Abstract

This study aims to analyze the dispute resolution mechanisms and the dynamics of legal aspects in Islamic banking practices in Indonesia. The background of this research is based on the rapid development of the Islamic banking industry accompanied by an increasing potential for disputes due to default, differences in contract interpretation, and violations of Islamic principles. This study uses a qualitative approach with a normative (doctrinal) research type through a library study of laws and regulations, legal literature, and court decisions. The results show that Islamic banking disputes have unique characteristics that are not only contractual, but also contain normative-religious dimensions because they must meet the principles of Islamic compliance. Dispute resolution can be achieved through two channels: non-litigation (negotiation, mediation, and Islamic arbitration) which emphasizes the principles of deliberation and substantive justice, and litigation through the Religious Courts which provides legal certainty. In addition, the dynamics of legal aspects in Islamic banking practices indicate challenges in the form of legal pluralism, regulatory disharmony, and the development of Islamic financial technology that requires legal adaptation. Thus, it is necessary to harmonize positive law and sharia principles as well as increase the capacity of law enforcement agencies in order to create a dispute resolution system that is effective, fair and provides legal certainty for the parties.

Abstract

Sistem perbankan syariah merupakan entitas perbankan yang menjalankan operasionalnya berlandaskan pada ketentuan-ketentuan syariat Islam, dengan penekanan utama pada pengharaman riba, gharar, dan maisir. Ragam produk serta layanan primer yang disediakan oleh perbankan syariah mencakup skema pembiayaan, fasilitas simpanan, dan berbagai jasa keuangan lainnya yang telah diselaraskan dengan hukum Islam. Skema pembiayaan yang ditawarkan meliputi akad murabahah, musyarakah, mudharabah, dan ijarah, sementara fasilitas simpanan terdiri atas tabungan wadiah serta deposito mudharabah. Di samping itu, perbankan syariah turut menyajikan layanan perbankan digital, konsultasi keuangan berbasis syariah, dan instrumen investasi melalui sukuk. Implementasi produk dan layanan tersebut bertujuan untuk menghadirkan manfaat ekonomi yang berkeadilan, transparan, dan selaras dengan etika syariah, sekaligus mendorong inklusi keuangan bagi seluruh lapisan masyarakat.

Abstract

The advancement of technology and knowledge has driven global innovation, transforming social, personal interactions, and economic transactions through the internet. Technology companies such as software, web, and internet play a crucial role in Indonesia's industry, particularly in the innovation of economic transactions known as financial technology (fintech). Meanwhile, Shariah financial systems, based on Shariah principles, offer ethical and just alternatives in financial management, known as Shariah fintech. This study employs literature review methods to examine Shariah fintech as a key instrument in future financing. Research findings indicate that there are currently 7 Shariah fintech P2P lending companies established in Indonesia. Shariah fintech's advantages in financing instruments over conventional methods include unique regulations tailored for Shariah fintech, direct oversight by the Shariah Supervisory Board (DPS), and operations based on Shariah principles. Furthermore, Shariah fintech supports sustainable economic growth by avoiding financing sectors that are prohibited and promoting profit-sharing models. Regulatory support from the government, OJK, and DSN-MUI creates an environment conducive to the development of the Shariah financial industry. Overall, with the world's largest Muslim population, Shariah fintech not only provides Shariah-compliant financing solutions and promotes financial inclusion but also plays a crucial role in supporting sustainable economic growth in Indonesia.

Abstract

The Shariah Supervisory Board (DPS) plays a vital role in ensuring that the operations and financial products of Islamic financial institutions comply with Shariah principles. This research aims to explore the roles, responsibilities, and challenges faced by DPS through analyzing the available literature. Through the literature study method, this research analyzes various secondary sources, including scientific articles, books, regulations, and reports from Islamic financial institutions. The results show that DPS has a key role in providing trust to stakeholders, but also faces various challenges, such as the lack of uniform global standards and limited resources. This study provides recommendations to strengthen the role of DPS, including improved training and education of DPS members, as well as harmonization of regulations at the international level. Thus, DPS can be more effective in supporting the sustainable growth of the Islamic finance industry in accordance with Islamic principles.

