Abstract

Terhadap debitur yang wanprestasi, kreditur memiliki hak untuk menuntut kompensasi atas kerugian yang diderita. Kajian perbandingan hukum pengaturan ganti rugi akibat wanprestasi dengan civil code of the Netherlands merupakan hal penting mengingat pengaturan yang berlaku bagi wanprestasi dalam perjanjian di Indonesia sampai saat ini masih mendasarkan civil code Belanda yang pertama kali diberlakukan di Hindia Belanda tahun 1848 sedangkan Belanda telah memiliki civil code baru yang diundangkan pada 1 Januari 1992. Kajian dibatasi pada hak pihak yang menderita kerugian untuk menuntut kompensasi akibat wanprestasi pihak lain. Objek perbandingan hukum ini adalah lembaga hukum, hakikatnya merupakan perbandingan hukum legislasi, sifat perbandingannya horizontal, tujuannya adalah applied comparative. Bahan hukum primer dan sekunder didapatkan dengan cara studi dokumen, pengolahan data dilakukan secara kualitatif dan disimpulkan melalui metoda perbandingan hukum. Berdasarkan hasil kajian perbandingan hukum, diberikan beberapa rekomendasi bagi pembaharuan ketentuan wanprestasi, yaitu berkenaan dengan specific performance, kewajiban kreditur menyatakan kompensasi yang dikehendakinya, konversi kewajiban yang tidak dilaksanakan menjadi kewajiban mengganti sejumlah uang, hak kreditur menunda pelaksanaan prestasi, batasan hak membatalkan perjanjian, serta kewajiban debitur untuk memastikan bahwa setelah pemutusan kontrak dia mampu mengembalikan apa yang telah diterima. Abstract

An agreement creates an obligation, which is a legal relationship between the parties. If one party fails to fulfill its duties to the other party as promised, it is considered a breach of contract by one party against the other. One of the external factors that disrupt contract execution is a disruption event. In contrast to the concepts of force majeure and hardship, which have been acknowledged in Indonesian law, the argument of disruption events has not been recognized, even in the context of legal literature. However, in certain contracts with extended durations, the concept of disruption event has been incorporated into the creation of an accidental provision. This accidental provision is intended to address unforeseen events that may impair the contract's implementation. Given the importance of regulating disruption events in the agreement clause to anticipate the legal consequences that arise if an event occurs that disrupts the implementation of the contract, this research raises two issues: 1) What is the nature or essence of a disruption event? and 2) How is the formulation of an anticipatory disruption event clause in the contract? As a result of the research, it can be concluded that a disruption event is an unpredictable event that significantly impacts the industry and business. 2) A disruption event clause must at least contain information about the following: the definition of a disruption event, the scope or limits of a disruption event, the obligation to notify the affected party of a disruption event, the legal effects of a disruption event on contractual obligations and on the relationship between contractors, and the possibility of negotiation.

Abstract

Informed consent is a fundamental component of modern medical practice that emphasizes the importance of a patient’s approval after receiving clear, adequate, and understandable information regarding a medical procedure. This concept reflects not only respect for patient autonomy but also serves as a legal safeguard for healthcare professionals in the performance of their duties. In Indonesia, the regulation of informed consent has undergone notable development. Ministerial regulations, the Medical Code of Ethics, and Law No. 17 of 2023 on Health provide the normative foundation that affirms patients’ rights to obtain sufficient information and to give conscious consent before any medical intervention. This study applies a normative juridical method with a statutory and conceptual approach. The findings reveal that the latest legal framework reinforces documentation obligations and clarifies the standards that must be fulfilled by medical practitioners, including in emergency situations. Nevertheless, practical implementation remains challenged by several factors, such as patients’ limited comprehension, the use of complex medical terminology, time constraints faced by healthcare providers, and the suboptimal practice of written documentation. These challenges create potential legal disputes, both in civil and criminal domains, when medical procedures are carried out without valid consent. Therefore, the effective application of informed consent requires synergy between clear regulations, adequate understanding among medical personnel, and improved health literacy among the public. Consequently, informed consent should not be seen merely as an administrative formality but rather as an essential legal and ethical safeguard that enhances the quality of healthcare services.

Abstract

Penelitian ini bertujuan untuk menganalisis efektivitas perlindungan hukum terhadap investor pasar modal berdasarkan perspektif law and economics. Penelitian ini menggunakan metode hukum normatif yang diperkaya dengan pendekatan empiris, perundang-undangan, konseptual, kasus, dan perbandingan. Sumber data diperoleh dari data primer dan sekunder. Teknik pengumpulan data dilakukan melalui studi kepustakaan, wawancara, dan studi dokumen. Hasil penelitian menunjukkan bahwa kerangka regulasi pasar modal di Indonesia telah memadai secara normatif melalui Undang-Undang Nomor 8 Tahun 1995 dan peraturan OJK serta BEI. Namun, efektivitas perlindungan hukum terhadap investor belum optimal karena lemahnya implementasi dan pengawasan, sehingga menimbulkan asimetri informasi dan tingginya transaction cost yang merugikan investor. Perlindungan preventif seperti keterbukaan informasi dan literasi keuangan belum berjalan maksimal, sementara perlindungan represif melalui sanksi belum memberikan efek jera. Maka diperlukan upaya perbaikan melalui penguatan pengawasan, peningkatan literasi keuangan, reformasi mekanisme penyelesaian sengketa, transparansi informasi, dan pemberian insentif positif bagi perusahaan patuh guna menciptakan pasar modal yang sehat, efisien, dan terpercaya.

