Abstract

This study analyzes the legal status of marriage among native Christians within the dualistic legal system of the Dutch East Indies during the 19th and 20th centuries. The main issue is the contestation between church law and colonial civil law, which affected the legality of native Christian marriages. The research employs a structural historical approach, utilizing colonial archival sources and church documents. The findings reveal that the Dutch colonial government implemented ambivalent policies that created structural tension between ecclesiastical and state authority. This legal dualism resulted in legal uncertainty for native Christian marriages recognized by the church but not always acknowledged by colonial civil law. The study contributes to a deeper understanding of colonial legal dynamics and their impact on indigenous communities.

Abstract

Nowadays, land ownership's issues become complicated and often result in conflict to nation, either individually or groups (mass). Lack of clarity of the status of the land requires a historical approach to the study of the legal regulation of land that changed following regime, which resulted in changes to the rights and status of land ownership. Results of this study concluded that the problems came out from an incomprehensive notice from the regulator/government, in order to clarify which regime used by now. Most of the people are sticking with the understanding of property rights (bezitzrecht) or tenure (beschikkingsrecht) of land, which is different from the concept of land title rights (eigendom). Therefore, the Government is expected to socialize the concept of land title rights (eigendom) and other present land rights so the conflicts will decrease or subside. Keyword: property rights (bezitzrecht), land title rights (eigendom), regulation history

Abstract

This article explains two types of land property rights in Indonesia's colonial civil law. It aims to find the reasons for today's legal disputes and suggest solutions. These issues started with two kinds of rights: Western civil property rights and indigenous property rights. The research uses a historical method with four steps: gathering information, analyzing it, understanding it, and rebuilding the history. The main sources are historical documents, focusing on their authenticity. The study finds that the colonial civil law had two types of land rights, each with its own rules and limits. This dual system came from unclear colonial policies about indigenous land ownership.

Abstract

Siswodipuran Subdistrict, located in Boyolali Regency, Central Java, is home to a number of historical colonial-era buildings that have yet to be systematically documented. A lack of public and governmental awareness and understanding regarding the historical value and economic potential of these heritage structures poses a significant challenge. This community engagement program aims to support the preservation and visual dissemination of these colonial buildings through digital media as a means of education, research, and strengthening local identity. The methods employed include lectures, discussions, guided historical scriptwriting, documentary video production, and online publication. The Social History Research Group of the Faculty of Cultural Sciences, Universitas Sebelas Maret, in collaboration with community partners and the local government, produced a documentary video and media publications highlighting the historical potential of the Siswodipuran area. The outcomes of this program include popular articles, educational videos on YouTube, and increased community participation in cultural heritage preservation. It is expected that this initiative can serve as a model for local historical documentation and encourage the utilization of historical buildings as cultural and economic assets for the community.
