)Peran Pejabat Pembuat Akta Tanah dalam pembagian hak bersama berupa tanah warisan secara adat diSurakarta telah sesuai dengan peraturan perundang-undangan yaitu membantu Kepala Kantor PertanahanKota Surakarta untuk mempersiapkan data sebelum peralihan hak didaftarkan ke Kantor Pertanahan, sebagaikonsultan hukum bagi para ahli waris (klien) yang akan mengurus pembagian hak bersama, membuat AktaPembagian Hak Bersama, meneliti berbagai persyaratan dalam proses pembagian hak bersama, membantuKepala Kantor Pertanahan Kota Surakarta untuk menyelenggarakan tertib administrasi pertanahan (3)Kendalayang dihadapi Pejabat Pembuat Akta Tanah dalam pembagian hak bersama berupa tanah warisan secara adatdi Surakarta, berupa substansi hukum dan budaya hukum.

Abstract

Sekian bulan telah terlewati dan sebaran Covid 19 makin meluas dan mengkhawatirkan. Gugus Tugas Percepatan Penangan Covid 19 pun telah dibubarkan dan diubah menjadi Komite Penangan Covid 19 dan Pemulihan Ekonomi Nasional oleh Presiden berdasarkan Peraturan Presiden No. 82 Tahun 2020. Pemerintah telah menetapkan wabah Covid 19 sebagai bencana non-alam dengan status sebagai bencana nasional berdasarkan ketentuan UU No. 24 Tahun 2007 tentang Bencana Nasional. Meluasnya sebaran Covid 19 tersebut telah berimplikasi terhadap berbagai aspek kehidupan masyarakat di bidang ekonomi, termasuk pangan, sosial, budaya, dan hukum. Ini berarti dalam menghadapai pandemi Covid 19, salah satu hal pokok yang perlu menjadi perhatian pemerintah adalah mengenai kedaulatan pangan. Memang kedaulatan pangan saat ini telah memasuki era baru, setelah Presiden Joko Widodo memasukkan kedaulatan pangan ke dalam satu diantara sembilan cita-cita politik yang harus dilaksanakannya.

Abstract

The objective of this study is to objectively analyze and examine the legal protection of the community regarding the status of area land in West Lampung Regency. This research is sociolegal because it only determines law as a social phenomenon. This research was conducted in West Lampung Regency the research location was in Sukapura Village, Sumberjaya District, West Lampung Regency, and in the location of the forest land in the disputed area. The results of the authors can be concluded, firstly, that the regulation of tenure over forest area land in West Lampung Regency cannot provide legal protection for indigenous peoples because, in several findings, it is known that the land and the holder of rights over it are recorded for the first time in the registration book. Second, the regulation of valid land tenure rights in order to provide protection to the community regarding the status of forest area land in West Lampung is to check the status of the land. In the event that the means of proof as referred to in paragraph 1 are not available or are no longer available, proof of rights can be carried out based on the fact that the land parcel in question has physically been in possession for twenty years or more consecutively by the applicant for registration and preliminary introduction with conditions.

Abstract

Service public-based technology from the Mortgage Rights system electronic expected can give convenience for user system that, will but in its implementation Not yet walk in a way maximum. Problems arise if the owner guarantee dies during the mortgage​​ in a way electronically registered. This Study’s objective is to know the implications of Integrated Mortgage Rights registration​ in a way electronically if the owner guarantee dies. Study This is study law normative. Data used in the study This is secondary data. Collected data is then analyzed in a way descriptive qualitative with the use statute approach or approach legislation. Research results this if the owner guarantee died when the Mortgage Rights were registered in a way electronics, cause Number Identity Population owner guarantee in system Registration of Mortgage Rights No registered. This matter is causing mortgage rights not to be born. Because the creditor​ did not get guarantee certainty law when the Deed Granting Mortgage Rights was already signed through a power of attorney to impose mortgage rights because the APHT cannot registered to the Land Office.

Abstract

This research aims to identify the causes of onrechtmatige daad Notary in the division of joint property in the decision of the Cirebon District Court number 83/Pdt.G/2022/PN Cbn. This research is a type of doctrinal legal research or normative legal research, with a statute approach and case approach. The sources of legal materials in this research are primary legal materials and secondary legal materials. The technique of collecting legal materials using literature studies and analyzed using the syllogism method using a deductive mindset. The results showed that the causes of Notary irregularities in the making of the deed of division of joint property in the decision of the Cirebon District Court number 83/Pdt.G/2022/PN Cbn, are: a) the absence of good faith from Defendant I and Defendant II (Notary), namely Defendant II (Notary) assisted Defendant I in making the Deed of Separation of Joint property number 66 dated January 26, 2016 without the knowledge, without meeting, without signatures, fingerprints and without explanation from the Plaintiff, the Notary violated Article 16 paragraph (1) letter a, letter b and letter c, Article 44 paragraph (1) b) Defendant II (Notary) did not read the deed in front of the Plaintiff, the Notary violated Article 16 paragraph (1) letter l. Defendant II (Notary) also violated Article 3 paragraph (1) of the Notary Code of Ethics. Defendant II (Notary) committed an act against the law (onrechtmatige daad) Article 1365 of the Civil Code, Defendant II (Notary) is subject to civil liability. Defendant I and Defendant I (Notary) are jointly and severally liable in paying immaterial damages to the Plaintiff, paying court costs and dwangsom fees. Sanctions on the deed made by the Notary become invalid and not legally binding, so that it is declared null and void.

