Abstract

The enactment of Law Number 30 of 2014 on Government Administration had given the changes to the authority of the State Administrative Court. There are two mechanism of the case investigation in the State Administrative Court in providing legal protection against a lawsuit or petition filed by the public. The first mechanism is to file a lawsuit directly to the State Administrative Court. The second mechanism is to resolve internal disputes within the government before filing a lawsuit to the Administrative Courts. There are two mechanisms of the case investigation prove that the existence of discrimination for people who seek justice in the case investigation system in the State Administrative Court. This research focus on an issues first the nature of public legal action by the government in government administration and second Ratio legis non-judicial legal protection against public legal acts  by the government. The results which have to be achieved are to provide the prescription of essential truth. There are several problems approach used in this study, such as statute approach, conceptual approach, and case approach.

Abstract

Dalam Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah  disebutkan bahwa œDesa dapat mendirikan badan usaha milik desa sesuai dengan kebutuhan dan potensi desa. Substansi UU ini menegaskan tentang janji pemenuhan permintaan dalam konteks pembangunan tingkat desa. Logika pendirian BUMDes didasarkan pada kebutuhan dan potensi desa, sebagai upaya peningkatan kesejahteraan masyarakat. Disisi lain sesuai dengan asas negara hukum yaitu bahwa segala tindakan pemerintahan harus berdasarkan atas hukum, maka dalam konteks pemerintahan desa, berdasarkan Undang-Undang Nomor 6 Tahun 2014, disebutkan bahwa Kepala Desa bersama-sama BPD dapat membentuk Peraturan Desa. Permasalahan yang sering muncul yaitu bahwa tidak semua Kepala Desa maupun BPD memiliki kompetensi atau kemampuan dalam penyusunan peraturan perundang-undangan (khususnya Peraturan Desa), termasuk di wilayah Desa Gondanglor Kabupaten Lamongan. Padahal Peraturan Desa merupakan dasar legalitas bagi setiap tindakan pemerintahan desa, termasuk manakala Pemerintah Desa ingin membentuk suatu BUMDes. Berdasarkan studi awal di lapangan dimana belum ada Peraturan Desa tentang BUMDes di wilayah mitra, maka menjadi penting untuk dilakukan pendampingan hukum berupa penyusunan peraturan desa tentang BUMDes dalam rangka pemberdayaan ekonomi masyarakat desa.

Abstract

Upaya hukum keberatan dan banding ke Pengadilan Pajak merupakan bentuk perlindungan hukum preventip dan represip yang diberikan oleh Undang-Undang Nomor 16 Tahun 2009. Namun di masyarakat, khususnya di Desa Pohjejer Kecamatan Gondang Kabupaten Mojokerto, upaya hukum keberatan dan banding tersebut kurang dipahami dan dimengerti sehingga mereka hanya bisa berkeluh kesah manakala menerima surat ketetapan pajak yang dirasakan kurang adil. Berdasarkan studi awal di lapangan tersebut, maka perlu dilakukan pendampingan hukum dalam upaya hukum keberatan dan banding ke Pengadilan Pajak bagi masyarakat Desa Pohjejer Kecamatan Gondang Kabupaten Mojokerto dalam penyelesaian sengketa pajak.

Abstract

National development planning model with its long-term time dimension in Indonesia is carried out with the National Long-Term Development Plan (RPJPN) which replaces the Planned Overall National Development (PNSB) and the General Outlines of the Principles of the State (GBHN). Based on the analysis of the data obtained, it can be seen that since 2004 the use of the RPJN has turned out to cause fluctuating dynamics in the existing development outcomes. The occurred changes resulted in inconsistencies in the direction of development when there was a change of state development actors such as President, Governor, Regent/ Mayor, and other state institutions. The reason for this is that there is no permanent structure that can be used as a reference for a long-term development program that will be carried out by the managing state institutions, particularly the government. Based on this, the aim of this study was to create a form of reformulation of the principles of the state. This research was a normative research with a statutory, historical and conceptual approaches. To answer this problem, the idea of the state principles was born which departed from combining the advantages of PNSB, GBHN, and RPJPN which were then packaged into a new state principle system, with ideological principle and technocratic strategy.

