Abstract

Objective study For the analysis of the implementation of environmental law and environmental conservation efforts in Indonesia, the methods used are method study qualitative and type study studies. References . Types of studies References used for digging deep understanding about a topic or phenomenon with analyzing literature And where are the relevant sources? in study This is related to the implementation of environmental laws and environmental conservation efforts in Indonesia. As for the data, it was obtained through the study and analysis of various references, like journals, scientific articles, and documents related to the topic being researched. Then, the researcher read an interesting thread and concluded from the results, findings, and study. Results study This leads to a conclusion. In the context of implementing environmental law and environmental conservation efforts in Indonesia, this research identifies a number of key aspects. Implementation of environmental law is faced with a number of challenges, including conflicts of interest, unequal access to the law, and differences in capacity at the regional government level. However, environmental conservation efforts in Indonesia also show positive initiatives, such as natural habitat conservation, reforestation programs, and renewable energy development. Technological and social innovations are key to increasing the effectiveness of conservation efforts.

Abstract

The protection of personal data has emerged as a critical concern in the digital era, particularly in Indonesia, where data breaches are increasing at an alarming rate. This study investigates the effectiveness of Indonesia's data protection policies, focusing on the implementation of Law No. 27 of 2022, and identifies the factors affecting its enforcement. Employing a qualitative approach with a case study methodology, the research analyzes three major data breach incidents involving Tokopedia, BRI Life, and BPJS Kesehatan. Data collection methods included in-depth interviews with legal practitioners and document analysis of relevant regulations and reports. The findings reveal significant gaps in the enforcement of Law No. 27 of 2022, including weak sanctions, inadequate oversight mechanisms, and limited public awareness of data privacy rights. Although the law provides a foundational framework, its effectiveness is hindered by insufficient penalties and the absence of an independent supervisory authority. For instance, while Tokopedia implemented policy revisions post-breach, similar incidents remain likely due to inadequate deterrent measures. Comparatively, the European Union's General Data Protection Regulation (GDPR) demonstrates higher effectiveness through stringent sanctions and robust enforcement mechanisms. This study contributes to the discourse on data privacy by highlighting the shortcomings of Indonesia’s current policies and proposing strategic recommendations. These include harmonizing domestic regulations with international standards, strengthening enforcement through independent oversight bodies, and enhancing public education on data privacy rights. By addressing these challenges, Indonesia can establish a more robust data protection framework, fostering trust in its digital ecosystem and ensuring alignment with global practices.

Abstract

The COVID-19 pandemic has driven an increase in social media activity as a means of communication and expressing opinions, but it has also introduced new challenges to freedom of expression. This study aims to analyze policies restricting freedom of expression on social media during the pandemic from the perspective of constitutional law. A qualitative descriptive approach was employed, with data collected through in-depth interviews, focus group discussions (FGDs), and legal document analysis. The study involved 15 informants, comprising legal experts, human rights activists, and social media users. Findings indicate that 60% of informants consider the restriction policies to be ambiguous and prone to misuse, while 40% support these policies for maintaining social stability. In this context, the Electronic Information and Transactions Law (UU ITE) serves as the primary legal basis for these policies. Yet, its implementation is often criticized for conflicting with democratic principles and human rights. The study also reveals that while the policies have successfully reduced the spread of false information, their impact on freedom of expression is significant, including the removal of critical content targeting the government. This study highlights the need for more transparent, fair, and evidence-based policies to balance public protection and respect for individual rights. Abstract

Protecting personal data has become increasingly critical in the digital era, especially in Indonesia, where data breaches remain a pressing issue. Blockchain technology has emerged as a potential solution due to its decentralization and enhanced security mechanisms. This study aims to analyze the legal aspects of implementing blockchain technology for personal data protection in Indonesia, focusing on its effectiveness and alignment with existing regulations. A qualitative methodology was employed, including case studies in the fintech and healthcare sectors, supported by normative legal analysis. The findings indicate that blockchain significantly improves data security, with companies reporting a notable decrease in data breaches after adoption. Mechanisms such as hashing and decentralization ensure data integrity and reduce unauthorized access. However, regulatory gaps and high implementation costs hinder widespread adoption. The Personal Data Protection Law (UU PDP) in Indonesia does not yet address the unique characteristics of blockchain, creating legal ambiguities. This study highlights the need for regulatory updates and suggests targeted incentives to encourage adoption. The research contributes to theoretical understanding by integrating legal analysis with blockchain implementation and offers practical recommendations for policymakers. Future studies should explore cross-sectoral applications and comparative analyses with countries successfully adopting blockchain.

Abstract

Restorative justice has gained attention as an alternative approach to resolving minor criminal cases, offering a rehabilitative and community-oriented process. In Indonesia, its implementation aims to reduce the judicial burden and promote offender reintegration. However, inconsistencies in application and its effectiveness in reducing recidivism remain concerns. This study evaluates the effectiveness of restorative justice in Indonesia by examining case resolution speed, victim satisfaction, and recidivism rates. Using a comparative study method with qualitative and quantitative approaches, data were collected from legal documents, case studies (2018–2023), and stakeholder interviews. The findings show that cases resolved through restorative justice increased from 500 in 2018 to 2,300 in 2023, reflecting broader adoption. Survey results indicate 70% of victims were satisfied with restorative justice outcomes, compared to 50% in conventional proceedings. The recidivism rate for offenders undergoing restorative justice was 40%, lower than 55% in conventional sentencing but still higher than the Netherlands (65%) and Canada (68%). This study highlights the importance of law enforcement support, victim participation, and community involvement in the success of restorative justice. Strengthening national policies is essential to ensure more consistent and effective implementation. These findings offer valuable insights for policymakers in enhancing restorative justice practices in Indonesia to build a more efficient and rehabilitative criminal justice system.

