Abstract

Marriage is a legal relationship that is a legal relationship between a man and a woman who have fulfilled the requirements of marriage according to the provisions, for as long as possible. The position of property in the marriage is different, so that it will result in different rights to the property. Not all marriages run smoothly, so that it can result in the termination of marital relations either due to the death of one of the parties (divorce dead) or divorce (divorce alive). One of the legal consequences of a marital bond is the formation of marital property. The classification of marital property is included in the problem, resulting in difficulties or harm to third parties in the event of a transfer of rights.

Abstract

The World Trade Organization (WTO) serves as a venue and a tool for resolving issues brought on by the rise of trade disputes between parties. The European Union is challenging Indonesia at the WTO over a policy that forbids the export of nickel ore, which is one of the trade dispute issues. When the Indonesian government advanced a ban on nickel ore exports in 2019, the conflict between the European Union and Indonesia became even more intense. A normative legal research utilizing secondary data kinds is the research methodology adopted. According to the discussion that followed this study's findings, the WTO is charged with overseeing how disputes between the European Union and Indonesia are resolved. The Dispute Settlement Body's position in the present mechanism process because of WTO rules ties it from the beginning when the European Union sued Indonesia to the conclusion when the body issues a verdict. The first stage of dispute resolution runs from the request for EU discussions on November 22, 2019, to the publication and dissemination of the panel report on November 30, 2022, which marks the conclusion of the phase. The European Union ultimately prevails in this trade fight, while Indonesia suffers a setback. It has been established that Indonesia breached the WTO's prohibition on the export of nickel ore and that there are legitimate products there that do so.

Abstract

Gerakan ‘politik hijau’ di Indonesia diawali dengan adanya kesadaran yang dipacu kondisi nasional kita dimana terjadi berbagai kerusakan lingkungan hidup akibat pembangunan yang terlalu berorientasi pertumbuhan dan strategi pembangunan yang eksploitatif sehingga mengancam kelestarian lingkungan hidup. Gagasan ecocracy ini merupakan upaya untuk mengutamakan pembangunan berkelanjutan yang berwawasan lingkungan hidup dalam arus politik pembangunan nasional. Namun, walaupun Indonesia dalam konstitusinya telah mengakui subjective right atau duty of the state tetapi pemuatan pola dan arah pembangunan berkelanjutan belum ditempatkan pada pasal-pasal khusus melainkan ditumpangkan atau dicampurkan dengan hak-hak fundamental lainnya. Konsep ekokrasi (ecocracy) harus menjadi kaidah penuntun dalam pembuatan kebijakan negara (politik hukum) dalam perlindungan dan pengelolaan lingkungan hidup. Konsep ekokrasi agar dapat dijalankan dalam sistem bernegara, maka perlu dijabarkan dalam green constitution, green legislation serta green budgeting.

Abstract

The outreach program to children in orphanages regarding the impact of theft and bullying, as well as preventive measures, is an important effort to raise awareness and provide better understanding to children who are vulnerable to such actions. The aim of this study is to evaluate the effectiveness of the outreach in reducing the risk of theft and bullying in orphanage environments. The method used is a descriptive approach with a qualitative design through interviews, observations, and distributing questionnaires to the children and caregivers in the orphanage. The outreach was conducted through interactive sessions with materials on the negative impacts of theft and bullying, as well as preventive strategies, including the importance of communication, empathy, and social skills. The results of the study show that after the outreach, children in the orphanage demonstrated a better understanding of the importance of protecting themselves from bullying and theft, and they exhibited higher awareness to avoid and report such incidents. This outreach program has a positive impact in creating a safer and more respectful environment in the orphanage

Abstract

Abstract Local governments play a crucial role in managing the National Health Insurance (Jaminan Kesehatan Nasional, JKN). Despite various advancements achieved, issues surrounding the uneven distribution of Participants Receiving Premium Assistance (Penerima Bantuan Iuran, PBI) persist and fail to meet the principles of justice. This situation also threatens the rights of JKN participants. The objective of this research is to evaluate the support provided by local governments to the JKN program. The research methodology employs a juridical normative approach. Research findings reveal an agreement that all PBI participants must be registered with Community Health Centers (Puskesmas), resulting in limited freedom for PBI participants, including those who are impoverished and underprivileged, to select healthcare facilities in accordance with the provisions of the Health Law. Legally, local government support for the JKN program is explicitly stated in the Health Insurance Law (Undang-Undang BPJS) and Government Regulation Number 82 of 2018. However, the distribution of PBI participants is still not fully implemented.  AbstrakPemerintah daerah memiliki peran yang sangat penting dalam mengelola Jaminan Kesehatan Nasional (JKN). Meskipun telah dicapai berbagai kemajuan, permasalahan dalam distribusi peserta Penerima Bantuan Iuran (PBI) yang belum merata dan belum memenuhi prinsip keadilan tetap menjadi isu yang perlu diatasi. Situasi ini juga mengancam hak-hak peserta JKN. Tujuan dari penelitian ini adalah untuk mengevaluasi dukungan yang diberikan oleh pemerintah daerah terhadap program JKN. Metodologi penelitian menggunakan pendekatan yuridis normatif. Hasil penelitian menunjukkan bahwa telah ada kesepakatan bahwa seluruh peserta PBI wajib didaftarkan di Puskesmas, yang pada gilirannya mengakibatkan peserta PBI, termasuk mereka yang berstatus miskin dan tidak mampu, tidak memiliki kebebasan untuk memilih fasilitas kesehatan sesuai dengan ketentuan dalam Undang-Undang Kesehatan. Dari segi hukum, dukungan pemerintah daerah terhadap program JKN jelas tertera dalam Undang-Undang BPJS dan Peraturan Pemerintah Nomor 82 Tahun 2018. Namun, distribusi peserta PBI masih belum sepenuhnya terlaksana.

