Abstract

Based on Indonesian ideals of environmental concern, the green economy was started to transform economic development. The green economy is a spoke of sustainable development because of its revolutionary and transformative effects in the fields of economics, society, and the environment. Unintentionally, numerous laws and regulations include provisions related to the green economy. It is fascinating to analyze from the standpoint of Islamic legal maxims (fiqh rules or qawaid fiqhiyyah) in order to illuminate the significance and motivation behind the adoption of pertinent legal rules and policies. This study intends to investigate the substance of legal studies on the green economy in Indonesia before further analyzing it in light of Islamic legal principles. The research findings are interpreted using a normative juridical research technique. The study of positive law and the literature on Islamic law are sources of information. The study's findings indicate that there isn't a particular law that has provisions related to the green economy in terms of terminology. However, laws and government rules pertaining to environmental protection from an economic standpoint can be found that contain the substance. Therefore, in Presidential Decree No. 98/2021, the government more thoroughly regulates it. Government initiatives and laws pertaining to the green economy can be seen from the perspective of Islamic legal maxims as fulfilling fiqh norms. The current policy is a legal requirement that obliges the legal community to abide by it and contribute to the realization of a green economy. It represents the government's goal to eliminate the risks brought on by environmental degradation.

Abstract

Penelitian ini bertujuan untuk menjelaskan konsep pengembangan industri halal yang didasarkan pada potensi, kendala dan dampak. Mandatori halal, yaitu kewajiban sertifikasi halal yang diberlakukan kepada seluruh pelaku usaha sesuai dengan ketentuan Pasal 4 Undang-undang No. 33 Tahun 2014 Tentang Jaminan Produk Halal. Selama ini hanya sebagian dari pelaku Usaha Mikro Kecil dan Menengah di Kota Jayapura yang bersertifikat halal. Kewajiban sertifikasi halal akan membantu mengembangkan industri halal di Kota Jayapura. Penelitian ini menggunakan deskriptif kualitatif dengan pendekatan yuridis-normatif. Hasil penelitian menjelaskan bahwa penahapan kewajiban sertifikasi halal untuk produk makanan dan minuman sampai dengan tahun 2024 (Pasal 140 Peraturan Pemerintah No. 39 Tahun 2021 Tentang Penyelenggaraan Bidang Jaminan Produk Halal). Potensi tersebut meliputi adanya sertifikasi halal gratis, self declare (ikrar halal) dan banyaknya pelaku Usaha Mikro Kecil dan Menengah yang dilakukan oleh mama-mama Papua. Kendala sertifikasi halal meliputi beralihnya kewenangan dari Majelis Ulama Indonesia kepada Badan Penyelenggara Jaminan Produk Halal, kurangnya pemahanan pentingnya label halal dan penguasaan penggunaan perangkat elektronik. Dampak dari mandatori halal akan membantu meningkatkan kepercayaan konsumen, pengembangan usaha, dan membantu pencapaian program pemerintah.

Abstract

The halal mandatory forces business actors in Papua to carry out halal certification. So far, business actors in Papua do not know the essence of mandatory halal and its implications. This study aims to examine the mandatory halal phenomenon that applies to business actors in Papua. Imam Abu Zahrah's sharia maqasid approach serves to interpret this phenomenon. A qualitative descriptive research method with a phenomenological study approach was used in this study. Data collection by means of passive participatory observation and exploration of normative juridical literature. The results of the study show that mandatory halal is able to have a positive impact on economic growth and development in Papua. With mandatory halal, business actors in Papua can increase the existence of their products, especially for local products in terms of market expansion. From the perspective of Imam Abu Zahrah's maqashid sharia, the mandatory granting of halal certification fulfills maslahah on three elements. First, tahdzib al fard in the form of providing education to business people in Papua about the importance of halal products for consumers. Second, Iqamah Al'Adalah (upholding justice) in the form of the generalization that all products produced by Muslim or non-Muslim business actors have the right to obtain halal certification. Third, Jalb Al Maslahah (public interest) in the form of rights for consumers throughout Indonesia that the products consumed from Papua are clearly halal for the benefit.

