Abstract

The crime of sexual violence arises from the intention and opportunity of the perpetrator due to the lack of conditions that provide legal protection for the victim. Therefore, it is important to carry out policies and preventive measures before the crime of sexual violence occurs. This research focuses on non-penal policies, namely policies that are more preventive. This study aims to examine the review of Islamic criminal law in looking at the non-penal policies that have been carried out by the Banda Aceh City Government in overcoming sexual violence. The research method used in this study is empirical legal research with a sociological approach and the main data source is the policy carried out by the Banda Aceh City Government, in terms of tackling sexual violence, then the data obtained from the field will be seen in the perspective of Islamic criminal law. As for the results of this research, many efforts have been made to minimize the occurrence of sexual violence crimes in the city of Banda Aceh. Among them, there is the role of the Pamong Praja Police Unit (Satpol PP) and the Wilayatul Hisbah Police Unit in enforcing qanun, as well as the appointment of Muhtasib Gampong personnel. In addition, the Banda Aceh City Government also issued a Mayor's Circular Letter containing an appeal to wear Muslim/Muslim women's clothing, and the Islamic Sharia Office through the Da'wah Field routinely runs programs in the context of overcoming sexual violence. The various non-penal policies implemented by the Banda Aceh City Government are basically in line with the principles required by Islamic law, and can be categorized as part of the provisions of taʿzīr. However, based on the understanding of the Qur'an and Hadith, Islamic criminal law essentially emphasizes preventive aspects that are rooted in people's personal awareness, such as maintaining views, regulating associations, controlling lust, and other behaviors that can prevent offenses.

Abstract

Silver humans, individuals who paint their entire bodies with metallic paint and appear in public spaces to beg, have become a common sight in various major cities in Indonesia. This practice not only poses health risks due to exposure to hazardous chemicals, but also raises social and legal issues. According to Article 504 of the Criminal Code, begging in public places is a criminal offense punishable by imprisonment. However, the positive legal approach focuses more on punishment than rehabilitation. This study aims to analyze the behavior of silver human exploitation from the perspective of Islamic criminal law with a focus on ta'zir sanctions and the principles of maqashid syari'ah. The research method used is a normative approach with qualitative analysis of fiqh literature, maqashid syari'ah, and relevant laws and regulations. The results of the study found that the behavior of silver human exploitation is contrary to the five main objectives of sharia: protecting religion (hifz al-din), life (hijz al-nafs), reason (hifz al-'aql), offspring (hifz al-nasl), and property (hifz al-mal). Therefore, imposing ta'zir sanctions that are educational and rehabilitative in nature is more appropriate for creating public interest than simply imposing imprisonment as stipulated in the Criminal Code. This study emphasizes the importance of synergy between positive law and Islamic criminal law in formulating policies that protect perpetrators while maintaining public order.

