Abstract

This research evaluates the peace arrangements in PKPU and their potential to cause injustice to debtors. It also examines the legal implications of bankruptcy decisions on rejected peace plans submitted by debtors to PKPU. The research uses a statutory, conceptual, and case approach, drawing from primary legal materials such the 1945 Constitution of the Republic of Indonesia, BW, HIR, RBG, the Bankruptcy and PKPU Laws, the Judicial Powers Law as well as PKPU decisions. Secondary sources such as scholarly articles and books authored by bankruptcy and PKPU experts, as well as tertiary sources such as dictionaries and encyclopedias, were also utilized. The research findings reveal that: (1) the rejection of the settlement by the creditor causes injustice, due to the creditor's unreasonable grounds for rejection. However, the Bankruptcy Law and PKPU grant rights to the creditor under Article 222 paragraph (2), Article 289, and Article 281, enabling them to bankrupt the debtor on the grounds that the debtor's peace plan does not cover the entire amount of the debt. (3) a bankruptcy decision resulting from the rejection of a debtor's peace plan is an unsuitable decision that causes significant losses for both the debtor and the creditor.

Abstract

judul artikel ini adalah menegakkan kesetaraan: perlindungan hukum bagi penumpang difabel pada transportasi laut, Persoalan hukum terkait pemenuhan hak-hak penyandang disabilitas pada transportasi laut merupakan hal yang sangat penting. Tidak jarang penumpang disabilitas tidak mendapatkan haknya. Oleh karena itu, beberapa dari mereka terkadang mengalami kesulitan hingga terjatuh, diharapkan hak-hak penumpang disabilitas dapat terpenuhi dengan baik. Dengan menerapkan metode kualitatif, artikel ini bertujuan untuk mengetahui pengaturan dan implementasi hak-hak penumpang disabilitas pada transportasi laut. Hasil penelitian mengungkapkan bahwa pemenuhan hak-hak penumpang disabilitas khususnya pada transportasi laut belum maksimal. Oleh karena itu, pemerintah Indonesia harus melakukan peninjauan secara komprehensif terhadap peraturan perundang-undangan yang ada untuk memastikan seluruh pihak yang terlibat dapat bekerja dengan baik untuk pemenuhan hak-hak penumpang disabilitas pada transportasi laut.

Abstract

The rapid adoption of smartwatches in the healthcare sector presents a fundamental duality between the potential for medical innovation and systemic risks to the right to privacy. This research aims to critically analyze the juridical-ethical gap between the health data governance practices of the smartwatch industry and the normative standards mandated by Law Number 27 of 2022. Using a normative legal research method and a gap analysis approach, this study dissects how industry practices systematically create a transparency deficit and devalue the meaning of informed consent into an illusory agreement. The analysis reveals a diametrical opposition between the regulatory ideal (das sollen), which prioritizes user autonomy, and the reality of industry practices (das sein), which are driven by commercial interests and formalistic compliance. This gap not only exposes users to data exploitation but also challenges the effectiveness of Law Number 27 of 2022 in addressing the complexity of wearable technology. Therefore, this research recommends a paradigm shift from the fragile consent-based model to a rights-based model. Furthermore, it urges the formulation of specific implementing regulations for the health technology sector to bridge the existing gap and build a fair and accountable digital ecosystem.

Abstract

The issue of child marriage and education are closely interconnected. One of the factors contributing to the increasing number of marriage dispensation requests for minors is the lack of access to education, particularly among children who drop out of school due to financial limitations.The article aims to analyze the role of education in reducing the number of marriage dispensation requests for minors. It focuses on emphasizing the importance of education in preventing early marriages and promoting better decision-making among children. The study employs a doctrinal method using a qualitative legal research approach. It examines existing legal frameworks and educational factors related to child marriage in Indonesia. The research reveals that education plays a significant role in reducing marriage dispensation requests by equipping children with a better understanding of marriage and its implications. This empowers them to make more informed decisions. The study also suggests that the government should review and strengthen legal protections while ensuring the right to education for children to help address this issue.

Abstract

Cases of corporations unable to pay fines for environmental damage continue to increase, with bankruptcy often chosen as a means to resolve such liabilities. This study aims to analyze the legal protection of the state as a preferred creditor in cases of corporate bankruptcy caused by environmental harm, with a case study of PT Ricky Kurniawan Kertapersada. The research employs a qualitative method using legislative, case, and comparative approaches to examine Indonesia’s bankruptcy law. The novelty of this research lies in the idea of recognizing environmental debts as “ecological preferred claims” and the urgency of progressive legal mechanisms to safeguard the state’s right to environmental recovery even when companies go bankrupt. The findings show that Indonesia’s bankruptcy regulation remains privatistic and fails to accommodate ecological justice, often neglecting state claims. Therefore, this study recommends amending Law No. 37 of 2024 on Bankruptcy and PKPU.
