Abstract

Sistem pemidanaan penjara di Indonesia saat ini menghadapi sejumlah tantangan signifikan, termasuk overkapasitas lembaga pemasyarakatan (lapas), stigma sosial terhadap narapidana, dan tingginya tingkat residivisme. Meskipun rehabilitasi dianggap sebagai tujuan penting dari pemidanaan, program pembinaan yang ada saat ini belum sepenuhnya berhasil mencapai tujuan tersebut. Kurangnya kualitas program rehabilitasi, ditambah dengan ketidakmampuan sistem pemasyarakatan dalam menyelesaikan masalah sosial dan ekonomi yang melatarbelakangi perilaku kriminal, membuat alternatif pemidanaan semakin dibutuhkan. Oleh karena itu, reformasi sistem pemasyarakatan dengan memperkenalkan alternatif pemidanaan seperti restorative justice dan reintegrasi sosial menjadi kunci dalam menciptakan sistem pemidanaan yang lebih manusiawi dan efektif. Pemberdayaan mantan narapidana, pencegahan kriminalitas melalui pendidikan, serta pemberian peluang kerja bagi mantan narapidana perlu menjadi fokus utama dalam program pembinaan untuk mencegah kejahatan berulang dan memperbaiki kualitas hidup mereka setelah keluar dari penjara. Dalam konteks ini, peran kebijakan hukum dan reformasi pemidanaan yang memperkenalkan pendekatan yang lebih holistik sangat penting untuk mengatasi masalah yang ada dalam sistem pemasyarakatan di Indonesia.

Abstract

Perjanjiian jual beii merupakan salah satu bentuk kontrak yang mengikat antara penjual dan pembeli, yang diatur dalam Kitab Undang-Undang Hukum Perdata (KUH Perdata). Dalam perjanjian ini, terdapat hak dan kewajiban yang jelas bagi kedua belah pihak, di mana penjual berhak menerima pembayaran atas barang yang diserahkan, sementara pembeli berhak atas jaminan kepemilikan dan kualitas barang tersebut. Selain itu, risiko dalam jua! beIijuga diatur dengan ketentuan yang berbeda-beda bergantung pada jenis barang yang diperjualbelikan. Risiko pada barang tertentu, misalnya, dapat berpindah ke pembeli meskipun barang tersebut belum diserahkan, sesuai dengan Pasal 1460 KUH Perdata, meskipun ketentuan ini mengalami penyesuaian berdasarkan Surat Edaran Mahkamah Agung No. 3 Tahun 1963. Untuk barang tumpukan dan barang berdasarkan timbangan atau ukuran, risiko berpindah setelah barang tersebut dipisahkan atau diukur. Pengaturan ini bertujuan untuk memberikan kepastian hukum dan keadilan bagi kedua belah pihak dalam menjalankan perjanjian jual beli. Dengan demikian, Perjanjiian jual beii yang mengatur hak, kewajiban, dan risiko berfungsi untuk menciptakan transaksi yang adil, transparan, dan saling menguntungkan.

Abstract

Criminal law is a branch of law that regulates crimes and violations and the sanctions that can be imposed on perpetrators. A good understanding of criminal law is very important for society to be able to avoid acts that violate the law and understand their rights and obligations as citizens. Criminal law is a collection of rules that determine what actions are prohibited and subject to criminal sanctions. Actions that are categorized as criminal acts can include crimes and violations. Regarding this matter, it is deemed necessary by the Rotnama Village Government, Mdonahiera District, Southwest Maluku Regency to schedule it as a form of cooperation in implementing service to the Rotnama Village Community through socialization with the theme "Bacarita with the Rotnama Village Community" which in principle provides legal understanding and builds legal awareness to Rotnama Village community regarding various legal problems that occur and forms of resolution. The implementation of community service activities is carried out by the Lecturer Team at the request of the Head of Rotnama Village to collaborate in implementing community service activities for the Rotnama Village Community in order to provide an understanding of criminal law which is very important for every member of the community. By understanding criminal law, people can contribute to creating a safe and orderly environment and ensure that their rights are protected by law

Abstract

This community service activity aims to enhance the understanding and capacity of the Village Governments and Village Consultative Bodies (BPD) of Wonreli, Abusur, Lebelau, and Oirata in the process of formulating Village Regulations (Peraturan Desa or Perdes) that are aligned with legal principles and applicable statutory provisions. The socialization was motivated by the generally low level of understanding regarding both the procedures and substance of Perdes formulation, which has led to weak regulatory quality at the village level. The methods employed in this activity included lectures, interactive discussions, and simulations of Perdes drafting, all of which referred to Law Number 12 of 2011 on the Formation of Legislation. The results of the activity indicated a significant increase in legal awareness and participants’ understanding of the importance of legality, participation, and transparency in the village legislative process. This activity also succeeded in encouraging local initiatives to formulate village regulations that are more responsive, accountable, and tailored to the real needs of the local community. Therefore, this socialization made a tangible contribution to strengthening democratic and law-based village governance.

Abstract

Informed consent is a fundamental component of modern medical practice that emphasizes the importance of a patient’s approval after receiving clear, adequate, and understandable information regarding a medical procedure. This concept reflects not only respect for patient autonomy but also serves as a legal safeguard for healthcare professionals in the performance of their duties. In Indonesia, the regulation of informed consent has undergone notable development. Ministerial regulations, the Medical Code of Ethics, and Law No. 17 of 2023 on Health provide the normative foundation that affirms patients’ rights to obtain sufficient information and to give conscious consent before any medical intervention. This study applies a normative juridical method with a statutory and conceptual approach. The findings reveal that the latest legal framework reinforces documentation obligations and clarifies the standards that must be fulfilled by medical practitioners, including in emergency situations. Nevertheless, practical implementation remains challenged by several factors, such as patients’ limited comprehension, the use of complex medical terminology, time constraints faced by healthcare providers, and the suboptimal practice of written documentation. These challenges create potential legal disputes, both in civil and criminal domains, when medical procedures are carried out without valid consent. Therefore, the effective application of informed consent requires synergy between clear regulations, adequate understanding among medical personnel, and improved health literacy among the public. Consequently, informed consent should not be seen merely as an administrative formality but rather as an essential legal and ethical safeguard that enhances the quality of healthcare services.
