Abstract

This study aims to examine the implementation of waste management policies through waste banks in North Rawa Badak Urban Village, using Merilee S. Grindle's Policy Implementation theory as a framework. Additionally, it aims to identify the key actors and power relations involved in the policy's execution and to outline the factors affecting policy implementation, utilizing the model proposed by Ripley and Franklin. This study employs a qualitative research method, gathering data through literature review, interviews, and observation. The subjects of this study included North Jakarta Environmental Agency, the North Rawa Badak Urban Village Waste Bank, environmental expert and academic, and Karang Taruna North Rawa Badak Urban Village. The study's findings indicate that the implementation of waste management policies through waste banks in North Rawa Badak Urban Village has not aligned with the expected standards of smooth functioning, level of compliance, performance, operational effectiveness, and expected impact. Consequently, the waste bank has not achieved optimal results and has not been successful in its implementation.

Abstract

The problem of poor air pollution quality is becoming more serious often in big cities, especially in the capital city of DKI Jakarta. Apart from vehicle emissions, there are other problems that are also important due to the use of Steam Power Plants (PLTU) around the Jakarta area. PLTU Suralaya in Banten is one of the largest sectors that emits the amount of emissions that have an impact on the surrounding area. This study aims to provide a description of the strategy carried out by the Non-Government Organization (NGO) Trend Asia as an effort to control air pollution pollution in Jakarta through transboundary emissions by the Suralaya PLTU. This research uses qualitative case study research methods and will be strengthened by the theory of environmental NGO strategy by MC. Cormick as an analysis knife of this study. The results of this study explain the strategies used by Trend Asia in efforts to control transboundary emission pollution of the Suralaya coal-fired power plant from nine MC strategies. The relevant Cormick used six strategies, namely Working with Elected Officials, Undertaking Research, Campaigning and Organizing Public Protests, Promoting Media Coverage of Environmental Issues, Information Exchange, and Generating Local Community Involvement in Environmental Protection.

Abstract

This research aims to analyze the implementation of asymmetric decentralization in Indonesia with the case study of Papua. Efforts to end the conflict in Papua are a priority for the Indonesian government. This research uses qualitative research methods packaged in a normative legal approach, including historical and legal approaches as primary sources for research. Based on the special autonomy law, there’s potential and equitable development through articles that provide opportunities for Indigenous Law 2/21. Because several changes lead to equality and the elimination of inequality. However, in practice, asymmetric decentralization can possibly become a problem, especially regarding the threat of conflict due to expansion and acts of corruption, collusion, and nepotism. In practice, several indicators have not been able to provide a solution to the separatism movement in Papua, especially regarding the peace agreement. The Implementation of special autonomy has not been a complete solution. Meanwhile, in the relevance of special autonomy, Law 2/21 sporadically has been by the requests represented DPRD included in the expense of discrimination and development allocation. However, in several demands, the Indonesian government has not been able to answer one of which is dialogue and openness of journalistic activities.

Abstract

Penelitian ini bertujuan memberikan analisis seputar upaya penegakan hukum lingkungan dalam program strategis nasional food estate. Kurangnya penegakan hukum lingkungan di Indonesia menjadi sorotan, komitmen yang dipegang pemerintah melalui PBB perlahan memudar. Perubahan kebijakan yang merugikan lingkungan terus dilakukan, mulai dari Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup diganti dengan Undang-Undang No. 11 Tahun 2020 tentang Cipta Kerja lalu dirubah Perpu. No. 2 Tahun 2022 tentang Cipta Kerja. Termasuk dalam pemberian pedoman penggunaan hutan dari Kementerian Lingkungan Hidup dan Kehutanan yang cenderung kontradiktif dengan tujuan kementerian tersebut. Sementara itu, penelitian ini menggunakan metode kualitatif atau studi pustaka. Selain itu, penelitian ini menggunakan metode yuridis normatif dengan menjadikan kebijakan atau produk hukum sebagai objek penelitian. Dengan ini implementasi program food estate masih jauh dari aspek good governance sesuai dengan penegakan hukum lingkungan. Oleh karena itu, tantangan untuk menegakan hukum lingkungan masih menjadi sorotan mengingat perubahan kebijakan terus dilakukan oleh pemerintah untuk keberlangsungan proyek strategis nasional yang ambisius. Dengan demikian, penting untuk menegakan hukum lingkungan sesuai dengan konsep dan bentuk good governance pada program food estate. Mengingat pembangunan berkelanjutan mesti ditekan oleh prinsip hukum lingkungan untuk memberikan penyeimbangan dalam setiap proses mekanisme food estate.

Abstract

Pembangunan Ibu Kota Nusantara merupakan sebuah upaya yang dilakukan pemerintah Indonesia untuk mengurangi ketimpangan dan menghilangkan Jawasentris. Kalimantan Timur terpilih menjadi kawasan untuk pembangunan Ibu Kota baru karena termasuk wilayah yang strategis dan letaknya yang tepat untuk membangun sentral pemerintahan yang baru dan berkelanjutan. Kalimantan sebagai salah satu paru-paru dunia yang terkenal akan hutannya yang membentang luas serta didalamnya terdapat flora dan fauna endemik. Pembangunan ibu kota ini menimbulkan permasalahan baru karena merusak lingkungan akibat deforestasi terhadap hutan. Hal ini menjadi fokus utama peneliti karena dalam implementasi pembangunan Ibu Kota Nusantara ini, pemerintah kurang memerhatikan aspek keseimbangan antara kepentingan manusia dengan alam. Deep Ecology menekankan seluruh makhluk hidup memiliki nilai dan hak yang sama untuk dihargai terlepas alam mempunyai manfaat bagi manusia. Tujuan penelitian ini untuk menganalisis konsep Deep Ecology Arne Naess terhadap pembangunan Ibu Kota Nusantara untuk melindungi ekosistem dan pembangunan berkelanjutan. Penelitian ini menggunakan metode penelitian kualitatif dengan analisis sumber data sekunder yaitu studi pustaka dari literatur mengenai Ibu Kota Nusantara. Penelitian ini menunjukkan penerapan prinsip Deep Ecology dapat memberikan panduan dalam merancang pembangunan yang lebih ramah lingkungan. Penelitian ini menyimpulkan bahwa diperlukan integrasi Deep Ecology dalam pembangunan Ibu Kota Nusantara untuk mencapai keseimbangan antara manusia dan alam.

