Abstract

This study aims to obtain similarities and differences regarding legal formulation in online prostitution. Hitherto, prostitution has remained to exist in Indonesian society. In context, the existing perpetrators of prostitution do not peddle conventionally but also virtually, in which online prostitution that gradually increases is a common term that refers to this phenomenon. The current law enforcement against perpetrators of online prostitution performs as the consequence of the national law in which national laws have yet remained to accommodate in criminalizing perpetrators of online prostitution. The criminalization of perpetrators in online prostitution may contrast with the principle of legality so that national laws should accommodate perpetrators of online prostitution regarding their criminal liability. In particular, these national laws should address whether to prohibit the attitude that proliferates online prostitution so that perpetrators of online prostitution should be accountable for their crimes. Henceforth, this measure intends to avoid the overlap of the principle of legality in criminal law. Keywords: Online Prostitution, Criminal Liabilities, Principle of Legality.

Abstract

Various attempts to accommodate a child's opinion in courts have proven successful, and this participation has been increasingly regarded as integral to children's rights. However, the issue remains problematic, particularly in the Global South countries like Indonesia. This paper examines the legal and regulatory framework of protecting children in Indonesia to comply with children's right to opinion and how this right is implemented. Then, it demonstrates the significant role of forensic science in complementing legal inquiry to consider a child's opinion in court. Using policy-oriented study and doctrinal research with qualitative analysis and, to some extent, a comparative perspective, this paper elaborates on Indonesia's experience in protecting children's right to opinion with legislation in India, particularly dealing with child sexual offences. This study shows that Indonesia's legal and regulatory framework of children protection had not specified to elucidate children's right to an opinion, particularly in the Child Protection Law, the primary legal basis for children protection. Also, Indonesia is yet to have a robust and consistent practice of human rights-based instruments considered in the court, indicated by a lack of comprehensive understanding in law enforcement to implement this right. While the interpretation in law enforcement is essential to be optimised toward child-oriented resolution, taking the child's opinion in court promotes human rights practice in Indonesia. Compared to adults, children are complex, particularly in a case of a child victim of rape-related pregnancy. The forensic approach can be an alternative by involving forensic experts in courts to consider a child's psychology and physical condition.Keywords: Children's Rights, Forensic Science, Indonesian Courts, Right to Opinion.

Abstract

The court does not always demand or require visum et repertum when examining homicide cases.  Forensic autopsy may not be required at all by the criminal court when deciding that the accused is guilty of homicide as charged. The verdict may be reached based on other evidence. The author, using a juridical normative approach, concludes that the absence or presence of a visum et repertum does influence the judge’ consideration and matters to the final verdict. Considering that, regardless of the surviving family’s consent, in cases of unnatural death, forensic autopsy and the making of a visum et repertum should be mandatory.

Abstract

The dynamics of genital reconstruction create disparities in the rights of transsexual individuals to form families and the legitimacy of marriage in Indonesia for transsexual individuals who lack clarity under the Marriage Law. The methodology employed is normative legal research, analyzing applicable regulations and religious perspectives. The discussion encompasses an explanation of the position of transsexual individuals following gender reassignment surgery, which impacts the legitimacy of marriage for transsexual individuals who have undergone genital reconstruction, in accordance with religious law and the Marriage Law, as well as the legal implications of the marriages conducted. The analysis indicates that the six officially recognized religions in Indonesia tend to reject the legitimacy of transsexual marriages, viewing them as same-sex unions that violate religious norms. The legal implications for transsexual individuals vary: for those without medical indications, marriages are considered same-sex; whereas for those who undergo surgery to affirm their gender, marriages may be deemed valid. The conclusion reveals a dissonance between legal frameworks and social norms, as well as challenges faced by transsexual individuals in accessing equal marriage rights.

Abstract

Roscoe Pound memberikan kontribusi penting dalam pengembangan sosiologi hukum melalui konsep law as a tool of social engineering. Pemikirannya menekankan bahwa hukum tidak hanya berfungsi sebagai aturan normatif, tetapi juga sebagai instrumen yang mampu mengatur dan menyeimbangkan kepentingan individu dalam masyarakat. Penelitian ini bertujuan untuk menganalisis pemikiran Pound serta implikasinya dalam sistem hukum kontemporer. Dengan menggunakan metode studi pustaka dan pendekatan normatif, penelitian ini mengkaji enam pedoman utama dalam ilmu hukum sosiologis yang dikembangkan oleh Pound, termasuk peran hukum dalam kontrol sosial dan efektivitasnya dalam penegakan hukum. Hasil penelitian menunjukkan bahwa hukum dapat berfungsi sebagai alat rekayasa sosial yang adaptif, dengan syarat adanya kebijakan hukum yang responsif terhadap perubahan sosial dan kebutuhan masyarakat. Implikasi dari kajian ini menegaskan bahwa hukum harus dirancang secara dinamis agar dapat menciptakan keseimbangan dan harmoni dalam mengelola konflik kepentingan individu, sehingga mampu mewujudkan keadilan sosial yang lebih inklusif.

