Abstract

Indonesia, as a country based on law, emphasizes the supremacy of law as a basic principle. However, inconsistencies in law enforcement continue to pose significant challenges. The establishment of West Papua as a new province in 2022 raises complex governance issues, particularly in the role of the DPRD in formulating regional regulations. These regulations must be responsive to local needs and inclusive of regional cultural diversity. This study explores the DPRD's commitment to fulfilling its legislative function, identifies challenges faced in this process, and provides recommendations for improving the quality of legislation and governance. Using a juridical-sociological approach, this study combines normative legal analysis with a study of social realities in West Papua. Data were collected through interviews with DPRD members, community leaders, and academics, as well as a review of legislative documents and qualitative analysis. The findings of this study reveal that although the DPRD is trying to develop inclusive and effective Perda, challenges such as limited human resources, lack of public participation, and political dynamics affect the legislative process. However, there are opportunities to foster collaboration with traditional leaders and local organizations and utilize technology to improve legislative efficiency. This study underlines the importance of commitment, inclusiveness, and innovation in legislative functions. Strengthening the capacity of the DPRD, ensuring active public participation, and utilizing local wisdom are important steps towards achieving effective governance and sustainable development in Southwest Papua.

Abstract

Perlindungan hukum bagi petugas penolong (Rescuer) Badan Nasional Pencarian dan Pertolongan (BASARNAS) yang mengalami kecelakaan atau meninggal dunia saat pelaksanaan operasi Search and Rescue (SAR). Penelitian ini dilakukan melalui pendekatan studi literatur untuk memahami implementasi perlindungan hukum yang ada serta tantangan yang dihadapi dalam pelaksanaannya. Metode Penelitian yang digunakan dalam penelitian adalah Normatif dengan mengkaji peraturan yang relevan dengan penelitian. Penelitian ini menunjukkan bahwa meskipun terdapat peraturan yang mengatur perlindungan bagi petugas penolong, implementasi di lapangan masih menghadapi berbagai kendala, termasuk masalah administratif, keterbatasan dana, dan kurangnya pemahaman tentang hak-hak hukum oleh para petugas. Studi ini merekomendasikan peningkatan sosialisasi hukum, penyediaan asuransi, serta pembentukan mekanisme pengawasan yang lebih efektif untuk memastikan perlindungan yang lebih baik bagi petugas penolong (Rescuer)  BASARNAS.

Abstract

Amid the expansion of extractive industries that threaten ecosystems and marginalize indigenous communities, the Awyu Tribe in South Papua faces increasing pressure over the ownership and protection of their customary forests. This study aims to explore the ownership conflict of Awyu customary forests, assess the effectiveness of national and international legal frameworks, and evaluate the implementation of state policies in securing indigenous rights and ecological justice. The urgency of this issue lies in the persistent neglect of the Awyu people's legal standing, where regulations often fail to reflect their lived realities and cultural values. Using a normative legal method, the research applies statutory, conceptual, comparative, and case-based approaches, relying on secondary data sourced from literature and analyzed through qualitative-descriptive techniques. Findings indicate that although both national and international law recognize indigenous rights, implementation on the ground is obstructed by bureaucratic inefficiencies and competing economic interests. The principle of Free, Prior, and Informed Consent (FPIC) is frequently disregarded, resulting in systemic land dispossession and environmental degradation. This research offers a novel perspective by integrating fragmented legal mechanisms into a cohesive approach to indigenous forest protection. As a normative recommendation, the study calls for stronger enforcement of FPIC, institutional reform to reduce regulatory bias, and the meaningful inclusion of indigenous voices in policy formulation and implementation.

Abstract

This study aims to explore and understand how legal protection is provided to women victims of domestic violence (DV) and the forms of DV that affect women. The method used in this study is empirical legal analysis, which is descriptive and analytical in nature, with an interview approach involving five sources who have direct experience in cases of domestic violence. The novelty of this study lies in its focus on the factors that support and trigger domestic violence involving women, as well as an in-depth analysis of the legal protection provided to victims. The results of the study show that victims of domestic violence experience various forms of violence, including physical, sexual, psychological, economic, verbal, and spiritual abuse, which are influenced by factors such as patriarchal culture, misguided religious understanding, and personal problems within the household such as infidelity and economic difficulties. The conclusion of this study is that although legal protection for female victims of domestic violence already exists, there are still many factors that hinder its effective implementation, particularly those related to social stigma, legal ignorance, and limited access to legal and psychosocial services.

Abstract

Massive exploitation of coral reefs and their surrounding ecosystems often occurs without considering conservation and sustainability, especially in tourist destinations, as seen in Raja Ampat Regency. The research employed both normative juridical and empirical juridical approaches with a descriptive-analytical approach. The types of data used were primary data, obtained directly from respondents, and secondary data, obtained from literature studies, documentation, and interviews. The research findings indicate that the legal norms governing law enforcement for coral reef protection in Raja Ampat Regency constitute violations of norms with strict sanctions, providing education to combat theft and/or destruction of marine ecosystems, with the aim of raising awareness among the public that such actions are criminal offenses. The enforcement of sanctions for legal violations against coral reefs in Raja Ampat Regency takes the form of patrols to monitor criminal acts of ecosystem destruction and also conducts socialization to help the community understand the consequences of damaging marine ecosystems. The concept presented by the author in the research reaffirms the importance of the role of parents and all elements of society in maintaining public order and security, particularly community development. It emphasizes that it is not solely the responsibility of the police, as without the functioning and involvement of parents and community elements, the police cannot effectively and efficiently carry out their duties in fostering the community.