Abstract

This research emphasizes the importance of synergy between positive law and Islamic criminal law in formulating policies that protect perpetrators while maintaining public order. Silver men, which are individuals who paint their entire body with metal paint and appear in public spaces to beg, have become a common sight in various major cities in Indonesia. This practice not only poses health risks due to exposure to hazardous chemicals, but also raises social and legal problems. Based on article 504 of the Criminal Code, begging in public places is a criminal offense that can be punished with imprisonment. However, a positive legal approach focuses more on enforcement than coaching. This study aims to analyze the self-exploitation behavior of silver humans from the perspective of Islamic criminal law with a focus on ta'zir sanctions and the principles of maqashid shari'ah. The research method used is a normative approach with qualitative analysis of fiqh literature, maqashid shari'ah and relevant laws and regulations. The results of the study found that the self-exploitation behavior of silver humans is contrary to the five main goals of sharia: to protect religion (hifz al-din), soul (hijz al-nafs), intellect (hifz al-'aql), heredity (hifz al-nasl), and property (hifz al-mal). Therefore, the imposition of ta'zir sanctions that are educational and rehabilitative in nature is more appropriate to create benefits, rather than just imprisonment as stipulated in the Criminal Code. Penelitian ini menekankan pentingnya sinergi dari hukum positif dan hukum pidana islam dalam merumuskan kebijakan yang melindungi pelaku sekaligus menjaga ketertiban umum. Manusia silver yaitu individu yang mengecat seluruh tubuhnya dengan cat logam dan tampil diruang publik untuk mengemis, telah menjadi pemandangan umum diberbagai kota besar Indonesia. Praktik ini tidak hanya menimbulkan resiko kesehatan akibat paparan bahaya kimia berbahaya, tetapi juga memunculkan permasalahan sosial dan hukum. Berdasarkan pasal 504 KUHP mengemis ditempat umum merupakan tindak pidana yang dapat dikenakan pidana kurungan. Namun pendekatan hukum positif lebih menitikberatkan pada penindakan daripada pembinaan. Penelitian ini bertujuan menganalisis perilaku eksploitasi diri manusia silver dari perspektif hukum pidana islam dengan fokus pada sanksi ta’zir dan prinsip maqashid syari’ah. Metode penelitian yang digunakan adalah pendekatan normatif dengan analisis kualitatif terhadap literature fiqih, maqashid syari’ah dan peraturan perundang-undangan yang relevan. Hasil penelitian menemukan bahwa perilaku eksploitasi diri manusia silver bertentangan dengan lima tujuan utama syariat: menjaga agama (hifz al-din), jiwa (hijz al-nafs), akal (hifz al-‘aql), keturunan (hifz al-nasl), dan harta (hifz al-mal). Oleh karena itu, penjatuhan sanksi ta’zir yang bersifat mendidik dan rehabilitative lebih sesuai untuk menciptakan kemaslahatan, dibandingkan sekedar hukuman kurungan sebagaimana diatur di KUHP.

Abstract

Legal protection for victims of terrorism should ensure justice and welfare for the victims, both from the perspective of Islamic criminal law and positive law. In reality, the application of law in Indonesia, particularly in the context of victim protection from terrorism, still faces challenges such as legal obstacles and limitations in victim protection mechanisms. This research aims to examine legal protection for terrorism victims from the perspectives of both Islamic criminal law and positive law. This article falls under qualitative legal research. The methodology employed is a normative juridical study with a correlational analysis between Islamic law and positive law. The findings conclude that legal protection for terrorism victims in the context of Islamic criminal law and positive law aims to protect victims' rights and ensure justice. Islamic criminal law emphasizes victim restitution through diyat (compensation) and qisas (retributive justice), while positive law in Indonesia focuses on restitution and state compensation. Despite their different approaches, both are complementary in ensuring victim protection.

Abstract

Penelitian dilakukan untuk menjawab permasalahan tinjauan hukum Islam terhadap parameter pemidanaan dalam KUHP, dengan pendekatan metode penelitian hukum normatif. Metode penelitian yang digunakan yaitu yuridis normatif dengan mekanisme pengumpulan data studi kepustakaan. Hasil analisis menyimpulkan bahwa parameter pemidanaan dalam KUHP Nasional telah memberikan parameter yang sangat efektif dalam menjatuhkan pidana mati bagi tersangka sebagaimana yang tertuang dalam pasal 54 KUHP Nasional, hal ini dilakukan melalui pendekatan sistem delphi yang telah dimodifikasi dengan cara memberikan skor pada setiap variabel dalam pasal a quo. Sejalan dengan hal tersebut, hukum pidana Islam juga memberikan parameter yang jelas dalam menjatuhkan terpidana yang notabene dijatuhi hukuman mati, dengan merujuk pada kitab Al-Wajiz, namun terdapat perbedaan yang cukup signifikan terkait jenis tindak pidana yang dilakukan. Sehingga tulisan ini akan memberikan gambaran mengenai pentingnya parameter dalam menjatuhkan hukuman mati bagi pelaku tindak pidana.