Abstract

AbstractThis article try to analyze the concept of administrative effort and it implementation at the court. Enacted of Act Number 30 of 2014 on Government Administration leads the change of administrative court system in Indonesia. One of these change related to administrative effort. Legal issues in this article research is: first, do administrative effort must be taken before sues to administrative court; and second, whether original administrative decision or edministrative effort decision that used as an dispute object when apply a administrative lawsuit to administrative court. In accordance with the legal issues above, this article research is normative research to seek solutions to legal issues which are emerged. The results which have to be achieved are to provide the prescription of essential truth. There are several problems approach used in this study, such as statute approach and conceptual approach. Expected of this research can be found a norm that can be provides legal protection for the people especially in administrative dispute.  In Addition, this research trying to analize of legal protection principle over government action on public law and law enforcement of legal public act by government that could be pursued if there is any detrimental to society. Abstrak Artikel ini bertujuan untuk menganalisa konsep mengenai upaya administratif dan penerapannya di pengadilan. Berlakunya Undang-Undang Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan membawa perubahan dalam sistem peradilan tata usaha negara di Indonesia. Salah satu perubahan tersebut berkaitan dengan upaya administratif. Isu hukum dalam penelitian artikel ini pertama apakah upaya administratif harus ditempuh terlebih dahulu sebelum mengajukan gugatan sengketa tata usaha negara ke PTUN; dan kedua apakah keputusan tata usaha negara awal atau keputusan upaya administratif yang dijadikan obyek sengketa apabila mengajukan gugatan di Peradilan Tata Usaha Negara. Sesuai dengan isu hukum di atas, maka penulisan artikel ini menggunakan metode penelitian yuridis normatif untuk mencari pemecahan atas isu hukum yang timbul. Hasil yang hendak dicapai adalah memberikan preskripsi tentang kebenaran yang hakiki. Diharapkan dari penelitian ini didapatkan formulasi norma yang dapat memberikan perlindungan hukum bagi rakyat khususnya dalam hal sengketa tata usaha Negara dan menganalisis tentang hakikat dari  perbuatan hukum publik oleh pemerintah dan penegakan hukum terhadap perbuatan pemerintah dalam hukum publik yang merugikan masyarakat.

Abstract

Abstrak Asas-Asas Umum Pemerintahan yang Baik saat ini menjadi salah satu dasar penilaian bagi hakim di Peradilan Tata Usaha Negara untuk menguji suatu tindak pemerintah tersebut mengandung unsur kerugian bagi masyarakat atau tidak. Adanya UU 30 Tahun 2014 tentang Administrasi Pemerintahan telah memperluas kompetensi Peradilan Tata Usaha negara dimana obyek gugatan dalam PTUN tidak hanya KTUN (beschikking) akan tetapi juga tindakan faktual dari pejabat atau badan tata usaha negara. Dengan adanya perubahan UU No. 5 Tahun 1986 tentang Peradilan Tata Usaha Negara yaitu UU No. 9 Tahun 2004 dan UU No. 51 Tahun 2009 mempertegas keberadaan Asas-Asas Umum Pemerintahan yang Baik sebagai alasan menggugat di PTUN. Tidak bisa dipungkiri saat ini konsep hukum Islam banyak dipakai dan diterapkan dalam tindakan-tindakan hukum, baik dalam ranah hukum bisnis atau privat maupun hukum publik. Oleh karena itu maka konsep pemerintahan yang baik menurut Islam perlu dikaji secara mendalam, sering disebut dengan konsep fiqh siyasah. Penelitian ini ditujukan untuk meneliti perbandingan antara konsep Asas-Asas Umum Pemerintahan yang Baik di satu sisi dengan konsep fiqh siyasah di sisi yang lain. Abstract The General Principles of Good Government are currently one of the assessment bases for the judges in the Administrative Court to examine whether or not actions of the government contains the elements of harm for the community. The existence of Law No.30 of 2014 on Government Administration has expanded the competence of The Administrative Court (PTUN) in which the object of lawsuit in the Administrative Court is not only the Decisions of Administrative (beschikking) but also factual action from official or administrative institutions. With the amendment of Law No.5 of 1986 on the Administrative Court namely Law No. 9 of 2004 and Law No.51 of 2009 affirms the existence of The General Principles of Good Government as one of reasons to sue in the Administrative Court. It is inevitable today that the concept of Islamic law is widely used and applied in legal actions, whether in the realm of business law, private law or public law. Therefore, the concept of good government according to Islam needs to be studied further, often referred to as the concept of fiqh siyasah. This study is aimed to examine the comparison between the concept of The General Principles of Good Government with the concept of fiqh siyasah.

