Abstract

Most of the waqf assets received by PCM DAU from the Wakifs are immovable waqf assets in the form of land. Waqf land managed by PCM DAU is a total of 36 waqf assets, while waqf land that does not yet have a certificate is a total of 10 waqf assets. Obstacles to not registering waqf land are the lack of human resources, lack of awareness about the importance of registering waqf land, a culture of society that has high trust in Nadzir to manage the waqf land, the understanding that waqf is legal and has legal force only by following the provisions in Fiqh Islam, the notion that the management of waqf land certificates is too convoluted, the procedure is long and requires high costs. To solve this problem the service team provides a solution by providing: Socialization regarding the urgency of Waqf Land Registration; Dissemination of waqf land registration procedures starting from the handing over of waqf land by the wakif to the issuance of the waqf land certificate; Assistance in the identification and completion of the documents needed in the registration of waqf land; Assistance in registering waqf land until it enters the National Land Agency (BPN). The mentoring method is used in this service activity with an individual approach. The process for socializing the urgency of waqf land registration will be carried out on March 20, 2021, while the implementation of the socialization of waqf land registration procedures will be carried out on May 15, 2021, for assistance activities for identification and completeness of waqf land registration documents from May 1 to August 23, 2021, as for the process of assisting land registration waqf to the BPN office will be carried out on December 7, 2021.   Abstrak Pendampingan Pendaftaran Tanah Wakaf yang Dikelola Pimpinan Cabang Muhammadiyah Kecamatan Dau-Malang. Harta benda wakaf yang diterima oleh PCM DAU dari para Wakif sebagian besar merupakan harta wakaf tidak bergerak berupa tanah. Tanah wakaf yang dikelola oleh PCM Dau adalah sejumlah 36 aset wakaf, sementara tanah wakaf yang belum memiliki sertifikat adalah sejumlah 10 aset wakaf. Kendala belum dilakukannya pendafatran tanah wakaf adalah kurangnya sumber daya manusia, kurangnya kesadaran tentang pentingnya pendafatran tanah wakaf, kultur masyarakat yang memiliki kepercayaan yang tinggi kepada Nadzir untuk mengelola tanah yang diwakafkan, pemahaman bahwa wakaf telah sah dan memiliki kekuatan hukum hanya dengan mengikuti ketentuan dalam Fiqh Islam, Anggapan bahwa pengurusan sertifikat tanah wakaf terlalu berbelit – belit, prosedurnya lama dan membutuhkan biaya tinggi. Untuk menyelesaikan permasalahan tersebut tim pengabdi memberikan solusi dengan pemberian: Sosialisasi mengenai urgensi Pendaftaan Tanah Wakaf; Sosialisasi mengenai prosedur pendaftaran tanah wakaf mulai dari penyerahan tanah wakaf oleh wakif sampai dengan terbitnya sertifikat tanah wakaf; Pendampingan identifikasi dan kelengkapan dokumen – dokumen yang dibutuhkan dalam pendaftaran tanah wakaf; Pendampingan pendaftaran tanah wakaf sampai masuk ke Badan Pertanahan Nasional (BPN). Metode pendampingan digunakan dalam kegiatan pengabdian ini dengan pendekatan individual. Poses pelaksanaan sosialisasi urgensi pendaftaran tanah wakaf dilakukan pada 20 Maret 2021, sedangkan pelaksanaan sosialisasi prosedur pendaftaran tanah wakaf dilakukan pada 15 Mei 2021, untuk kegiatan pendampingan identifikasi dan kelengkapan dokumen pendaftaran tanah wakaf dilakukan 1 Mei sampai dengan 23 Agustus 2021, adapun proses pendampingan pendaftaran tanah wakaf ke kantor BPN dilaksanakan pada tanggal 7 Desember 2021.

Abstract

Omah Kripik Mbote, one of the household food industry (IRTP), encounters challenges in acquiring distribution permits, a crucial step in initiating an IRTP business. One major hurdle is the lack of comprehension and knowledge regarding the permit processing procedures. To address this issue, assistance was provided to facilitate the acquisition of an IRTP marketing authorization for Omah Kripik Mbote. This assistance aims to offer a comprehensive understanding of the procedures involved in obtaining an IRTP marketing authorization and processing a Home Industry Food Production Certificate (SPP-IRT) for Omah Kripik Mbote. The approach utilized in this assistance includes both classical and individualized methods, focusing on: a) disseminating information about the procedures for obtaining IRTP marketing authorization; b) aiding in identifying the requirements for acquiring IRTP marketing authorization; and c) guiding through the process of obtaining IRTP marketing authorization. As a result of this assistance, Omah Kripik Mbote has gained a better grasp of the procedures for obtaining IRTP marketing authorization, along with the issuance of SPP-IRT with PIRT numbers.