Abstract

Hen Tecahi Yo Onomi T'mar Ni Hanased is a motto that describes Port Numbay (Jayapura City). The contextualization of the motto is not only a symbol of writing, but also has implications for the values of religious moderation in Jayapura City. The purpose of this study is to provide an analysis of the implications of the contextualization of the Jayapura city motto on the values of religious moderation. The qualitative content analysis method is used as an approach in this study. The results showed that the motto Hen Tecahi Yo Onomi T'mar Ni Hanased is a form of representation of local wisdom of Port Numbay.  The motto has been attached to the community in Jayapura City, even textually the motto is written in many office agencies, government agencies, road balio, and school agencies. The contextualization of the motto contains religious moderation values that describe the life of the people of Jayapura City. The values of religious moderation reflected in the motto are the values of tolerance, unity, accommodating local culture, and creating religious harmony. Given that Jayapura City is known as a multi-ethnic area. So that the strengthening of the contextualization of the motto makes Port Numbay a peaceful city.

Abstract

The significant role of halal Micro and Small Enterprises (MSEs) in Indonesia's economy and the challenges they face in accessing capital from conventional financial institutions. With the rise of digital financial technologies, Sharia-based Securities Crowdfunding (SCF) platforms using sukuk offer a promising alternative for providing halal-compliant funding to these enterprises, facilitating their growth and contribution to the halal industry. Therefore, The purpose of this research is to evaluate the feasibility of using Sharia-based Securities Crowdfunding (SCF) with sukuk as an alternative financing solution for halal Micro and Small Enterprises (MSEs) in Indonesia. The proposed method utilizes a prospective analysis to determine the viability of a sukuk-based Sharia SCF using qualitative descriptive research methods, including literature studies, are employed to delve more into the findings of the analysis. The study's findings indicate that sukuk-based Sharia SCF can serve as a viable alternative source of business capital that is assured to be halal. MSE actors have the opportunity to enhance their business by leveraging the SCF provider platform in Indonesia, which offers attractive investment returns. SHAFIQ and LBS Crowdfunding are platforms that facilitate the execution of sharia-compliant investments, specifically sukuk. Enforcing halal certification as a requirement can serve as a catalyst for the growth of the Micro, Small, and Medium Enterprises (MSE) sector in Indonesia, positioning it as a key player in the halal industry by 2024. The research implies that sukuk-based Sharia Securities Crowdfunding (SCF) can significantly improve capital access for halal Micro and Small Enterprises (MSEs) in Indonesia, fostering their growth and sustainability. This approach also strengthens Indonesia's position in the global halal market by ensuring halal compliance in financing.

Abstract

Islamic philanthropy is part of Sustainable Development Goals (SDGs) as per Article 3 [b] Presidential Regulation No.111 of 2022, highlighting the legal framework (Presidential Regulations No.111/2022) and its connection to SDGs. This research aims to analyze to what extent Islamic philanthropic institutions can achieve SDGs according to Article 3 [b]. This research used a descriptive qualitative with an empirical juridical approach. Primary data was obtained from interviews and documentation, while secondary data came from legal materials. Atltas.ti software version 9.0 was used to analyze the data. The results show planning was carried out by getting involved in the preparation of a national development plan, contributing to national and regional action plans, and reducing SDG programs in the institution's strategic plan. The implementation, however, only focuses on blended financing schemes and initiates a ‘program follows money’ approach to aligning all programs with SDGs. In terms of monitoring and evaluation, these aspects are still constrained by filling in the reporting matrix, which needs converting. The contribution of this research is to contextualize the role of Islamic philanthropic institutions towards SDGs by providing policy recommendations for the government, such as enhancing the role of philanthropic institutions, developing blended financing schemes, legal reforms, and multisector collaboration. Lembaga filantropi Islam merupakan bagian dari lembaga yang terlibat dalam mewujudkan SDGs di Indonesia dan telah diatur melalui Peraturan Presiden No.111 Tahun 2022. Tujuan penelitian untuk melihat sejauhmana lembaga filantropi Islam dalam mencapai SDGs ditinjau dari sisi regulasi. Jenis penelitian ini adalah deskriptif kualitatif dengan pendekatan yuridis empiris. Data primer diperoleh dari wawancara dan dokumentasi, sedangkan data sekunder berasal dari bahan hukum (perundang-undangan). Seftware Atltas.ti versi 9.0 digunakan sebagai tools untuk mengananalisis data. Hasil penelitian menunjukkan bahwa bentuk perencanaan dilakukan dengan turut terlibat dalam penyusunan rencana pembangunan nasional, pengisian rencana aksi nasional dan daerah, serta menurunkan program SDGs dalam rencana strategis lembaga, dari segi pelaksanaan hanya berfokus pada skema blended finance serta diperlukan inisasi “programme follows money” untuk meng in-line kan seluruh program dengan SDGs, dari segi pemantauan dan evaluasi masih terkendala dengan pengisian matriks pelaporan yang dinilai perlu dikonversi. Penelitian ini berkontribusi dalam wujud konteksualisasi peran lembaga filantropi Islam terhadap pencapaian SDGs sekaligus memberikan rekomendasi kebijakan yang ditujukan kepada pemerintah seperti peningkatan peran lembaga filantropi, pengembangan skema blended finance, pembaharuan hukum dan kolaborasi multi-sektor.