Abstract

This study aims to determine the effect of Attitude, Green Product, and Digital Marketing on the Consumptive Behavior of Generation Z in Pekanbaru City from the perspective of Maqasid Syariah. This research uses a quantitative approach with data collected through questionnaires distributed to 399 Generation Z respondents in the Binawidya District, Pekanbaru City. Data analysis was conducted using SPSS version 26 with validity, reliability, classical assumption tests, t-test (partial), F-test (simultaneous), and coefficient of determination (R²). The results show that the Attitude variable has a positive and significant effect on Consumptive Behavior (t = 86.170 > 1.996; Sig. = 0.000 < 0.05), Digital Marketing also has a positive and significant effect (t = 3.276 > 1.996; Sig. = 0.001 < 0.05), while Green Product has no significant effect (t = -0.418 < 1.996; Sig. = 0.676 > 0.05). Simultaneously, the three variables have a significant effect on Consumptive Behavior (F = 4953.606; Sig. = 0.000 < 0.05) with an R² value of 0.974, indicating that 97.4% of the variation in consumptive behavior is explained by these variables From the perspective of Maqasid Syariah, the findings suggest that the consumptive behavior of Generation Z can be directed toward ethical and value-based consumption through the preservation of (Hifzh Ad-Din), intellect (Hifzh al-‘Aql), wise management of wealth (Hifzh al-Mal), and environmental awareness (Hifzh al-Nafs and Hifzh al-Nasl). Therefore, Islamic principles play a crucial role in shaping balanced and responsible consumption patterns in the digital era.

Abstract

This study aims to analyze the implementation of Antam gold buying and selling transactions at the ABC Pekanbaru gold shop from the perspective of Maqasid Sharia. Gold as a ribawi commodity has special provisions in its buying and selling practices, so a transaction mechanism is needed that is not only valid according to Islamic jurisprudence, but also able to realize benefits and avoid harm. The Maqasid Sharia approach, especially in safeguarding assets (hifz al-mal), is used to assess the suitability of gold transaction practices with the main objectives of Sharia. This study uses a qualitative method with a descriptive approach. Data were obtained through interviews with employees and customers of the ABC Pekanbaru gold shop, and supported by documentation. The analysis was carried out by linking field findings with the five objectives of Maqasid Sharia, namely protection of religion, life, mind, descendants, and property. The results show that protection of assets is a very prominent objective of Maqasid Sharia in gold buying and selling practices at the ABC Pekanbaru gold shop, this protection is realized through clear contracts, price transparency that follows market mechanisms, and the availability of buyback facilities that provide certainty of value and liquidity for customers. This mechanism protects customers from the risk of fraud and unreasonable losses, but based on the different views of Islamic scholars who require gold transactions to be carried out in cash and direct handover, the provision of cash transaction services is an important step to ensure that the assets owned by customers are truly protected from elements of usury and are valid according to Sharia.

Abstract

Pasar modal syariah menjadi salah satu instrumen strategis dalam memperkuat perkembangan ekonomi Islam, yang berorientasi pada penerapan prinsip-prinsip syariah serta berlandaskan pada tujuan fundamental maqashid syariah. Penelitian ini berfokus pada analisis integrasi prinsip-prinsip maqashid syariah dalam perumusan regulasi serta pengembangan instrumen pasar modal syariah di Indonesia, ditinjau melalui perspektif hukum dan ekonomi Islam. Pendekatan penelitian yang digunakan bersifat kualitatif dengan metode studi kepustakaan, yang menelaah berbagai regulasi Otoritas Jasa Keuangan (OJK), fatwa Dewan Syariah Nasional Majelis Ulama Indonesia (DSN-MUI), serta sumber-sumber literatur relevan lainnya. Hasil penelitian menunjukkan bahwa penerapan maqashid syariah telah membentuk model maqashid-oriented regulation, di mana regulasi pasar modal tidak hanya menekankan kepatuhan hukum formal, tetapi juga nilai kemaslahatan, keadilan, dan perlindungan investor. Integrasi antara OJK dan DSN-MUI memperkuat legitimasi hukum dan moral pasar modal syariah serta mendorong inovasi produk keuangan seperti green sukuk dan social sukuk yang berorientasi pada kesejahteraan sosial. Penelitian ini merekomendasikan penguatan indikator kinerja maqashid dan peningkatan literasi keuangan syariah sebagai dasar pengembangan pasar modal yang etis, inklusif, dan berkelanjutan. (The Islamic capital market is a strategic instrument for strengthening the development of the Islamic economy, oriented towards the application of sharia principles and based on the fundamental objectives of maqashid sharia. This research focuses on analyzing the integration of maqashid sharia principles in the formulation of regulations and the development of sharia capital market instruments in Indonesia, viewed from the perspective of Islamic law and economics. The research approach used is qualitative with a literature study method, which examines various regulations of the Financial Services Authority (OJK), fatwas of the National Sharia Council of the Indonesian Ulema Council (DSN-MUI), and other relevant literature sources. The results show that the application of maqashid sharia has formed a maqashid-oriented regulation model, where capital market regulations emphasize not only formal legal compliance but also the values of welfare, justice, and investor protection. The integration between the OJK and DSN-MUI strengthens the legal and moral legitimacy of the Islamic capital market and encourages innovation in financial products such as green sukuk and social sukuk that are oriented towards social welfare.
