Abstract

This article discusses maintaining family integrity through Ruqyah Syar'iyah from the perspective of Maqashid Syari'ah at the Ruqyah Syar'iyah Institute in Aceh. The importance of writing this article is based on the complexity of the challenges faced by modern families, including the threat of tafriq magic to house hold harmony. The purpose of this article is to explore the concept of Ruqyah Syar'iyah and analyze its contribution in maintaining family integrity. This research uses a field approach with a case study at the Aceh Ruqyah Syar'iyah Institute, involving observation, interviews, and literature study. The results of the discussion include an in-depth understanding of Ruqyah Syar'iyah as a form of Islamic medicine and the urgency of applying Maqashid Shari'ah in maintaining the family. The conclusion of this article is that understanding the concept of Ruqyah Syar'iyah and the application of Maqashid Syari'ah are important foundations in maintaining family integrity, creating an atmosphere of rabbaniyah, and maintaining the noble purpose of marriage as part of Islamic preaching.

Abstract

This study aims to explain hudur al-qalb as a tasawuf psychotherapy method for mental health. As a literature research, this article will examine hudur al-qalb in the thinking of Sufi experts, such as al-Ghazali and Ibn al-’Arabi, and to what extent it can provide benefits in mental health, namely peace of mind and soul. This research has implications for efforts to cure mental stress by tasawuf psychotherapy. This research is qualitative in nature, namely it is carried out by collecting, analyzing, and interpreting narratives comprehensively on visual data to gain complete, comprehensive and holistic insight into the phenomenon of hudur al-qalb. The results of the study found that Hudur al-qalb is a condition in which the heart is awake, namely in a stand-by position. This vigilance keeps the heart in awareness, and of course in vigilance. This wakefulness keeps the heart in awareness and in ‘mindfulness’. This condition leads to intelligence of mind, meaning of life, clarity of heart, as well as silence and reassurance of the soul. In addition, this condition can also eliminate mental anxiety and reduce negligence.

Abstract

The purpose of the research is to find out how the performance of Nazhir in the management of waqf land in Tanjung Morawa Subdistrict, to find out what are the steps taken by Nazhir in Tanjung Morawa Subdistrict in productive waqf management, and to find out what are the inhibiting factors for productive waqf management in Tanjung Morawa Subdistrict. The research conducted is social research. The research method used in this discussion is qualitative research method. The approach that the author uses in discussing this research is an empirical or sociological approach. The method of data collection carried out by the author is by means of field observation and examining the data sources that the author mentions, namely primary, secondary, and tertiary. The management of waqf land carried out by Nazhir in Tanjung Morawa District has not led to productive waqf, only limited to maintenance and utilization, In general, the management of waqf land in Tanjung Morawa District is still in the traditional and consumptive period, which is only effective in terms of social religion. The steps taken by Nazhir in developing waqf productively in Tanjung Morawa District are: The making of the baitul Mall box carried out by the Nazhir of the Shalatul falah mosque and the management of rice fields as a baitul mall carried out by Mr. Masduki in Punden Rejo Village, where the proceeds from the rice fields are used as a source of KAS income for the mosque and are also distributed to underprivileged people. factors that hinder the development of productive waqf in Tanjung Morawa District, including: The strength of the old understanding of Muslims regarding waqf management, Lack of socialization to Nazir and Nazirs who are not professional in carrying out productive waqf management.