Abstract

Indonesia is a country of religious culture, and the enactment of Law No.1 of 2023 is an effort to decolonize and recognize and strengthen the existence of customary law in Indonesia. This research will explore the ability of judges in implementing Article 2 of the Law. This research adopts normative legal research using conceptual, statutory, and comparative approaches. The results of this study show that judges in Indonesia generally have a positivist view due to the limited views of judges. The recommendation from this research is for judges in Indonesia to explore, follow, and understand the laws that live in society. This needs to be done so that in determining a decision in accordance with the spirit, norms, values that exist in society and can realize an ideal customary criminal justice system, ideal customary criminal justice.

Abstract

The general public's low understanding of basic provisions related to halal is still very low in general and this includes Perum Widorosari, Kartosuro District, Sukoharjo Regency, Central Java. So it is necessary to socialize legal counseling Government Regulation Number 39 of 2021 concerning Guarantees of Halal Products and various technical provisions for its application to be very appropriate and relevant to continue to be carried out. Public understanding that is adequate for the importance of implementing halal standards will pave the way for the establishment of halal zones that specifically fulfill the consumer's needs

Abstract

The research evaluates the legal protection regulation for the ownership of population data in Indonesia. The type of the research is normative research with statute approaches. This study uses the Theory of Legal Protection, Theory of Legal Certainty, and Theory of Formation of Legislation. The source of research data is secondary data. Data collection technique is documentation study. The use of logic in legal research is deductive logic. The qualitative techniques used is a systematic or logical interpretation technique. The result show that that regulations have not been able to provide legal protection for the ownership of population data in Indonesia because a) the protection of ownership of population data in Indonesia has not been regulated in general regulations, b) Protection of population data ownership in the form of a prohibition is regulated by sectoral regulations. However, it has not regulated in detail how the form of protection of population data about the processing of population data, and isn’t in accordance with the principles of establishing regulations, c) the protection of population data has not been accommodated in various regulations governing the protection of personal data where these regulations are still not in accordance with the principles and principles of establishing regulations.

Abstract

Critical for rural development, village land assets often trigger disputes due to ambiguous boundaries and competing claims. Despite legal frameworks like Permendagri No. 1/2016 and Book C of the Village, consensus-based deliberation (musyawarah) frequently fails, necessitating court intervention. This study investigates the causes of unsuccessful non-litigation resolutions and formulates justice-based optimization strategies for deliberation in Larikrejo Village, Central Java. Using interviews and observations, empirical legal research with qualitative analysis was conducted to examine socio-legal dynamics between the Village Government and communities. Disputes stem from historical boundary ambiguities and power asymmetries, with mediation failing due to entrenched distrust. Courts provided binding solutions, but hybrid models (deliberation + litigation) are proposed to enhance fairness and efficiency. The study advocates for institutional training in mediation (BPD), legal empowerment for villagers, and cross-regional comparisons to refine hybrid dispute resolution, balancing local traditions with legal enforcement.

Abstract

Currently, the business world is rapidly growing, as evidenced by the increasing application of business development through franchise systems widely adopted by entrepreneurs in Indonesia. The economic development of society in this technological era has certainly undergone various changes, resulting in business relations becoming more accessible to everyone. Therefore, adequate legal protection is needed to minimize potential problems that may arise, aiming to ensure justice and legal certainty within society. This means that the development of the business world must be accompanied by strong and sufficient legal protection to support potential legal issues in the future. In other words, regulations that provide legal justice and effective dispute resolution methods are required, which will particularly impact the parties involved, especially those who suffer losses, along with clear legal accountability so that violators can be held responsible for their actions. This research is normative legal research with a conceptual approach, and the data collection techniques used include literature study and a case study on decision No. 25/Pdt.G/2022/PN Srl. The findings show that dispute resolution in the case was carried out through litigation efforts, proving that the defendant committed a breach of contract in a franchise agreement that had already been notarized. This indicates that the franchise agreement was drafted by the parties into a legal document with strong evidentiary value. The document clearly establishes the legal relationship between the parties regarding their rights and obligations, created to ensure legal justice and to prevent future disputes. Furthermore, legal accountability was addressed in the judgment’s ruling, which was considered sufficient to cover all losses suffered by the plaintiff.