Abstract

CSR implementation in Indonesia includes social and environmental responsibility. As felt by the people of Klandungan Hamlet, Landungsari Village, Dau District, Malang Regency, which was affected by the process of building a home stay by a commercial company in Malang Regency. There is a need for a symbiotic mutualism relationship between business actors in running their businesses and the community can also be able to carry out activities properly in the process of development and operations of the company in the future. The purpose of this service is to provide socialization and assist residents in fulfilling their rights over the development and / or operations of the company so that in the future there will be no conflicts. The method used is to accompany the negotiation meeting of the parties without taking sides, drafting the agreement until a win-win solution is reached. The result of this service is that the parties reach an agreement with the signing of a joint statement which can be used as a guide if a conflict arises.

Abstract

Cryptocurrency investment is currently expanding quickly on a global scale as well as in Indonesia. On the one hand, cryptocurrency can be used as a medium of exchange or a form of money, which represents the original purpose of cryptocurrency. On the other hand, it can also be used as a commodity or as digital assets, also known as crypto assets. Cryptocurrency is illegal to use as money in Indonesia, but it is legal to exchange it as an asset. This study explores the legal protections for holders of collateral against the loss of crypto assets as well as how crypto assets are governed by material guarantees in Indonesia. A conceptual and statutory approach, technical analysis, and a normative legal research methodology were applied in the study. The legal material was analyzed by using the content analysis approach, which involved examining the content and legality of the material gleaned from various laws and regulations by looking at the relevant legal precedents. The discussion results discover that crypto assets fall under the definition of "intangible movable objects" as defined in article 503 BW. In addition, crypto assets had material rights in the form of material guarantees in the form of a pledge and fiduciary guarantees, allowing the parties to carry out their agreements in good faith even in the event that the collateral object is lost. These disputes could be settled through either non-litigation or litigation.

Abstract

Environmental problems have occurred in the global scope, both developed and developing countries. Environmental problems are not only problems of developed countries or industrialized countries including Indonesia. Efforts to overcome environmental problems in developing countries have no other choice but to carry out development. Without the level of development, people will decline, and the environment will be increasingly damaged. Development must still be carried out without damaging the environment. This balance must be maintained in order to preserve the environment. Indonesia has been paying attention to environmental management since 1972. Settlement of environmental disputes through litigation does not produce many results. Dispute resolution through non-litigation channels assumes that dispute resolution through litigation results in very disappointing results. This study wants to conduct a study related to the implementation of Government Regulation No. 54 of 2000 concerning Service Providers for Environmental Dispute Resolution Services Outside the Court and find obstacles and solutions in resolving environmental disputes out of court. The implementation of Government Regulation No. 54 of 2000 at the central government level has established a service provider institution based on the Decree of the State Minister of the Environment Number 77 of 2003 concerning the Establishment of an Out-of-court Environmental Dispute Resolution Service Provider (LPJP2SLH) at the Ministry of the Environment, but its performance has not yet been felt. Abstrak Masalah lingkungan telah terjadi dalam lingkup global, regional maupun nasional baik negara maju maupun negara berkembang. Masalah lingkungan bukan hanya masalah negara maju atau negara industri namun juga pada negara berkembang termasuk Indonesia. Upaya mengatasi permasalahan lingkungan di negara berkembang tidak ada pilihan lain selain melakukan pembangunan. Pembangunan tetap harus dilakukan tanpa merusak lingkungan. Keseimbangan ini harus dijaga agar kelestarian lingkungan tetap terjaga. Indonesia telah memperhatikan pengelolaan lingkungan sejak tahun 1972. Penyelesaian sengketa lingkungan melalui litigasi tidak banyak membuahkan hasil. Penyelesaian sengketa melalui jalur non-litigasi didasarkan pada asumsi bahwa penyelesaian sengketa melalui jalur litigasi memberikan hasil yang sangat mengecewakan. Penelitian ini ingin melakukan kajian mendalam Peraturan Pemerintah Nomor 54 Tahun 2000 tentang Penyelenggara Jasa Penyelesaian Sengketa Lingkungan Hidup di Luar Pengadilan, serta mencari kendala dan solusi penyelesaian sengketa lingkungan hidup di luar pengadilan. Pelaksanaan Peraturan Pemerintah Nomor 54 Tahun 2000 di tingkat pemerintah pusat telah membentuk lembaga penyedia layanan berdasarkan Keputusan Menteri Negara Lingkungan Hidup Nomor 77 Tahun 2003 tentang Pembentukan Layanan Penyelesaian Sengketa Lingkungan Di Luar Pengadilan Penyelenggara (LPJP2SLH) di Kementerian Lingkungan Hidup, namun kinerjanya belum optimal.

