Abstract

Bali, as a premier tourist destination, has led to a high population density in Denpasar, increasing the risk of criminal activities, particularly motor vehicle theft (curanmor) in the West Denpasar jurisdiction. Effective policing efforts, including the implementation of the Integrated Security System Based on Traditional Villages (Sipandu Beradat), are needed to address this issue. However, due to the persistently high number of curanmor cases in the past three years, it is necessary to study the implementation and factors influencing the optimization of Sipandu Beradat. This study employs theories of cooperation, the Sipandu Beradat concept, policing science, management theory, crime prevention theory, and optimization concepts. The research is conducted using a qualitative method with a descriptive-analytical approach, involving interviews, observations, and document studies. Data analysis techniques include data reduction and data triangulation. The findings indicate that the Sipandu Beradat Forum has undertaken several efforts to prevent motor vehicle theft, such as joint patrols, socialization, inter-element communication, and regulation of incoming residents. However, these efforts have not been maximized due to several internal factors, including the lack of government-allocated funding and human resource constraints, as well as external factors such as environmental conditions and public vigilance. To optimize these efforts, it is necessary to secure funding, enhance personnel quality, and organize tasks and responsibilities more effectively. The conclusion of this study.

Abstract

The principle of constitutional supremacy serves as a foundational cornerstone within Indonesia’s legal and governmental framework, positioning the 1945 Constitution of the Republic of Indonesia (UUD NRI 1945) as the highest authority in the hierarchy of legislation. This supremacy is not merely symbolic; it acts as a fundamental norm (grundnorm) that should guide both the legislative process and the execution of state power. This article explores how the principle of constitutional supremacy is applied in the enforcement of law in Indonesia, while also highlighting the normative and structural challenges that hinder consistent constitutional adherence. Utilizing a normative juridical approach, this study analyzes statutory regulations, Constitutional Court rulings, and observes state practices. The findings reveal that despite the Constitutional Court’s significant role in safeguarding constitutional integrity through judicial review, implementation at the practical level often suffers from regulatory inconsistencies, non-compliance with constitutional rulings, and limited constitutional understanding among law enforcers and lawmakers. To address these issues, institutional strengthening, legislative reform, and widespread constitutional education are imperative to ensure all state actions and policies are in harmony with the principle of constitutional supremacy.

Abstract

Abstract

Informed consent is a fundamental component of modern medical practice that emphasizes the importance of a patient’s approval after receiving clear, adequate, and understandable information regarding a medical procedure. This concept reflects not only respect for patient autonomy but also serves as a legal safeguard for healthcare professionals in the performance of their duties. In Indonesia, the regulation of informed consent has undergone notable development. Ministerial regulations, the Medical Code of Ethics, and Law No. 17 of 2023 on Health provide the normative foundation that affirms patients’ rights to obtain sufficient information and to give conscious consent before any medical intervention. This study applies a normative juridical method with a statutory and conceptual approach. The findings reveal that the latest legal framework reinforces documentation obligations and clarifies the standards that must be fulfilled by medical practitioners, including in emergency situations. Nevertheless, practical implementation remains challenged by several factors, such as patients’ limited comprehension, the use of complex medical terminology, time constraints faced by healthcare providers, and the suboptimal practice of written documentation. These challenges create potential legal disputes, both in civil and criminal domains, when medical procedures are carried out without valid consent. Therefore, the effective application of informed consent requires synergy between clear regulations, adequate understanding among medical personnel, and improved health literacy among the public. Consequently, informed consent should not be seen merely as an administrative formality but rather as an essential legal and ethical safeguard that enhances the quality of healthcare services.