Abstract

Green retail sukuk is a new study to solve government infrastructure development problems from a funding perspective. These problems can be answered by retail green sukuk. In its application, green retail sukuk uses the construction of the wakalah contract as the basis for the contract. This study aims to examine more deeply the existence of green retail sukuk in supporting sustainable development in Indonesia and explore the position of wakalah contracts during the issuance process. A qualitative content analysis approach is used as the analytical method. This study emphasizes the context analysis of the results of a comprehensive literature study. The results showed that green retail sukuk offered two types of investment, namely Sukuk Ritel (SR) and Sukuk Tabungan (ST). Each of these types has unique and different characteristics. The application of the wakalah contract used in the two types is different, and is more dominant in the savings sukuk scheme. Even though the wakalah contract is used as the basic contract construction for the two types of retail sukuk. Promoting green retail sukuk is able to provide alternative implications for disaster mitigation in Indonesia through investment support for the development of sustainable government green projects.

Abstract

The 2030 Sustainable Development Goals (SDGs), particularly Goal 3: Good Health and Well-being, emphasize the importance of healthy living and well-being for all. This study explores the Islamic concept of Syumuliyah – the holistic and comprehensive nature of Islamic teachings – as a potential framework for achieving this critical SDG. Through a qualitative library research approach, this study examines how Islamic principles, including those related to health, hygiene, and spiritual well-being, can contribute to the realization of SDG 3. Findings indicate that Islamic teachings offer a comprehensive approach to health, encompassing physical, mental, and spiritual dimensions. Key elements include the importance of cleanliness, proper nutrition, physical activity, and spiritual practices such as prayer and reflection. Notably, medical education can be traced back to the verses of the Qur'an and the Sunnah of the Prophet Muhammad (SAW), emphasizing the importance of preventive healthcare and holistic well-being. By embracing the Syumuliyah of Islam, individuals and communities can cultivate healthier lifestyles and contribute to the overall well-being of society, thereby advancing the objectives of SDG 3.

Abstract

Abstract: The existence of ecotourism in Indonesia needs a massive boost. Thus far, the development of ecotourism has yet to be optimal despite its significant implications in responding to the achievement of a green economy. Ecotourism offers uniqueness by prioritizing environmental conservation as a selling point and requires an appropriate development model. This research aims to address the challenges of ecotourism development based on a green economy using the alternative Fiqh Biah model. A qualitative research method with a qualitative content analysis approach was employed. The content analysis focused on ecotourism in Indonesia, the Green Economy, and Fiqh Biah. The results indicate an interconnection between ecotourism and the Green Economy regarding impacts on the economic, social, and environmental sectors. The suggested construction for ecotourism development includes: 1) Hima’: an alternative for forest-based ecotourism development, 2) Harim: a protection and mitigation system for ecotourism, and 3) Ihya al-Mawat: an opportunity to create new ecotourism by utilizing abandoned land. Abstrak: Eksistensi ekowisata di Indonesia perlu didorong lebih massif. Sejauh ini, pengembagan ekowisata belum maksimal. Meskipun implikasinya sangat besar dalam merespon pencapaian green economy. Sebab ekowisata tidak hanya mempunyai keunikan, yaitu mengutamakan konservasi lingkungan sebagai nilai jual. Konstruksi model pengembangan ekowisata yang tepat sangat diperlukan. Penelitian ini bertujuan untuk menjawab tantangan pengembangan ekowisata yang berasis green economy menggunakan alternatif model Fiqh Biah. Metode penelitian kualitatif dengan pendekatan qualitative content analysis. Analisis konten yang dimaksudkan berfokus pada topik ekowisata di Indonesia, green economy dan Fiqh Biah.  Hasil penelitian menunjukkan bahwa terdapat interkoneksi antara ecotourism dan green economy dari segi dampak pada sektor ekonomi, social dan lingkungan. Kemudian konstruksi yang disarankan untuk pengembangan ekowisata meliputi: 1) hima’: sebagai alternatif pengembangan ekowisata berbasis hutan, 2) Harim : sebagai sisten proteksi dan mitigasi ekowisata, dan 3) Ihya al-Mawat: menjadi peluang untuk menciptakan ekowisata baru dengan memanfaatkan tanah terlantar.