Abstract

Rental agreements are usually made in writing in a standardized form, namely the content, form and closing have been standardized unilaterally by the business actor. This agreement is coercive and causes losses for the lessee and even an imbalance in the position between consumers and producers. This study aims to: (1) determine the contents of the standard clauses in the car rental agreement at Komando Rent a Car whether or not they are in accordance with the principle of good faith (2) to determine the legal consequences of including the standard clause in the car rental agreement at Komando Rent a car. The type of research used in this study is empirical juridical by using data collection techniques through interviews and literature studies. The results of the study show that: (1) the car rental agreement at Komando Rent a Car is not in accordance with the principle of good faith because there is a standard clause in the form of delegation of responsibility for business actors to the detriment of one of the parties, does not reflect a sense of justice and violates the law (2 ) the legal consequence of the inclusion of a standard clause which contains the transfer of responsibility for this business actor is that the agreement is null and void and can be subject to imprisonment and fines. Abstrak Perjanjian sewa biasanya dilakukan secara tertulis yang sudah dalam bentuk baku yaitu isi, bentuk serta penutupannya telah dibakukan secara sepihak oleh pelaku usaha. Perjanjian ini bersifat memaksa dan menimbulkan kerugian bagi pihak penyewa bahkan terdapat ketidakseimbangan posisi antara konsumen dan produsen. Penelitian ini bertujuan untuk: (1) mengetahui isi klausula baku pada perjanjian sewa menyewa mobil di Komando Rent a Car telah sesuai atau tidak dengan asas itikad baik (2) untuk mengetahui akibat hukum dari pencantuman klausula baku pada perjanjian sewa menyewa mobil di Komando Rent a Car. Jenis penelitian yang digunakan dalam penelitian ini adalah yuridis empiris dengan menggunakan teknik pengumpulan data melalui wawancara dan studi kepustakaan. Hasil penelitian menunjukkan bahwa: (1) perjanjian sewa menyewa mobil di Komando Rent a Car tidak sesuai dengan asas itikad baik karena terdapat klausula baku berupa pelimpahan tanggung jawab pelaku usaha sehingga merugikan salah satu pihaknya, tidak mencerminkan rasa keadilan dan melanggar Undang-Undang (2) akibat hukum dari pencantuman klausula baku yang memuat pengalihan tanggung jawab pelaku usaha ini adalah perjanjian tersebut batal demi hukum dan dapat dikenai sanksi penjara dan denda.

Abstract

This study aims to investigate the Legal Position of celebrities in promoting goods through the Instagram platform and the form of legal liability by celebrities for endorsements or advertised products. With a normative Legal method supported by statutory and conceptual approaches in the context of problem-solving, and Library Research, this research reveals that the legal position of celebrities holds no legal basis which specifically regulates the legal position of celebrities and no rules used and applied, resulting in a vacuum in norms. When a problem regarding endorsement with indications of products not in accordance with what is advertised emerges, this issue involves Liability based on fault. In such a case, the relevant form of liability where the celebgram is responsible for losses caused by mistakes contravening Article 4 letter h of Law No. 8 of 1999 concerning Consumer Protection asserting that consumers are entitled to compensation, compensation and/or replacement if the goods and/or services received are not by the agreement or not as they should be. Abstrak Penelitian ini bertujuan untuk dapat mengetahui tentang Kedudukan Hukum selebgram dalam mempromosikan barang melalui platform Instagram serta untuk dapat mengetahui tentang bentuk pertanggungjawaban hukum oleh selebgram atas endorsement atau produk yang diklankan. Metode penelitian yang dipakai adalah jenis Penelitian Hukum Normatif dengan metode pendekatan perundang-undangan (the statute approach), penelitian ini juga menggunakan pendekatan konseptual (the conceptual approach) yang digunakan dalam rangka pemecahan masalah, serta penelitian ini merupakan penelitian kepustakaan (Library Research). Hasil penelitian yang didapat adalah Kedudukan hukum selebgram secara khusus ditegaskan bahwasanya tidak ada dasar hukum yang mengatur secara khusus mengenai kedudukan hukum selebgram dan belum memiliki aturan yang dipakai dan diterapkan akibatnya terjadi kekosongan norma. Ketika terjadi permasalahan mengenai endorsement dengan indikasi produk yang tidak sesuai dengan yang diklankan maka bentuk pertanggungjawaban yang dilakukan adalah Liability base on fault. Dimana dalam hal ini dapat dijelaskan bahwa Bentuk pertanggungjawaban yang relevan adalah dimana selebgram bertanggungjawab atas kerugian yang disebabkan oleh kesalahan yang dilakukannya terdapat dalam Pasal 4 huruf h UU No. 8 Tahun 1999 tentang Perlindungan Konsumen yang berbunyi konsumen berhak untuk mendapatkan kompensasi, ganti rugi dan/atau penggantian, apabila barang dan/atau jasa yang diterima tidak sesuai dengan perjanjian atau tidak sebagaimana mestinya.