Abstract

The establishment of a cement factory by PT Semen Indonesia in the Kendeng Utara Mountains has triggered a prolonged conflict lasting 11 years due to local community resistance. Cement raw material mining activities are perceived as environmentally damaging, and the issuance of Central Java Governor's Decree No. 660.1/17 of 2012 on Environmental Permits is considered inconsistent with other regulations. This decision legitimized mining operations, exacerbating tensions between the community, environmental organizations, and the government. This study aims to identify the root causes of the conflict between the Kendeng community in Gunem District, Rembang Regency, and PT Semen Indonesia, while evaluating conflict resolution efforts. Using descriptive analysis based on literature reviews and digital media coverage, the study applies the theory of ecocentrism to examine the conflict dynamics. The findings reveal the presence of power dominance obstructing conflict resolution, despite various efforts by the community and non-governmental organizations. These results highlight the need for a more inclusive approach grounded in ecological justice to address the issue

Abstract

This article discusses the analysis of environmental impact of IKN development through agenda settings. The development of IKN comes from the massiveness of potential natural disasters that occur in Jakarta. The low position of the land with the ocean makes the issue of Jakarta sinking even greater in 2050. Then, DKI Jakarta is also known as the most populous province in Indonesia. The impact is the high level of congestion, the rise of slums to high air pollution. This is due to the centralization of political economic development in Jakarta. Seeing this urgency, the Government issued Law Number 3 of 2022 concerning IKN. Pros and cons ensued considering that the validity of the law only took 43 days. In addition, environmental damage is also increasing considering that Kalimantan is often considered the heart of the world. Mass deforestation that makes the existence of raw forests threatened to disappear. The community's economy is threatened. This ambiguity is further sharpened by the concept of IKN which carries a smart city. The theories used is agenda settings. The method used is descriptive  qualitative research and literature study.Artikel ini membahas mengenai analisis dampak lingkungan pembangunan IKN melalui agenda settings. Pembangunan IKN berasal dari massivenya potensi bencana alam yang terjadi di Jakarta. Rendahnya posisi daratan dengan lautan, membuat isu Jakarta tenggelam pada tahun 2050 semakin besar. Kemudian, DKI Jakarta juga dikenal sebagai provinsi terpadat di Indonesia. Dampaknya, tingkat kemacetan yang tinggi, maraknya pemukiman kumuh hingga tingginya polusi udara. Hal ini disebabkan oleh sentralisasi pembangunan ekonomi politik yang ada di Jakarta. Melihat urgensi tersebut, Pemerintah mengeluarkan UU Nomor 3 Tahun 2022 mengenai IKN. Pro kontra pun terjadi mengingat keabsahan UU tersebut hanya memakan waktu 43 hari. Selain itu, kerusakan lingkungan juga semakin meningkat mengingat Kalimantan sering dianggap sebagai jantung dunia. Deforestasi massal yang membuat eksistensi hutan baku terancam hilang. Perekonomian masyarakat menjadi terancam. Ambiguitas ini semakin dipertajam dengan konsep IKN yang mengusung smart city. Teori yang digunakan adalah agenda settings. Metode yang digunakan adalah penelitian kualitatif deskriptif dan studi pustaka.

Abstract

This study aims to identify the form of discrimination against female workers in PT AICE's policies in 2017, and to evaluate the implementation of human rights in employement practices. Using qualitative research methods by means of library research, namely research that collects information and data using various library materials such as documents, books, magazines, historical stories, and others. The results show that PT AICE has violated Labor Law No. 13 of 2003 with discriminatory policies against female workers, such as not providing nutritious food and shuttle transportation for female workers who work at night. These violations are considered a form of violence and exploitation against women workers. In addition, patriarchal culture still influences inequitable access and opportunities for women in the labor sector, which is reflected in the company's unwillingness to fulfill the rights of women workers, such as reproductive rights, health insurance during pregnancy, and rights for women workers who work at night. These findings show that there are still many human rights violations against women in the world of work.

Abstract

General elections in Indonesia are designed to ensure equality and justice for all voters and candidates, regardless of party affiliation. Despite these principles, election violations do occur, including criminal acts, breaches of ethical standards by election organizers, and administrative violations related to election procedures. To protect the integrity of elections, which is crucial for democracy, lawmakers have classified certain electoral frauds as criminal offenses. The Election Law not only outlines the procedures for conducting elections but also prohibits actions that undermine the fairness of the process and imposes penalties on offenders. The type of research in this study is normative legal research, which is a research method that focuses on written legal norms. accompanied by a comparative study of the country of Nigeria The results showed that the small number of reports of election crimes that continued to the level of investigation, prosecution, and examination in court until the issuance of a permanent legal force decision (inkracht van gewisjde) showed that the handling of election crimes in the elections had not been effective. The same is true for Nigeria through INEC. Although INEC has the authority to initiate cases of electoral offenses, it rarely does so due to a lack of supervisory capacity due to understaffing and the inability or unwillingness of the police to collect evidence and conduct investigations.