Abstract

Penelitian ini mengkaji penerapan mediasi penal sebagai alternatif penyelesaian tindak pidana kecelakaan lalu lintas di Indonesia. Kecelakaan lalu lintas masih menjadi masalah serius yang membutuhkan solusi hukum efektif di luar proses peradilan konvensional. Mediasi penal yang berbasis prinsip keadilan restoratif menawarkan pendekatan yang lebih cepat, ekonomis, dan harmonis dengan melibatkan korban, pelaku, dan masyarakat dalam proses penyelesaian. Kajian ini menguraikan dasar hukum mediasi penal dalam sistem hukum Indonesia, termasuk diskresi kepolisian dan peraturan terkait, sekaligus menegaskan potensinya dalam mengurangi penumpukan perkara dan meningkatkan akses terhadap keadilan. Pembahasan diperkaya dengan perbandingan praktik di negara lain seperti Austria dan Jerman untuk mengusulkan model mediasi yang ideal—victim-offender mediation—bagi konteks Indonesia. Tantangan implementasi, termasuk belum adanya payung hukum formal dan kebutuhan perubahan paradigma penegak hukum, turut dianalisis. Temuan penelitian merekomendasikan mediasi penal sebagai mekanisme pelengkap peradilan pidana tradisional, khususnya untuk tindak pidana ringan, guna mencapai hasil pemulihan sekaligus menjaga kepastian hukum dan harmoni sosial.

Abstract

This paper aims to discuss the doctrine of res ipsa loquitur as an unlawful act in medical malpractice and its implications on the balance of protection for patients and medical personnel after the enactment of the Health Law. The urgency of this paper lies in examining the applicability of the res ipsa loquitur doctrine in relation to Articles 310 and 440 of the Health Law. The application of the res ipsa loquitur doctrine in proving medical malpractice cases is strategic in determining the existence or absence of unlawful acts due to negligence. The res ipsa loquitur doctrine makes it easier for patients as plaintiffs to prove negligence through a reverse burden of proof mechanism by medical personnel. Although not a formal piece of evidence, the res ipsa loquitur doctrine can be used as a relevant legal basis, especially when supported by medical records, to assess the conformity of medical actions with professional standards and operational procedures. The legal relationship in therapeutic transactions, which is asymmetrical in nature, requires proportional protection, both in relation to the provisions of Article 310 of the Health Law, which encourages non-litigation dispute resolution, and in relation to Article 440, which opens up criminal law channels for serious negligence in medical services. Therefore, the application of the res ipsa loquitur doctrine in criminal law must be strictly limited through a restorative justice approach as a fair alternative with balanced protection interests for patients and medical personnel.

Abstract

Pertanggungjawaban pidana dokter dalam pelayanan telemedisin seringkali menjadi sorotan utama dalam proses hukum, terutama ketika terjadi hal-hal yang tidak dikehendaki oleh pasien atau keluarganya, sementara ketidakakuratan informasi dari pasien terkadang tidak mendapat perhatian yang setara. Undang- Undang Nomor 17 Tahun 2023 tentang Kesehatan merupakan dasar kejelasan mengenai tindak pidana dan pertanggungjawaban pidana dokter dalam pelayanan telemedisin yang timbul dari faktor-faktor yang berada di luar kendali mereka, seperti keterbatasan teknologi, keterangan pasien, dan kesesuaian dokter dalam praktiknya. Tujuan penelitian ini untuk menentukan pelayanan telemedisin yang berakibat pada hal- hal yang tidak dikehendaki pasien atau keluarganya termasuk dalam tindak pidana serta dapat dipertanggungjawabkan menurut hukum. Metode penelitian yang digunakan adalah penelitian hukum dengan pendekatan undang-undang dan konseptual. Hasil penelitian menunjukkan bahwa ketidakpuasan pasien atas pelayanan atau kelalaian dokter dapat menimbulkan masalah hukum yang mengarah pada tindak pidana. Tindakan yang tergolong tindak pidana dalam telemedisin adalah perbuatan yang dilarang dan diancam sanksi sesuai UU Kesehatan. Pertanggungjawaban pidana dokter timbul apabila kesalahan terbukti berakibat serius, seperti diagnosis atau pengobatan yang dilakukan tanpa pemeriksaan fisik yang memadai, sehingga dokter dapat dikenakan sanksi pidana sesuai dengan ketentuan hukum yang berlaku.
