Abstract

Law Number 5 of 2018 on the Eradication of Terrorism Crimes provides the legal basis for the involvement of the Indonesian National Armed Forces (Tentara Nasional Indonesia/TNI) in counterterrorism efforts as a response to the escalating threat of terrorism. The expansion of TNI’s authority raises significant juridical concerns, particularly with regard to the principles of due process of law and the protection of human rights. This study employs a normative juridical method using statutory, doctrinal, and academic literature approaches relevant to criminal law policy and criminal justice policy. The findings indicate that TNI involvement through military operations other than war (MOOTW) has the potential to generate repressive actions that are inconsistent with the paradigm of criminal law enforcement. Such risks include the possibility of extrajudicial killings and violations of fundamental principles under the Indonesian Criminal Procedure Code, such as the presumption of innocence and the right to a fair trial. Therefore, the involvement of TNI in counterterrorism efforts should be limited, auxiliary to the Police, and implemented based on political decisions of the state while ensuring the protection of human rights and legal certainty.

Abstract

Abortion is a complex legal issue because it relates to medical, moral, religious, and human rights aspects. In Indonesian criminal law, the regulation of abortion crimes has changed with the enactment of Law Number 1 of 2023 concerning the Criminal Code (National Criminal Code), which replaced the Old Criminal Code in Law Number 1 of 1946. This study aims to compare the provisions of abortion crimes in both regulations. The research method used is normative legal research with a statutory and comparative approach, through a literature review of primary and secondary legal materials. The results show that the Old Criminal Code criminalizes abortion almost absolutely without providing exceptions for medical or humanitarian reasons. In contrast, the National Criminal Code adopts a more contextual approach by continuing to qualify abortion as a criminal act but providing exceptions for abortions carried out in accordance with statutory provisions. This change reflects a paradigm shift in criminal law toward protecting humanitarian values and substantive justice

Abstract

This study analyzes an acquittal in a case of premeditated murder committed jointly by multiple perpetrators, focusing on Supreme Court Decision Number 939 K/PID/2022. Premeditated murder, as regulated under Article 340 of the Indonesian Criminal Code (Law No. 1 of 1946), requires elements of intent and prior planning, and may be committed jointly through the mechanism of complicity (deelneming) as provided in Article 55 paragraph (1) of the Criminal Code. This study employs a normative legal research method using statutory, conceptual, and case approaches, with primary data derived from statutory regulations and secondary data derived from books, legal documents, and journals. The findings show that the majority of the panel of judges applied the defense of necessity (noodweer) based on the concept of a "continuing event" to justify the defendant's actions, despite facts indicating that the victims were already under the control of law enforcement officers and no longer armed, meaning the actual threat had ceased. This condition raises debate regarding the limits of applying the principles of proportionality and subsidiarity in the defense of necessity under Article 49 paragraph (1) of the Criminal Code. The study concludes that evidence constitutes a fundamental element in determining criminal liability, and that the dissenting opinion in the decision is considered to better reflect legal certainty, proportionality, and the protection of human rights compared to the majority judges' considerations.

Abstract

The enactment of the National Criminal Code through Law Number 1 of 2023 represents a fundamental reform in the Indonesian criminal law system. One of the crucial issues arising from this reform concerns the consistency of the existence of the principle of lex specialis derogat lex generalis in relation to special criminal laws that have developed outside the Criminal Code. This principle theoretically functions as a guideline for resolving normative conflicts between general criminal law provisions and special criminal law provisions. This study aims to analyze the consistency of the regulation and application of the lex specialis derogat lex generalis principle within the National Criminal Code and its implications for the applicability of special criminal laws. The research employs normative legal research using statutory and conceptual approaches. The findings indicate that although the National Criminal Code normatively positions itself as general criminal law (lex generalis), there are regulatory dynamics that may affect the application of the lex specialis principle, particularly in its relationship with special criminal legislation. Therefore, systematic interpretation and normative harmonization are required to ensure the consistent application of the lex specialis derogat lex generalis principle in the national criminal law system in order to guarantee legal certainty and effective law enforcement..

Abstract

Illegal fishing merupakan ancaman serius bagi kedaulatan dan keberlanjutan sumber daya perikanan di Indonesia. Penelitian ini bertujuan mengkaji pengaturan kebijakan hukum pidana terhadap tindak pidana illegal fishing berdasarkan Undang-Undang Perikanan, serta menganalisis efektivitasnya dalam menanggulangi praktik illegal fishing di perairan Indonesia. Metode yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual melalui studi kepustakaan yang dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa kebijakan hukum pidana telah tersusun secara sistematis melalui sanksi pidana berjenjang dan adanya tindakan penenggelaman kapal yang terbukti menekan aktivitas illegal fishing secara signifikan. Namun efektivitasnya belum sepenuhnya optimal akibat adanya tumpang tindih kewenangan antar lembaga, keterbatasan sarana pengawasan, dan kompleksitas pembuktian terutama terhadap kapal berbendera asing. Penelitian ini menyimpulkan bahwa penanggulangan illegal fishing memerlukan pendekatan terpadu yang memadukan kebijakan penal dan non penal, penguatan kelembagaan, serta kerja sama internasional yang efektif dan berkesinambungan.
