Abstract

This article wants to find several styles and models of spirituality in modern society that arise due to inner uncertainty in interpreting life in the modernization era. Modernity has indulged in ease and promised luxury in life as well as worship of science and technology and abandoned religious teachings. This research is of a normative type with a sufistic approach and is descriptive in nature which produces five features and two models namely: 1) heteronomy spirituality, 2) autonomous spirituality, 3) interactive spirituality, 4) extactic spirituality, and 5) constructive spirituality and 1) post-spirituality, and 2) urban sufism.Artikel ini ingin menemukan beberapa corak dan model spiritualitas masyarakat modern yang muncul akibat ketidakpastian batin dalam memaknai kehidupan di era modernisasi. Kemodrenan telah mengumbar kemudahan dan menjanjikan kemewahan dalam kehidupan sekaligus pemujaan terhadap ilmu pengetahuan dan teknologi serta meninggalkan ajaran agama. Penelitian ini berjeniskan normatif dengan pendekatan sufistis serta bersifat deskriftif yang menghasilkan lima corak dan dua model yakni: 1) spiritualitas heteronomy, 2) spiritualitas otonom, 3) spiritualitas interaktif, 4) spiritualitas ekstaktik, dan 5) spiritualitas konstraktif serta 1) post-spiritualitas, dan 2) urban sufism.

Abstract

This study discusses buying and selling contracts which are prohibited from the perspective of Islamic law. Basically, Islam itself allows buying and selling anything as long as it does not conflict with Shari'a law. But in reality, in practice there are still many buying and selling that are prohibited from being carried out. Normative research was carried out by searching the verses of the Qur'an, hadith and literature that are related to this discussion. The results of the search are analyzed qualitatively and are described with the aim of obtaining an explanation as intended in the discussion. Based on the study, it was found that several types of sale and purchase agreements were prohibited, including: 1) Selling and buying khamr, carrion, pigs and statues, 2) Selling and buying under subterfuge, 3) Selling and buying Gharar, 4) Selling and buying Najsy, and 5) Selling Buy usury.

Abstract

This study discusses the problems of the legal system in the implementation of health services for the community in Indonesia. The main focus of this study is on the discrepancy between the applicable regulations and the implementation, which has an impact on the non-optimal health services. Factors such as weak coordination between agencies, limited human resources and health facilities, and lack of supervision over the implementation of regulations are the main obstacles. The research method used is a normative juridical approach by reviewing laws and regulations. The results of the study show the need for regulatory harmonization and strengthening of the supervision system to ensure fair and equitable health services. In addition, improving the quality of human resources and health infrastructure is a crucial factor in realizing optimal health services.

Abstract

The increase in international migration has led to a growing number of migrant workers in irregular or illegal situations, especially from developing countries such as Indonesia. In reality, illegal migrant workers are often seen solely as violators of immigration laws, so their presence is often associated with repressive actions such as detention and deportation. In addition, the presence of illegal migrant workers often creates vulnerabilities, including exploitation, discrimination, human trafficking, and limited access to justice. This study aims to analyze the understanding of human rights protection for illegal migrant workers and state responsibilities in the context of international law. The method used in this study is normative legal research with a legislative and conceptual approach, through an analysis of international legal instruments such as the Universal Declaration of Human Rights, ICCPR, ICESCR, and ILO Convention No. 143 of 1975. The research findings show that illegal migration status does not eliminate the basic rights of migrant workers as individuals with human rights. The state is responsible for respecting, protecting, and fulfilling the rights of illegal migrant workers without discrimination. This protection includes the right to decent working conditions, fair wages, protection from exploitation, and access to justice. Therefore, migration policies based on human rights and alignment of national laws with international legal standards are needed to ensure humane and fair protection for irregular migrant workers.

Abstract

Penelitian ini bertujuan untuk menganalisis efektivitas International Criminal Court (ICC) dalam menanggulangi kejahatan perang di tengah dinamika konflik kontemporer yang semakin kompleks. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Data sekunder dianalisis secara kualitatif untuk mengevaluasi hambatan yuridis dan politis mahkamah. Temuan penelitian menunjukkan bahwa efektivitas ICC terhambat oleh tiga faktor utama: ambiguitas prinsip komplementaritas yang sering dimanipulasi oleh negara melalui peradilan semu (sham trials), tantangan validasi bukti digital (Open Source Intelligence) dalam konflik asimetris, serta ketergantungan ekstrem pada kerja sama politik negara anggota dalam eksekusi surat penangkapan. Kasus surat penangkapan terhadap Vladimir Putin menegaskan bahwa tanpa mekanisme eksekusi yang otonom dan pembaruan standar pembuktian digital, ICC berisiko hanya menjadi instrumen keadilan yang bersifat simbolis dan selektif terhadap kekuatan geopolitik besar.

Abstract

Traditional knowledge in the culinary field constitutes a form of communal intellectual property containing significant cultural, social, and economic values for Indonesian society. One prominent example is rendang, originating from Minangkabau traditions and recognized internationally. This research aims to examine legal protection for Indonesian culinary traditional knowledge under the Trade Related Aspects of Intellectual Property Rights (TRIPS) Agreement, and to analyze the legal implications of Malaysia's claim over rendang. Using normative legal research methods supported by primary, secondary, and tertiary legal materials, the results indicate that although TRIPS has been ratified through Law No. 7 of 1994, protection of traditional knowledge in Indonesia still faces significant obstacles including limited legal regulations, weak law enforcement, and low public awareness. National inventory of communal intellectual property is identified as a crucial step to document and strengthen the legal basis for Indonesia's traditional knowledge, including through international recognition via UNESCO.

Abstract

Although the prohibition on the use of force has been established in international law, contemporary armed conflicts continue to challenge its application, particularly regarding aggression. This study aims to analyze the qualification of the 2026 military strikes by the United States and Israel against Iran as a crime of aggression under the Rome Statute of the International Criminal Court (ICC), and to examine the use of self-defense and its implications for international law enforcement. The research employs a normative juridical method using statutory and conceptual approaches, supported by primary and secondary legal materials. The findings indicate that the military action fulfills the elements of the crime of aggression due to absence of United Nations Security Council authorization and lack of a valid self-defense justification. Furthermore, the study reveals that the expansion of self-defense, particularly preventive self-defense, poses a serious threat to international legal norms. The limitation of ICC jurisdiction weakens enforcement of international criminal law against powerful states. This study concludes that strengthening legal frameworks is essential to ensure accountability. It is recommended that international legal mechanisms be reformed to enhance consistency and fairness in addressing acts of aggression.

Abstract

Young people are the buds, potential, and generation that will carry forward the ideals of the nation and state in the future. Children must undergo character development, which is a process that involves actions taken to live a worthy life. The character of a country determines how far the country can progress. Children need proper education to develop good character. Becoming better begins with knowledge, which also helps a person to distance themselves from negative traits such as acts of corruption. Corruption is the act of abusing trust in an organization or in something to benefit oneself. Corruption is behavior that can hurt many aspects of people's lives, including income, poverty, and economic growth. This can also cause several problems resulting in significant losses for the country. Therefore, efforts are needed to eradicate corruption, especially for children who are still in elementary school. Give children a definition of corruption and teach them the importance of respecting authority figures. This research aims to teach Indonesian citizen children in Kampung Pandan Malaysia that moral qualities can protect a person from negative things, such as corruption.