Abstract

Zakat, as a central pillar of Islamic socio-economic justice, serves not only as a religious obligation but also as a mechanism for redistributing wealth and promoting social welfare. In Indonesia, where Pancasila functions as the national ideology and moral compass of development, the implementation of zakat reflects a convergence between faith-based ethics and state-based welfare ideals. This study examines zakat as a social welfare instrument that operationalizes the philosophical values of Pancasila within Indonesia’s pluralistic welfare system. While existing studies largely focus on the economic or administrative dimensions of zakat, this research contributes by conceptualizing zakat as an ideological and ethical mechanism that bridges Islamic moral economy and state-based welfare principles. Employing a qualitative normative–sociological approach, the study analyzes Islamic legal sources, national zakat regulations, particularly Law No. 23 of 2011 on Zakat Management, and institutional practices of the National Zakat Agency (BAZNAS) through document analysis and institutional interpretation. The findings demonstrate that zakat implementation in Indonesia embodies Pancasila values through three integrative dimensions: spiritual justice grounded in belief in One Almighty God, social solidarity reflecting humanitarian and communal ethics, and distributive justice aligned with the fifth principle of Pancasila—social justice for all Indonesian people. This study argues that the zakat–Pancasila nexus offers an inclusive and ethically grounded welfare model, providing both theoretical insights for Islamic legal studies and practical implications for public welfare governance in Indonesia. Zakat, sebagai salah satu pilar utama keadilan sosial-ekonomi Islam, tidak hanya berfungsi sebagai kewajiban keagamaan, tetapi juga sebagai mekanisme redistribusi kekayaan dan peningkatan kesejahteraan sosial. Di Indonesia, di mana Pancasila berfungsi sebagai ideologi nasional sekaligus pedoman moral pembangunan, pelaksanaan zakat mencerminkan titik temu antara etika berbasis keagamaan dan cita-cita kesejahteraan yang dibangun oleh negara. Penelitian ini mengkaji zakat sebagai instrumen kesejahteraan sosial yang mengoperasionalkan nilai-nilai filosofis Pancasila dalam sistem kesejahteraan Indonesia yang bersifat pluralistik. Sementara penelitian-penelitian sebelumnya umumnya menitikberatkan pada dimensi ekonomi atau administratif zakat, studi ini memberikan kontribusi dengan memposisikan zakat sebagai mekanisme ideologis dan etis yang menjembatani ekonomi moral Islam dengan prinsip-prinsip kesejahteraan berbasis negara. Penelitian ini menggunakan pendekatan kualitatif normatif–sosiologis dengan menganalisis sumber-sumber hukum Islam, regulasi nasional tentang zakat—khususnya Undang-Undang Nomor 23 Tahun 2011 tentang Pengelolaan Zakat, serta praktik kelembagaan Badan Amil Zakat Nasional (BAZNAS) melalui analisis dokumen dan interpretasi institusional. Hasil penelitian menunjukkan bahwa implementasi zakat di Indonesia merefleksikan nilai-nilai Pancasila melalui tiga dimensi integratif, yaitu: keadilan spiritual yang berlandaskan pada Ketuhanan Yang Maha Esa, solidaritas sosial yang mencerminkan nilai-nilai kemanusiaan dan kebersamaan, serta keadilan distributif yang selaras dengan sila kelima Pancasila, yakni keadilan sosial bagi seluruh rakyat Indonesia. Penelitian ini menegaskan bahwa relasi zakat dan Pancasila menawarkan model kesejahteraan yang inklusif dan berlandaskan etika, sekaligus memberikan kontribusi teoretis bagi kajian hukum Islam serta implikasi praktis bagi tata kelola kesejahteraan publik di Indonesia

Abstract

Abstract: This study examines the discourse on mut‘ah in divorce initiated by the wife in Indonesia, which is not explicitly regulated in statutory law or the Compilation of Islamic Law (KHI). According to Article 158 of the KHI, the right to mut‘ah is granted only to wives divorced by their husbands (talaq), not to wives who file for divorce. This research employs a normative juridical method by analyzing statutory regulations such as Marriage Law No. 1 of 1974 and the KHI, and by comparing them with classical Islamic jurisprudence (fiqh). This approach is combined with an analysis of justice from the perspective of maqashid shari‘ah. The findings indicate that mut‘ah may be granted to a wife in cases of cerai gugat as long as the wife is not nusyuz. Granting mut‘ah to a wife who initiates divorce is viewed as an implementation of justice and as an effort to protect women’s rights in the aftermath of divorce. This study recommends regulatory reform of both statutory law and the KHI regarding the provision of mut‘ah in cases of cerai gugat, in accordance with the values of justice within Indonesian Muslim society. Abstrak: Penelitian ini membahas diskursus mut‘ah dalam cerai gugat di Indonesia yang tidak diatur secara eksplisit dalam undang-undang dan Kompilasi Hukum Islam (KHI). Menurut Pasal 158 KHI, hak mut‘ah hanya diberikan kepada istri yang diceraikan oleh suaminya (talak), bukan kepada istri yang mengajukan perceraian. Metode yang digunakan adalah yuridis normatif dengan menelaah peraturan perundang-undangan seperti UU Perkawinan No. 1/1974, KHI dan membandingkannya dengan fikih. Pendekatan ini dipadukan dengan analisis keadilan dalam perspektif maqashid syarī‘ah. Hasil penelitian menunjukkan bahwa pemberian mut‘ah dapat diberikan kepada istri dalam kasus cerai gugat selama istri tidak nusyuz. Pemberian mut‘ah kepada istri yang melakukan cerai gugat dipandang sebagai implementasi keadilan serta sebagai upaya melindungi hak perempuan akibat perceraian. Penelitian ini merekomendasikan perubahan regulasi terhadap undang-undang dan KHI dalam kasus pemberian mut‘ah dalam cerai gugat sesuai dengan nilai keadilan dalam masyarakat Muslim Indonesia.