Abstract

The proliferation of deepfake technology, powered by artificial intelligence, presents a growing threat to digital democracy by enabling the spread of highly realistic manipulated content that can distort public perception, undermine trust, and disrupt electoral integrity. This study critically examines the urgency of establishing specific legal regulations for deepfake content in Indonesia, where existing cyber laws remain too general to address the nuances of AI-generated disinformation. Employing a qualitative normative-legal approach and comparative analysis with legal frameworks in the United States, South Korea, and the European Union, the research identifies a significant regulatory gap and offers a multidimensional framework that integrates legal, ethical, and democratic perspectives. The findings reveal that Indonesia lacks a clear definition and legal category for manipulated content, resulting in insufficient legal protections for individuals and institutions vulnerable to digital deception. The study proposes a context-sensitive model of regulation that aligns with international best practices and responds to Indonesia’s legal and sociopolitical realities. This research contributes to the discourse on digital law by offering a novel regulatory scheme capable of addressing the ethical and democratic challenges posed by deepfake technology.

Abstract

The rapid development of Artificial Intelligence (AI) technologies has significantly transformed digital content production, particularly through deepfake technology, which enables the creation of hyper-realistic audio-visual representations without consent. This phenomenon poses substantial threats to individual privacy and the integrity of digital identity, especially in legal systems that lack responsive regulatory frameworks. This study aims to analyze the extent to which the Indonesian legal system is equipped to protect individual privacy rights from deepfake threats and to examine regulatory models from other jurisdictions as comparative references. Employing a normative juridical approach combined with comparative legal analysis, the research reviews national laws, international regulations, academic literature, and case studies involving non-consensual synthetic content. The findings reveal that Indonesia lacks specific legal instruments addressing digital image and voice authorization. Although Law No. 27 of 2022 on Personal Data Protection and the Electronic Information and Transactions Law are in place, they do not explicitly cover digital identity manipulation. Indonesia's regulatory framework remains insufficient compared to regulations such as the European Union’s General Data Protection Regulation (GDPR) and AI Act, or the United Kingdom’s Online Safety Act. The study identifies five legal dimensions relevant to deepfake regulation, with three of them, including digital voice, image rights, and digital authorization, currently unregulated. This research contributes to the discourse on digital law by highlighting the urgency for regulatory reform and the recognition of digital identity as a protected legal right within Indonesia’s legal system.

Abstract

The development of the digital economy in Indonesia presents both opportunities and challenges that materially affect the effectiveness of legal protection for digital consumers. This study aims to examine the impact of digital consumer protection legislation on consumer trust and its subsequent effect on the growth of online economic transactions. A quantitative approach was employed, surveying 400 active digital consumers in Indonesia using an online survey, and analyzed using multiple linear regression. The results indicate that the effectiveness of laws, especially with respect to regulatory clarity and personal data protection, poses a significant positive influence on consumer trust. Thus, it can be argued that trust drives consumers' intentions to continue digital transactions, leading to the continuous, sustainable growth of the digital economy. At the heart of this research is the legal-and-consumer-behavior approach integrated into an empirical model, with primary focus on the under-researched topic in Indonesia. Practically, this result provides a good platform for consumer-facing policymakers who want to design adaptive regulations and nudge businesses into adopting compliance as a strategy in their efforts to build digital consumer loyalty.

Abstract

Dalam praktiknya terdapat ketimpangan atau diskriminasi dalam penerapan tindak pidana, yaitu tidak semua pecandu atau korban penyalahgunaan narkotika tidak mendapat saksi atas tindakan berupa rehabilitasi medis dan sanksi. Penelitian ini merupakan penelitian deskriptif analitis dan jenis penelitian dalam penelitian ini adalah Hukum Normatif, dengan menganalisis data primer dan data sekunder secara kualitatif. Hasil penelitian menunjukkan bahwa pelaku tindak pidana narkotika yang dapat digolongkan sebagai pengedar narkotika adalah dengan kriteria sebagai berikut: (1) Pelaku pada saat ditangkap tertangkap basah oleh tim penyidik kepolisian atau penyidik Badan Narkotika Nasional (BNN), (2) terbukti memproduksi, mengimpor, mengekspor, atau mengedarkan narkotika golongan I tanpa hak atau melawan hukum (3) Terbukti mengedarkan, menawarkan untuk menjual, menjual, membeli, bertindak sebagai perantara dalam jual beli, menukar, menyerahkan atau menerima narkotika golongan I (4) Dalam hal penggunaan narkotika golongan I secara melawan hukum dan tanpa hak mengakibatkan orang lain meninggal dunia atau cacat tetap, (5) Terbukti memproduksi, mengimpor, mengekspor, atau mengedarkan narkotika golongan II tanpa hak. atau melawan hukum berupa tanaman yang beratnya 1 (satu) kilogram atau lebih (6) Terbukti mengedarkan, menawarkan untuk dijual, menjual, membeli, bertindak sebagai perantara dalam jual beli, menukar, menyerahkan atau menerima narkotika golongan II (7) Dalam hal penggunaan narkotika golongan II kepada orang lain secara melawan hukum dan tanpa hak yang mengakibatkan orang lain meninggal dunia atau cacat tetap, (8) Meminta, memberi atau menjanjikan sesuatu, memberi kesempatan, merekomendasikan, memberi fasilitas, memaksa dengan ancaman, pemaksaan dengan kekerasan, penipuan, atau membujuk anak yang belum cukup umur untuk melakukan tindak pidana.