Abstract

A dispute over the location of a land plot is a dispute caused by confusion in the designation of land plots or boundaries. This dispute can cause losses for parties who have an interest in the land plot. Land dispute resolution, one of which is a dispute over the location of land parcels, can be resolved through non-litigation channels through mediation. Mediation as an alternative to dispute resolution is considered more profitable for the parties because it uses a win-win solution method. This research is an empirical juridical research, using primary and secondary data sources. The location of the research is at the Kediri Regency Land Office. The result of this study is the implementation of mediation at the Kediri Regency Land Office through several stages guided by Article 6 paragraph (1) of the Regulation of the Minister of Agrarian and Spatial Planning/Head of the National Land Agency Number 21 of 2020 concerning the Handling and Settlement of Land Cases. The implementation of mediation at the Kediri District Land Office has obstacles including the parties to the dispute not being present at the time of mediation and having a bad faith. In this case, the solution that can be provided by the Kediri District Land Office is to advise the parties to resolve the dispute through litigation at the Kediri District District Court. Abstrak Sengketa letak bidang tanah merupakan sengketa yang disebabkan oleh kekeliruan dalam penunjukan bidang atau batas tanah. Sengketa ini dapat menyebabkan kerugian bagi pihak yang memiliki kepentingan atas bidang tanah tersebut. Penyelesaian sengketa pertanahan salah satunya sengketa letak bidang tanah dapat diselesaikan melalui jalur non litigasi melalui mediasi. Mediasi sebagai alternative penyelesaian sengketa dinilai lebih menguntungkan bagi para pihak sebab menggunakan metode win-win solution. Penelitian ini merupakan penelitian yuridis empiris, dengan menggunakan sumber data primer dan sekunder. Lokasi penelitian berada di Kantor Pertanahan Kabupaten Kediri. Hasil penelitian ini adalah pelaksanaan mediasi di Kantor Pertanahan Kabupaten Kediri melalui beberapa tahapan yang berpedoman pada Pasal 6 ayat (1) Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Nomor 21 tahun 2020 tentang Penanganan dan penyelesaian Kasus Pertanahan. Pelaksanaan mediasi di Kantor Pertanahan Kabupaten Kediri memiliki hambatan diantaranya adalah para pihak yang bersengketa tidak hadir pada saat mediasi serta beritikad tidak. Dalam hal ini, solusi yang dapat diberikan oleh pihak Kantor Pertanahan Kabupaten Kediri adalah menyarankan kepada para pihak untuk menyelesaikan sengketa melalui jalur litigasi di Pengadilan Negeri Kabupaten Kediri.

Abstract

The purpose of this study is to investigate the legal consequences that exporters may face when an unintentional error occurs in customs clearance procedures carried out by the Customs. This research applies the normative juridical research method to analyze the legal liability of the Customs in the case of inadvertent customs documents, focusing on the provisions stipulated in PMK 274/PMK.04/2014. Data collection is done through a literature study using primary legal sources, especially related laws and regulations. Data were classified and analyzed normatively to understand the implementation and impact of Customs' legal liability. The results of the study provide an overview of the export duty restitution mechanism and aspects of the legal liability of Customs, focusing on export cancellation, overpayment, and the role of the Tax Court. This research is expected to contribute to a deeper understanding of the customs legal framework in Indonesia and can serve as a reference for relevant stakeholders.

Abstract

This study aims to analyze the juridical perspective on the cultural heritage protection regulation in Indonesia, particularly in the Special Region of Yogyakarta (DIY). Employing a case study approach, this research explores the implementation of the Cultural Heritage Law in the context of DIY, as well as the efforts of the Yogyakarta Regional Government to strengthen and preserve cultural heritage amidst social polarization. The study also addresses challenges faced in preservation endeavors, such as limited resources and sustainable maintenance efforts. By analyzing juridical aspects and field practices, this research provides a richer understanding of the execution of the Cultural Heritage Law in DIY. Through community participation, DIY effectively manages to safeguard cultural heritage despite differences and societal polarization. The study yields an in-depth insight into the pivotal role of the Cultural Heritage Law and the efforts of the DIY Government in conserving cultural richness for future generations.