Abstract

Abstract This study examines how Bela Negara Education improves Indonesia's main islands' asymmetric defensive strategy. Our narrative assessment identifies effective and contextually acceptable state military education programs that match the topography of these important islands. The main island’s defense plan (P3B) implements the comprehensive defense strategy by designating the main islands as defensive bases from outer to inner mandala. Bela Negara Education is vital to public knowledge and active participation in the defense system. The 3CS Bela Negara Education program has promoted Bela Negara values and attitudes. Bela Negara Education should be based on five values: patriotism, sacrifice, nation-state consciousness, Pancasila as the guiding ideology, and Bela Negara capability development. This schooling should use four learning paths. This study advocates a welfare-first approach before teaching national values and developing stakeholder synergy for Bela Negara Education. Abstract

The legal institution of marriage is a legitimate bond between individuals who meet established legal criteria, designed to last indefinitely. Within this framework, the legal status of matrimonial property is crucial, as it determines the specific rights held by each spouse. A marital relationship can end, either through the death of one spouse (dissolution of marriage by death) or through an official divorce decree. Legally, a consequence of entering this bond is the formation of joint property. Nevertheless, Law Number 1 of 1974 concerning Marriage explicitly distinguishes between joint property and separate property (harta asal or personal property). The precise classification of this separate property often presents significant challenges, particularly during the process of property transfer, which potentially results in difficulties or losses for third parties. This research analyzes the process of transferring rights over separate property following the dissolution of marriage based on Law No. 1 of 1974 and identifies its legal implications. The main focus is on the legal mechanism to protect the rights of third parties in transactions involving separate property that has not been clearly classified.

Abstract

The imposition of an additional criminal penalty in the form of dishonorable discharge from military service on perpetrators of desertion is within the judge's authority, even though related desertion regulations may allow the perpetrator not to be discharged. The judge has the discretion to consider the nature and essence of the defendant's actions, which are deemed unfit to be retained in military service. This dismissal is seen not only as an administrative sanction but also as an effective preventive strategy against deviant behavior among soldiers, while providing legal certainty for recidivists of the criminal act of desertion. This research uses a normative juridical method with document study as the data collection technique, involving relevant legislation and court decisions. The analysis is carried out qualitatively and normatively and presented descriptively. The results indicate that dismissal can be an effective preventive measure, supporting the enforcement of military discipline, and providing a deterrent effect against similar future violations.

Abstract

In military criminal law, a service member who commits a repeated criminal offense (recidivist) may be subject to an additional penalty in the form of dishonorable discharge from military service. This sanction is based on military interests, as the member is deemed no longer beneficial or representative of the Indonesian National Armed Forces (TNI) or the public, considering their history of repeated criminal acts. However, in Judge's Verdict Number 196-K/PM.II-09/AD/XII/2021 of the Military Court II-09 Bandung, the defendant, a ten-time recidivist, was not subjected to the additional penalty of military discharge by the Panel of Judges. This research employs a normative juridical approach using document study for data collection and a normative qualitative analysis method, involving an in-depth analysis of the Judge's Verdict and the positive legal provisions in Indonesia. The findings conclude that the considerations given by the Panel of Judges in the said verdict failed to provide a proportional balance between legal interests, public interests, and military interests. The author argues that the Panel of Judges should have imposed the additional penalty of discharge from military service on the Defendant, as their actions are deemed to have a negative impact on the life order and value system within the TNI, such as the Sapta Marga (Seven Pledges), Delapan Wajib TNI (Eight TNI Obligations), Soldier's Oath, and other military foundations.

Abstract

The postponement of the General Election (Pemilu) is a crucial issue in a democratic state governed by law such as Indonesia, where the constitution mandates elections be held every 5 (five) years. Controversy arose from the Central Jakarta District Court Decision Number 757/Pdt.G/2022/PN Jkt Pst, which ordered the General Election Commission (KPU) to postpone the 2024 General Election. This decision not only contradicted the constitution but was also problematic for ruling beyond the plaintiff's demands (ultra petitum partium). The indication of applying the principle of erga omnes in the decision also became a separate polemic, considering that this principle is fundamentally relevant only in the realm of public law, whereas the Central Jakarta District Court operates within the scope of private law. This research employs a normative juridical approach with descriptive-analytical specification, and a normative qualitative analysis method by analyzing Decision Number 757/Pdt.G/PN Jkt Pst against positive law provisions in Indonesia. The conclusion of the study indicates that Central Jakarta District Court Decision Number 757/Pdt.G/PN Jkt Pst is an invalid decision, as the Panel of Judges exceeded its authority (ultra vires) and ruled ultra petitum partium. Furthermore, the principle of erga omnes cannot be applied to the decision because it is inherently applicable only to court decisions within the scope of public law, not private law.
