Abstract

BUMD (Badan Usaha Milik Daerah) memiliki peran yang sangat penting dalam pembangunan daerah. BUMD memiliki kedudukan yang strategis terhadap PAD (Pendapatan Asli Daerah) yang mana dengan adanya PAD dapat membantu dan mempercepat pembangunan ekonomi di daerah. Dari sektor BUMD harus terus mengupayakan agar mengalami peningkatan pendapatan, sebab setoran dari BUMD tersebut menjadi salah satu bagian penyumbang PAD Jawa Timur. Oleh karena itu, diperlukan peningkatan kinerja pegawai di BUMD Jawa Timur. Penelitian ini bertujuan untuk mengetahui upaya pengembangan kinerja BUMD Provinsi Jawa Timur, Mengetahui kinerja pegawai BUMD Provinsi Jawa Timur, dan Menciptakan strategi pengembangan AMO dalam meningkatkan kinerja BUMD Provinsi Jawa Timur. Jenis penelitian ini adalah deskriptif kualitatif dengan fokus penelitian Untuk melihat problematik ini dalam perspektif teori AMO (Ability, Motivation, Opportunity), dan untuk memahami dan mengungkap cara pengembangan kinerja BUMD serta peningkatan kinerja pegawai BUMD di Jawa Timur. Teknik analisis data yang akan digunakan dalam penelitian ini adalah Interaktive model. Hasil penelitian menunjukkan bahwa peran strategis Badan Usaha Milik Daerah (BUMD) yang dituntut semakin profesional dalam peningkatan pelayanan dan peningkatan kontribusi pendapatan daerah. Dengan meningkatkan kinerja melalui evaluasi kinerja dengan AMO (Ability, Motivation, Opportunity).

Abstract

Unversitas merupakan “habitat” dari “spesies” yang unik dengan kualifikasi terpelajar. Kampus tampil sebagai institusionalitas manajemen universitas. Ruas-ruas administratif diciptakan dengan wadah birokratik. Kampus mustinya mampu menguraiartikan dan mengartikulasikan “suara kampung” secara keilmuan. Kekuatan penalaran dan moral adalah identitas tunggal. Otokam harus diancangkan untuk mencapai “pendidikan kritis yang membebaskan.” Semua instrumen kelembagaan “ide universitas” ditambatkan pada titik yang sama: “Pelayanan dan pemberkatan atas lahirnya bayi-bayi unggul.” Dinamika perceraian sain dan filsafat, lengsernya rezim Newton, serta inovasi paradigmatik yang dewasa ini menghiasi belantara ilmu, adalah momentum tepat untuk merekonstruksi otokam. “Hukum bukanlah kosmos kaidah yang otonom”. Hukum ada dalam lilitan kompleksitas “warna”. Ia bukanlah “pelangi” yang atraktif. Hukum adalah suara norma dan realita, gemilang aturan dan fakta. Hukum itu normatif, sekaligus empiris. Penglihatan ini akan mampu mengkonstalasi dan mengkonstatir hukum tidak sekedar “adonan firman normatif”, tetapi juga manifestasi “totalitas fenomena empiris” yang eksis dalam entitas sosial. Pencampakan hukum dari salah satu “nuansa” (normatif saja atau empiris saja) adalah tonggak datangya malapetakan hukum. Pandangan arogan-segmental tentang hukum jelas “mendegradasi hukum” dan menjadikan hukum mengalami derita “beban sejarah” dalam lorong sains global. Kita tidak hendak mau mendendangkan “lonceng kematian hukum” atawa bergaya “kacamata kuda” bukan? Mari mempelajari hukum dalam “khazanah dan mozaik” norma dan fakta. Kalau otokam tidak “berwisata” ke sana, mari kita gelar sendiri kenduri kolosal otonomi berkarya di kantin sebelah.

Abstract

The Brantas River, which is a national strategic area, is currently experiencing pollution. The massive pollution of the Brantas River and causing its water quality to decline is a problem that must be taken seriously. The worrying quality of the Brantas River shows the performance of the Indonesian government at the central, provincial, and district/city levels in managing river quality. Although there has been a Supreme Court decision regarding the pollution of the Brantas River, the government does not yet have a comprehensive plan and serious political will to restore the polluted Brantas River. This paper aims to analyze the enforcement of environmental administrative law through monitoring instruments as the implications of a lawsuit for pollution of the Brantas River based on the Supreme Court of the Republic of Indonesia Decision No. 08/Pdt.G/2019/PNSb. Based on the results of the analysis, it is necessary to take concrete actions from executive institutions and the community so that the pollution of the Brantas River is immediately resolved and does not recur in the future and so that the water quality can improve better.

Abstract

Abstract— The electronics industry has been a key driver of economic growth and employment in many developing countries, including Indonesia. Participating in global electronics supply chains can  have  several  benefits,  including  the  growth  of  domestic  industries  as  competitors  and suppliers, and increasing exports.  This study uses a normative legal research method with the statutory approach, conceptual approach, and case approach. Based on the digital supply chain in Indonesian society and industry for implementing DSCM in Indonesia, namely, First, it does not violate the principle of direct, general, free, confidential, honest, and fair. Abstract

International treaties in the field of protection of atmosphere and trans-boundary air pollution that qualified as ‘soft law’ and ‘hard law’ legal document has developed since 1919 until at present. From the Study on the International treaties, it can be known that the global community has strong commitment to the problem of protection of atmosphere and trans-boundary air pollution. Unfortunately, it can be concluded, that those international treaties is so fragmented and therefore, is difficult to be implemented comparing with instrument of international environmental law in general.Keyword: international treaties, protection of atmosphere, transboundary air pollution

Abstract

The functional meaning of environmental license in order to manage environment can be seen on the precision or exactness of fulfillment of conditions of environmental license which administratively is relevant for environmental protection. The conditions, that must be met to hold environmental license, have important meaning to evaluate environmental management conducted by corporation. Conditions of environmental license as inserted in document of license are direction that must be followed by the holder of license. Government institutions which have competence to give license should formulate all aspects of operation of industrial activity in the form environmental license.Keywords: environmental licence, environmental protection, environmental management.

Abstract

Nowadays, The Institutional of environmental in regional experinced many changes, its cause of stipulated of Law No. 23 of 2014 on Local Government and Government Act No. 18 of 2016 on Local Government Organization. Rule about central government authority and local government authority on environment aspect that ruled by Act No. 32 of 2009 on Protection and Management of Environment must be adjusted with Act No. 23 of 2014 on Local Government and Government Act No. 18 of 2016 on Local Government Organization. This research analyze about institutional harmonization on statute approaches. It is expected that this research give a knowledge of affairs which central government authority, province government authority, and district/regency government authority clearly especially on environment aspect. The minister of environment and forestry in order to implementing coordinative function, should be obliged to synchronize working program of environment institution between local and central government for making integrated environment management (policy) approaches.

Abstract

Dynamic of commitment of International Community in the issue of control upon global warming has been developed since 1919 up to present. From available list of international treaties, it can be seen how strong the commitment of global community in the issues of environment, global warming as well as climate change. Unfortunately, it can be concluded, that those international treaties is so fragmented and therefore, is difficult to be implemented comparing with instrument of international environmental law in general. However, political will of national state is the essence to create international agenda. It is because olitical will of the state national is the core to make international agenda .It was because good reasons of a government can bring a good thing for the country and its people , especially again in control global warming So that in this case the state also has a role in realizing environmental sustainability for its people, it is also indirectly a part of the obligation of the state to maintain the stability and survival of the people and the preservation of natural resources in the country, for the welfare and prosperity of all the people .
