Abstract

Abstract

The development of marketing strategies in the modern economy has given rise to various innovative pricing models, one of which is the Pay-What-You-Want (PWYW) system, or the “pay as you wish” payment model. This model allows consumers the freedom to determine the amount they consider appropriate for a product or service. Although this strategy is considered capable of increasing consumer trust and loyalty, its existence raises normative questions from the perspective of Islamic economic law, particularly regarding the clarity of price within a sale and purchase contract. This study aims to analyze the construction of Islamic law toward the practice of Pay-What-You-Want in the context of modern marketing strategies and to assess its compatibility with the principles of fiqh muamalah. This research uses a qualitative approach with a library research method through the analysis of literature on fiqh muamalah, contemporary Islamic economics, and academic studies related to the Pay-What-You-Want model in modern business practices. The analysis is conducted using a normative-conceptual approach that examines the principles of contracts (akad), price clarity (tsaman), mutual consent of the parties (an-tarāḍin), and the potential presence of gharar (uncertainty) in transactions. The results of the study indicate that the Pay-What-You-Want practice can, in principle, be understood as a form of flexibility in the pricing mechanism as long as it fulfills the element of mutual consent and does not create uncertainty that harms either party. From the perspective of Islamic law, this model may be constructed as a permissible form of transaction provided that it fulfills the principles of transparency, fairness, and does not contain excessive gharar. Therefore, the Pay-What-You-Want practice can be viewed as a marketing innovation compatible with the principles of Islamic economics when implemented within the framework of Sharia business ethics.

Abstract

The tension between the validity of theological marriage (classical fiqh) and its formal legality (state law) remains a crucial discourse in Indonesia, particularly in religious regions. Many people perceive marriage registration merely as an administrative burden with no implication for religious validity, leading to the prevalence of unregistered marriages. This normative legal research employs a statute approach and a conceptual approach. Data were gathered through a literature review of authoritative fiqh texts, Indonesian family law regulations, and the theory of Maqāṣid al-Syarī‘ah. The study reveals that the absence of discussions of marriage registration in classical fiqh was due to the historical communal socio-political context, which differs from modern state structures. Through the lens of Maqāṣid al-Syarī‘ah, the formalisation of marriage registration has risen from a ḥājiyyāt (secondary need) to a ḍarūriyyāt (primary necessity). This is because registration serves as the sole instrument in protecting wives’ civil rights (ḥifẓ al-māl) and ensuring children’s legal identity and lineage (ḥifẓ al-nasl) before positive law. This research concludes that marriage formalisation is a manifestation of public interest (maṣlaḥah mu’tabarah) that must be fulfilled to uphold substantive justice within Muslim family institutions in Indonesia.

Abstract

This study examines the integration of Ahlussunnah wal Jamaah An-Nahdliyah (Aswaja) values into the Islamic Religious Education (PAI) curriculum at the Darussalam Islamic Institute of Martapura. The research responds to the need for graduates who possess academic competence, religious moderation, and character rooted in local socio-cultural values. A qualitative case study approach was employed. Data were collected through semi-structured interviews, participatory observations, and document analysis involving 10 purposively selected participants, consisting of institutional leaders, lecturers, and student representatives. Data were analyzed using thematic analysis supported by NVivo 12 Plus software. The findings reveal that Aswaja values are integrated through three interconnected dimensions: understanding (knowing), practice (doing), and internalization (being). These dimensions are reflected in the institution’s vision and mission, curriculum structure, learning activities, worship practices, and holistic evaluation processes. The curriculum also incorporates Banjar traditions, such as tahlilan, haul commemorations, and grave pilgrimages, as media for character education. The novelty of this study lies in proposing an integrative curriculum model that links Aswaja values with local cultural traditions to strengthen character formation, religious moderation, and graduate adaptability in contemporary society.

Abstract

The resilience of migrant Muslim families in Malaysia faces complex challenges, including limited access to education, legal marriage vulnerability, and economic instability. This community service research aims to strengthen family resilience through a multidisciplinary approach integrating education, marriage law, and Sharia economics. The activities were conducted from April 13–27, 2026, in Kuala Lumpur, in collaboration with the Indonesian School of Kuala Lumpur (SIKL), targeting students and parents in fostered schools. The method employed is Asset-Based Community Development (ABCD) with a descriptive-qualitative field approach. The service team involved cross-faculty student collaboration (Tarbiyah, Sharia, and Islamic Economics and Business) to provide basic literacy mentoring, legal marriage education (isbat nikah), and Sharia-based household financial management simulations. The results show significant improvements in children's literacy skills, increased parental awareness of the importance of legal documents for civil rights protection, and a shift in consumption patterns toward more planned financial management. In conclusion, interdisciplinary integration is effective in forming a "Resilient Family" model for the global Muslim community, capable of adapting to sociogratis challenges and local policies in Malaysia while maintaining their Islamic identity.