Abstract

Land is considered very important for human life that needs to be maintained. Land law in Indonesia has been regulated in Law Number 5 of 1960 concerning Basic Regulations on Agrarian Principles (UUPA), which means that it is a whole of written and unwritten legal norms. Land is not only a place to stand, but also a place for the growth of natural resources, habitat for various types of living things, as well as the foundation for economic and social development, not infrequently this causes a problem or conflict. This research aims to find out the existence of agrarian law in solving customary land problems in Sorong Regency. This research uses a socioligical juridical approach method to examine the problems studied. The results of this study indicate that Agrarian Law becomes the basis for resolving customary land issues in Sorong Regency without overriding Customary Law and Customary Law that already exists in the community in Sorong Regency.

Abstract

Penelitian ini menganalisis pengusiran masyarakat dari lokasi tanah hak ulayat marga sagisolobri di kabupaten sorong selatan dari perspektif hukum pidana. kasus ini berawal dari konflik politik lokal yang memicu pengusiran paksa tiga pulu kepala keluarga oleh marga sagisolobri. pengusiran ini dilakukan dengan alasan perbedaan dukungan politik dalam pemilihan kepala daerah dan kekecewaan terhadap ketidakmampuan memperjuangkan aspirasi komunitas dalam birokrasi pemerintahan. penelitian ini menyoroti dampak pengusiran terhadap hak asasi manusia, termasuk hak atas tanah, hak untuk menentukan nasib sendiri, dan hak atas kehidupan yang layak. selain itu, penelitian ini juga menekankan pentingnya konsultasi dan persetujuan yang bebas, didahulukan dan berdasarkan informasi dalam setiap tindakan yang mempengaruhi masyarakat adat. kesimpulan penelitian menunjukkan bahwa pengusiran ini melanggar hak asasi manusia yang diakui secara internasional dan nasional serta memperkuat pola dominasi dan marginalisasi terhadap masyarakat adat, mengancam pelestarian lingkungan dan keberlanjutan global.

Abstract

Keberadaan serta kebiasan-kebiasaan yang hidup menjadi aturan hukum masyarakat adat dalam bingkai Negara Kesatuan Republik Indonesia hingga saat ini masih eksis dan mengalami perkembangan. Penelitian ini bertujuan untuk menganalisis mengenai proses penyelesaian tindak pidana berdasarkan adat suku moi (studi kasus di polres kota sorong). Penelitian ini menggunakan metode penelitian empiris yuridis. Teknik pengumpulan data dilakukan dengan cara melakukan studi lapangan (field reseach). Hasil penelitian ini menunjukan bahwa penegakkan hukum adat terhadap tindak pidana berdasarkan adat Moi dipengaruhi oleh penghormatan masyarakat adat Moi yang sangat menjunjung tinggi adat istiadat itu pedoman hidup. Sementara itu, penyebab digunakan adat Moi dalam proses penyelesaian masalah di adat Moi dianggap lebih adil dan mewakili suasana kebatinan masyarakat suku Moi, serta lebih memberikan efek jera pada pelaku, dan juga berkaitan dengan hukuman ghaib yang dipercaya akan dihadapi oleh pelaku.

Abstract

Customary law is one of the laws that is still firmly enforced in Sorong City, West Papua, the Moi Tribe is one of several tribes in Sorong City and is a tribe that is still thick in the customary law inheritance system. The position of sons and daughters in the customary law inheritance system of the Moi tribe is often a matter of debate, because looking at the customary law system that applies in Papua, it still uses the Patriarchal system but is also based on family law.            This research is empirical research, namely legal research by using field data as primary data sources, such as the results of interviews, observations and documentation. Then it is supported by secondary data, namely articles, journals and previous research.            The results of this study indicate that: 1). The Customary Inheritance System in the MOI Tribe gives equal status to men and women as heirs, but there are differences in the distribution of inheritance. 2). The difference in the position of female heirs and male heirs is caused by the MOI Indigenous Community adhering to the principle of patriarchy, namely, men are the first heirs and women are the second heirs.

Abstract

The purpose of this study is to describe the arrangement of layoffs for reasons of efficiency in the Manpower Act and the Job Creation Act, and to analyze the legal position of efficiency layoffs in the Job Creation Law against the Constitutional Court Decision No. 19/PUU-IX/2011. This normative research was conducted by means of a literature study using primary and secondary legal materials. The result of this study is that Article 154A paragraph (1) letter b of the Job Creation Law regulates layoffs on the grounds of efficiency that they may be carried out even without being followed by the permanent closure of the company. However, Article 154A paragraph (1) letter b has violated the Constitutional Court Decision No. 19/PUU-IX/2011 which states that efficiency layoffs must be followed by permanent closure of the company. Therefore, Article 154A paragraph (1) letter b contradicts the Constitutional Court Decision which has a higher position than the law because the source of the validity of the Constitutional Court's decision is the 1945 Constitution.