Abstract

This research delves into the role of children in the continuity of the nation and state, particularly in the context of criminal acts of child assault. The research focuses on understanding the considerations of judges in imposing sanctions and the application of these sanctions from the perspective of Islamic criminal law. Utilizing a qualitative approach and referring to the normative framework, data were collected through literature research, analysis of legal publications, and examination of relevant court decisions. Comprehensive analysis was conducted by evaluating judges and the imposition of sentences in the context of positive Indonesian criminal law. This study seeks to make a significant contribution to deepening the understanding of child protection in the legal realm, considering both positive legal aspects and the values of Islamic criminal law. The findings of this research are expected to provide deeper insights into the challenges and solutions that can be applied to protect children from acts of assault. The implications of these research findings can serve as a basis for formulating policy recommendations aimed at enhancing child protection from assault crimes. These recommendations may include concrete steps that can be taken by the government, legal institutions, and the community to create a safer and more supportive environment for children. As part of the effort to build a fair and just legal system, this research is expected to offer a holistic perspective on this issue, considering both the positive legal perspective and the values of Islamic law.

Abstract

This journal discusses the Legal Protection of Child Victims of Sexual Exploitation. What is meant by child sexual exploitation is the use of children for the purpose of fulfilling sexual desires. Children as victims of criminal acts need to be protected in accordance with what is regulated in Law No. 35 of 2014 concerning Child Protection so that in the future the child is expected to be able to continue his life like children in general and no longer have the feeling that he is a victim of crime. This paper uses a juridical-empirical legal research method with a qualitative approach. The results that can be taken from this paper are that the legal protection of children as victims of sexual exploitation based on Law No. 35 of 2014 concerning Child Protection has provided legal protection in general for children as victims of crime and specifically for children who are sexually exploited.

Abstract

Hukum pidana positif maupun hukum pidana Islam mengatur mengenai tindak pidana pembunuhan yaitu tindak pidana yang akibatnya menghilangkan nyawa seseorang. Pada dasarnya yang sering menjadi pembahasan adalah tindak pidana yang dilakukan oleh masyarakat umum atau masyarakat sipil, namun tindak pidana pembunuhan tidak menutup kemungkinan dilakukan oleh aparat penegak hukum yang dalam hal ini dimaksud adalah pihak kepolisian maka dari itu penelitian ini dilakukan untuk meneliti lebih dalam mengenai bagaimana ketentuan hukum bagi aparat kepolisian yang melakukan tindak pidana pembunuhan perspektif hukum pidana Islam. Dengan menggunakan dua rumusan masalah yaitu bagaimana pengaturan Hukum di Indonesia tentang tindak pidana pembunuhan yang dilakukan aparat kepolisian, dan bagaimana ketentuan hukum pidana Islam tentang tindak pidana pembunuhan yang dilakukan aparat penegak kepolisian. Penelitian ini merupakan penelitian yuridis normative dengan menggunakan tiga sumber data yaitu primer sekunder dan juga tersier. Hasil dari penelitian ini menunjukkan bahwa pandangan Hakim terhadap aparat penegak hukum yang melakukan tindak pidana pembunuhan yaitu mengikuti ketentuan hukum pada peradilan umum sebagaimana yang diatur di dalam pasal 338 sampai dengan 350 KUH Pidana, dan dalam perspektif hukum pidana Islam maka ditinjau dari jenis tindak pidana yang dilakukan dan tidak menutup kemungkinan untuk mendapatkan permohonan maaf dari pihak keluarga korban untuk mendapatkan keringanan.

Abstract

The restorative approach to the recovery of losses caused by criminal acts of corruption offers alternatives that focus on restoring relationships and losses compared to retributive approaches that only emphasize punishment. This study uses a normative juridical method with the law approach to analyze the basic principles of restorative approaches, recovery mechanisms, benefits, challenges, and implementation in Indonesia. The restorative approach is based on the principle of restoring losses, active participation of all parties, and reintegration of the perpetrators. The results of the discussion show that the restorative approach has the potential to increase justice and improve social relations, although there are still significant challenges. The application of this approach in Indonesia requires stronger legal and community support. This study concluded that the restorative approach can improve the law enforcement system with a greater focus on recovery and reintegration. Suggestions for further development include legal reform and increasing community participation to optimize the recovery of losses due to criminal acts of corruption, so that further legal reform is carried out to support restorative mechanisms and increase community participation.