Abstract

Licensing is a spirit of administrative law that studies law in a moving state. Licensing is required for the running of a government, both central government and regional government. Based on the principle of decentralization, regional governments are allowed to regulate their own areas and for this reason permits are issued by the regional government. In practice, there is a lot of overlapping and overlapping regarding licensing between the central government and regional governments both in terms of substance and technical implementation in each existing Regional Work Unit (SKPD), the enactment of Law Number 6 of 2023 concerning the Determination of Replacement Government Regulations Law Number 2 of 2022 concerning Job Creation Becomes a Law changing the licensing constellation in Indonesia. In the area licensing is attempted to be carried out through a service system implemented by Online Single Submission (OSS) and One Stop Integrated Service (PTSPP), both of which must be integrated with OSS. Licensing services in areas that are integrated with or PTSP are the focus of this research study. This research is normative legal research that uses a statutory approach and a conceptual approach that will be used to answer existing legal issues.

Abstract

The existence of regional autonomy in Indonesia is implemented through regional leaders who have the authority to run local government. When carrying out their duties, regional leaders are supervised by other state institutions as a form of checks and balances in government power. Hence, the procedure to dismiss regional leaders regulates to involve the Regional People's Representative Assembly, the Supreme Court, and the President through the Minister of Home Affairs as a form of right to dismiss. However, the existence of the proportionality principle in the procedure to dismiss regional leaders, through the right given to regional leaders to defend themselves, has yet to be regulated in the law. This article talks about two things: first, the procedure to dismiss regional leaders, and second, the legal consequences and the position of a chance to summon regional leaders to explain and defend themselves in the procedure to dismiss regional leaders. This article aims to find the importance of proportionality principles in the procedure to dismiss regional leaders. The method used in this article is legal research, with statutes, conceptual, and case approaches. The results of this research show that although the procedure to dismiss regional leaders has been regulated in law, applying the proportionality principle only exists in jurisprudences. Hence, an ius constituendum is needed to determine legal consequences and certainty regarding the procedure to dismiss regional leaders.

Abstract

In the era of the industrial revolution 4.0 which caused the information to be easily spread, it turned out to have a bad impact, which led to the birth of the post-truth era. The post-truth era is an era in which objective facts become blurred because of broad public opinion. This makes it easy to spread hooks and expressions of hatred in society. The high perpetrators of hoax distribution and expressions of hatred make a legal solution needed that not only focuses on the deterrent effect for the perpetrators but the recovery of the community in its original condition. To restore the community's condition to its original condition, a restorative justice approach is used, one of which is through mediation by the police. This article will discuss, firstly related to the concept of mediation of penalties by the police in Indonesia and secondly it will discuss the approach of mediation of penalties by the Indonesian police in the handling of criminal acts of hate speech in electronicmedia. This article is a legal article that uses a statute approach, conceptual approach, and case approach. Based on the analysis in this article, it was found first the police nowdasy have an authority to solve the problem with restorative justice secondly that the first approach that pollice need to use in handling hate speech is by mediating in order to realize restorative justice by police agencies in Indonesia.