Abstract

According to Indonesian law, monogamy is the foundation of marriage, although this principle is not unbreakable but rather flexible. Marriage law sets forth strong guidelines and requirements for polygamous marriages in order to prevent violations of and injury to wives' rights and to generally safeguard women. This study compares the polygamy provisions based on Egyptian and Indonesian law to examine the polygamy issue. The research is normative, using secondary data, qualitative analysis, and deductive conclusion. Research findings: Indonesian law regarding polygamous marriages is more comprehensive and complex than Egyptian law. Here some characteristics of polygamous marriages: the husband asks permission to engage in polygamy from the court; there is an obligation of notification and permission from the first wife; a reason to practice polygamy; sanctions for parties who violate the provisions on polygamy. In conclusion, Muh.Irham's decision was proven to have abandoned Nurdiana because she remarried secretly and according to Article 45 (1) PP No.9 1975 Muh.Irham was threatened with a fine of Rp.7500. Meanwhile, Big Ramy was proven to have committed polygamy secretly and according to Article 23 Bis Law 100 of 1985 was threatened with imprisonment for 6 months and a fine of 200 (Two Hundred) Pounds.

Abstract

Bubarnya perkawinan akibat perceraian mempengaruhi status hukum dan menimbulkan akibat hukum. Salah satu akibat hukum yang timbul dari perceraian adalah hak asuh terhadap anak. (1) Bagaimana persamaan dan perbedaan pengaturan tentang alasan perceraian dan akibatnya terhadap hak asuh anak di Indonesia dengan Turki? (2) Bagaimana persamaan dan perbedaan ketentuan perceraian dan penyelesaian kasus tentang perceraian dengan alasan perzinahan dalam Putusan Nomor XXX/Pdt.G/2021/PN/Bjw berdasarkan Undang-Undang Perkawinan Indonesia dan putusan Hukuk Dairesi 2021/3939 E., 2021/5197 K.  berdasarkan Türk Medeni Kanunu Turkish Family Law of Cyprus tahun 1951? Penelitian hukum normatif ini sifatnya deskriptif, dilakukan melalui metode perbandingan hukum. Menggunakan data sekunder, dianalisis secara kualitatif, disimpulkan dengan metoda deduktif. Hasil penelitian: putusnya perkawinan karena perceraian menurut hukum Indonesia dan Turki sama-sama harus melalui pengadilan; ada kesamaan alasan perceraian, yaitu perzinahan, penganiayaan, kejahatan dan tidak adanya harapan rukun kembali. Ada perbedaan tenggang waktu untuk alasan perceraian karena meninggalkan pihak lain. Ke dua negara sama-sama menetapkan hak asuh anak setelah perceraian ke dua negara berada pada ayah dan ibu, dan ayah berkewajiban memberikan nafkah bagi isteri. Dengan perbedaan, di Turki kewajiban memberikan tunjangan kepada istri didasarkan pertimbangan setelah perceraian, maka istri akan menjadi lebih miskin

Abstract

This study examines the separation of marital property after divorce between mixed married couples. It compares Indonesian and Dutch laws on the division of matrimonial property upon divorce, focusing the case of Henk Willem van Der Spil (a Dutch citizen) and Dyah Supriyantini (an Indonesian citizen). The study shows how the two legal systems are alike and different The research type is normative and descriptive, utilizing secondary data, qualitative analysis, and a comparative legal approach with deductive conclusions. The findings display similarities: 1) Research considers the division of shared belongings among couples in mixed marriages according to the HPI factors; 2) Both the Indonesian and Dutch HPI designate Indonesian law as applicable. The variations include: 1) Under Indonesian law, land and buildings are not counted as community property, whereas Dutch law regards them as such and divides them equally. 2) Indonesian law excludes the income of the Tulips Hotel and Resto from community property, while Dutch law includes it. 3) The Dutch law recognizes "divorce covenant," a concept that is not present in Indonesian law. Recommendations: to achieve fairness, judges should. consider international civil law and foreign law aspects when dividing property in joint ownership between mixed marriage couples.

Abstract

International marriage is a marriage between two parties with different nationalities. As every country has its own civil law that regulates marriage, international marriage involves aspects of international civil law. This study raises two key issues: first, the determination of applicable laws related the material and formal conditions of marriage; and second, the citizenship of spouses as well as children in an international marriage. The discussionadopts a comparative perspective, focusing on Indonesian and Japanese legal systems.   This study employs normative legal research, utilizing a statutory and comparative approach, analyzing primary, secondary, and tertiary legal materials through qualitative methods and inductive conclusions. Results of the study indicate conceptual similarities between Indonesian and Japanese law in the area under study. First, material conditions of international/mixed marriage are determined based on the principle of lex patriae, while formal conditions are based on the lex loci celebration. principle Second, international marriage does not cause the spouses to automatically lose their own or obtain the citizenship of their spouse but can only obtain the citizenship of their spouse through a naturalization application. Children born in international marriages obtain citizenship based on the principle of ius sanguinis, and if this leads to dual citizenship, within a certain period of time the child must choose one of the nationalities. The existing literature concerning international marriage indicates that there is a gap of research with comparative approach between Indonesian and Japanese law. Thus, in addition to enriching the study of law related to international marriage, the results of this study can be used as educational materials for the Indonesian diaspora in Japan and vice versa.
